Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) This permit authorizes only the dock, pier, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non- water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. At a minimu reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) The pier and associated structures shall have a minimum setback distance of 15' between any parts of the structure and the adjacent property owners' areas of riparian access. 6) In order to ensure compliance with Condition No. 5 of this permit, an as-built survey of the authorized project must be carried out and a copy provided to the Division of Coastal Management within 60 days of project completion. 7) This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused form existing or future operations undertaken by the United States in the public interest. 8) The covered boatlift shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. 9) The authorized covered boatlift shall be single story, and shall not be designed to allow for second story use. 10) Any portion of the permitted access pier built over coastal wetlands must not exceed six feet in width and must be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 11) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and must be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 12) The roof of the covered platform shall not be designed for second story use. General NOTE: This permit does not authorize the excavation or filling of any wetland or open water areas, even temporarily. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. PROJECT DESCRIPTION (;AW 0GIVI The project is located at 336 Marker Fifty Five Drive in the Marker Fifty Five subdivision in the central portion of Holden Beach, adjacent to the AIWW in Brunswick County. The project site is a .36 acre lot that has water frontage on the AIWW. To get to the property, one should travel US 17 to Shallotte, then follow NC 130 towards Holden Beach. Continue to follow NC 130 as it turns right and cross over the Holden Beach Bridge. At the base of the bridge,turn right onto Ocean Boulevard West. Travel west to High Point Street, and turn right. Take another right turn onto Brunswick Avenue, and then a nearly immediate left onto Marker Fifty Five Drive. 340 Marker Fifty Five Drive is located on the left. The highground property has an average elevation of approximately 13 feet above mean sea level. The lot is developed,with a single family home and driveway. Most of the yard has been landscaped up to the coastal marsh. Newhan fine sands underlie the property. The site is classified Urban Transition by the Holden Beach Land Use Plan. Municipal water is provided and wastewater is handled by individual septic tanks. The highground area consists of lawn and landscape vegetation. Towards the AIWW,the high ground takes a moderate slope of about 15 feet down to coastal wetlands. High coastal marsh vegetation, including, Black Needle Rush(Juncus roemarianus), and Salt Meadow Grass S artina ap tens)is interspersed with Giant Cordgrass (sRartina cynosuroides)near the base of the slope and extending waterward, where Smooth Cordgrass( artina alterni ora)becomes prominent and extends waterward to the open water of the AIWW. Areas of Black Needle Rush(Juncus roemarianus)occur out near the waterway as well. The waters of the AIWW are Classified SA by the NC Division of Water Quality. The AIWW in this area is not designated as a Primary Nursery Area(PNA),by the NC Division of Marine Fisheries. This area of the AIWW is closed to the harvesting of shellfish. Proposed Project The applicant is proposing to construct a residential pier and dock with boat lift to provide access to the AIWW. The property has a shoreline length of approximately 85 linear feet along the waterway. The pier would be elevated above the wetlands at its landward end. From the top of the slope, the 6 foot wide pier would be 443 feet in length. It would extend approximately 100 feet from the edge of the marsh and terminate with a 13' x 14'covered fixed dock, a 8' x 16' floating dock, and a 4' x 4' landing area leading to a 12' x 27.5' covered boat lift. This would provide a total of two boat slips at this facility. The application shows existing water depths at the proposed docking location are in the range of—3 feet at mean sea level (MSL). The measured width of the waterbody is 541.5 feet. 10. ANTICIPATED IMPACTS The proposed docks, walkway, and boat lift would incorporate 640 square feet of Estuarine Waters and Public Trust Area. The proposed structures would be located 5 feet from the edge of the Corps of Engineers' AIWW channel setback. The pier would exceed 1/4 width of the waterbody. However,there are longer piers within 200 feet on either side of the property, and the proposed pier would not exceed 1/3 the width of the waterbody. The proposed project would not encroach into the 15 ft setback from the adjacent riparian corridors. A short term increase in turbidity can be expected during piling installation. The Wilmington Regional Office staff recommends that the permit be issued including all of the standard conditions for the proposed work. Any necessary Permits must be obtained from the Corps of Engineers. This office would have no objection to the issuance of a permit subject to the following conditions: l. This permit authorizes only the docks,piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures,whether floating or stationary, may become a permanent part of the pier without permit modification. No non- water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. The pier and associated structures shall have a minimum setback distance of 15'between any parts of the structure and the adjacent property owners' areas of riparian access. 6. The pier facility shall accommodate no more than 2 vessels. At no time shall more than 2 vessels be moored, docked or located at the facility. The restriction on the number of vessels shall apply to all marine vessel types, including, but not limited to motorboats, sailing vessels and personal watercraft. 7. In general, Holden Beach allows development in Conservation classified AECs which is consistent with the State's minimum use standards. The Town of Holden Beach Land Use Plan contains some policies which exceed the State's minimum use standards. However, none of these policies appear to be applicable to this project. Staff review of the plans and specifications has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. By copy of this letter, we are informing you that your project will not require a stormwater management permit. If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. The North Carolina Wildlife Resources Commission has reviewed the project for impacts to wildlife and fishery resources. A site visit was made on December 15, 2004. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act(48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the Coastal Area Management Act (G.S. 113A-100 through 113A-128). Construction of a private 443 ft. pier and dock with covered boat lift is proposed on a 0.36 acre lot along the AIWW. Though no longer than adjacent piers,the structure would cross a wide margin of high quality coastal wetlands providing habitat for raccoon, opossum, wading birds, waterfowl,juvenile fishes, and estuarine invertebrates. Area waters are classified SA. We anticipate primary adverse impacts from the project to be damage to wetland vegetation during construction and shading of wetland vegetation after construction. To minimize these impacts, we recommend the following permit conditions. 1. Construction will avoid the April I to September 30 period of peak biological activity. 2. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above,you should consider the review period extended. If this agency does not render a permit decision within 70 days from 10/28/04,you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project.
