This permit, issued on November 23, 2005 , is subject to compliance with the application(where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
:= 1) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
2) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over public trust
waters without permit modification.

4) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.

permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury,..
which may be caused from existing or future operations undertaken by the United States in the public
interest.
6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
7) This permit authorizes a maximum of ten boat slips
NOTE: Any proposal to add one or more additional boat slips to the authorized 10-slip facility will
require that the docking facility be classified as a marina, and will therefore require a review
under the N.C. Environmental Policy Act (NCEPA).

8) If the permittee discovers any previously unknown historic or archaeological remains, including but not
limited to shipwrecks, while accomplishing the authorized work, he will immediately notify the District
Engineer, Wilmington Branch, U.S. Army Corps of Engineers at [phone], who will initiate the
required State and Federal coordination.
t 9) At least one week prior to initiation of construction, the permittee shall contact the N.C. Division of
Archives and History(DAH) at [phone], and provide this agency the opportunity to monitor
construction. If significant archaeological features are exposed, the DAH will be allowed reasonable
time to record and/or recover features prior to the continuation of construction activities.
10) The proposed project must receive approval from the Wilmington District Historic Commission prior to
commencement of the permitted activities.

ADDITIONAL, CONDITIONS
General
11) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon

due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions ;;

12) The West Indian Manatee (Trichecus manatus), which is listed as a federally endangered species, has
been reported in North Carolina waters. In order to protect the West Indian manatee all work should be

through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which
may Be Used by the West Indian Manatee in North Carolina" shall be followed.

13) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.

dependent activities are not authorized within 30 feet of the normal high water level.

121.1 or 113-229.Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office

9. PROJECT DESCRIPTION,
The project is located on the east bank of the Cape Fear River, adjacent to the south side of Nun Street, in downtown
Wilmington, in New Hanover County. The property is a .85 acre tract, with approximately 220 feet of river frontage and
measuring approximately 175 feet in depth. The property has an average elevation of+20 feet above mean sea level.
A nine unit condominium building with associated gravel driveway and parking are currently under construction at the project
site.A new 185 linear foot bulkhead and an approximately 80 linear foot brick wall stabilize the shoreline of the property. The
new bulkhead terminates about 80 feet from the southern property line,at a sandy estuarine beach area.Highground vegetation
consists of ornamental vegetation and several mature hardwood trees. Waterward of the bulkhead are patches of mixed
coastal/404 type wetland vegetation,including:Carex spp.,Giant Cordgrass(Spartina cynocoroides), and Smooth Cordgrass
(Spartina alterniora). The Cape Fear River is approximately 1000 feet wide at the project site.
CAMA Major Permit No.98-99 was originally issued on 10/13/99 for a nine unit condominium building,a ten slip community
dock and elevated boardwalk. The permit was amended on 10/21/99 for additional shoreline stabilization. Construction of the
185 linear foot wooden bulkhead was completed, however, the construction of the condominium building and elevated
boardwalk was initiated,but not completed. Construction of the community dock was never initiated.CAMA Major Permit No.
98-99 expired on 12/31/02.
Waters of the Cape Fear River are classified as SC,by the NC Division of Water-Quality.There are no shellfish resources in the
project area.At the project site,the Cape Fear River is designated as a Primary Nursery Area(PNA),by the NC Division of
Marine Fisheries. The highground portion of the project is classified as"Developed"by the Wilmington-New Hanover Land
Use Plan. The CAMA Areas of Environmental Concern and any area located in the 100-year flood plain are classified as
"Conservation".
PROPOSED PROJECT:
The applicant proposes to construct a ten-slip community docking facility and an elevated wooden boardwalk. The new
community dock would serve the existing nine-unit condominium complex on the property. Landward of the new
bulkhead,the applicant would construct and subsequently dedicate to the City,a wooden boardwalk, 12 feet wide by 200
feet long,which would be consistent with the City of Wilmington's 1984 Riverwalk Improvements Plan. The public
boardwalk would be elevated over the unvegetated shoreline.The applicant also proposes to construct a dock with a boat
slip for each of the existing nine units within the condominium building and one additional slip for owners guest use.A
24foot long by 4foot wide access ramp would be constructed from the new bulkhead to a 10 feet wide by 8 feet long ramp
landing. The landing would then terminate in a proposed floating dock,which would be located parallel to the shoreline.
The floating dock would be 140 feet long and 8 feet wide,with five perpendicular finger piers,each 30 feet long and 4 feet
wide, located 35 feet on center,on the waterward(west)side of the main dock.Two mooring pilings would be installed
north and south of the floating dock to complete the end boat slips. Additional mooring pilings would be installed between
each finger pier to create the proposed ten boat slips. The structure would be located landward of the harbor line of the
adjacent federal channel. The applicant is processing this major permit application for the 10-slip community dock due to
an oversight,which ultimately led to the expiration of the previous permit.

10. ANTICIPATED IMPACTS•
The proposed community pier would incorporate approximately 4,476 sq. ft. of estuarine waters and public trust area. River
bottom disturbance and temporary turbidity increases would be associated with the construction. The project would provide
boating access to the condominium owners,as well as,expand the City of Wilmington's Riverwalk project,by the dedication of
the public walkway.

Recommendations for State Permit—Gene Merritt "Governor's Landing"
I have no objections to the project subject to standard permit condition for pier facilities of this type:
1. This permit authorizes only the docks,piers, and other structures and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structures,whether floating or stationary,
may become a permanent part of the structure without permit modification. No non-water dependent uses of
structures may be conducted on, in,or over public trust waters without permit modification.
2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or
adjacent to the authorized work.
3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and
shall not exceed the established pierhead line.
4. The permittee must install and maintain,at his expense,any signal lights and signals prescribed by the U.S. Coast
Guard,through regulations or otherwise,on authorized facilities.
5. In order to protect water quality,runoff from the construction must not visibly increase the amount of suspended
sediments in adjacent waters.
6. This permit does not authorize the interference with any existing or proposed Federal project,and,the permittee
will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused
from existing or future operations undertaken by the United States in the public interest.
7. The permittee will maintain the authorized work in good condition and in conformance with the terms and
conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without
having the permit transferred to a third-party.
8. This permit authorizes a maximum of(10)boat slips. At no time shall more than(10)vessels be moored or docked
at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not
limited to motorboats, sailing vessels and personal watercraft.
9. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at
or adjacent to the authorized work.
NOTE: Any proposal to add one or more additional boat slips to the authorized 10 slip facility will require
that the docking facility be classified as a marina, and will therefore require a review under the N.C.

community dock with ten (10) boat slips and elevated wooden boardwalk to be located on the
east bank of the Cape Fear River, adjacent to the south side of Nun Street, in downtown
Wilmington, in New Hanover County,North Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of the CAMA-Corps Programmatic Permit process for construction activities that
receive authorization from the State of North Carolina. Therefore, you may commence
construction activity in strict accordance with applicable State authorization and the approved
plan. Failure to comply with the State authorization or conditions of the Federal permit could
result in civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or

Dear Mr. Merritt :
I have been asked whether the developers of the
Governor' s Landing project on Nun Street have a vested
right under the City' s Land Development Code to complete
the construction of a ten-slip community docking facility
adjacent to the project on the Cape Fear River. The
Wilmington City Council issued a special use permit for
this project on December 8, 1998 . Section 18-88 of the
Wilmington City Code requires that the construction of the
use permit under a special use permit be commenced within
one year of the issuance of the permit . The City had
previously determined that construction had commenced on
this project in accordance with the requirements of the
ordinance.
The special use permit was conditioned on compliance
with the site plan submitted to the City Council which
included the construction of the boat slips and a riverwalk
to be dedicated to the City of Wilmington. By letter dated
December 12 , 2000, the City previously approved the
configuration of the boat slips.
Based on the above, the developer has a vested right
under the special use permit to complete the Governor' s
Landing project including the ten boat slips . All
construction must be in compliance with the terms of the

special use permit and the construction plans approved by
the City.

The Division of Coastal Management(DCM)received the CAMA Variance Request you filed on behalf of Mr.
Gene Merritt on October 18,2005. Your request involves Mr.Merritt's application for a CAMA major permit to
construct a 10-slip community docking facility on the Cape Fear River and an elevated wooden boardwalk along the
adjacent Wilmington waterfront in New Hanover County. The proposed project is located within a Primary Nursery
Area(PNA)as designated by the N.C.Marine Fisheries Commission.
By letter dated October 13,2005,DCM denied your application on the basis of its inconsistency with the 1999
Wihmington-New Hanover Land Use Plan(LUP)as required by N.C.G.S. § 113A-120(a)(8). At the time,DCM
staff indicated that the applicant could ask the local government to amend the land use plan to eliminate the
inconsistency or petition the CRC for a variance. We have since learned that the Commission cannot consider a
variance request in these circumstances.
We have been advised that N.C.G.S. § 113A-120.1 only authorizes the Coastal Resources Commission(CRC)to
vary its own rules,standards,or orders. The Commission does not have the authority to issue a variance from a
local land use plan provision,nor does it have the authority to issue a variance from the statutory requirement that
CAMA permit decisions must be consistent with the local land use plan. Since the local land use plan provision was
the only grounds for denial of the CAMA permit,the appropriate avenue of relief is from the local government. A
land use plan amendment continues to be one way to resolve the issue.Another option would be to show that the
applicant has legally cognizable vested rights to construct the marina under local zoning and planning standards.If
the applicant has vested rights under local ordinances,DCM could reconsider the permit denial because in that case
the current local land use plan provision restricting marinas in primary nursery areas may not apply to the project.

This letter is in response to your application for a Major Permit under the Coastal Area
Management Act (CAMA), in which authorization was requested to construct a 10-slip
community docking facility on the Cape Fear River and an elevated wooden boardwalk along the
adjacent Wilmington waterfront in New Hanover County. Processing of the application, which
was received as complete by the Division of Coastal Management's Wilmington Regional Office
on August 16, 2005, is now complete. Based on the state's review, the Division of Coastal
1�lana,ement has made the following findings:
1) The joint State and Federal review of the project was generally favorable.
2) The proposed project is located within a Primary Nursery Area (PNA) as designated
by the North Carolina Marine Fisheries Commission.
3) The 1999 Wilmington-New Hanover County Land Use Plan (page 90) defines
marinas as "commercial marinas, rental slips, community boating facilities, and
residential piers renting more than two slips.'' Furthermore, community boating
facilities are further defined as, "a private non-profit boating facility including a
dock, pier, and/or launching ramp on property which has water frontage, the use of
which is intended to serve 5 or more residential lots or units. The right to use such
facility must be conferred by an easement appurtenant to the residential lot it is
intended to serve. No commercial activities of any kind shall be allowed within the
confines of the facility." Therefore, with your request for a 10-slip community
docking facility, this project must be considered a marina for the purposes of review
under the 1999 Wilmington-New Hanover County Land Use Plan.
4) Under Section 4 Areas of Environneental Concern of the Wilmington-New Hanover
County Land Use Plan, Policy 4.8 (as amended April 2, 2001), bullet one, reads,
"Marinas shall not be allowed in Primary Nursery Areas (PNA), Outstanding
Resource Waters (ORW), or open Shellfishing Waters (SA)."

Given the preceding findings, it is necessary that your request for issuance of a CAMA
Major Permit under the Coastal Area Management Act be denied. This denial is made pursuant
to N.C.G.S. 113A-120(a)(8) which requires denial for projects inconsistent with the state
guidelines for Areas of Environmental Concern or local land use plans.
If you wish to appeal this denial, you are entitled to a hearing. The hearing will involve
appearing before an Administrative Law Judge who listens to evidence and arguments of both
parties and then makes a recommendation to the Coastal Resources Commission. Your request
for a hearing must be in the form of a written petition, complying with the requirements of
§150B of the General Statutes of North Carolina, and must be filed with the Office o
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714, within twenty
(20) days from the date of this letter. A copy of this petition should be filed with this office.

Dear Mr. Huggett:
Reference the application of Gene Merritt for a Department of the Army permit to
construct a community dock with ten(10)boat slips and elevated wooden boardwalk to be
located on the east bank of the Cape Fear River, adjacent to the south side of Nun Street, in
downtown Wilmington, in New Hanover County,North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE)prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required,upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.

3. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land-clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in
the construction or maintenance of this project,within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste,the
permittee shall immediately report it to the N.C. Division of Water Quality at(919) 733-5083,
Ext. 526 or(800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
6. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
7. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard,through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office
at(910) 772-2191.
8. No portion of the authorized docking facility may extend waterward of the U.S. Army
Corps of Engineers Harbor Line.
9. An as-built survey will be performed after the structure is completed and sent to the
Wilmington Regulatory Field Office for verification that the structure does not extend waterward
of the U.S. Army Corps of Engineers Harbor Line.
10. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work,he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
11. Approval of the structure was based on determinations that there would be no
obstruction to navigation. The structure may be damaged by wave wash from passing vessels.
Issuance of this permit should not be construed, as relieving the permittee of taking proper steps
to insure the structure and moored boats will not be damaged by wave wash.

12. The permittee shall advise the Corps in writing at least two weeks prior to beginning
the work authorized by this permit and again upon completion of the work authorized by this
permit.
13. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
14. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include,but is not limited to, the immediate installation of silt fencing or
similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally,the project must
remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973
(North Carolina General Statutes Chapter 113A Article 4).
15. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management(NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
16. The permittee,upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will,without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre-project condition.
17. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S.Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.
18. The Permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The Permittee is not relieved of this
requirement if he abandons the permitted activity without having it transferred to a third party.
19. The West Indian manatee (Trichechus manatus), which is listed as a federally
endangered species,has been reported in the waters in New Hanover County. In order to protect
the West Indian manatee all work should be done during the period from November 1 to May 31.
If work must be done during the period from June through October the enclosed guidelines,
entitled"Precautions for General Construction in Areas Which May Be Used by the West Indian
Manatee in North Carolina"must be followed.

The applicant proposes to construct a community dock with ten(10)boat slips and an
elevated wooden boardwalk.
Areas of Environmental Concern(AEC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SC and are not open to the harvesting of
shellfish. The area is a Primary Nursery Area(PNA).
I have reviewed this proposal for consistency with the 1999 Wilmington-New Hanover
County CAMA Land Use Plan and offer the following comments.
The general area of the project is classified as Resource Protection while the AECs
impacted by the work are classified as Conservation.
Under Section 4 Areas of Environmental Concern of the Wilmington-New Hanover
County Land Use Plan, Policy 4.8 (as amended April 2, 2001),bullet one, reads
"...Marinas shall not be allowed in Primary Nursery Areas (PNA),Outstanding
Resource Waters(ORW),or open Shellfishing Waters (SA)."
The 1999 Wilmington-New Hanover County Land Use Plan(page 90) defines marinas as
"commercial marinas,rental slips, community boating facilities, and residential piers
renting more than two slips."
Further, community boating facilities are defined as "a private non-profit boating facility
including a dock,pier, and/or launching ramp on property which has water frontage, the
use of which is intended to serve 5 or more residential lots or units. The right to use such
facility must be conferred by an easement appurtenant to the residential lot it is intended
to serve. No commercial activities of any kind shall be allowed within the confines of the
facility."
As noted above,the area of the proposed community boating facility is Primary Nersery
Area(PNA). Therefore, the proposed project is in conflict and not consistent with
Policy 4.8 of the 1999 Wilmington-New Hanover County CAMA Land Use Plan.
Therefore,I recommend this permit be denied.

We have reviewed the CAMA permit application concerning Gene Merritt of GMC Real Estate Inc.'s
proposed plans to construct a ten-slip community docking facility and a 200-foot elevated wooden boardwalk
at Governor's Landing adjacent to the Cape Fear River and Nun Street in Wilmington,NC.We recommend
that several conditions concerning cultural resources protection included in the original CAMA permit#98-
99 be included in the new permit.These are specifically conditions 25,26,and 28 on pages 4 and 5 of permit
#98-99. Conditions 24 and 27 have previously been fulfilled.
The above comments are made pursuant to Section 106 of the National Historic Preservation Act and the
Advisory Council on Historic Preservation's Regulations for Compliance with Section 106 codified at 36 CFR
Part 800.

I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the
application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on page
3 of this permit,the Project Data Sheet.The stormwater control has been designed to handle the runoff from
20,399 square feet of impervious area. This infiltration trench must be operated xvith a vegetated filter.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts
of the permit.
4. The tract will be limited to the amount of built-upon area indicated on page 3 of this permit, and per
approved plans.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in it's entirety, vegetated and operational for its
intended use prior to the construction of any built-upon surface except roads.
2. During construction,erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must
be followed in its entirety and maintenance must occur at the scheduled intervals including,but not limited
to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of trenches, bypass structure, drop inlets and piping.
g. Access to the bypass and infiltration structure must be available at all times.
h. The vegetated filter will be kept grassed with no erosion.The spreader mechanism will be kept free
of sediment and trash, and must distribute the runoff evenly over the width of the filter.
4. Records of maintenance activities must be kept and made available upon request to authorized personnel
of DWQ. The records will indicate the date,activity,name of person performing the work and what actions
were taken.
5. The facilities shall be constructed as shown on the approved plans.This permit shall become voidable unless
the facilities are constructed in accordance with the conditions of this permit, the approved plans and
specifications, and other supporting data.
6. Upon completion of construction,prior to issuance of a Certificate of Occupancy,and prior to operation of
this permitted facility,a certification must be received from an appropriate designer for the system installed
certifying that the permitted facility has been installed in accordance with this permit, the approved plans
and specifications, and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification.
7. Do not use the infiltration trench system as an Erosion Control device. During construction, other means
of controlling erosion must be used.If no other alternative is available,and the system is used as an Erosion
Control device, it must be restored to design condition prior to occupancy of the facility.
8. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
9. The Director may determine that other revisions to the project should require a modification to the permit.

10. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum
of ten years from the date of the completion of construction.
11. Prior to the sale of any portion of the property,an access/maintenance easement to the stormwater facilities
shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale
of any portion of the property.
12. The permittee is responsible for verifying that the proposed built-upon area does not exceed the allowable
built-upon area.
13. The runoff from all built-upon area on the project must be directed into the permitted stormwater control
system.
14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements ofthe permit.Within the time frame specified in the notice,the permittee shall submit a written
time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall
provide copies of revised plans and certification in writing to the Director that the changes have been made.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there
is a name change of the Permittee, a formal permit request must be submitted to the Division of Water
Quality accompanied by an application fee,documentation`from the parties involved,and other supporting
materials as may be appropriate. The approval of this request will be considered on its merits and may or
may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute
143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes,rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)
which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action, including those as may be required by this Division,
such as the construction of additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all
components of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a
permit modification, revocation and reissuance or termination does not stay any permit condition.

DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an Area of
Environmental Concern as designated under the CAMA was received on August 16, 2005.
According to said application, Gene Merritt-GMC Real Estate Inc., proposes to construct a
community dock with ten (10) boat slips and elevated wooden boardwalk, at the east bank of the
Cape Fear River, south of Nun Street, in downtown Wilmington, New Hanover County.
A copy of the entire application may be examined or copied at the office of Robb Mairs at
N.C. Environment and Natural Resources, Division of Coastal Management, 127 Cardinal Drive
Extension, Wilmington, North Carolina 28405, (910-796-7291) during normal business hours.
Comments mailed to Charles S. Jones, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to September 15, 2005, will be
considered in making the permit decision. Later comments will be accepted and considered up to
the time of permit decision. Project modification may occur based on review and comment by the
public and state and federal agencies. Notice of the permit decision in this matter will be provided
upon written request.

Dear Mr. Merritt:
The Division of Coastal Management hereby acknowledges receipt of your application for State approval for
development of your property located at Inlet Point Harbor Subdivision, in Wilmington,NC, in New Hanover County. It
was received complete on 8/16/05,and appears to be adequate for processing at this time. The projected deadline for
making a decision is 10/30/05. An additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the initial deadline stated above,you should
consider the review period extended. Under those circumstances,this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 8/16/05,you may request a meeting with the
Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will
be held within five working days from the receipt of your written request and shall include the property owner, developer,
and project designer/consultant.
NCGS 113A-119(b)requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a"Notice of Permit Filing"postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be:Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal review
agencies for their comments. If additional information is required based on this review,the agencies may contact you
directly.
