Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this minor modification authorizes additional boatlift to the existing 1 docking facility, all as expressly and specifically set forth in the attached workplan drawings. No other i additional structures, whether floating or stationary, shall become a permanent part of this facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) This minor modification shall be attached to the original Permit No. 79-05, which was issued on 6/3/05 and both documents shall be readily available on site when Division personnel inspect the project for compliance. 3) All conditions and stipulations of the active permit remain in force under this minor modification unless specifically altered herein. The Kollings currently have 1 boat lift, one wet slip and a lift for two personal water craft. The Ledbetter's dock consisted of 4 wet slips. Based on my observations of /existing/ conditions, an additional slip at the Ledbetter property would not cause a shellfish closure. It should be noted that the distance between the two docks may be less than 100 feet. In such case, a combined slip count of greater than 10 slips would cause a shellfish closure. State Permit No. 79-05 was transferred to Mr. Russell Ledbetter on 7/11/2005 and is due to expire on 12/31/2008. The action proposed consists of the installation of a boatlift,measuring approximately 13' in length by 13' in width on the landward side of the authorized"U-shaped"floating dock. The location of the boatlift would be in an area that was not an authorized slip in approximately—3' @ normal low water(NLW). This would allow the facility to accommodate an additional slip to a total of five(5)vessels. The agent states that there would be no additional construction to the existing facility to allow for the installation of the boatlift. The structure would not encroach into the adjacent riparian corridors 15' setback requirement. Mr.Jeremy Humphrey,Health Specialist with the N.C.Division of Environmental Health Shellfish Sanitation and Recreational Water Quality has stated in an attached email that the additional slip under this request would not cause a shellfish closure. The applicant has submitted check(No. 15850)in the total amount of$100 for the modification. This office has no objections to modification request for State Permit No. 79-05.
