Authorizing development ir_ Onslow County at Atlantic Ocean and ocean beach within
limits of Town of N. Topsail Beach, as requested in the permittee's letter dated 12/6/19 and drawing dated
12/6/19.
This permit, issued on January 9,2020 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines imprisonment or civil action- or may cause the permit to be null and void.
1) Unless specifically altered herein, this Minor Modification authorizes dune rehabilitation activities to
be carried out one (1) time, all as expressly and specifically set forth in the modification request letter
dated 12/6/19 and drawing dated 12/6/19. Any request to carry out additional activities within an
area where dune rehabilitation activities have been completed under this permit shall require a
modification of this permit.
2) All dune rehabilitation work shall take place entirely within the areas indicated on the attached
workplan drawing. Any request to carry out additional activities outside of the areas indicated shall
require additional modification of this permit.
3) The bulldozed material shall be aligned to the greatest extent possible with existing adjacent dune
ridges and shall be of the same general configuration as adjacent natural dunes.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and the Chair
other qualified persons within twenty (20) days of the issuing of the Coastal Resources Commission.

Any maintenance work or project modification not covered Division of Coastal Management
hereunder requires further Division approval.
This permit and its conditions are hereby accepted.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees `
that your project is consistent with the North Carolina Coastal Signature of Permittee
Management Program.

ADDITIONAL CONDITIONS
4) In order to protect threatened and endangered species, and to minimize adverse impacts to intertidal and
beach resources, no dune rehabilitation activities shall occur from April 1 to November 15 of any year
without prior approval from the North Carolina Division of Coastal Management in consultation with
the appropriate resource agencies.
5) The movement of material utilizing a bulldozer, front end loader, backhoe, scraper, or any type of earth
moving or construction equipment shall not exceed one foot in depth measured from the pre-activity
surface elevation.
6) Equipment utilized to repair the dunes shall not be operated seaward of the mean low water elevation
contour.
7) All equipment must use the previously authorized construction access points. Creation of any new
construction access points shall require authorization from the Division of Coastal Management.
8) Dune repair activities shall be conducted in such a manner that a sufficient area waterward of the toe of
the dune, with sufficient elevation, is maintained to allow for unhindered pedestrian and emergency
vehicle passage at high tide.
9) This activity shall not significantly increase erosion on neighboring properties and shall not have a
significant adverse effect on important natural resources.
10) This permit does not grant any property rights or exclusive privileges.
11) No work may be done on any individual's private property without written consent of the property
owner(s).
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
13) No sand shall be placed on any sand bags that have been determined by the DCM to be subject to
removal under 15A NCAC 07H .0308(a)(2). In order to ensure compliance with this condition, the
Division shall be contacted at (910) 796-7215 prior to project initiation to allow the Division to meet on
site with the permittee and/or contractor.
14) This Minor Modification shall be attached to the original of Permit No. 191-05, which was issued on
12/5/05, as well as all subsequent modifications and renewals, and copies of all documents shall be
readily available on site when Division personnel inspect the proj ect for compliance.
15) All conditions and stipulations of the active permit remain in force under this Minor Modification,
unless specifically altered herein.
NOTE: This Minor Modification does not eliminate the need to obtain any additional ermits or
authorizations that may be required. REC9.IVED
