This permit, issued on Jnne 29,2005 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below.Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Shoreline Stabilization
1) As indicated on the attached workplan drawings, the bulkhead alignment shall connect at the applicant's
property line on the northwest side and across the mouth of the boat ramp area to the existing bulkhead
corner on the applicant's property.
2) The alignment of the permitted bulkhead shall be staked by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of any construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) The bulkhead shall be constructed prior to any backfilling activities.
4) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No.excavation or other land disturbing activities
is permitted except for that which may be required for the construction of the bulkhead wall, riprap,
deadmen cables, etc. This .permit does not authorize any excavation waterward of the approved
alignment.
6) The backfill material shall be clean and free of any pollutants except in trace quantities.
7) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead.
General
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No.
050726.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No.
200510886.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. Please sign both the original (buff-
colored form) and the copy. Return the copy to this office in the enclosed envelope. Signing the permit and
proceeding means you have waived your right of appeal described below. Please retain the original(buff-colored
form),as it must be available on site when the project is inspected for compliance.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229.Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty(20)days,the matter must be resolved prior to work initiation.
The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands
all permit requirements.
From time to time,Department personnel will visit the project site.To facilitate this review,we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

PROJECT SETTING
The project site is located at 165 Walnut Island Blvd., Walnut Island Subdivision, Grandy,
Currituck County and adjacent to the Currituck Sound. The property consists of three
contiguous lots-1, 2 and 19 that have a combined area of 12,937 square feet. The
property is flat, has an elevation of approximately 3 feet above normal water level (NWL)
and has sandy soils. The property is vegetated with lawn grasses and shrubs. Man-made
features on the property consist of a mobile home set on a permanent foundation, a
swimming pool, a small single-family dwelling, a concrete boat ramp and a shoreline
bulkhead.
The property has approximately 160 feet of bulkhead of which, approximately 35 feet front
the Currituck Sound. The property has a small triangular shaped bay-like area where the
boat ramp is located. Bulkhead walls on each side of the boat ramp have been
constructed along the shoreline. The bulkhead wall connecting to the adjacent property to
the northwest is approximately 60 feet long and the bulkhead wall connecting to the
applicant's bulkhead on the Currituck Sound is approximately 65 feet long. The mouth of
the bay-like area is approximately 56 feet wide and the water depths range from 0 to 1-1/2
feet deep.
The adjacent property to the east is an undeveloped subdivision lot that has a shoreline
bulkhead and the adjacent property to the northwest is an undeveloped subdivision lot with
a partial bulkhead and relic riprap.
The waters of the Currituck Sound in this area are classified SC and are closed to shellfish
taking.
DEVELOPMENT PROPOSAL
The applicant has experienced shoaling and trash deposition in the boat ramp area and
she no longer uses the boat ramp. The applicant proposed to construct a bulkhead to
connect at the corner of her property line on the northwest side and across to the mouth of
the bay to the existing bulkhead corner on the Currituck Sound. The proposed bulkhead
will be approximately 56 feet long and will require approximately 116 cubic yards of fill
material below NWL for backfill. The maximum distance waterward of NWL for the
proposed bulkhead is 52 feet.

ANTICIPATED IMPACTS
The development proposal will result in approximately 2,400 square feet of Public Trust
Area, Estuarine Water Areas of Environmental Concern and 400 square feet of Estuarine
Shoreline AEC being filled. While no submerged aquatic vegetation (SAV) was observed
at the site, the Currituck Sound has several large areas of SAV beds sound wide. The
development proposal will result in temporary water turbidity during construction.

Dear Mr. Huggett:
Reference the application of Mary Perschy for a Department of the Army permit to
construct a bulkhead and place backfill material across an existing boat ramp area, on property
located at 165 Walnut Island.Boulevard, adjacent to the Currituck Sound,near Grandy, in
Currituck County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE)prior to implementation.
2. Except as authorized by this permit or any USACE approved modification to this permit,
no excavation,fill or mechanized land-clearing activities shall take place at any time in the
construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
3. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
4. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management(NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.

The applicant proposes to close off an existing boat ramp with a new bulkhead with
backfill located at 165 Walnut Island Blvd., off US 158, Walnut Island Subdivision,
Grandy, Currituck County and on a man-made basin off the Currituck Sound. The
project involves filling approximately 2,400 square feet of Public Trust Area and
Estuarine Waters behind a proposed 56-foot long bulkhead. The proposed alignment
will connect at the corner property line on one side of an existing corner on the
applicant's property to create a straight alignment along the applicant's property.
The development proposal is similar to a proposal authorized by CAMA Major Permit
#43-05 and is located across the street from that site.
The development proposal is consistent with 07H.0208 Use Standards (b)(7) bulkheads
(D)(1-iv) and (11) filling of canals, basins and ditches. There are no wetlands at the site.
It is recommended that the development proposal be approved with the following
conditions:
1. The bulkhead alignment will connect at the applicant's property line on the
northwest side and across the mouth of the boat ramp area to the existing
bulkhead corner on the applicant's property and in no case greater than 52 feet
waterward of the normal water line.
2. The alignment of the authorized bulkhead must be staked by a representative of
the Division of Coastal Management within a maximum of 30 days prior to the
start of construction. Failure to initiate construction within 30 days, or erosion of
the shoreline by adverse weather conditions, will require the alignment to be
restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.

3. The bulkhead must be constructed prior to any backfilling activities.
4. The bulkhead must be structurally tight so as to prevent seepage of backfill
materials through the structure.
5. The bulkhead must be solid and constructed of treated wood, concrete slabs,
metal sheet piles or other suitable materials approved by department personnel.
No excavation is permitted except for that which may be required for the
construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does
not authorize any excavation waterward of the approved alignment.
6. The fill material will be clean and free of any pollutants except in trace quantities.
Metal products, organic materials, or unsightly debris will not be used.
7. All backfill material will be obtained from a high ground source and confined
behind the permitted bulkhead.
8. All fill material to be placed below normal water level will be confined behind the
permitted bulkhead.

threats from stormwater runoff since no significant new impervious area is proposed. The Director has
determined that projects that are reviewed and approved by the Division as not posing water quality threats
from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A
NCAC 2H.1000. For this reason, we are informing you by way of this letter that your project will not require a
stormwater management permit.
Please keep in mind that this determination does not affect your legal requirements to obtain other permits
which may be required by the Division of Water Quality, the Division of Land Resources, Coastal Area

Sound on property located at 165 Walnut Island Boulevard (NC SR-1186) in
Grandy, Currituck County.
DATE: April 25, 2005
Consistency Determination: The request is consistent with/not in conflict with the Currituck
County 1990 Land Use Plan (LUP) certified by the CRC at their
July 25, 1991 meeting.
Overview: The site consists of three contiguous lots with a combined area of 12,937 square
feet located adjacent to Walnut Island Boulevard along the Currituck Sound. The property is
vegetated in lawn grasses and shrubs and is approximately 3 feet above the Normal Water
Level (NWL). Existing site improvements include a mobile home on a permanent foundation, a
swimming pool, and a single-family dwelling. Existing shoreline improvements consist of 160
linear feet of bulkhead and a boat ramp that is located within an approximately 56 foot wide
triangular shaped bay area. The boat ramp area has experienced shoaling and trash
deposition and is no longer used.
The bay area is to be filled and approximately 56 linear feet of bulkhead is to be installed
adjacent to the canal. Approximately 116 cubic yards fill material will be provided for backfill.
The waters of the Currituck Sound in this area are classified as SC and are closed to shellfish
harvest. While no submerged aquatic vegetation (SAV) was observed at the site, the Currituck
Sound has several large areas of SAV beds sound wide.
Anticipated impacts resulting from this project are expected to include: the filling of
approximately 2,400 sq. ft. of Estuarine Waters and Public Trust Waters AECs and 400 sq. ft of
Estuarine Shoreline AEC.
Basis for Determination:
The site area is designated as "Developed" on the Currituck County Land Use Classification
Map. Discussion on page 30 of the LUP notes that AECs also qualify for the "Conservation"
classification. The following are LUP policies that may be applicable to this request:

APPLICATION FOR CAMA MAJOR
DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice
as required by NCGS 113A-119(b)that application for a development permit in an Area of
Environmental Concern as designated under the CAMA was received on April 13, 2005.
According to said application, Mary Perschy proposes to close off an existing boat ramp
with a new bulkhead and backfill at 165 Walnut Island Blvd., Grandy, NC.
A copy of the entire application may be examined or copied at the office of Frank
Jennings, Field Representative of the Division of Coastal Management, located at 1367 US
17 South, Elizabeth City, NC, 252-264-3901 during normal business hours.
Comments mailed to Charles S. Jones, Director, Division of Coastal Management,
400 Commerce Avenue, Morehead City, NC 28557, prior to May 15, 2005, will be
considered in making the permit decision. Later comments will be accepted and
considered up to the time of permit decision. Project modification may occur based on
review and comment by the public and state and federal agencies. Notice of the permit
decision in this matter will be provided upon written request.

Dear Mr. Warren:
The Division of Coastal Management hereby acknowledges receipt of the application for Mary
Perschy submitted for State approval for development of property located at 165 Walnut Island
Blvd., Grandy, Currituck County. It was received complete on April 13, 2005, and appears to
be adequate for processing at this time. The projected deadline for making a decision is June
27, 2005. When such time is necessary to complete the review, an additional 75-day review
period is provided by law. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those circumstances,
this letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from the date received, you
may request a meeting with the Director of Division of Coastal Management (DCM) and permit
staff to discuss the status of your project. Such a meeting will be held within five working days
from the receipt of your written request and shall include the property owner, developer, and
project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete
application.
