Shoreline Stabilization 1) The alignment of the permitted riprap shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 2) The riprap shall not extend waterward more than 10 feet from the normal water level at any point along its alignment at the time of construction. It shall be of a size sufficient prevent its movement from the site by wave or current action. 5) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. 6) The backfill material shall be clean and free of any pollutants except in trace quantities. 7) All backfill material shall be obtained from a high ground source. Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 943 Washington Square Mall, Washington, NC 27889 8) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). Stormwater Management 9) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW7050330 on 4/20/05. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. General 10) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 11) No vegetated wetlands or submerged aquatic vegetation shall be excavated or filled even temporarily. PROJECT SUMMARY: The applicant proposes to stabilize the stream bank with riprap, slope the lot for a single-family home, and construct a gazebo. Robert David Knight&Janet Taylor Knight Norton Engineering and Planning Beaufort County Project Setting The project site is located off SR1119 adjacent to the Pamlico River near the Town of Chocowinity in Beaufort County. Mr. Knight purchased ten lots from the adjacent Pamlico Bluffs subdivision and has consolidated them to one 6.64-acre tract for a single-family dwelling. The 6.64-acre track includes a somewhat unique geological feature; an approximately 30' high erosion escarpment or bluff shoreline bordering the Pamlico River. Access to the project site is via the entry road and cul du sac in Pamlico Bluffs.There are no existing structures or facilities on the project site. The Pamlico River along the project site is an estuarine water body classified as SC/NSW by the North Carolina Environmental Management Committee. The near shore area along this section of the Pamlico River range from zero water depth at the shore,to approximately15"deep 50' offshore and±20"deep 100' offshore. The project site is bordered to the west by a single-family dwelling located in the Pamlico Bluffs subdivision. That portion of Pamlico Bluffs is subdivided with little development activity. Taylor's Gut, a small stream borders the project site to the east. Vegetation on the site consists of pines, oaks,beech trees, sweet gums, and various under-story shrubs indigenous to the area. Several small segemented patches of Juncus roemerianus were observed along the shoreline. Seasonal conditions limit evaluation of submerged aquatic vegetation at this time. However, evidence observed during the field investigation indicates that there is at least some presence of submerged aquatic vegetation during the growing season. Project Description The applicant proposes to grade the existing±30' bluff down to a 2:1 slope and armor the slope with riprap for approximately 450' of shoreline. Riprap will be placed on average 5' waterward of the normal water level not to exceed 10' beyond normal water level. ` The applicant proposes to build a single-family home and driveway on an upland portion of the project site. A 1000-gallon septic tank and underground wastewater field will manage sewage disposal. Building plans include the construction of a±20 X±20 observation gazebo approximately 60' landward of the normal water level. Anticipated Impacts The project as proposed will result in the filling of±2,250 square feet for shoreline stabilization. ±27,000 square feet of shoreline bluff will be impacted to create the 2:1 stabilized slope. The gazebo as constructed will impact±400 square feet 60 feet from the normal water level. As a result of construction, short-term turbidity is anticipated along the project site. Mike S. Biologists with the North Carolina Wildlife Resources Commission(Commission)reviewed the CAMA Permit No. 104-05 modification request with regard to impacts on fish and wildlife resources. The project site is located off SR 1119 adjacent to the Pamlico River near Chocowinity,NC and has been visited numerous times, including the most recent visit on April 5, 2006. Our comments are provided in accordance with provisions of the Coastal Area Management Act(G.S. 113A-100 through 113A-128), as amended, and the Fish and Wildlife Coordination Act(48 Stat.401,as amended; 16 U.S.C. 661 et seq.). The applicant proposes to modify an existing CAMA permit to allow the addition of eleven wooden groins in the Pamlico River. The groins would be spaced at no less than 50' intervals, no more than 25' in length from the normal water level (NWL), and no greater than 1' above NWL. The original permit allowed 450' of shoreline to be graded at a 2:1 slope and rip-rapped to extend an average 5' not to exceed 10' beyond NWL. The CAMA permit application also included+/-324' of breakwater proposed 55' waterward NWL that would have essentially paralleled the rip-rapped area.This proposed breakwater consisted of five rock segments and four open segments, each 36' in length with the rock segments extending approxitnately 2 1"above NWL. The proposed breakwater was removed from the permit application after th NC Wildlife Resources Commission and NC Division of Marine Fisheries expressed concern with the br kwater and its impact to aquatic resources. The Pamlico River is classified SC NSW by the Environmental Management Commission and is neither a primary nursery area nor open to shellfish harvesting. The Commission has reviewed the minor modification request and objects to the installation of the eleven groins. The purpose of the groins as stated in a March 17, 2006 memo to Mike Thomas,NC Division of Coastal Management, from Jerol Selby, agent for the Knights, is to capture natural sand movement. Our concerns with the initial CAMA Major Permit application included the impact the breakwater system would have on the important soft mud habitat found along shore(Tripp, 2 May 2005). This soft mud bottom is important to anadramous fish spawning and nursery areas and supports submerged aquatic vegetation(SAV). The groins are designed to accrete sand, which may convert the shallow water habitat area to beach. Protection of this residential lot has been accomplished through the permitted 450' of rip-rapped shoreline. Our site data & observations are some- what different. The Knight Project will be less supportive of the Property & River environment if the breakwater is deleted and the shoreline rock moved to the waterline as will be discussed below. Both issues were carefully considered in advance. The submitted design followed three pre-reviews with USACE(WRFO) &with NC DENR DCM, DWQ & DLR/LQS. However, either/ both USDI/FWS recommendations will be accepted, if required & allowed, rather than to accept construction delays and added bluff erosion risk from the approaching hurricane season. Before requiring changes, please carefully consider our design content below & allow a design review meeting if needed. 4. In comparing the NC CAMA Plan to the USDI/FWS letter, several clarifications may help as follows: a. My general use of the term SAV ( sub-acquatic vegetation ) is better stated as AV ( aquatic vegetation ) with submerged vegetation ( SAV's ) and emergent plants ( EP's ) as two of 4-5 sub-categories. The 5-8 small patches of near-shore black needle rush ( Juncus Roemerianus ) ( 8-30 feet from mean water (no wind) and mostly near Taylor's Gut ) , are AV/EP's shown on the drawings & in the Plan. The design already minimizes harm to these and to in-water cypress with little, if any, impact. These important AV/EP's and any SAV's are needed to naturally seed the expected expansion of plant and aquatic life behind the proposed segmented breakwater and Allyn S. On numerous site visits since Sept. 2004, under-water SAV's on the hard Pamlico River sand bottom were not observed out to 400 feet The USDI/FWS letter appears to primarily anticipate future potential SAV development based on the shallow shoreline ( Dwg. K-1,K-1A for MLW bottom profile). I question this potential because the shoreline is a medium/high energy wave site facing north-east into a 3 plus mile reach with common north-east winds of 35 knots, regular wind driven water rises of 18-24 inches and waves of 2-4 feet ( NOAA Chart # 11554 —Appendix I ) . See these same conditions at nearby Bath Buoy #5 DWQ data for May 4-6,2005 Lat .The NE low pressure caused 2-3 ' waves & a bluff base-to-shore distance reduction from 20 feet to 9 feet on an 18 inch water rise. Shore edge water was black with sediment and inch thick iron precipitates were breaking up. The shoreline is scouring and receding at an average surveyed rate of one foot per year ( past 40-50 years ). Given that NC environmental reports & conferences are correct, these areas are poor support for unprotected SAV development. Any development, without protection, will be highly sensitive to a particular season and weather patterns with hurricanes having major impacts. Except at the confluence of Taylor's Gut and the Pamlico River ( which area is carefully avoided ), near shore visible AV's are virtually non-existent for the one mile North to Hill's Point ( Pg 2 & Appendix G ). b. The nearby and similar Hills Point residential areas including Rt. 1122 at its end and along Hill Creek Road ( page 2 Map ) have well over 500 yards of permitted & installed 5-10, in-water rock revetments, gabion & vinyl walls and in-water groins. Groins have extended shore-lines 20 + feet with sand from NE wind and wave action. Few if any AV's, EP's or SAV's are developing. We will accept permit-authorized groins in lieu of the segmented breakwater as added protection. c. The gabion breakwater is covered in detail on pages 20 & 21 of the Plan ( incl. AV/SAV's ) with detailed design, references and equivalent pictures ( W-9 ) in Appendix W-1 through W-12. Attention is called to an identical NC implementation in the 2001 "Managing Erosion & Estuarine Shorelines" ( UNC-SG-01-12 ), S. Rogers, NC Sea Grant, & T. Scrabal, NC Coastal Federation. The NC Coastal Federation is now implementing an approved NC DENR Major Permit for up to 30 NC breakwater projects including machine-added sand fill & plants in public waters. Mitigation is in the improvement of coastal waters habitat for marine life. This Plan anticipates the same results using natural wind-driven fill & existing plant remnants. The Knight Property design independently happens to be identical to the 2001 implementation. Breakwater objectives are to: (1) Deplete wave energy and allow the natural development of vegetated tombolos near shore. I believe that this design will increase aquatic life potential; not decrease it. (2) Cause sand buildup in front of rock stabilization to reduce toe scouring in exposed areas. This sand is expected to partly replace bluff erosion nourishment blocked by stabilization. (3) Provide a narrow path in front of rock stabilization for out-of-water maintenance access. (4) Achieve cost viability by constructing all or part of the breakwater during rock stabilization. (5) Provide adequate rock mass against wave action per USACE Coastal Engineering Manual. (6) Enhance marine life while avoiding rock disbursal through the use of gabion baskets. d. The proposed shoreline rock revetment ( page 19 Sec. E ) is shown in Drawing K-1A ( Appendix J ) layout and in Drawing K-2 & K-3 ( Appendix D&E ) in cross-section. Note that over 50% of the Propertv shoreline is being left natural. At its closest point to water, the existing bluff base is only 20 feet from mean high water ( no wind ). The excavated bluff angle of 26.5 degrees ( 2:1 or 50% slope ) is at a maximum without costly bank shear stabilization and specialized erosion control. Lower slopes will be used at lower bluff heights. Level space at the top of the bluff is at a premium due to the land falloff to the Taylor's Gut Wetland & Tributary ( Diag. #2 page 6 and Dwg. K-2 ). The bluff base withdraws from the shore line both to the north and south of the closest point to water. Rock entry into the water up to 10 '( 4-6 "of depth ) occurs only in the narrowest bluff base area and has been recommended by contractors. Several rejected alternatives are discussed on page 19. Wetland areas and Taylor's Gut are completely avoided ( 75` + natural buffers ). Wind tides & high water levels further restrict shoreline width ( Dwg. K-2 & pg.17 ). Field data is plotted in Appendix U-1,3. Wind tides routinely impact shoreline width by over 10 feet. There is extremely limited shoreline space below the highest bluff peak for construction. This Plan seeks to avoid a potential Permit violation from rock rolling into the River beyond limits during toe construction in a tight space. The normally approvable rip rap limit of up to 10 feet in water ( 5 feet average ) is desirable but not mandatory from a design viewpoint. Backing up the rock revetment toe further than behind the normal water line will become a critical design and construction limitation in the area of maximum bluff height. The first 10-15 feet of bluff height needs to be minimally impacted because of the 6-8 foot high moist clay layer at River level. A clean & compacted fill in front of this soft clay layer is particularly desirable. Please coordinate your decision process with NC DENR in Washington & Morehead City and advise us of any restrictions which will be placed on our Maior Permit Application, The Site wastewater plan for Beaufort County is approved The Site Storm-water Plan is approved The Site Erosion Control Plan is being reviewed The Site CAMA Major Permit approval is pending As a minor separate subject, you mentioned the abandoned off-shore duck blind in public trust waters 450 feet off shore as shown in Appendix H of this Plan. The breakwater is proposed to be constructed on average 50 feet offshore from the normal water level. The breakwater will be constructed of 3' X 3' X 12' long gabion baskets. The breakwater will extend above normal water level approximately 21 inches. The rock baskets will be arranged to alternate 36 feet of rock and 36 feet of open water for a total of five rock baskets and four open water segments. The DMF does not object to the shoreline stabilization or to the sloping of the lot. However, the DMF is opposed to the breakwater for two reasons. The first concern with the breakwater is the potential for the area behind the breakwater to shoal over with sand. Currently the habitat along this shoreline is soft mud which provides an excellent habitat for submerged aquatic vegetation [SAV (Street et al. NCCHPP, 2005). The other concern has to due with navigation and safety. Although the water depths around the proposed breakwater is shallow (about 15")jet skis and shallow draft motor boats can easily navigate in these depths. No backfill of the breakwater or any other filling of wetlands, estuarine waters, public trust areas or high ground is authorized by this permit. 5. No excavation of shallow water bottom, any wetlands or high ground is authorized by this permit. 6. Perpendicular sections, return walls, or sections which would enclose estuarine waters or public trust areas shall be allowed under this permit. 7.
