This permit, issued on November 21,2005 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations,special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) Unless specifically altered herein, the dimensions of the area to be dredged shall not exceed 50 ft. x 233
ft., all as expressly and specifically set forth in the attached permit application and workplan drawings.
Any proposal to alter the dimensions of the area to be dredged shall require permit modification.
2) Excavation shall not exceed -10 feet below the normal water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
3) No vegetated wetlands shall be excavated or filled.

4) The tempor4y placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
5) No excavation shall take place within 20 feet of the southern shoreline of the basin.
Spoil Disposal
6) All excavated materials shall be confined to the upland disposal site indicated in the attached permit
application. Any proposal to change the location of the disposal site to a location other than the site
designated in the application may require permit modification. Contact a Division of Coastal
Management Representative at(252) 946-6481 for this determination.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan shall be required for this project. This plan shall be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environment and Natural Resources, Division of Land Resources,
Land Quality Section, 943 Washington Square Mall, Washington, NC 27889.
7) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a sediment curtain shall be placed across the barge slip
opening during excavation activities, and a 24-hour period after completion of excavation shall elapse
prior to sediment curtain removal to prevent unnecessary siltation into the adjacent water body.
Shoreline Stabilization
8) The alignment of the permitted riprap shall be staked by the permittee and approved by a representative
of the Division of Coastal Management within a maximum of 30 days prior to the start of any
construction.
9) The alignment of the approved riprap shall not extend more than 2 feet from the normal water level at
any point along its alignment.
10) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to
prevent its movement from the approved alignment by wave or current action.
11) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite,
marl, or broken concrete.

General
12) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
,upon due notice from the'Corps of Engineers, to -remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No,.'
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that, in accordance with the
rules of the Environmental Management Commission, many non-water dependent activities are
not authorized within 50 feet of the normal water level or landward edge of any coastal wetlands.

NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3400 (DWQ Project No. 05-1842), which was issued on 11/8/05.

1980000291 (COE Action Id. No. 200610017) which was issued on 10/31/05.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. Please sign both the original (buff-
colored form) and the Xerox stamped "Copy". Return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below. Please retain the original
(buff-colored form),as it must be available on site when the project is inspected for compliance.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty(20)days,the matter must be resolved prior to work initiation.
The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands
all permit requirements.
From time to time, Department personnel will visit the project site.To facilitate this review,we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel

stabilize the landward end with riprap.

Project Setting
The project site is located at 429 West Main Street in the Town of Belhaven on a
barge slip off Pantego Creek, a tributary to the Pungo River, in Beaufort County, North
Carolina. The project site is fully developed as a facility for the shipping and storage of
agricultural related commodities. The site also receives gravel rock, lime and other
aggregate for businesses located in, around and east of Belhaven. The site is dominated
by six large grain bins with four grain elevators. There is a gravel/asphalt drive and scale
for trucks delivering locally grown grain to the facility. There is a railroad spur also on
the site. The entire area is covered with impervious surface, either under roof or covered
with asphalt and gravel. The barge slip dimensions are ±100' wide x ±300' long. The
west side of the barge slip is stabilized with a metal sheet pile bulkhead. While loading
and unloading, barges moor to the sheet pile bulkhead. The east side of the barge slip is
not stabilized with an erosion control structure, as the adjacent property on the east side is
not developed. The landward end of the barge slip is partially stabilized with a wooden
bulkhead.
Water depths in the barge slip range from 15' deep at the confluence with Pantego
Creek to 3' at the landward end. Average water depth in the barge slip is approximately
5.5'. The access channel to the barge slip in Pantego Creek has water depths ranging
from 12' to 14' deep.
Pantego Creek in the vicinity of the project site is classified as SC-NSW by the
Environmental Management Commission and Inland Waters by the Wildlife Resources
Commission. This area is closed to shell fishing.
Project Description
The applicant reports difficulty in loading and unloading barges due to the
shoaling in the barge slip that has occurred over time. Loaded barges draft approximately
8'. The applicant proposes to undertake maintenance excavation in an area in the barge
slip 5.0' wide x 233' long to a final depth of 10' below the Normal Water Level (NWL).
The excavation is to be undertaken with a long reach excavator or dragline placing the
material in a closed body dump truck to be hauled offsite to a prescribed upland location.
The applicant proposes to deploy a sediment curtain across the barge slip opening during
excavation activities. The applicant also proposes to place riprap along and above the
NWL at the landward end of the barge slip for shoreline stabilization.
Anticipated Impacts
The project will excavate 11,650 ftZ of bottom in the barge slip. The shoreline
stabilization will fill approximately 55 ft2 of bottom in the barge slip.

Dear Sir or Madam:
You have our approval, in accordance with the attached conditions,to place fill material within or
otherwise impact 0.00126 acres of non-vegetated wetlands to perform maintenance to a barge slip as
described in your application received by the Division of Water Quality(DWQ)401 Oversight/Express
Review Permitting Unit on September 29,2005. After reviewing your application,we have determined
that the Division of Water Quality(DWQ)General Water Quality Certification Number 3400 covers
these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the
US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including(but not limited to)
erosion and sediment control regulations and CAMA. Also,this approval to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon
expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project,you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project(now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications,the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit,North Carolina
Division of Water Quality, 1650 Mail Service Center,Raleigh,NC,27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification(GC) 3400.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification(associated with the approved water
impacts),you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition,which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh,N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

The Washington Regional Office received a copy of your CAMA application for your proposed pier project named
Hurricane Boat Yard Marina on September 28, 2005. Staff review of the plans and specifications has determined
that the project, as proposed, consists of activities that will not pose surface water quality threats from stormwater
runoff since no significant new impervious area is proposed.
The Director has determined that projects that are reviewed and approved by the Division as not posing water
quality threats from stormwater runoff should not be subject to the stormwater management permitting requirements
of 15A NCAC 2H.1000. For this reason, we are informing you by way of this letter that your project will not
require a stormwater management permit at this time.
The stormwater rules require the Division to permit the common plan of development, therefore, any future
development on the property, regardless of whether a CAMA Major permit is also required, will require a
Stormwater Management Permit application and permit issuance from the Division of Water Quality prior to any
construction. Any construction on the subject site,prior to receipt of the required permit, will constitute a violation
of 15A NCAC 2H.1000 and may result in appropriate enforcement action by this Office.
Please keep in mind that this determination does not affect your legal requirements to obtain other permits which may be
required by the Division of Water Quality,the Division of Land Resources,Coastal Area Management Act or any other
Federal,State or Local Government.

RE: Major Permit Application request by Perdue Farms, Inc. The applicant proposes to
conduct maintenance excavation in an existing barge slip and stabilize the landward
end with riprap. The project site is located off West Main Street in the Town of
Belhaven on a manmade basin off Pantego Creek, a tributary to the Pungo River, in
Beaufort County,North Carolina.
LUP CONSISTENCY DETERMINATION
The proposal is consistent with and not in conflict with the Beaufort County, NC
1997 Land Use Plan certified by the CRC on November 20, 1998.
PROJECT SUMMARY
The project site is located off West Main Street in the Town of Belhaven on a manmade basin
off Pantego Creek, a tributary to the Pungo River, in Beaufort County. The project site is fully
developed as a facility for the shipping and storage of agricultural related commodities. The site
also receives gravel rock, lime and other aggregate for businesses located in, around and east of
Belhaven. The site is dominated by six large grain bins with four grain elevators. There is a
gravel/asphalt drive and scale for truck deliveries. There is a railroad spur on site. The entire
site is covered with impervious surface, either structural or covered with asphalt and gravel. The
barge slip is 100' wide x 300' long. The west side of the barge slip is stabilized with a metal
sheet pile bulkhead. The east side of the barge slip is not stabilized with an erosion control
structure, as the adjacent property on the east side is not developed. The landward end of the
barge slip is partially stabilized with a wooden bulkhead. Water depths in the barge slip range
from 15' deep at the confluence with Pantego Creek to 3' at the landward end. Average water
depth in the barge slip is approximately 5.5'. The access channel to the barge slip in Pantego
Creek has water depths ranging from 12' to 14' deep. The applicant cites difficulty in loading
and unloading barges due top the shoaling in the barge slip that has occurred over time. Loaded
barges draft approximately 8'.
The applicant proposes to undertake maintenance excavation in an area in the barge slip 50' wide
x 233' long to a final depth of 10' below the Normal Water Level (NWL). The material would

be hauled offsite to a prescribed upland location. The applicant proposes to place riprap along
and above the NWL at the landward end of the barge slip for shoreline stabilization.
Anticipated impacts:
The project as proposed would excavate 11,650 ft2 of bottom in the barge slip. The shoreline
stabilization would fill 55 ftz of bottom in the barge slip.
Areas of Environmental Concern (AEC):
AECs impacted by the proposal include Public Trust Area and Public Trust Shoreline. The water
classification is SC-NSW and is not open to the harvesting of shellfish. The area is not a
Primary Nursery Area.
The Beaufort County Land Classification Map designates the area encompassing the subject
property as `Municipal Districts'and the AECs as "Conservation". Applicable or related policy
in the Land Use Plan relies on the Division of Coastal Management through the major permitting
review process:
"Ensure that all land development plans within AECs have evaluated all possible
alternatives to controlling pollution, erosion, natural barrier impacts, limiting
drainage, and reducing other potentially negative impacts related to land use

As an agency involved in the Division of Coastal Management's major permit application
review process, we have determined that more than one acre will be disturbed by the activities as
described. Therefore, in addition to a permit from the Division of Coastal Management, an erosion
and sedimentation control plan must be submitted to and approved by this office before development
begins. The requiring of an erosion and sedimentation control plan is based on a mandatory standard
for land4sturbin acavi, of the Sedimentation Pollution Control Act of 1973 (NCGS 113A-57(4)
and 113A-54(d)(4)], which states:
No person shall initiate any land-disturbing activity, if at least one acre is to be uncovered,
unless an erosion and sedimentation control plan for the activity is filed with the agency
having jurisdiction and approved.
The plan must be submitted at least thirty(30)days prior to project commencement. The plan
must include, but is not limited to, the following:
1. A scaled plat plan of the site, showing the affected areas as well as adjacent properties
which may be affected. Include contours if available_
2. Indicate critical areas such as wetlands, creeks, streams, drainage ways, marsh, etc.

3. Include a brief narrative describing the activities to be undertaken and a construction
schedule.

4. Indicate on the plat the measures to be utilized to prevent sediment from entering
adjacent properties, such as location of silt fences, silt basins, diversion ditches, areas
to be seeded, etc.
5. Include seeding and mulching specifications for both temporary and permanent
stabilization.
6. Include any other pertinent information directed at controlling offsite sedimentation,
slope degradation, and erosion.
Please be advised that the plan will be considered incomplete, and the statutory review period
will not begin,unless a non-refundable plan review processing fee, payable by check or money order
made out to the Department of Environment and Natural Resources, is included. The amount of the
fee is based on$50 for each whole or fractional acre of land to be disturbed (including offsite borrow
or waste areas).
To begin this project without the approval of an erosion/sedimentation control plan will be
considered a violation of the Act and may lead to the assessment of a civil penalty of up to $5000
initially plus $5000 per day for each day the project is deemed in violation.
For your convenience, we are enclosing a guideline for developing a plan. If you should have

This memo is in regards to the Major CAMA Permit Application submitted by Perdue Farms
Inc. for maintenance excavation of an existing barge slip, and riprap shoreline stabilization on site
the applicants property located at 429 West Main Street in the Town of Belhaven on Pantego Creek,
a tributary to the Pungo River,in Beaufort County,North Carolina. During an onsite meeting I heard
testimony regarding the grounding of barges in the slip and the amount of effort required from tugs
to free them. Although I have not personally witnessed these efforts, I am confident that bottom
sediment(s)are being deposited offsite resulting in unnecessary impact(s)to the immediate area. The
project exceeded the maximum allowable depth conditioned in CAMA General Permit 7H.1500.
For these reasons as well as the presence of supporting depths in the access channel I recommend
issuance of the permit as proposed. I recommend that the permit be issued with the standard
conditions including a condition requiring use of a sediment curtain during excavation activities. I
also recommend that no excavation is to be undertaken within 20' of the normal water level on the
south side of the basin. This should be done to prevent undermining of the bank assuming that the
side slopes of the area to be excavated will not be flatter than 2': 1'.

Dear Mr. Trowell:
Perdue Farms Incorporated is requesting a permit from the N.C. Division of
Coastal Management to perform necessary maintenance to our barge slip, located at our
grain facility in Belhaven. The current water depths in the access channel to the existing
barge slip average thirteen(13') feet;however,the existing water depth of our slip itself
cannot accommodate the draft required for loaded barges. The decreased water depths are
a result of materials being deposited during storms and other tidal events. This has lead to
build up from the landward end out in the barge slip. The decreased depth inhibits the
proper loading of barges and also presents the problem of the barge becoming grounded
in the slip due to its cargo. We are seeking to obtain approval that will allow us to
excavate the area outlined in the permit application to a depth of ten(10')feet, which will
allow adequate draft for the loaded barges. We will accomplish this excavation with the
use of an extended reach excavator and/or dragline, with all work being performed from
Perdue property. The excavated material will then be hauled off-site to a high ground
location by use of a closed body dump truck. In addition to the maintenance excavation,
we are also proposing to rock the shoreline of the barge slip to assist in preventing
erosion from landward sheet flow and drainage.

1f this agency does not render a permit decision. within 70 days from the 16
