Docking Facility 1) The area of the boathouse, as measured from the roof dripline, shall not exceed 400 sf. 2) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application.. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. Signature of Permittee Richard Kroeger Permit#9-05 r Page 2 of 3 ADDITIONAL CONDITIONS 3) The pier, boathouse and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. 6) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 7) The authorized boathouse and covered platform shall be single story, and shall not be designed to allow for second story use. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The authorized structure.and associated activity shall not cause an unacceptable interference with navigation. 10) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee shall not be relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 11) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. General 12) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NARRATIVE DESCRIPTION: Morehead City ®CM The applicant owns a lot that is 1.65 acres in size and is adjacent to the Trent River within the City of New Bern, Craven County. The street address is 5317 Trent Woods Drive, which is located east of Hwy 17 off SR 1214. The property is located just south of the SR 1214 —Trent Woods Dr. intersection. Applicant states that the property is approximately 30'above NWL, and is vegetated with wooded vegetation along the high bank shoreline and typical lawn grasses near the house. An existing dock is shared with the neighbor(Mr. Richard Ward)along the upstream property line. A joint easement has been deeded for access to this dock. The access(4'x 26')and a 180sf platform are within Mr. Kroegers riparian lines. Current development on the lot includes a single-family residence, asphalt driveway, tennis court, and the shared dock. The existing shared dock is the result of a CAMA General Permit issued in 1994 (GP—C12161) to Mr. Richard Ward.The 1995 aerial photos show that this dock was completed under this permit.The Kroegers purchased their property by deed dated July 24, 2000. The conveyance was made together with and subject to a joint easement for the use of the existing dock,which gave the Kroegers the right to use the existing dock and the obligation to share the maintenance with the Wards. The adjacent waterbody is the Trent River, that runs SW—NE to the Neuse River several miles downstream. The waterbody is not designated a primary nursery area by the DMF, and is classified SB, NSW by the DWQ. The Trent River and adjacent creeks are closed to shellfishing. Water depths in the area of the existing dock average-8'to -10'and reach a maximum depth of-15' at the offshore edge of the boat slips.The Trent River is approximately 2100' across and the existing boat slips are 82'from the edge of the channel. The Craven County Land Use Plan classifies this area as Developed,with all AEC'S classified Conservation. There are no shellfish or SAV resources evident at the project location. The applicant proposes a second docking facility within his riparian lines. The proposed dock includes a 5'x 48'access to 420sf trapezoidal shaped platform. The entire area of this platform would be covered. Adjacent to the platform, a 15' x 24' boathouse with a lift is proposed. The boathouse would have a 3' x 39' boardwalk around its perimeter. Project Description The high ground development proposed consists of two sets of steps, one 5' x 11' set that lands on a 6' x 10' landing, the other a 5' x 13' set that goes from the landing to the boardwalk at the NWL line. These steps and landing are to serve as access to the dock down the steep bank along the river. The proposed dock is 5' x 48' from the NWL to the shore side of the platform. The access dock leads to a 420sf trapezoidal shaped platform. To the west of the access platform a 15' x 27' boathouse with a lift is proposed. The edge of the roof would also cover a 3'x 39' boardwalk around the boathouse. The distance between the platform and the 3' boardwalk would be 12'. The total distance of the dock offshore as measured from the NWL is 67'. According to plats provided by the applicant and confirmed by site observation,this is within the existing pier headline. The proposed dock will be 15'or greater from the adjacent riparian lines, and is 82'from the channel. The dock and boathouse proposed are for private use. ANTICIPATED IMPACTS: Morehead City The total square footage of the upland development is 180sf. The access dock and platform rea on the proposed dock would incorporate 660sf of public trust area. The 15'x 27'boathouse would incorporate 405sf of public trust area. This would total 1245sf of public trust area incorporated between both docks on the property,all of which is shaded. The cumulative impacts from both piers on the Kroeger property are 600sf of platform area and two access's, one 5' x 48', the other 4' x 26'. One boat slip would be in place within the Kroeger 's riparian corridor. Navigation should not be impeded, as the dock is within the existing pier headline. Some turbidity could be expected during construction, but it should be short in duration and minimal in impacts. The applicant is a co-owner of a second dock of which the access and a platform is within his riparian corridor. The square footage of this dock was used to calculate the area remaining for the proposed second dock. The proposed new dock and covered deck along with the existing dock area are consistent with 15A NCAC 07H .0208 (b)(6)(D)(L), meeting the square footage requirement and the 15' setback. The boathouse being 405sf, does not meet 15A NCAC 07H .0208 (b)(6)(G)which states that boathouses shall not exceed 400sf. It is suggested that the applicant build the boathouse 15' x 26'6"instead of 15' x 27' so that the structure would comply with the regulation. I recommend the project be authorized as proposed, contingent upon the following conditions: 1. The boathouse must be brought within the 400sf rule. 2. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this marina/docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 3. The pier/boathouse and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel,then drawing a line perpendicular to the channel line that Page 02 Kroeger April 18, 2005 intersects with the shore at the point where the upland property line meets the water's edge. 4. The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. Footprint of the boathouse shall not exceed 400 square feet. 5. The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 6. The authorized covered platform/gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and must be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization 7. The authorized structure and associated activity must not cause an unacceptable interference with navigation. 8. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 9. The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard,through regulation or otherwise, on the authorized facilities. At a minimum,permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 10. All development within 50 feet of the normal water level must be consistent with Environmental Management Commission(EMC)Tar Pamlico/Neuse River buffer regulations in place at the time of such Development. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. My clients received a notice (from John W. Rouse, Jr., received via certified mail on November 17, 2004) that their neighbor, Richard James (Jamie) Kroeger, is applying for a major permit to construct a pier/deck/boat lift extending from his property, and asking the Wards, as owners of adjacent property, to contact you in the event of emy objections to the proposal. By way of background, the Kroegers purchased their property by deed dated July 24, 2000. A copy of this deed is enclosed for your reference. The conveyance was made together with and subject to a joint easement for the use of the existing boat dock, which gave the Kroegers the right to use the existing dock and the obligation to share the maintenance with the Wards. The existing dock and connecting walkway are located along the property lines of the Wards and the Kroegers. A copy of the joint agreement is attached along with a survey showing the existing dock. Following the purchase by the Kroegers, they became dissatisfied with having to share the existing dock and filed an application for a minor permit for the construction of a new dock. (Due to the recent application for a Major Permit, my assumption is that the minor permit was denied). There are some differences between the earlier (rejected) proposal and the current proposal, including the following: a. The current proposal is in the form of a "Major Permit" rather than a "General Permit". b. The size of the planned deck structure is larger than before (the size of the planned deck, excluding the boat lift and associated pier structures, is given as 599 square feet). c. The proposed walkway from the shoreline to the deck (not including the deck area itself) is indicated as just under 48 feet in length. The earlier(rejected)proposal listed the length as only 40 feet. The proposal notes that there is already an existing pier/deck/boat lift structure currently extending from the Kroeger's property, immediately adjacent to the shared property line. A portion of this existing pier/deck, per previous legal agreements (as stated in the deeds to Ward's property and Kroeger's property) is for shared/joint use by both the Kroegers and the Wards pursuant to the Agreement. All of the existing deck area on the Kroeger's side of the extended property line is legally designated for such shared/joint use. The existing deck described above is approximately 190-200 square feet (this not including the walkway to the deck, boat lift area or that portion of the structure built by Ward and legally designated for Ward's exclusive use). Given a maximum of 400 square feet of deck for a single property as noted for the "General Permit" process above, and assuming that a second structure from the same property were even allowed, compliance with this portion of the regulations would appear to allow the Kroegers only about 200 additional square feet of deck/pier. Does the Division of Coastal Management wish to establish a precedent allowing clearly defined size limits to be avoided simply by using the "Major Permit" process rather than the "General Permit"process? It was noted in the response to the previous proposal that the proposed walkway, 40 feet in length, seemed to be noticeably longer than the walkways to other docks in this part of the Trent River. For comparison, the comparable walkway for the existing structure is only about 25 feet long. The current proposal is for an even longer span- almost 48 feet in length. If approved, might the walkway not encroach on the channel, affecting the general public (since the channel is closer to the shoreline on this side of the river)? The final question is the most important for my clients: with respect to permitting and any other regulatory issues, what would be the situation with respect to Ward's ability in the future to rebuild/replace the existing structure (including, but not limited to, the shared/jointly maintained deck)? For example, in the event of hurricane damage resulting in partial or total destruction of the existing structure, can you (the Division of Coastal Management/CAMA) and Kroeger make an assurance that the Wards would be allowed to rebuild to its current specifications? Or, if built, would the currently proposed structure affect such a future decision? Summary: For obvious reasons, the Wards would, in principle, prefer that the Kroegers have a separate dock and would like to agree to the proposed construction. However, we are concerned that the proposal: a. does not seem to comply with the intent of existing CAMA guidelines with respect to the size of the planned structures and having two separate structures on one property. The Kroegers have not taken any action to terminate the joint easement. Therefore, they still have the same rights and responsibilities to share in the maintenance of the existing dock. Also, they will continue to have the right to use the existing dock as part of the original agreement. My clients' biggest concern is the effect of allowing the Kroegers to construct a new dock, pier and boathouse on the future ability of my client to make repairs and/or replacement of the existing dock should it be damaged. The elevation of the property is approximately 30 feet above NWL and consists of loamy well-drained sand. The front of the developed lot contains upland wooded vegetation. No wetlands are located at the proposed project site. The property is zoned residential/single family and the proposed project is consistent with the applicable zoning. The normal water depth at the end of the proposed structure is approximately 15 feet. Soundings were taken at 10 foot intervals with consistent readings at 15 feet from the end of the dock to the nearest edge of the marked channel (please refer to attached drawings). The depth of the water beneath the covered boatlift ranges from 13 to 15 feet deep. The distance separating the proposed dock and the edge of the marked channel is approximately 82 feet. Will the Division of Coastal Management waive the maximum size limitation, or does this not apply? 2. The dimensions shown are confusing and possibly grossly inaccurate. a. The drawing specifies lateral distances on either side of the structure of 20 feet and 53 feet, but the point from which the measurements are made is not specified. Are these intended to be distances from adjacent property lines? (Subtotal = 20 + 53 = 73 feet) b. The width of the proposed structure is not clearly stated, with different angles depicted on the shore side and river side of the structure. The shore side measurements, however, show lengths of 12 feet (for the "deck open" and portion of the "walkway") + 5 feet (for additional"walkway") + an additional 15 feet (for the boat lift and adjacent pier). This seems to be noticeably longer than the walkways to other docks in this part of the Trent River(as the channel is closer to the shoreline on this side of the river). For comparison, the comparable walkway for the existing structure is only about 25 feet long. Is this extra length necessary, and might it not encroach on the channel, affecting the general public? 4.
