The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 5) This permit does not authorize the interference with any existing or proposed Federal project,and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 7) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 8) All portions of the fixed pier located over coastal wetlands shall not exceed a width of 6 ft. and shall be elevated a minimum of 36 inches above the marsh substrate as measured to the bottom of the decking. 9) This permit authorizes a maximum of 3 docking spaces. At no time shall more than 3 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in association with the docking facility. Furthermore, due to the proximity of the Carolina Beach Yacht Basin, boats utilizing the docking facility shall be subject to frequent wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. General 10) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such h removal or alteration. Charles T. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 13) This permit does not authorize any high ground construction. Only the structures located in or over the water as outline in the attached workplan drawings are hereby authorized. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water F dependent activities are not authorized within 30 feet of the normal high water level. NOTE: Should either adjacent property be sold prior to the initiation of construction, the P ermittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. NOTE- The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 05- 0476. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 197800056 (COE Action Id. PROJECT SUMMARY: The applicants propose the construction of a private pier that would terminate in a T-head platform, (1) landing platform, (1) floating dock, and (2) finger piers into Carolina Beach Yacht Basin, in Myrtle Grove Sound. PROJECT DESCRIPTION: Morehead CiL The physical address of the property is 115 Florida Ave., adjacent to the Carolina Beach Yacht Basin, in the Town of Carolina Beach, New Hanover County. To locate the applicants' property, take Carolina Beach Road (US Highway 421) from Wilmington to Carolina Beach approximately 15 miles. Approximately 2.5 miles from Snow's Cut Bridge, turn left onto Carl Winner Drive and continue until you reach a stop sign at Canal Drive. Turn left onto Canal Drive and continue north approximately 2 miles until you reach Florida Ave. Turn left onto Florida Ave. and the property of interest will be located on the left hand side. The applicants'lot is 0.267 acres and has 100 linear feet of shoreline that is stabilized by a wooden bulkhead. The lot averages approximately 6 feet above mean sea level. The applicants are in the process of constructing a duplex building on the property. Highground vegetation that exists on the property is primarily lawn grass. Vegetation waterward of the existing bulkhead consists of a band of mixed coastal wetlands, which include Sea Oxeye (Borrichia frutescens), Salt Meadow Grass (Spartina patens), Black Needle Rush (Juncus roemarianus) and Smooth Cordgrass (Spartina alterniflora). Waterward of the bulkhead and vegetation are broken up old concrete slabs, which are present only on the eastern end of the property's bulkhead. There are four (4) existing mooring pilings within open water that the applicants propose to remove prior to construction of the pier structure. The Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Carolina Beach Yacht Basin are classified SB# by the Division of Water Quality.They are NOT designated as a Primary Nursery Area by the N.C.Division of Marine Fisheries and they are CLOSED to the harvest of shellfish PROPOSED PROJECT: The applicants propose the construction of a private pier that would terminate in a T-head platform, (1) landing platform, (1) floating dock, and (2) finger piers into Carolina Beach Yacht Basin, in Myrtle Grove Sound. The pier structure would consists of a 6' wide by 50' long elevated walkway which would terminate in a 8' x 10' T-head. Extending from the T-head via an access ramp the applicant proposes a 10' wide by 4' long access platform for ramp support. The access ramp would lead to a 8' wide by 34' long floating dock, which would run parallel to the shoreline. Waterward of this floating dock the applicants propose to extend two (2)4' wide by 29' long finger piers. These proposed finger piers would run perpendicular to the shoreline and would be located 12' apart. The proposed finger pier located on the western end of the floating dock would run in the same alignment as the fixed pier. The proposed pier structure would provide docking space for up to (4)vessels. The applicants state that one slip would be designated as transient docking only. ANTICIPATED IMPACTS The proposed pier system construction would incorporate 924 sq. ft. of Estuarine Waters and Pubic Trust Area and would result in the shading of 536 sq. ft. of coastal wetlands. Minor increases in turbidity should be expected during construction. The proposed pier, T-head, platform, floating dock and finger piers would extend approximately 115 feet into a waterbody which measures approximately 560 feet across. This distance would conform with both the 1/4 rule and the established pier lengths. As proposed, the applicant's proposal would not extend beyond the Town Carolina Beach Historical Pierhead Line.
