NARRATIVE DESCRIPTION: Project Setting Morehead City DCM The site is located on Lot 31 on Sandy Point Drive in the Sandy Point subdivision and is approximately 2.5 miles northeast of the community of Merrimon, on the Neuse River, in Carteret County. The Sandy Point subdivision was formerly owned and operated by the Weyerhaeuser Company as a commercial pine plantation. The Weyerhaeuser Company began the development of the subdivision in the late 1990's. The roads are paved and there are multiple houses constructed,however,none are yet built immediately adjacent to the proposed project site. Lot 31 encompasses 7.415 acres total and there is a large section of coastal wetlands approximately 100' to 150' wide on the southern half of the lot that is vegetated predominantly with Cladium jamaicense. The property lines of the lot do not extend to the Neuse River,rather,the Sandy Point Home Owners Association own a strip of land approximately 30' to 60' wide between the Neuse River and Lot 31 which is mostly un-vegetated beach with patches of Snartina patens. The lot rises from approximately 4.5' above MSL at the northern property boundary to approximately 7' above MSL and is relatively flat from there to the paved road at the property's southern boundary. The majority of the upland area on the lot is vegetated with pine trees of various ages. The Neuse River is classified SA; HQW and NSW by the EMC in the vicinity of the proposed construction. The Neuse River is not classified by the Division of Marine Fisheries as either a primary or secondary nursery area but is open to shell fishing. The Carteret County Land Use Plan categorizes this area of the county as Rural,with all AEC's classified as Conservation. Stormwater Plan#SW8 960111 was approved for low-density residential development in this subdivision on 1/23/97. A Sedimentation/Erosion Control Plan was submitted for approval on 2/14/05. Project Proposal The applicant proposes to construct a two-story 60' X 60' single-family residence with a two car parking garage underneath the main structure. The applicant also proposes to construct a 14' X 725' marl/gravel driveway from Sandy Point Drive to a 25' X 30' parking area adjacent to the proposed residential structure. Water would be supplied to the residence by a private well the applicant proposes to construct 130' landward of the Neuse River and 50' northeast of the proposed dwelling. Wastewater from the proposed residence would be treated and disposed of via a proposed on-site low pressure pipe wastewater system which would include a septic tank,pump tank, and active and repair drainfields. Of the 7.415 acres on the lot, approximately 3.0 acres would be cleared and graded for the proposed construction activities. A 1,400 sq. ft. section of the proposed grading is within the Division of Coastal Management's Estuarine Shoreline AEC. All proposed development is located on the upland area of the lot. Anticipated Impacts As proposed the project would disturb 130,680 sq. ft. of high ground,of which 14,500 sq. ft.would be impervious surface for the residence,driveway, and other infrastructure. All proposed impervious surfaces are outside of the N.C. Division of Coastal Management 75' Estuarine Shoreline AEC. This equates to a 0% proposed impervious surface within DCM's 75' Estuarine Shoreline AEC and a 4.5% proposed impervious surface for the entire lot. All proposed development is located outside of any Coastal or Section 404 Wetlands and outside of the N.C. Division of Water Quality's Neuse River Basin Riparian Buffer Zone. Based upon my review, I have no objection to the issuance of this permit but offer the following conditions: r 1 The Division of Water Quality approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW8 960111 Mod., which was issued on 01/23/97. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. J2 Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property(e.g. silt fence, diversion swales or berms, sand fence, etc.). 3 Any building constructed shall comply with the North Carolina Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program. NOTE: The building code or flood damage prevention ordinance may impose additional more restrictive requirements than the Division's standards for development in areas of environmental concern(AECs). Please excuse the acronyms, but a contracted name works better than a full length name. Sandy Point, like many other communities, has a standing Architectural Review Committee to review all plans for homes,landscaping, home size,type of architectural composition, etc, prior to the start of any construction. We do this because we are striving to end up with a subdivision of uniformly beautiful,well-designed homes. For many of the residents, Sandy Point will be the last house they will ever buy, and we ail want to be known as a beautiful subdivision. It is to that end we are concerned about a number of items included in the Request for a Major Permit before you now. Please let us be more specific: • One of the reasons The Major Permit was required because the homeowner, James Mighore Cleared more than one acre without a permit. Had the homeowner sought approval in advance from the SPARC to dear the 3+ acres, he would not have received approval. Absent the Committee's approval, the land was cleared anyway. Abiding by the Sandy Point Covenants,which Mr. Mighore received before starting his home,there would have been no misunderstanding or differential reading of the covenants. Mr. Migliore chose to do the tree removal first,and ask permission later. The SPHOABOD would like to see the areas that were improperly Cut down, be restored as close as possible to it's original appearance and function. • The Current driveway has been placed in an unacceptable location. The current driveway clearly cuts through the 50'setbacks designated by CAMA and State Law. In fact,the driveway violates the 50'setback for almost half of its length. d The SPHOASOD as well as the ARC would appreciate meeting CAMA on-site with the homeowner, and clearly delineate the wetlands, coastal marsh lines, river shore line and uplands so the committees have the boundaries in hand before any further damage or misunderstandings occur in regards to this property. • Cursory analysis of the site today would reveal that virtually all the original silt fence has been blown down or knocked over and should be replaced before any construction proceeds. Silt fence specified on Stroud Engineering drawring would be an acceptable design. • The Major Permit application refers to a Storm Water Permit number SW8960111 dated January 23, 1997, What does this permit approve? If there were Issues regarding approval of storm water runoff, what does this mean for the mis-located driveway and entrance? • Finally,the septic system_ The original permit that was approved by the county Board of Health called for a single stage system. This original permit was approved by the SPARC and land was cleared in accordance with that permit. The original permit issued conforms to size requirements to handle number of bedroom and baths lot owner has constructed. The Major Permit is stating a twin tank septic system, 8 septic system and a N 39tid 1sf env AHldA 3N39 T6SEKL TS:60 S00Z/ZT/b0 pump tank. As we are sure you understand, the pump tank requires electricity to transfer the waste to the drain lines_ No electricity, no pumping of waste. Our frequent history of hurricanes reminds as that we are dependent on electricity just to survive. In this case, no electricity for days would certainly mean overflow of the system and contamination of the adjacent wetlands, as well as the beach area. The ARC has approved of a traditional, gravity-fed septic system, as gravity is not dependent on electricity to function. Absent a design for the twin tank system the Committee does not approve of the use of a pump tank. Approval may follow submission of the dual tank plan to the ARC for analysis and evaluation, We have also attached the original letter of Approval from the ARC,for your information,which states the ARC's concerns regarding the driveway and house setback.
