This permit, issued on October 19,2005 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below.Any violation of these terms shall
be subject to fines, imprisonment or civil action; or shall cause the permit to be null and void.
Upland Development
1) Unless specifically altered herein, this permit authorizes only the grading and other land disturbing
activities associated with the redevelopment of the property owned by the applicant located on
Harbor Rd (SR 1140) adjacent to Wanchese Harbor, Mill Landing Creek basin, including the grading
necessary for the construction of the approved boat ramp, removal of the existing concrete slab, the
steel sheet pile wall, and the removal of the existing riprap, all as expressly and specifically set forth
in the attached permit application forms and drawings. Any additional land disturbing activities
and/or construction shall require a modification of this permit. Contact a Division of Coastal
Management representative at(252) 264-3901 for this determination.

Excavation
2 ROsOnot exceed -12 feet below the normal water level in front of lots 29 and 29A and
excavation shall not exceed -7 feet below the normal water level in front of lots 28A and 24. In no case
shall the depth of excavation exceed the depth of connecting waters.
3) No excavation shall take place outside the areas indicated on the attached workplan drawings.
Spoil Disposal
4) All excavated materials shall be confined to the area designated on the attached workplan drawing 2 of
15, dated 6/28/05. Any proposal to relocate the location of the spoil disposal site shall require permit
modification.
5) All excavated materials shall be confined above mean high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
Shoreline Stabilization
6) The proposed alignment of the permitted bulkhead and riprap shall be staked by the applicant and
approved by a representative of the Division of Coastal Management within a maximum of 30 days prior
to the start of any construction.
7) The alignment of the approved bulkhead shall be in accordance with the attached workplan drawings.
8) The bulkhead shall be constructed prior to any backfilling activities.
9) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
10) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation or other land disturbing activities,
other than those approved under this permit, are permitted except for that which shall be required for the
construction of the bulkhead wall, riprap, deadmen cables, etc.

11) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to
prevent its movement from the approved alignment by wave or current action.
12) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite,
marl, or broken concrete.
13) The backfill material shall be clean and free of any pollutants except in trace quantities.

14) No backfill material is to be placed within 30 feet of the normal water line, except that which shall be
used to backfill the area behind the permitted bulkhead.
Boat Ramp
15) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or
poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact
waters of the State or waters that will enter waters of the State.'
Docking Facilities
16) This permit authorizes the removal of the docks, piers, and other structures:and uses located in or over
the water that are expressly and specifically set forth in the permit application and attached workplan
drawings. This permit authorizes the reinstallation of the docking facility located in front of lots 29 and
30 to its original dimensions and configuration (86.5 ft. x 10 ft. with two finger piers, 12 ft. x 3 ft.), and
the instillation of the two bollards, all as expressly and specifically set forth in the permit application and
attached workplan drawings. No other structure, whether floating or stationary, shall become a
permanent part of this docking facility without permit modification. No non-water dependent uses of
structures shall be conducted on, in or over public trust waters without permit modification.
Sedimentation and Erosion Control
17) .Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
18) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
Concrete Wharf/Apron
19) This permit authorizes the 15 ft. x 70 ft. long concrete apron with a 15 ft. "dog leg" located on lot 24,
and the 20 ft. x 25 ft. concrete apron located on lot 28A, all as expressly and specifically set forth in the
permit application and attached workplan drawings. The permittee shall take every precaution to ensure
that live concrete shall not contact waters of the State or waters that will enter waters of the State.
General
20) This permit authorizes the removal of the four 2-inch pvc outfall pipes and their replacement with the 6- {
inch outfall pipe, all as expressly and specifically set forth in the permit application and attached
workplan drawings.

21) The. permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such .
removal or alteration.
22) No vegetated wetlands shall be excavated or filled without permit modification.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that shall be required, including but not limited to a modified
Stormwater permit from the Division of Water Quality.
NOTE: Future development of the permittee s property shall require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal water level.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. Please sign both the original (buff-
colored form) and the Xerox stamped "Copy". Return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below. Please retain the original
(buff-colored form),as it must be available on site when the project is inspected for compliance.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty(20)days, the matter must be resolved prior to work initiation.
The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands
all permit requirements.
From time to time,Department personnel will visit the project site.To facilitate this review,we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel

of the Seafood Industrial Park, to construct a concrete wharf and to dredge areas of the basin.

PROJECT SETTING
The NC Seafood Industrial Park is located on 54 acres adjacent to a man-made basin adjoining Mill
(Landing) Creek off Roanoke Sound and at the end of Harbor Road (SR 1140) in Wanchese, Dare
County. The Park is proposing further development of lots 24, 28A, 29A, 29 and 30, which have a
combined area of 3.6 acres. The lots have a combined shoreline length of approximately 460 feet that
is stabilized by concrete bulkheading and riprap. Existing development on the property includes five
metal buildings, concrete parking areas, two docks, two piers, and three sport fishing boat rigging
slips. Most of the remaining undeveloped area of the property is covered with marl with very little
vegetation existing at the site. The property elevation is approximately eight feet above normal water
level (NWL). One of the lots was once used as the NCDOT ferry repair facility, which included a
marine railway and a transfer table. The old infrastructure for the repair facility has been removed
except for the paved areas. Currently the tenants include a sport fishing boat construction business, a
marine engine distributor, the NC Division of Marine Fisheries, a commercial seafood business and a
marina. Adjacent riparian properties consist of a boat basin and a marsh.
The waters of Mill Creek are classified as SC by the Division of Environmental Management and are
closed to shellfish taking. The water depths in the basin in this area range from less than one foot in
the north corner of the basin to -26 feet.
DEVELOPMENT PROPOSAL
In order to provide a straight shoreline for lots 29A, 29 and 30, the applicant proposes to construct 250
feet of steel sheet pile bulkheading. The proposed bulkhead alignment will be a maximum of 3f=t
waterward of the existing shoreline bulkhead and will average approximately 7 feet waterward of NWL
along 110 feet of the alignment. The remainder of the proposed bulkhead alignment will be along the
shoreline that has existing riprap. The riprap will be removed and the bulkhead installed. In this
section, the applicant proposes to construct a 30-foot wide concrete boat ramp. The boat ramp will be
80 feet long with approximately 30 feet below NWL. The applicant proposes to install riprap stone
along the waterward toe and west side of the proposed boat ramp for stability, as well as 50-foot long
steel sheet pile sidewalls. Along this section shoreline, the applicant proposes to construct a 15-foot
wide concrete shoreline apron or wharf to be located on land, adjacent to the shoreline of the proposed
bulkhead.
An existing dock will be removed during construction of the bulkhead and replaced when the bulkhead
is completed.
The applicant proposes to dredge the basin bottom near shore of lots 29 and 29A to a depth of-12 feet
below NWL. The proposed dredge area is approximately 140 feet by 15 feet with a 20-foot by 20-foot
extended area into the basin. The existing water depths in this area range from -12 feet to -1 foot.
The bottom in this area is soft muck.

In order to provide a straight shoreline along lot 24 and a portion of lot 28A, the applicant proposes to
remove existing shoreline riprap and construct approximately 90 feet of steel sheet pile bulkhead.
Approximately 70 feet of bulkhead will be along the shoreline of lot 24 and will have a maximum
distance of 5 feet waterward of NWL and will average approximately 3 feet waterward of NWL.
Approximately 20 feet of bulkhead will be constructed along the shoreline of lot 28A that will have a
maximum distance of 18 feet waterward of NWL and will have an average of 12 feet waterward of
NWL. The proposed bulkhead alignment will stabilize a corner area of the Seafood Park basin. The
applicant proposes to construct a 25-foot long return wall at lot 28A, a 25-foot long retaining wall at
the corner of the basin and a 15-foot long return wall on lot 24.
The applicant proposes to construct a 15-foot wide concrete apron or wharf on lot 24, approximately
70 feet along the shoreline with a 15-foot long dog leg at the corner. The applicant proposes to
construct a 20-foot by 25-foot concrete apron or wharf on lot 28A. The applicant proposes to install a
new six-inch stormwater outfall pipe to replace four existing two-inch pipes and a scour ditch that
currently directs stormwater runoff into the basin.
The applicant proposes to dredge the basin bottom near shore in the corner at lots 28A and 24 to a
depth of -7 feet below NWL. The proposed dredge area is approximately 65 feet by 45 feet with
existing water depths that range from -7 feet to -3 feet below NWL. The bottom is soft muck.
Spoil material will be deposited behind the proposed bulkhead to facilitate settling. The applicant
proposes to install temporary sheeting to contain the spoil material. The material will be deposited
approximately six feet above ground elevation and remain in place for a minimum of 60 days. Once
bulkhead backfill settling has abated, the spoil material will be removed to lot 2 at the park. The
applicant indicates that approximately 450 cubic yards of bottom material will be excavated for the
project.
An existing 17-foot by 140-foot commercial grade dock will be rehabilitated during this project. No
new docks are proposed. The existing dock for lot 30 that will be relocated was authorized by CAMA
permit #29-03.
ANTICIPATED IMPACTS
The development proposal will result in the following impacts:
1. The proposed bulkhead will result in 1,120 square feet of Public Trust Area (PTA) and
Estuarine Waters (EW) Areas of Environmental Concern (AECs) being filled with
approximately 415 cubic yards of backfill material placed below NWL.
2. The proposed boat ramp will result in approximately 900 square feet of PTA and EW being
filled and 1,500 square feet of Estuarine Shoreline (ES) AEC being paved. The rock to
stabilize the ramp will result in 340 square feet of PTA and EW being filled with approximately
71 cubic yards of material.

3. The removal of approximately 230 feet of existing riprap to facilitate the construction of the
proposed bulkhead will result in the loss of 1,075 square feet of ES AEC, changing to PTA and
EW AECs.
4. The deposition of spoil material behind the bulkhead to mitigate for future settling will result in
the filling of 5,770 square feet of ES AEC.
5. The construction of the concrete wharf will result in the filling of 5,330 square feet of ES AEC
with impervious surface.
6. The proposed dredging will result in the disturbance of approximately 5,750 square feet of PTA
and EW AECs. Approximately 450 cubic yards of bottom material will be removed.
7. Temporary water turbidity will occur during construction.

Statement of Compliance
With the N.C. Environmental Policy Act (N.C.G.S. 113A-1 to 10)
The NC Seafood Industrial Park Authority's Shoreline Improvements Project does involve the
expenditure of public funds and will require multiple agency approvals to construct. However,
as discussed in the attached document (CAMA Major Development Application with required
documentation attached for the Wanchese Seafood Industrial Park Shoreline Improvements
Project), the NC Seafood Industrial Park Authority does not believe that the project will result in
significant adverse environmental impacts.

Wanchese Scorood Industrial Park Shoreline improvements
The l:urpose ofthe proposed shorelinc improvements is to provide docking and water
access for commercial tenants and stale agencies located in the North Carolina Wanchese
Seafood industrial Park. This work includes installation of a new bulkhead, removal and
rein Ullotion of a timber clock, construclion of a new timber dock, retrofitting of an
existi rig structure, removal and reinstc:tllation of pan outtall, and dredging. 1'hc major
construction of the shoreline improvements consists of a new steel sheet pile bulkhead
willr.a 15-foot wide slab-on-grade apron behind (sec Section I3-13). This new bulkhead
�tnd slab-on-grade apron is to be installed along approximately 350 feet of shoreline. 'hhe
new bulkhead will provido stability along the shorel:: i'aciiilating both industrial
loading,up to 750 psf, along the waters edge and basin dredging for up to 14 feet of
water depth, which is consistent with the existing facilities located in the Seafood
Industrial Park.
The construction of the new bulkhead along Lots 30 and 29 will require the removal and
dispo&al of the exisling rip rap shoreline protection and two lengths of existing steel ,heel
pile bulkhead totaling 40 feet. "There is also a 76-loot long existing concrete sheet pile
bulkhead that will be left in place and cutoff 4 feet from the top. Minor excavation will
be required for the removal of the existing steel sheet pile bulkhead and partial
dornolition of the concrete sheet pile bulkhead. This material typically consists of
previously placed sand fill. 'There is an existing timber dock 86,5 feet long by 10 feet
wide with 2 finger piers 12 feet long by 3 feet wide along the existing conc7ete sheet pile
bulkhead that is to he removed, stored, and reinstalled in front of the new steel sheet pile
bulkhead, sec Section A-A. The new bulkhead will be installed approximately 6.0 feet
waterward of the existing concrete bulkhead. The area of state waters to be filled in front
oi'the existing bulkhead is approximately 710 sq ft with an associated volume of 400 eu
yds and is to be filled with clean, dry fill material_
The rroposed bulkhead continues along Lot 29 to the edge of Lot 29A where the
proposed project entails the installation of a new vessel landing for the N.C. Marine
Fisheries resource Enhancement Program. This vessel landing is to provide a 30-foot
wide landing extending 52-feet landward of the proposed bulkhead al a 15% slope and is
for 1h,- operation of a landing craft type vessel (see Section C-C). Adjacent to the vessel
landing and also located on Lot 29A is a proposed 18 11 by 28 ft timber clock that has
been previously permitter) under LAMA permit 147-00, see Section D-D. The
installation of the proposed bulkhead and landing along Tots 29 &29A results in the
removal of material above NWL creating new state waters. The new state waters created
by thr construction of this project is 1,075 sq 11. This excavation along with the
excawation for the vessel landing is a total of 575 cu yds of highground excavation,
Thero is also proposes{dredging in front of the new bulkhead facility to achieve water
depth adjacent to the new bulkhead and for the construction of the vessel landing. This
proposed dredging in stale waters is 2,910 sq fl with an associated volume of 250 cu yds.
Along;Lot 28A,thcro is an existing Limber dock with concrete deck that is structurally
inadequate for its current use. As such, this project includes the retrofitting of the timber
�
bent caps with galvanized steel plates on either side and bolted through to provide the
structural capacity required, see Sections E-E and J-J. At the northeast end of the
existing dock on Lot 28A, the new bulkhead with slab-on-grade apron continues,
extending the existing dock facility another 17.5 feet (see Section F-F) and then turns 90
degrees and extends for another 70 feet to tie into the back edge of the existing concrete
platform(see Section H-H). The construction of this segment of bulkhead is associated
with the fill of approximately 410 sq ft of state waters with a volume of 15 cu yds. The
proposed project also includes dredging in order to provide water depth in front of the
new bulkhead. The dredging in this area consists of 2,780 sq ft and a volume of 200 cu
yds.
The soil stratum of the site includes a layer of highly compressible peat that will result in
large settlements of the area over time. As such, the proposed project includes the use of
the dredged and excavated material to surcharge the construction area thereby mitigating
the concern of future settlements. The areas of proposed surcharging are depicted on
Sheet 14 of 15 of the plats incorporated with this application package. In order to
surcharge the area temporary sheeting will be installed that will contain the surcharge
material. The containment system will be lined with a geotextile filter fabric, see Section
K-K for a section of the proposed temporary containment system. This temporary
containment and proposed surcharging would be for a minimum period of 60 days. The
material would then be transported to Lot 2 on the property where a silt fence and
vegetative covering would be used to contain the material and prevent erosion.
Along the northeast side of the building on Lot 28A, there are existing drainage problems
that are to be addressed in this project. There is an existing scour drainage ditch
alongside the building that is undermining the building slab. There are four 2-inch
diameter outfall pipes in this scour ditch that discharge on the riprap slope. The proposed
project consists of regrading this area to drain to an existing storm water manhole that
will be recast with a grated opening and then sod the area. A new closed concrete
collection box will be installed for the four drain lines, that will feed into a new 6-inch
diameter outfall pipe that will sleeve through the new bulkhead. See Section G-G for the
existing scour ditch and outfall pipes and the new proposed regarding and outfall pipe.
There are budgetary concerns associated with this project. As such, it is the intent to
provide a set of construction documents that include a base bid project for construction
purposes along with a series of additive bid items that will be included as funding allows.
Two of these additive bid items are presented in this permit application; the first being
the vessel landing for the N.C. Marine Fisheries Research Enhancement Program and the
second being the previously permitted 18 ft by 28 ft timber dock. If there are insufficient
funds for the construction of the vessel landing, the bulkhead and 15 ft wide slab on
grade apron will continue uninterrupted to the end of the timber dock with concrete slab
on Lot 28A. It is also anticipated that the dredging to a 12 ft water depth would extend to
within 35 ft of the end of the bulkhead. This would result in an increase in the dredge
area of 1780 sq. ft. and an increase in dredge volume of 225 cu. yds.

In accordance with your application to be covered under the State Stormwater General
Permit for Bulkheads and Boat Ramps, received on August 31 2005, we are forwarding
herewith the subject Certificate of Coverage Number SW7050$32 to construct, operate
and maintain impervious areas associated with bulkheads and boat ramps, under the
subject General Permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and Title 15A NCAC 2H .1000, the stormwater
management rules.
Please take notice that this Certificate of Coverage is not transferable except after
notice to the Division of Water Quality.(DWQ). The DWQ may require modification or
revocation and reissuance of the Certificate of Coverage.
This permit does not affect the legal requirement to obtain other permits which may be
required by the Division of Water Quality the Division of Land Resources, Coastal Area
Management Act, or any other Federal, State, or Local agency, law, rule, or ordinance.

In compliance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws,Rules and Regulations promulgated and
adopted by the North Carolina Environmental Management Commission.
All owners or developers of projects where either a CAMA Major Permit or a Sedimentation
Erosion Control Plan approval is required, and a bulkhead or a boat ramp is proposed, are hereby
authorized to construct, operate and maintain impervious areas in compliance with the General
Permit conditions and the provisions of 15A NCAC 211 .1000 (hereafter referred to as the
"stormwater rules'), the approved stormwater management plans and specifications, and other
supporting data as attached and on file with and approved by the Division of Water Quality and
considered a part of this general permit.
The General Permit shall become effective on September 1, 2003.

PERMITTED ACTIVITIES
Until this permit is modified or rescinded,permittees are authorized to construct, operate and
maintain impervious surfaces associated with a bulkhead or boat ramp,which has met the
following standards. All stormwater runoff from these projects shall be in accordance with the
attached schedules as follows.
Section A—Final Limitation and Controls
Section B—Schedule of Compliance
Section C—General Conditions
STANDARD CONDITION FOR GENERAL PERMITS
This General Permit does not relieve the permittee from responsibility for compliance with any
other applicable federal, state, or local law,rule, standard, ordinance, order,judgement, or
decree.
GENERAL PERMIT COVERAGE
All persons desiring to be covered by this General Permit must register with the DWQ or
appropriate delegated agency by the filing of a Notice of Intent(NOI) and applicable fees. The
NOI shall be submitted and a certificate of coverage issued prior to the construction of any
impervious surfaces associated with the construction of a boat ramp or bulkhead.
Any owner or developer not wishing to be covered or limited by this General Permit may make
application for an individual Stormwater Management Permit in accordance with NCAC
2H.1000, stating the reasons supporting the request. Any application for an individual permit
should be made at least 90 days prior to the time the permit is needed.
This General Permit does not cover activities covered by an individual permit. Any person
conducting an activity covered by an individual permit but which could be covered by this
General Permit may request that the individual permit be rescinded and coverage under this
General Permit be provided.
The definition of any word or phrase in this General Permit shall be the same as given in Article
21, Chapter 143 of the General Statutes of North Carolina, as amended. Other words and phrases
used in the General Permit are defined in 15A NCAC 2H.1002.

SECTION A: FINAL LIMITATIONS AND CONTROLS
During the period beginning on the effective date of the general permit,the Permittee is
authorized to construct,operate and maintain impervious surfaces associated with the
construction of bulkheads and boat ramps. Stormwater runoff from the permitted impervious
surfaces shall be in accordance with the following conditions:
1. A minimum 30' wide vegetated buffer is required to be maintained between all
impervious surfaces and the normal high water line.
2. The runoff from boat ramps and other impervious surfaces outside the 30' buffer area
must be directed away from surface waters to the extent practicable.
3. Bulkheads and that portion of a boat ramp within 30' of the mean high water line are
considered water dependent structures, and are allowed to discharge stormwater runoff
from those areas directly into the receiving waters.
4. No impervious surfaces other than a bulkhead,boat ramp and an access road may be
constructed. If any other impervious surface, such as a parking area, is proposed,
coverage under the General Permit is not applicable, and an individual Stormwater
Management Permit or other General Permit is required.
5. The approved Site&Grading Plan and Erosion Control Plan (if required) will be
followed.
6. The approved Site &Grading plan shall contain the following items:
a. A clear vicinity map showing the direction and distance to the nearest town or
city, street name, street number and the nearest intersection of two major roads.
b. The receiving waters.
C. The site drawn to scale showing all proposed built-upon surfaces.
d. All existing and proposed contours and spot elevations.
e. A legend of all symbols used on the site plan.
f. A delineation of the property lines with bearings and distances.
g. A delineation of jurisdictional 401/404 wetlands and coastal wetlands, or a note
on the plans stating that none exist.
h. A delineation of the 575' AEC area as applicable.
i. A delineation of the 30' buffer area.
j. A calculation of the proposed amount of built-upon area.
7. No new stormwater piping shall be allowed except that minimum amount necessary to
direct runoff beneath an impervious surface such as a road and that minimum amount
needed under driveways to provide access. Long runs of pipe, or pipe that discharges
directly to surface waters, are prohibited.
8. The amount of built-upon area must be minimized as much as possible.

SECTION B: SCHEDULE OF COMPLIANCE
1. The permittee shall at all times provide adequate stabilization measures in conformance
with the approved Site & Grading Plan and Erosion Control Plan.
2. The permittee shall submit all information requested by the Director or his representative
within the time frame specified in the written information request.
3. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, including,but not limited to,
the following items:
a. Any revision to the approved plans,regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign of, addition to or deletion of the approved amount of built-upon area,
regardless of size.
e. Further subdivision of the project area.
f. Alteration of the proposed drainage.
4. The Director may determine that revisions to the project will require a modification to
permit coverage.
5. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the General Permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modif}ring the site to meet minimum requirements. The permittee shall provide copies of
revised plans and certification in writing to the Director that the changes have been made.

SECTION C: GENERAL CONDITIONS
1. Failure to abide by the conditions and limitations contained in the General Permit is
considered a violation of NCAC 2H.1000, and is grounds for enforcement action in
accordance with North Carolina General Statutes 143-215.6A to 143-215.6C, or for
certificate of coverage termination, revocation and reissuance, or modification in
accordance with NCGS 143-215.1.
2. The certificate of coverage is not transferable except after notice to and approval by the
Director. In the event of an ownership change, the Director may require a separate NOI
and certificate of coverage. The approval of this request will be considered on its merits,
and may or may not be approved. The permittee is responsible for compliance with all
permit conditions until such time as the Director approves the transfer.
3. The issuance of this general permit does not prohibit the Director from reopening and
modifying the general permit,revoking and reissuing the general permit,or terminating
the general permit as allowed by the laws, rules, and regulations contained in NCGS 143-
215.1 and 15A NCAC 2H.1000.
4. The certificate of coverage is issued in accordance with this general permit and may be
modified, revoked and reissued, or terminated for cause. The notification of planned
modifications or non-compliance does not stay any general permit condition.
5. Upon the presentation of proper credentials, and during nonnal business hours,the
pennittee shall allow the Director, an authorized representative of the Director, or DENR
staff,to enter the property, inspect the project for compliance with the permit, and sample
or monitor for water quality.
6. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.
7. Any person who knowingly makes any false statement, representation, or certification
regarding the project shall be subject to civil or criminal penalties.
8. The General Pen-nit,Notice of Intent, Certificate of Coverage, approved plans and
supporting documentation are considered public record and are open for inspection.

MEMORANDUM

SUBJECT: NC Seafood Industrial Park, Major Permit Application Recommendations
The applicant proposes to construct a bulkhead waterward of an existing riprap and
bulkhead structure along the shoreline of the Wanchese Seafood Industrial Park harbor,
to construct a concrete wharf with a boat ramp and to dredge areas of the harbor basin.
The development site is located at the end of Harbor Road (SR 1140), Wanchese, Dare
County and on the man-made harbor basin off Mill Landing Creek off Roanoke Sound.
While the shoreline is not experiencing erosion because of the existing riprap and sheet
pile bulkheading, this protected shoreline was developed by the Park from uplands.
The rest of the park's shoreline has a heavy-duty sheet pile bulkhead with a straight
alignment and on the shore side of the bulkhead, there is a paved wharf with mooring
bollards and cleats. The purpose of the development proposal is to finish construction
of the wharf and bulkhead along the shoreline consistent with other shoreline within the
park.
According to 07H.0208, the proposed wharf, boat ramp and bulkhead are water
dependent. The proposed boat ramp is larger and more heavy duty than those we
generally see. Its purpose is to facilitate the loading of oyster reef material on a NC
DMF vessel.
The proposed dredging is consistent with 07H.0208; however, the proposed spoil
deposition along the shoreline is not water dependent and is inconsistent with
07H.0209. Spoil material must be deposited 30 feet from NWL to be consistent with the
Coastal Shoreline rules. The applicant is proposing to use the spoil material as a
means to compact back fill material behind the proposed bulkhead and to provide a firm
base for the concrete wharf. This particular use of the spoil material appears water
dependent as part of the construction of the bulkhead and wharf and should be
authorized.

It is recommended that the development proposal be authorized as proposed with the
following conditions:
1 . Excavation will not exceed 12 feet below the mean low water level. In no case
shall the depth of excavation exceed the depth of connecting waters.
2. No vegetated wetlands/marsh grass will be excavated or filled.
3. The temporary placement or double handling of excavated or fill materials within
waters or vegetated wetlands is not authorized.
4. All excavated materials will be confined above mean high water and landward of
regularly or irregularly flooded marsh behind adequate dikes or other retaining
structures to prevent spillover of solids into any marsh or surrounding waters.
5. The diked disposal area will be constructed a sufficient distance from the mean
high water level or any marsh to eliminate the possibility of dike erosion into
surrounding wetlands or waters.
6. The disposal area will be properly graded and provided a ground cover sufficient
to restrain erosion within 30 working days of project completion.
7. The bulkhead will not extend waterward more than 10 feet from the normal water
level at any point along its alignment at the time of construction.
8. The alignment of the authorized bulkhead must be staked by a representative of
the Division of Coastal Management within a maximum of 30 days prior to the
start of construction. Failure to initiate construction within 30 days, or erosion of
the shoreline by adverse weather conditions, will require the alignment to be
restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.
9. The bulkhead must be constructed prior to any backfilling activities.
10. The bulkhead must be structurally tight so as to prevent seepage of backfill
materials through the structure.
11. The bulkhead must be solid and constructed of treated wood, concrete slabs,
metal sheet piles or other suitable materials approved by department personnel.
No excavation is permitted except for that which may be required for the
construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does
not authorize any excavation waterward of the approved alignment.

12. The fill material will be clean and free of any pollutants except in trace quantities.
Metal products, organic materials, or unsightly debris will not be used.
13. All fill material to be placed below normal water level will be confined behind the
permitted bulkhead.
14. This permit authorizes only the docks, piers, and other structures and uses
located in or over the water that are expressly and specifically set forth in the
permit application. No other structure, whether floating or stationary, may
become a permanent part of this marina/docking facility without permit
modification. No non-water dependent uses of structures may be conducted on,
in or over public trust waters without permit modification.
15. The pier/boathouse and associated structures shall have a minimum setback
distance of 15 feet between any parts of the structure and the adjacent property
owner's riparian access corridor, which is determined by drawing a line parallel to
the channel, then drawing a line perpendicular to the channel line that intersects
with the shore at the point where the upland property line meets the water's
edge.
16. No attempt will be made by the permittee to prevent the full and free use by the
public of all navigable waters at or adjacent to the authorized work.
17. The authorized structure and associated activity must not cause an unacceptable
interference with navigation.
18. The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee is not
relieved of this requirement if he abandons the permitted activity without having it
transferred to a third party.
19. This permit does not authorize the interference with any existing or proposed

Certification Number 3400 covers these water impacts. This Certification allows you to General Permit
No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get
or otherwise comply with any other federal, state and local requirements before you go ahead with your
project including(but not limited to) erosion and sediment control regulations and CAMA. Also,this
approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in
your application shall expire upon expiration of the 404 or CAMA Permit.

SUBJECT: NC Seafood Industrial Park, Major Permit Application Recommendations
The applicant proposes to construct a bulkhead waterward of an existing riprap and
bulkhead structure along the shoreline of the Wanchese Seafood Industrial Park harbor,
to construct a concrete wharf with a boat ramp and to dredge areas of the harbor basin.
The development site is located at the end of Harbor Road (SR 1140), Wanchese, Dare
County and on the man-made harbor basin off Mill landing Creek off Roanoke Sound.
While the shoreline is not experiencing erosion because of the existing riprap and sheet
pile bulkheading, this shoreline was not developed during the initial construction phase
of the park. The rest of the park's shoreline has a heavy-duty sheet pile bulkhead with a
straight alignment and on the shore side of the bulkhead, there is a paved wharf with
mooring bollards and cleats. The purpose of the development proposal is to finish
construction of the wharf and bulkhead along the shoreline on all remaining open lots,
According to 071-1.0208, the proposed wharf, boat ramp and bulkhead are water
dependent. The proposed boat ramp is larger and more heavy duty than those we
generally see. its purpose is to facilitate the loading of oyster reef material on a NC
DMF vessel.
The proposed dredging Is consistent with 07H.0208; however, the proposed spoil
deposition along the shoreline is not water dependent and is inconsistent with
071-1.0209. Spoil material must be deposited 30 feet from NWL to be consistent with the
Coastal Shoreline rules. The applicant is proposing to use the spoil material as a
means to compact back fill material behind the piuposed bulkhead and to provide a firm
base for the concrete wharf. This particular use of the spoil material appears water
dependent as part of the construction of the bulkhead and wharf and should be
authorized.

It is recommended that the development proposal be authorized as proposed with the
following conditions
1. Excavation will not exceed 12 feet below the mean low water level. In no case
shall the depth of excavation exceed the depth of connecting waters.
2. No vegetated wetlands/marsh grass will be excavated or filled.
3. The temporary placement or double handling of excavated or fill materials within
waters or vegetated wetlands is not authorized,
4. All excavated materials will be confined above mean high water and landward of
regularly or irregularly flooded marsh behind adequate dikes or other retaining
structures to prevent spillover of solids into any marsh or surrounding waters.
5. The diked disposal area will be constructed a sufficient distance from the mean
high water level or any marsh to eliminate the possibility of dike erosion into
surrounding wetlands or waters.
6. The disposal area will be properly graded and provided a ground cover sufficient
to restrain erosion within 30 working days of project completion.
7. The bulkhead will not extend waterward more than 10 feet from the normal water
level at any point along its alignment at the time of construction.
8. The alignment of the authorized bulkhead ri,ust be staked by a representative of
the Division of Coastal Management within a maximum of 30 days prior to the
start of construction. Failure to initiate construction within 30 days, or erosion of
the shoreline by adverse weather conditions, will require the alignment to be
restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.
9. The bulkhead must be constructed prior to any backfilling activities.
10. The bulkhead must be structurally tight so as to prevent seepage of backfill
materials through the structure.
11. The bulkhead must be solid and constructed of treated wood, concrete slabs,
metal sheet piles or other suitable materials approved by department personnel.
No excavation is permitted except for that which may be required for the
construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does
not authorize any excavation waterward of the approved alignment,

12. The fill material will be clean and free of any pollutants except in trace quantities.
Metal products, organic materials, or unsightly debris will not be used.
13. All fill material to be placed below normal water level will be confined behind the
permitted bulkhead.
14. This permit authorizes only the docks, piers, and other structures and uses
located in or over the water that are expressly and specifically set forth in the
permit application. No other structure, whether floating or stationary, may
become a permanent part of this marina/docking facility without permit
modification. No non-water dependent uses of structures may be conducted on,
in or over public trust waters without permit modification.
15. The pier/boathouse and associated structures shall have a minimum setback
distance of 15 feet between any parts of the structure and the adjacent property
owner's riparian access corridor, which is determined by drawing a line parallel to
the channel, then drawing a line perpendicular to the channel line that intersects
with the shore at the point where the upland property line meets the water's
edge.
16. No attempt will be made by the permittee to prevent the full and free use by the
public of all navigable waters at or adjacent to the authorized work.
17, The authorized structure and associated activity must not cause an unacceptable
interference with navigation.
18. The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee is not
relieved of this requirement if he abandons ine permitted activity without having it
transferred to a third party.
19. This permit does not authorize the interference with any existing or proposed
Federal project, and the permittee will not be entitled to compensation for

Consistency Determination: The request is consistent with/not in conflict with the Dare
County 2003 Land Use Plan certified by the CRC on July 24,
2003.
Overview: The NC Seafood Industrial Park is located on 54 acres adjacent to the Wanchese
Harbor Basin, a manmade basin that adjoins Mill Landing Creek off the Roanoke Sound at the
end of Harbor Road (SR 1140). Existing development on the Lots 24, 28A, 29, 29A, and 30
includes five (5) metal buildings and concrete parking areas, with remaining undeveloped areas
covered in marl with very little vegetation. The lots have a combined shoreline of approximately
460 linear feet. Existing shoreline improvements including two (2) docks, two (2) piers, and
three (3) sport fishing boat rigging slips. Most of the remaining undeveloped area is covered
with marl and very little vegetation. Currently the tenants include a sport fishing boat
construction business, a marine engine distributor, the NC Division of Marine Fisheries, a
commercial seafood business, and a marina.
Along the shoreline of lots 29, 29A, and 30, the existing pier will be removed and salvaged, and
existing riprap and sheet pile walls will be removed. Approximately 255 linear feet of steel sheet
pile bulkhead will be installed, and the salvaged pier will be reinstalled long the new bulkhead.
Riprap will be provided along the sheet pile sidewall abutting lot 30. A 30 foot wide concrete
boat ramp will be installed along the shoreline of lots 29 and 29A. The boat ramp will be 80 feet
long, with approximately 30 feet below Normal Water Level (NWL). Riprap will be provided
along the waterward toe and west side of the boat ramp. Fifty foot long steel sheet pile sidewalls
will be provided along either side of the boat ramp. The basin bottom near the shore of lots 29
and 29A will be dredged to a depth of —12 feet below NWL. The dredge area is approximately
140 feet by 15 feet with a 20 foot by 20 foot extended area into the basin.

Along lots 28A and 24, approximately 155 linear feet of steel sheet pile bulkhead will be
installed adjacent to the existing timber dock and along the shoreline, including sidewalls. A-.15
foot wide by 70 foot long concrete apron is proposed on along the shoreline of lot 24. A six-inch
stormwater outfall pipe will be installed on lot 24. A 20 foot wide by 25 foot long concrete apron
is proposed along the shoreline of lot 28A. The basin bottom near the shore corner of lots 28A
and 24 will be dredged to a depth of—7 feet below NWL. The dredge area is approximately 65
feet by 45 feet.
The waters of Mill Creek are classified as SC and are closed to shellfish taking. The water
depth in the basin is in this area range from less than one foot in the north corner of the basin to
—26 feet.
Anticipated Impacts resulting from this project are expected to include: the dredging of
approximately 5,750 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental
Concern (AEC); the filling of approximately 2,360 sq. ft. of Public Trust Area/Estuarine Waters
AEC and 12,600 sq. ft. of Estuarine Shoreline AEC; and the excavation of 1,075 sq. ft. of
Estuarine Shoreline AEC.
Basis for Determination:
The Dare County Land Classification Map identifies the site area as "Community Village". The
site is within Areas of Environmental Concern (AECs) therefore the "Conservation" classification
also applies. The following are LUP policies that may be applicable to this request:
Estuarine Waters/Shoreline: Policy #5, page 56.
"Estuarine Shoreline development should continue to be managed to protect and
preserve the natural resources of the estuarine waters and the estuarine shoreline.
The appropriate tools for this are the existing CAMA permit program and the Areas
of Environmental Concerns (AECs) designated under the CAMA program..."
Estuarine Waters/Shoreline: Policy#6, page 57.
"Dare County supports the installation and maintenance of estuarine bulkheads.
Offshore breakwaters, slopes, rip-rap, and voluntary setbacks in excess of CAMA
30-foot buffer rules should be promoted as additional methods for estuarine
shoreline management in lieu of estuarine bulkheads along estuarine shorelines
where these less invasive techniques would be equally effective in abating a
shoreline erosion problem."

Dear Mr. Peele:
The NC Division of Coastal Management hereby acknowledges receipt of your application on
May 6, 2005, for State approval for the development of the referenced project. An initial
screening of the submittal package has been conducted. This revealed certain deficiencies, which
must be corrected before the application package can be accepted as complete. To assist you in
expediting the permitting process as much as possible, I am notifying you of these deficiencies
immediately so that they can be quickly corrected to facilitate the detailed review by the Field
Representative.
I am returning the original application package so that the needed changes can be made, but will
retain a copy so that the Field Representative can commence the detailed review. Please
understand that the subsequent detailed review may reveal additional areas where further
information or documentation is required to demonstrate compliance with the rules directly
applicable to the proposed development. If this occurs, you will be notified of such issues
separately by the Field Representative.
Our initial screening has identified the following deficiencies:
1. Not all questions on the application have been answered, or indicated as "not applicable."
Please address the following items: Form DCM-MP-4, Item "a.(6) Platforms" should

o Near the boatramp, and below the water level there exists
an area that appears to indicate the placement of rock, but

Environmental Concern.
■ It appears that the proposed development will alter the flow of stormwater at this
Industrial Facility, and that the existing approved Stormwater Plan will have to be
altered. Any alterations to the Stormwater Plan that will be placed within the
Estuarine Shoreline Area of Environmental Concern (AEC), or that may be
located outside of an AEC that will cause stormwater flows to adversely affect an
AEC will need to be depicted on the drawings that have been submitted for this
permit.
■ It appears that the proposed alterations to the shoreline, immediately adjacent to
the Normal Water Line will increase the flow of stormwater across the 30 feet
buffer by sloping the proposed concrete areas toward the water. This is not
acceptable under the buffer rule provisions of the Rules of the Coastal Resources
Commission for Estuarine Shoreline AECs.
3. Please provide us with a copy of the letter and project description that you provided to the
adjacent riparian property owners, along with any comments or response from them that

you received in return. We note that you have provided the "green postcards" from the
Post Office that indicate that these owners received what you sent to them.
To expedite our response to your permitting request, we will commence the detailed review of
your application for a permit pending the receipt of the additional information requested above.
However, the statutorily provided 75/150 days allowed for review cannot commence until such

APPLICATION FOR CAMA MAJOR
DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice
as required by NCGS 113A-119(b)that application for a development permit in an Area of
Environmental Concern as designated under the CAMA was received on 06/30/05.
According to said application, NC Seafood Industrial Park proposes to construct a
bulkhead along the shoreline of the Park, and construct a concrete wharf and dredge areas
of the basin located at the end of Harbor Road in Wanchese, NC.
A copy of the entire application may be examined or copied at the office of Frank
Jennings, Field Representative of the Division of Coastal Management, located at 1367 US
17 South, Elizabeth City, NC, 252-264-3901 during normal business hours.
Comments mailed to Charles S. Jones, Director, Division of Coastal Management,
400 Commerce Avenue, Morehead City, NC 28557, prior to 09/07/05, will be considered in
making the permit decision. Later comments will be accepted and considered up to the
time of permit decision. Project modification may occur based on review and comment by
the public and state and federal agencies. Notice of the permit decision in this matter will
be provided upon written request.

The Division of Coastal Management hereby acknowledges receipt of the application
submitted for State approval for development of property located in Wanchese, Dare County.
It was received complete on 06/30/05, and appears to be adequate for processing at this time.
The projected deadline for making a decision is 09/13/05. When such time is necessary to
complete the review, an additional 75-day review period is provided by law. If you have not
been notified of a final action by the initial deadline stated above, you should consider the
review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from the date received, you
may request a meeting with the Director of Division of Coastal Management (DCM) and permit
staff to discuss the status of your project. Such a meeting will be held within five working days
from the receipt of your written request and shall include the property owner, developer, and
project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete
application.

Statement of Adjacent Property Owners' Responses
There were no comments received from the adjacent property owners to the North Carolina
Seafood Industrial Park, Mr. Willie Etheridge Jr. and Mr. Willie Daniels Jr., with regard to the
proposed dock and shoreline improvements project. Moffatt & Nichol sent an information
package to each adjacent property owner on behalf of the property owner. Each information
package consisted of a cover letter, a copy of the CAMA permit application, a copy of the
project description, and a copy of the permit application plats. This letter requested that they
provide comments to this letter within 30 days of the receipt of the letter and its attachments.
No response from the adjacent property owners have been received to date.
