Docking Facility
1) The alignment of the proposed docking facility shall be staked prior to construction and a pre-
application meeting to approve the staked alignment shall take place with a representative of the
Division of Coastal Management prior to construction.
2) An as-built survey shall be performed on the docking facility, and copies of the survey shall be provided
to the U.S. Army Corp. of Engineers and the Division of Coastal Management, within 60 days of
completion of construction.

ADDITIONAL CONDITIONS
3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
4) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, may become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over public trust
waters without permit modification.
5). No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
6) Any portion of the permitted access pier, and, docking facilities built over coastal wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
7) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee shall not be relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
8) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.

removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.

9. NARRATIVE DESCRIPTION:
Project Setting
The applicant owns a lot that is approximately 3/4 acre in size and is adjacent to Taylors Creek in the Town of Beaufort,
North Carolina, Carteret County. The street address is 1905 Front Street,which is accessed by going south off Hwy 70
in Beaufort onto Live Oak Drive, and east Front Street, then approximately one mile on the right adjacent to Taylors
Creek. Applicant states that the property is approximately 6' above MHW. The high ground is vegetated with typical
lawn grasses and Live Oak trees. Man-made features existing on site are a house and a shed.
The adjacent waterbody is Taylors Creek, which runs east—west for several miles between the Beaufort Waterfront
and the estuarine islands. Taylor's Creek empties into Gallants Channel to the west and the North River Thorofare to
the east. Taylor's Creek is approximately 400' wide from marsh edge to marsh edge at the site. The length of the
shoreline at the site is 75'. The soil on the high ground is sandy and leads to a 54'area of marsh. The marsh consists
of approximately 27' of high marsh (Juncus roemerianus) and 27' of low marsh (Spartina alterniflora). This marsh
serves as shoreline stabilization for the site. The shoreline two lots to the east has a wooden bulkhead and a pier. The
adjacent lot to the west has an existing dock. There is a federal channel in Taylors Creek that requires a 61'setback at
this location as defined by the USACE. The water depths at the proposed site range from 0'to-8' at NLW. A narrow
fringe of oysters along the marsh edge was observed at the time of the site visit.
Taylors Creek is not classified as a PNA by the Division of Marine Fisheries, and is classified as SC by the Division
of Water Quality. Taylors Creek is closed to shellfishing. The site is classified as Developed by the Carteret
County Land Use Plan, with all AEC's classified as Conservation.
The applicant proposes a private docking facility within his riparian lines. The proposed dock includes a 6' x 54'
access over wetlands continuing with a 6' x 56' access over open water. This leads to an 8' x 32'" L" platform with
a 3' x 15'finger pier on the west side of the access. Six additional outer tie pilings are proposed that would create
four boat slips.
Project Description:
The proposed pier would begin at the edge of the grassy high ground and the high marsh. The 6' wide access
would cross approximately 27' of high marsh (Juncus roemerianus) and 27' of low marsh (SSpartina alterniflora).
The pier would then cover 64' of open water area. The total distance from the marsh edge into the open water
including the outer tie off pilings would be 81'. According to plats provided by the applicant and confirmed by site
observation, the proposed pier would be in line with the pier to the west and would be slightly longer than the pier
to the east, but not longer than other piers in the vicinity. The tie off pilings on the east side of the proposed pier
would be on the riparian corridor line. The applicant has a signed waiver to approve the position of these pilings.
The tie pilings on the west side of the pier would be 26' from the riparian corridor. Applicant proposes four boat
slips in this facility. The proposed pier would be 19' from the USACE setback line. No high ground development is
proposed.

10. ANTICIPATED IMPACTS
The proposed pier is in line with other piers for private use along Taylors Creek. It would result in four boat slips. The
marsh area shaded would be 324sf. The total area of public trust open water incorporated by this facility would be
3888sf, of which 637sf would be shaded bottom. The total area of impact for this proposal would be approximately
4212 sf. No adverse navigational impacts are expected, as the pier would be in line with adjacent piers. Some turbidity
could be expected during construction, but should be short in duration.

This correspondence is in reference to the request made by TD Eure Construction on your
behalf, wherein Chuck Bissette proposed to amend State Permit #72-05, set to expire on 12/31/08. The
original permit authorized a four-slip docking facility within Taylor's Creek at 1905 Front Street,
Beaufort, Carteret County.
Your current request is to construct two boatlifts within the footprint of the authorized docking
facility. To do so, you propose adding two 13' x 13' lifts adjacent to the dock, within existing slips.
No additions will be outside of the existing authorized footprint and no more slips will be created. The
proposed development is depicted on a plat dated 4/17/08, received 4/18/08, and the written request
dated 2/13/08.
I agree with DCM Field Representative Brad Connell in his determination that the proposed is
consistent with the original intent of State Permit#72-05, and is in keeping with the General and
Specific Use Standards found in 15A NCAC 07H .0208. Please consider State Permit #72-05 refined
to include the above-described development by way of this letter. Note that this refinement must be
attached to the original permit for Division inspection, and all other conditions of the original permit
still apply.

The following are my comments and recommendations for the above referenced
proposal: The applicant proposes to build a private docking facility including four slips
at 1905 Front St, on Taylors Creek, Beaufort, Carteret County. The pier meets the
USACE setback line, and a waiver has been obtained from the property owner to the east
to allow encroachment into the 15' setback. The proposed dock is consistent with 15A
NCAC 07H .0208 (b)(6), allowing platform area of 4sf per linear feet of shoreline.
I recommend the project be authorized as proposed, contingent upon the following
conditions:
1 This permit authorizes only the docks, piers, and other structures and uses located
in or over the water that are expressly and specifically set forth in the permit
application. No other structure, whether floating or stationary, may become a
permanent part of this marina/docking facility without permit modification. No
non-water dependent uses of structures may be conducted on, in or over public
trust waters without permit modification.
2 Any portion of the permitted access pier and docking facilities built over coastal
wetlands must not exceed six feet in width and must be elevated a minimum of
three feet over the wetland substrate as measured from the bottom of the decking.
3 No attempt will be made by the permittee to prevent the full and free use by the
public of all navigable waters at or adjacent to the authorized work.

4 The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee is not
relieved of this requirement if he abandons the permitted activity without having
it transferred to a third party.
5 The permittee must install and maintain at his expense any signal lights or signals
prescribed by the U.S. Coast Guard, through regulation or otherwise, on the
authorized facilities. At a minimum, permanent reflectors should be attached to
the structure in order to make it more visible during hours of darkness or
inclement weather.
NOTE: This permit does not eliminate the need to obtain any additional state,
federal or local permits, approvals or authorizations that may be required.
NOTE: The permittee and/or his contractor is urged to meet with a representative
of the Division prior to project initiation.

LUP Consistency Determination: The proposal is Consistent With &Not in Conflict with the
1996 Town of Beaufort Land Use Plan certified by the CRC
on September 26, 1997, provided that all applicable local,
state, and federal development guidelines are met.
Overview:
Areas of Environmental Concern (AEC) impacted by the proposal include Estuarine Shoreline,
Estuarine Waters, Coastal Wetlands, and Public Trust Area. The Waters at the project site are
classified as SC and are closed to the harvesting of shellfish. The area is not a Primary Nursery
Area.
The Carteret County Land Classification Map designates the subject property AECs as
"Conservation". Development within the designated AEC is limited by CAMA regulations and
development guidelines. Applicable or related policy includes the following:
"Beaufort supports the use standards for estuarine and public trust areas as specified in
15A NCAC.0207."(Section IV Marine Resource Areas Policy(a), pg. IV-12)
"Residential, commercial, and industrial development should be allowed in coastal
wetlands which is consistent with 15A NCAC 7H and the policies contained in this
plan." (Section IV Residential, Commercial, and Industrial Development on Resources
Policy(a), pg. IV-11)
"In order to preserve natural vegetation and scenic views, "no buildings or houses or
structures excepting noncommercial docks or piers will be erected on the south side of
Front Street in this R-8 district" (Section IV Residential, Commercial, and Industrial

The Department of Environment and Natural Resources hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an Area of
Environmental Concern as designated under the CAMA was received on January 18, 2005.
According to said application, Mr. David Liggett has applied to build a private dock at 1905
Front St. in Beaufort within Coastal Wetlands, Estuarine Shoreline, and Public Trust Water

Dear Mr. Liggett:
The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your property located 1905 Front St., Beaufort. It was received on January 18,
2005, and appears to be adequate for processing at this time. The projected deadline for making a
decision is April 4, 2005. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on or about the
75th day.
If this agency does not render a permit decision within 70 days from the January 18, 2005, you may request
a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written request
and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card to
a telephone pole or tree along the road right-of-way fronting your property, or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could result
in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing
if you wish to receive a copy of my field report and/or comments from reviewing agencies.

BEING all that certain tract or parcel of land situate, lying and being in Beaufort
Township, Carteret County, North Carolina, and being more particularly described as
follows:
In the Town of Beaufort: Beginning at a point in the south line of the Beaufort-
Lennosville Road, it being the northeast corner of the lot of William O. Noe (his deed,
Book 94, Page 50); thence runs South 16-30 West, along William O. Noe's east line
approximately 565 feet to the waters of Taylor's Creek; thence along the waters of
Taylor's Creek to a point which in a straight line is South 8 1-00 East, 72 feet to a point in
