This permit, issued on August 10,2005 , is subject to compliance with the application(where consistent
with the permit), all applicable regulations, special conditions and notes set forth below.Any violation of these terms may
be subject to fines, imprisonment or civil action;or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the dock, pier, and other structures and uses located in or over the water that
are expressly and specifically set forth in the permit application dated 6/10/05 and attached workplan
drawing dated "revised" 6/10/05. No other structure, whether floating or stationary, may become a
permanent part of this docking facility without permit modification. No non-water dependent uses of
structures shall be conducted on, in or over public trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.

ADDITIONAL CONDITIONS
3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
4) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation.
5) The docking facility and associated structures shall have a minimum setback distance of 15 feet between
any parts of the structure and the adjacent property owner's riparian access corridor, which is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel
line that intersects with the shore at the point where the upland property line meets the water's edge.
6) All portions of the fixed pier located over coastal wetlands shall not exceed a width of 6 feet and shall be
elevated a minimum of 3 feet over the marsh substrate as measured from the bottom of the decking.
7) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
8) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
10) This permit authorizes a maximum of five boat slips. At no time shall more than 5 vessels be moored or
docked at the facility without permit modification. The restriction on the number of vessels shall apply
to all marine vessel types, including but not limited to motorboats, sailing vessels and personal
watercraft. In accordance with conditions made by the permittee, no vessel over 24 feet in length shall
be moored at this docking facility.
11) No portion of any structure shall be located within 80 feet of the near bottom edge of the federally
maintained AIWW channel. An as-built survey shall be performed on the docking facilities, and copies
of the survey provided to the U.S. Army Corps of Engineers and Division of Coastal Management,
within 60 days of completion of construction of these portions of the project.
NOTE: Due to the proximity of the AIWW, boats utilizing the docking facility shall be subject to
frequent wavewash from passing vessels. The issuance of this permit does not relieve the
permittee from taking all proper steps to ensure the integrity of the structure and the safety of
moored boats. The permittee shall not hold the State of North Carolina or the United States
liable for any damage to the structure or moored boats.

ADDITIONAL CONDITIONS
General
12) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
13) In accordance with comments made by the permittee in his 6/29/05 letter, the existing concrete boat
ramp shall be used for pedestrian traffic only and no vehicle traffic. To avoid damage to wetlands, the
boat ramp shall be used to launch kayaks, canoes and other low-impact watercraft only.
14) No wetlands shall be excavated or filled, even temporarily, without permit modification.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 05-
0822.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No.
197800056 (COE Action Id. No. 200500766) which was issued on 5/9/05.

State Dredge and Fill Law, for you to proceed with your project proposal. Please sign both the original (buff-
colored form) and the copy. Return the copy to this office in the enclosed envelope. Signing the permit and
proceeding means you have waived your right of appeal described below. Please retain the original(buff-colored
form),as it must be available on site when the project is inspected for compliance.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229.Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty(20)days,the matter must be resolved prior to work initiation.
The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands
all permit requirements.
From time to time,Department personnel will visit the project site.To facilitate this review,we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas,you may contact Department personnel

9. PROJECT DESCRIPTION:
The applicant's proposed project is located at 2448 Harbor Lane,adjacent to Topsail Sound and the Atlantic Intercoastal Waterway,
in Scotts Hill, Pender County. To get to the project site, from the intersection of US Hwy 17 and the southern crossing of
Scotts Hill Loop Road, go East approximately 2.5 miles. The address location is on the right side of the road before
reaching Scotts Hill Marina.
The project site is own y Mr. William R. Morris. The size of the entire track of land is 3 acres with an approximate
elevation f ove mean sea level (MSL). The shoreline area along the AIWW measures 125 ft. in width with the
igh wat level located at an existing wall of rip-rap. To allow access to the proposed pier, there is also a 20 ft.
o the southern adjoining property and boat ramp owned by Mr. Martin A. Sorensen. The boat ramp measures 15
ft. wide by 24 ft. long with marsh area between the boat ramp and open water. The marsh area measured from the existing
rip-rap to open waters of the AIWW measures an average distance of 80 ft. and is vegetated with Salt Meadow Hay
(Spartina patens), Black Needlerush(Juncus roemerianus), Smooth Cordgrass (Spartina alterniflora).
The waters of the AIWW adjacent to the project site are classified ORW by the North Carolina Division of Water Quality
and are Open to the ffarvest of�lellfish. The waters are not designated as a Primary Nursery Area. 7
10. PROPOSED PROJECT:
The applicant proposes to subdivide this 3-acre lot into 9 individual residential lots in addition to his own home lot and to
build a pier with boat slips for the use of the future homeowners. Two of the individual lots have been built upon in
addition to the applicants own house which is built on his home lot. To allow access to the proposed pier and existing boat
ramp, there is a 20 ft. easement through the southern adjoining property that is owned by Mr. Martin A. Sorensen. The
dimensions of the proposed structure would include the construction of 112 _ft. of 6 ft. wide pier with a 16 ft. x 16 ft. T-
head, a 8 ft. x 80 ft. floating pier, (six) 3 ft. x 5 ft. finger piers, (two)20 ft x 20 ft boat lifts and(eight) 14 ft. x 20 ft. boat
lifts. Water depths under the floating pier, finger piers and boat lifts range from 3 ft. below MLW at a point nearest to the
shoreline, to a depth of over 5 ft. below MLW at a point furthest from the shoreline. The applicant states that boat sizes
greater than 24 feet in length, cabins, live-a-boards or heads would not be allowed.
There is an existing marina basin (Scotts Hill Marina) located 425 ft. north of the proposed project. The single-family
residential lot,home and private pier located north of the project area is also owned by Mr. Morris. The area located south
of the proposed project is filled with single-family residential properties, some of which also have private piers
11. ANTICIPATED IMPACTS:
The proposed pier and 10 boat slips would incorporate approximately 4,656 sq. ft. of estuarine waters and public trust area
and would result in the shading of approximately 480 sq. ft. of coastal wetlands. The project could increase turbidity levels
during project activity,however, no long-term adverse impacts are anticipated. This project meets the 1/4width rule,channel
setback requirements and riparian setback requirements. r �'

It is recommended that a permit be issued subject to the following conditions:
1 The marina/docking facility will display a sign showing the location of the nearest/on-site pumpout facility,
including other appropriate waste disposal information, at the entrance and exit from the pier.
2 No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina/docking facility. Any sewage discharge at the marina/docking facility shall be considered a violation
of this permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.
3 The authorized structures and associated activity must not cause an unacceptable interference with
navigation.
4 This permit authorizes only the docks, piers, and other structures and uses located in or over the water that
are expressly and specifically set forth in the permit application. No other structure, whether floating or

Environmental Policy Act (NCEPA).
NOTE: Permanent reflectors should be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.
NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation
of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or
indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law.
NOTE: Due to the proximity of the AIWW, boats utilizing the docking facility will be subject to frequent
wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all

Project Description:
New 10-boat slip T-head pier with floating platform and finger piers adjacent to the Atlantic Intra-
coastal Waterway,just south of Scotts Hill Marina.
Comments:
l. Any docking facility consisting of more than five slips is considered a marina under the Pender
County Zoning Ordinance. A marina requires a special use permit be issued by the County prior
to any construction activity for this facility.
2. This facility will be located in Outstanding Resource Waters(ORWs). The Pender County
CAMA Land Use Plan does not allow new marina development in ORWs. The only exception is
when piers are consolidated to reduce the total number of piers that would otherwise be allowed.
3. Construction of a pier facility will require a building permit from the Pender County Inspections
Department,under the North Carolina Building Code. Any electrical components at the facility
will be required to be elevated in accord with FEMA Regulations. Some limited electrical
components may be placed below Base Flood Elevation if installed on a GFI Circuit.
4. Any subdivision of this property into additional lots will require approval under the Pender
County Subdivision Ordinance. Any lots in this area created after July 15, 1988 must be at least
20,000 sq. ft. in area.

19, 2005 we received confirmation from DWQ that the requested information was received and that the
revised project is exempt from 401 certification. Therefore, by way of this letter we are informing you
that your application is no longer on Division of Coastal Management hold and processing of the
application will continue which will make the 75 day deadline August 23, 2005. An additional 75 days
is provided by G.S. 113A-122(c), however, we expect to take action prior to that time and will do so as

On May 3, 2005, the Division of Water Quality (DWQ) in the Wilmington Regional Office
(WiRO) received your application dated May 3, 2005 from the Division of Coastal Management
to review for DWQ water Quality impacts/concerns. The DWQ has determined that your
application was incomplete and/or provided inaccurate information as discussed below. The
DWQ will require additional information in order to process your application for potential
impacts to protected wetlands on the subject property. Therefore, unless we receive the
additional information requested below, we will have to move toward denial of your application
as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we
receive this additional information. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
1. The Wilmington Regional Office has reviewed the Division of Coastal Management's
application for William R. Morns for a 10-slip community pier in Rich Harbor
subdivision. The Division of Water Quality can ONLY allow a 9-slip facility at this
location due to the waters being classified Outstanding Resource Waters (ORW) for
that area. NCAC 02B.0225(e) (7)(0 states that the only type of new or expanded
marina that shall be allowed shall be those marinas located in upland basins areas or
those with less than 10-slips, having no boats over 21 feet in length and no boats with
heads will be allowed in Topsail Sound and Middle Sound Area (Cape Fear River
Basin); including all estuarine waters from New Topsail Inlet to Mason Inlet,
includQ the Intracoastal Waterway and Howe Creek, but excluding Pages Creek and
Futch Creek. Pender County's Land Use Plan also limits the number of boat slips in
an ORW. Please modify the permit application to show compliance with the
most restrictive number of slips allowed in an ORW.

2. This Office is also concerned that there is the potential for impacts to the coastal
marsh at the existing boat ramp. The existing boat ramp does not go all the way
down to the waters edge and is vegetated with Spartina alterniflora waterward of the
ramp for approximately 30' +. If this ramp is used by the proposed subdivision home
owners there would be impacts to wetlands which would be considered a violation of
the Division of Water Quality's Rules. You may want to consider this potential
impact and propose some way to prevent/avoid this potential issue.
Please respond in writing within three weeks of the date of this letter by sending a copy

The North Carolina Wildlife Resources Commission has reviewed the project for impacts
to wildlife and fishery resources. We regret that time constraints prevented a site visit. Our
comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act
(48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the Coastal Area Management Act (G.S.
113A-100 through 113A-128).
The applicant proposes to construct a 10-slip community dock for a 9-lot subdivision on 3
acres fronting the AIWW. An existing marina basin(Scotts Hill Marina) occurs 425 ft. north of
the proposed work. An 80-ft. wide margin of coastal wetlands occurs along the shoreline.
Coastal wetlands typically provide excellent habitat for wading birds, raccoon, opossum,juvenile
fishes, and estuarine invertebrates. Area waters are classified SA and open to shellfish harvest.
The proposed community dock may be close enough to the existing marina to cause an
expansion in shellfish closure area. About 480 sq. ft. of coastal wetlands would be shaded by the
pier. Based on these concerns, we recommend the following conditions to permit issuance.
1. Pier decking should be elevated a minimum of 4 ft. off the marsh floor to reduce the
effects of shading.

Areas of Environmental Concern(AEC's) impacted by the proposal are EW, ES and PT.
Waters at the project site are classified as ORW and are open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 1991 Pender County Land Use
Plan and offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation.
In general, Pender County allows development in Conservation classified AECs which is
consistent with the State's minimum use standards. The Pender County Land Use Plan
contains some policies which exceed the State's minimum use standards including those
for marinas and wet slip marinas. Under (A) Resource Protection policies of the Pender
County Land Use Plan. "there shall be no new marinas allowed in or adjacent to
waters designated ORW..."
For permitting purposes, DCM defines marinas as more than (10) ten slips. However, the
Pender County Land Use Plan defines marinas "as any publicly or privately owned dock,
basin or wet boat storage facility constructed to accommodate more than five boats..."
The proposed project includes 10 slips and is defined as a marina by the 1991
Pender County Land Use Plan. Further, the proposed project is located in waters
designated as ORW.
Therefore, the project as proposed is NOT consistent and is in conflict
with the 1991 Pender County Land Use Plan Update.

were to use the facility for temporary or permanent dockage, appropriate closures to open

On April 25, 2005, the Field Investigative Report for a proposed 10-boat slip community pier applied for by Mr.
William R. Mooris was submitted for review. Inconsistencies in this Field investigative Report have since been found and
modified. The modifications made are listed as follows.
1. Section 7(F),Water classification type was changed from SA to ORW.
2. Section 7(F),was changed to read Yes,waters are open to the harvest of shell fish.
3. Section 9,paragraph 2 was changed to add that there is marsh area between the boat ramp and open water.
4. Section 9,paragraph 3 was changed to read;"The waters of the AIWW adjacent to the project site are classified
ORW by the North Carolina Division of Water Quality".
5. Section 10,paragraph I was changed to read;"Two of the individual lots have been built upon in addition to the
applicants own house which is built on his home lot".
The sections of this Field Investigative Report that have been modified are attached.

The Department of Environment and Natural Resources hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an Area of
Environmental Concern as designated under the CAMA was received on April 25, 2005.
According to said application, William R. Morris, proposes to build a 10 boat slip T-head
pier with a floating platform and finger piers, at 2448 Harbor Lane, adjacent to Topsail Sound and
the Atlantic Intercoastal Waterway, in Scotts Hill, Pender County.

Pender County. The application was first received on February 3,2005. On March 28, 2005 a request for additional information was
issued which identified information needed to make the application complete. This modified application was received on April 25,2005,
and appears to be adequate for processing at this time. The projected deadline for making a decision is July 9,2005. An additional 75-
day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action
by the initial deadline stated above,you should consider the review period extended. Under those circumstances,this letter will serve as
your notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from April 25,2005,you may request a meeting with the Director of the
Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working
days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b)requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find
a"Notice of Permit Filing"postcard which must be posted at the property of your proposed development. You should post this notice at
a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal review agencies for their
comments. If additional information is required based on this review, the agencies may contact you directly.

Dear Mr. Morris:
This letter is in response to your application request under the Coastal Area
Management Act(CAMA) to build a 10-boat slip T-head pier with a floating platform and
finger piers in Pender County. Processing of the permit application, which was received
by the Division of Coastal Management's Wilmington office on April 25, 2005, is
ongoing. However, it has been determined that additional information will be required
prior to the Division taking final action on your application. These items are summarized
below:
1) The N.C. Division of Water Quality, by way of the attached letter,has determined
that additional information will be required in order for that agency to adequately
review the proposed project. Due to the fact that a CAMA permit cannot be issued
without a water quality certification first being issued, it is necessary that processing
of your permit application be placed in abeyance until such time as the requested
information is provided to the Division of Water Quality, a water quality certification
is issued for the proposed project, and a copy of the certification is provided to this
office. Contact the Division of Water Quality directly at 910-796-7215 and reference
DWQ project 05-0822 if you have questions regarding this issue.
Also, please be aware that Pender County defines a marina as "any publicly or privately
owned dock, basin, or wet boat storage facility constructed to accommodate more than
five vessels and as additionally defined by the County are permitted only in non-
Outstanding Resource Waters."Therefore the current configuration of 10-boat slips is
considered a marina under the Pender County Land Use Plan and cannot be permitted as
proposed. To avoid permit denial, you are encouraged to modify the permit to include no
more than 5 boat slips, and the length of the pier cannot exceed 1/4 the length of the water
body. If you require assistance in determining the allowable length of the pier please feel
free to contact your DCM field representative (Gale Stenberg) at 910-796-7292, or you

in anywise appertaining unto the said parties of the second Part,
their heirs and assigns, in fee simple, FOREVER.
And the said parties of the first part, for their heirs,
executors and administrators do covenant to and with the said
parties of the second part, their heirs and assigns, that they are
seized in fee of the above granted and described premises, and they
have good right to sell and convey the same in fee simple; that the
same are free and clear from any and all encumbrances, and that they
will and their heirs, executors and administrators shall WARRANT
and DEFEND the title to the same against the lawful claims and
demands of any and all persons whomsoever.

County Registry; said southwestern corner being the
beginning corner of Tract 1 described above; running
thence from said beginning point, along the western
