PROJECT SUNVEVIARY: The applicant proposes to construct a 2,800 ft2 home and a 400'X10' driveway connecting the home to the street. This development would involve filling 1,855 ft2 of Section 404 Wetlands, creating 836 ft2 of Section 404 Wetlands, and disturbing 7,309 ft2 of high ground. Field Investigation Report: Frank Rush Page 02 --------------------------- 9. Narrative Description: The project is located at 7018 Emerald Dr in Emerald Isle,Carteret Co. This site is bordered to the north by Archers Creek off of Bogue Sound. East of the property is a vacant lot and west of the property is an existing single family residence. The aforementioned lot is 1.743 acres in size and averages 4' above sea level. The lot is 75' wide and 1,015 ft deep. Currently there are no structures existing on site. Along the shoreline there is a thick fringe of high marsh containing Black Needle Rush(Juncus roemarianus). Directly adjacent to the high marsh is a fringe of Section 404 Wetlands. Patches of Section 404 Wetlands are also scattered throughout the high ground. The vegetation on the highground area includes: Live Oak (Quercus vir ing iana),Sweet Gum(Liquidambar stryciflua),Loblolly Pine(Pinus taeda),Red Cedar (Juniperus vir ing iana),Yaupon(Ilex vomitoria) and Wax Myrtle(Myrica cerifera). In the project area,the NC Division of Water Quality classifies the waters of Archers Creek as SA- Outstanding Resource Waters(ORW). The area is designated as a Primary Nursery Area(PNA)by the NC Division of Marine Fisheries but it is closed to the taking of shellfish. Public water and electricity are accessible from this lot. 10. Proiect Description: Frank and Suzzanne Rush have made application to construct a 2,800 ft2 home for their personal residence. A 400'X10' driveway would also be built in order to connect the home to Emerald Dr. In the construction process the applicant proposes to fill 1,855 ft2 of Section 404 Wetlands, create 836 ft2 of Section 404 Wetlands, and disturb 7,309 ft2 of other high ground areas. The proposed 2,800 ft2 home would have a footprint 34' wide and 60' deep (2,040 ft2) including porches and decks. The driveway would be 400' long and 10' wide with aflare to 34' wide directly in front of the home to accommodate garage stalls on each side of the home. The driveway and home will result in 8.3% of the area within the 575' AEC to be impervious. In order to connect the home to Emerald Dr., the driveway must cross three areas of Section 404 Wetlands. This will result in 1,855 ft2 of wetland fill. In wetland areas,two feet of fill (with a 2:1 side slope), will be placed to accommodate the 10' wide driveway. The owners estimate that approximately 850 yd3 of fill will be necessary to raise the elevation of the footprint of the home and fill the wetland areas proposed for the driveway. On high ground,7,309 ft2 will be disturbed for the home and driveway. Town of Emerald Isle ordinances allow wetlands to be filled, however, any amount greater than 1,000 ft2 that is filled must be replaced. As such, the owners plan to construct a total of 836 ft2 of new wetlands in upland areas adjacent to existing wetlands in order to meet the Town's requirements. The wetland creation areas will be excavated to a depth sufficient to result in the creation of new wetlands. The applicant will be acquiring a Nationwide Permit from the Army Corps of Engineers during this permit review. Utilities to service the home are to include water,electricity and cable. An on-site septic system will be installed for sewage disposal. The septic system will be greater than 100' away from normal high water. Anticipated Impacts: The construction of the proposed home and driveway would require filling 1,855 ft2 of Section 404 Wetlands. Of this, 836 ft2 will be replaced resulting in a net loss of 1,019 ft2. On high ground, 7,309 ft2 will be disturbed for the home and driveway. Silt fences will be used to prevent fill material from being transported into the marsh and wetland areas. The home and driveway would create an impervious area of 8.3% within the 575' AEC. The lot is 75 ft wide and 1,015 ft deep, and fronts on Piney Creek (also known as Archer's Creek). The lot consists of approximately 475 ft (north to south) of upland area, and approximately 540 ft (north to south) of marsh area. The owners desire to construct the home near the boundary between the upland area and marsh area to secure views of the sound and marsh, and to secure privacy from Emerald Drive (also known as NC 58). The new home will be 2 stories over enclosed pilings, resulting in the appearance of 3 stories. The area within the enclosed pilings on the ground floor will be used only as an under-structure garage and for general storage. No habitable space will be on the ground floor, with the exception of an entry foyer and steps to the main living floor above. The total footprint of the structure is 34 ft wide by 60 ft deep (2,040 sq. ft.), including porches and decks. The total footprint, exclusive of the porches and decks, is 34 ft wide by 44 ft deep (1,328 sq. ft.). The driveway will be approximately 400 ft long from Emerald Drive to the home, and will be approximately 10 ft wide, with a flare to 34 ft wide directly in front of the home to accommodate garage stalls on each side of the front of the home. The driveway must cross 3 small wetland areas (depicted on the survey), and the total amount of wetland fill required to accommodate the driveway and a small area near the southwest corner of the home is approximately 1,835 sq. ft. Town of Emerald Isle ordinances allow wetlands to be filled, however, any amount greater than 1,000 sq. ft. that is filled must be replaced. As such, the owners plan to construct a total of 836 sq. ft. of new wetlands in upland areas adjacent to existing wetlands in order to meet the Town's requirements. The wetland creation areas will be excavated to a depth sufficient to result in the creation of new wetlands. The natural elevation of the area where the footprint of the home will be located ranges from 3-5 ft. above sea level. The owners plan to import sandy fill material to raise the elevation of the footprint to approximately 8— 10 ft. above sea level. The home will then be constructed on pilings, resulting in the main floor of the structure being an additional 9 ft higher than ground elevation. The owners estimate that approximately 850 cubic yards of fill will be necessary to raise the elevation of the footprint of the home and fill the wetland areas proposed for the driveway. Silt fences will be used to prevent fill material from being transported into the marsh and wetland areas, and if necessary, retaining walls will be constructed. Please note that the applicant has attempted to minimize wetland filling by locating driveway crossings in the narrowest section of wetland areas. The approved septic drain field is located in an area near Emerald Drive, approximately 350 ft. south of the home. The home will utilize a septic tank and pump tank to pump wastewater to the drain field, as indicated on the attached septic permit issued by the Carteret County Health Department. The proposal is to fill 1,855 ft2 Of Section 404 Wetlands within the 575' Estuarine Shoreline AEC and to construct a single-family residence and driveway on the property. The applicant is currently in the process of obtaining a Nationwide permit from the USCOE. The area within the AEC covered by impervious material is 8.3% which is less than the allowable 25%. Therefore, I recommend the project be authorized as proposed, contingent upon the following conditions: 1 The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 2 No excavated or fill material will be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). 3 Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.).
