This permit, issued on February 24, 2005 , is subject to compliance with the application(where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines im risonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
2) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee shall not be relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.

ADDITIONAL CONDITIONS
3) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over public trust
waters without permit modification.
4) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
5) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor. The line of division of
riparian access shall be established by drawing a line parallel to the channel, then drawing a line
p perpendicular to the channel line that intersects with the shore at the point where the upland property
line meets the water's edge.
7) In order to ensure consistency with Condition No. 6 of this permit, the permittee shall conduct an as-
built survey depicting the docking facility, property lines and riparian corridor lines. The survey shall be
submitted to the Division of Coastal Management within 60 days of completion of the permitted project.
8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
9) It is possible that the authorized structure may be damaged by wave wash from passing vessels. The
issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity
of the permitted structure and the safety of moored boats.
10) Any portion of the permitted access pier built over coastal wetlands shall not exceed six feet in width
and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of
the decking.
Erosion and Sedimentation Control
11) In order to protect water quality, runoff from construction must not visibly increase the amount of
suspended sediments in adjacent waters.
x 12) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).

13) All disturbed areas shall be provided a ground cover sufficient to restrain erosion within 30 calendar
days of project completion.

General
14) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 50 feet of the normal water level.

(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid

The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands
all permit requirements.
From time to time,Department personnel will visit the project site.To facilitate this review,we request that

ProjecL, Setting
The site is located approximately 4 miles southeast of the Town of Arapahoe at 142 Sunshine
Drive (Lot 40 in the Shine Landing subdivision), on Dawson Creek, in Pamlico County. The
joint applicants each owns 25% undivided interest in the non-residential lot. The lot slopes from
the Normal Water Level at the northern property boundary to approximately 11' above the
Normal Water Level at the property's southern boundary. The majority of the lot is composed of
freshwater and coastal wetlands. SSpartina alterniflora, Spartina ap tens, S6mus sue.,and Cladium
jamaicense can be found in the coastal wetlands on the property with multiple freshwater wetland
species found over 420' from the property's boundary with Dawson Creek. The property is 80
feet in length along the shoreline. The property rises quickly once beyond the wetland areas to a
flat upland area adjacent to Sunshine Drive.
Dawson Creek is classified SC; NSW by the EMC in the area of the proposed construction
and is less than 1000' from where Dawson Creek is classified SA; HQW NSW. Dawson Creek is
classified by the Division of Marine Fisheries as a secondary nursery area but closed to shell
fishing. Water depths in the area of the proposed boat slips range from -3.4' to -4.2' below the
NWL.
Currently there are no structures adjacent to the property, however, residential houses and
piers have been constructed on other lots within the subdivision. The developers of Shine Landing
Subdivision have installed a community dock for other off waterfront lot owners downstream from
the proposed project location.
Project Proposal
The applicants propose to construct a 6' X 60' marl/gravel walkway from Sunshine Drive to a
6' X 50' wooden access over high ground to a 6' X 404'wooden access over wetlands, to a 6' X
203'wooden pier with two 1.5' X 15' wooden finger piers and 8 wooden tie pilings to create four
15' X 30' boat slips. The access would be elevated 3 feet above the substrate where it crosses
over wetlands. The pier would be located 15' from the adjacent riparian property line to the East
and 20' from the adjacent riparian property line to the West. There are currently no piers on the
properties adjacent to the proposed project. The proposed pier location is within a cove and would
project out into the creek 203 feet beyond the Normal Water Level. Dawson Creek is
approximately 900 feet wide in the vicinity of the proposed pier.
Anticipated Impacts
As proposed the project would impact 660 sq. ft. over high ground, of which 360 sq. ft.
would be impervious surface in the area of the gravel walkway. The access over wetlands would
shade 2424 sq. ft. of wetlands. Construction of the access is expected to produce minor and
temporary impacts on the vegetation and grade/elevation of the wetlands from foot traffic and the
movement of construction equipment. The pier and associated boat slips would usurp 2898 sq. ft.
of Estuarine Waters and Public Trust Areas of Dawson Creek and would

create 1271 sq. ft. of shading of shallow water habitat as proposed. Localized turbidity impacts
are expected during pier construction. The pier would extend out from the NWL 203 feet,
approximately twice the length of the typical residential pier in Dawson Creek.

The following are my comments and recommendations regarding the above mentioned proposal.
The request is to construct a 6' X 60' gravel walkway to a 6' X 50' access over high ground to a
6' X 404' access over wetlands, to a 6' X 203'pier with two 1.5' X 15' finger piers and 8 tie
pilings for four boatslips. Based upon my review I have no objection to the issuance of this
permit but offer the following conditions:
1 No sewage, whether treated or untreated, shall be discharged at any time from any boats
using the docking facility. Any sewage discharge at the docking facility shall be
considered a violation of this permit for which the permittee is responsible. This
prohibition shall be applied and enforced throughout the entire existence of the permitted
structure.
2 This permit authorizes only the docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No
other structure, whether floating or stationary, may become a permanent part of this
marina/docking facility without permit modification. No non-water dependent uses of
structures may be conducted on, in, or over public trust waters without permit
modification.
3 The pier/boathouse and associated structures shall have a minimum setback distance of
15 feet between any parts of the structure and the adjacent property owner's riparian
access corridor, which is determined by drawing a line parallel to the channel, then
drawing a line perpendicular to the channel line that intersects with the shore at the point
where the upland property line meets the water's edge.

d Any portion of the permitted access pier and docking facilities built over coastal wetlands
must not Mood six feet in width and must be elevated a minimum of three feet over the
wetland substrate as measured from the bottom of the decking.
5 All development within 50 feet of the normal water level must be consistent with
1?nvironmental Management Commission (EMC) Neuse River buffer regulations in place
at the time of such Development.
6 No ,atte;rnpt will be made by the permittee to prevent the full and free use by the public of
all navigable waters at or adjacent to the authorized work.
7 The authorized structure and associated activity must not cause an unacceptable
interference with iiavigation.
8 This permit authorizes a.maximum of 4 boat slips. At no time shall more than 4 vessels
be moored or docked at the facility. The restriction of the number of vessels shall apply
to all marine vessel types, including but not limited to motorboats, sailing vessels and
Personal watercraft.
NO N"F,_ It is strongly recommended that the permittee exercise all available precautions in
the day-to-day operation of the facility to prevent facility waste from entering the
adjaccia waters. Such discharge, either directly or indirectly, to adjacent waters

Sunshine Landing Subdivision, adjacent to Dawson Creek near Arapahoe, Pamlico
County,North Carolina.
LUP Consistency Determination: The proposal is Consistent With&Not in Conflict with the
1992 Pamlico County Land Use Plan certified by the CRC on
July 24, 1992,provided that all applicable local, state, and
federal development guidelines are met.
Overview:
Areas of Environmental Concern (AEC) impacted by the proposal include Estuarine Waters (EW)
and Public Trust Area (PTA), and Coastal Wetland (CW). The Waters at the project site are
classified as SC; NSW and are closed to the harvesting of shellfish. The area is not a Primary
Nursery Area.
The Pamlico County Land Classification Map designates the subject property AECs as
"Conservation". Development within the designated AECs is limited by CAMA regulations and
development guidelines. Applicable or related policy includes the following:
"Except for the requirements established in Policy 10, which exceed the 1 SA NCAC 7H
minimum use standards, Pamlico County will permit those uses which conform to the
general use standards of the North Carolina Administrative Code (1 SA NCAC 7H)for
development within the 15A NCAC 7H as defined Areas of Environmental Concern
identified in this plan as Conservation areas I, III, and IV. The Conservation IV
classification includes estuarine and public trust waters. " (Residential, Commercial,
and Industrial Development Impacts on Resources, Policy 11,pg. IV-14)
"Pamlico County supports the use standards for estuarine and public trust waters as
specifies in 1 SA NCAC 7H.0207. " (Marine Resource Areas, Policy 1,pg. IV-14)

The Department of Environment and Natural Resources hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an Area of
Environmental Concern as designated under the CAMA was received on September 22, 2004.
According to said application, Jerry Nichols, Robert Chesshire, Mark Lomicka, and James
Buxton , propose to construct an access over the marsh for a distance of 454 feet, and construct a
pier 203 feet in length with 4 boat slips at Shine Landing S/D Lot # 40, adjacent to Dawson
Creek in Arapahoe, Pamlico County. A copy of the entire application may be examined or
copied at the office of Stephen Lane, NC Division of Coastal Management, located at 151-B
Hwy. 24, Hestron Plaza II, Morehead City,NC, (252) 808-2808 during normal business hours.
Comments mailed to Charles S. Jones, Director, Division of Coastal Management, 151-B
Hwy 24 Hestron Plaza II, Morehead City, NC 28557, prior to October 26, 2004 will be
considered in making the permit decision. Later comments will be accepted and considered up
to the time of permit decision. Project modification may occur based on review and comment by
the public and state and federal agencies. Notice of the permit decision in this matter will be
provided upon written request.

The NC Division of Coastal Management hereby acknowledges receipt of your application
submitted to this office by you on behalf of your clients for State approval for development within
Estuarine Waters, Public Trust Area, and Estuarine Shoreline located at Shine Landing S/D Lot
40, adjacent to Dawson Creek, Pamlico County. It was received on September 22, 2004, and
appears to be adequate for processing at this time. The projected deadline for making a
decision is December 6, 2004. An additional 75-day review period is provided by law when
such time is necessary to complete the review. If you have not been notified of a final action by
the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from September 22, 2004, you
may request a meeting with the Director of the Division ofCoastal Management and permit staff
to discuss the status of your project. Such a meeting will be held within five working days from
the receipt of your written request and shall include the property owner, developer, and project
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road rightof-
way fronting your property, or at a point along the road righfof-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.

Township, Pamlico County, North Carolina, and being more particularly
described as follows:
Being all of Lot No. Forty-five (45) , as the same is shown and delineated on
a Map of "Final Plan of SHINE LANDING" , said Map being recorded in Plat
Cabinet A, Slides 133-7 through 133-12, Pamlico County Registry, reference to
said Map being hereby made for a more perfect description of said property.
THIS CONVEYANCE IS MADE SUBJECT to those certain restrictive and protective
covenants recorded in Book 392, Page 517, Pamlico County Registry.
Also conveyed is Boat Slip #1 as shown on the map entitled "Proposed 4 Slip
Marina of Lot 40" recorded in Plat Cabinet A, Slide 135-6, Pamlico County

TOGETHER WITH an undivided one-fourth (1/4) interest in Lot Number 40, as

There is to be built on Lot 40 a pier to provide four (4) boatslips, the
owner of each slip to have the exclusive use of said slip. The use each
owner makes of the pier shall be such that it does not interfere with the use
of any other owner of the pier. All owners shall be equally responsible for
the maintenance, use, upkeep and replacement of said pier and any owner can
enforce this obligation against any other in any court of competent
jurisdiction in Pamlico County, North Carolina . If any owner, owner' s agent,
servant, employee, tenant, or relative causes damage to the pier, such damage
shall be the sole responsibility of that owner who shall be responsible for
all necessary repairs or replacement . This obligation shall likewise be
enforceable by any other owner in any court of competent jurisdiction in
Pamlico County, North Carolina.
Any improvements constructed on Lot 40 must conform to the restrictive
covenants on Shine Landing Subdivision.
The ownership of the fractional interest in Lot 40 may not be further reduced
and the taxes on said lot shall be paid on a prorata basis and when due .
This obligation may be enforced in t same manner as earlier provided for
maintenance and damage repairs . _.-
The fractional ownership interest in Lot 40 and the boatslip is an
appurtenance to ownership of a lot in Shine Landing and may be sold and
transferred only to a lot owner in Shine Landing. In the event a fractional
owner of Lot 40 and boatslip sells, conveys or transfers owner' s lot in The
Shine Landing, owner must first or contemporaneously transfer the boatslip
and fractional interest in Lot 40 to another owner in Shine Landing or the
transferee of owner' s lot . Failure to so specifically convey said fractional
interest and boatslip shall result in the same being deemed conveyed, sold
and transferred as an appurtenance of owner' s lot .
