South College Road, PMB:326 Wilmington, NC 28412 Dear Mr. Conard, This is with reference to your request, as acting agent for Inlet Point Harbor BOA, to modify State Permit#160- 05 which was issued to Inlet Point Harbor BOA on October 21, 2005, which was last modified on June 28, 2006. State Permit #160-05 expired on December 31, 2008. The applicant requested renewal of State Permit #160-05 in August 2009 after the six month grace period. This permit was subject to extension by the Session Law 2009-406, as amended by Session Law 2010-177, the Permit Extension Act, therefore the processing fee has been waived and renewal of the permit is authorized without exception. The new expiration date for State Permit#160-05 is December 31, 2012. The original permit authorized the maintenance excavation of an access channel and basin for the community marina within Myrtle Grove Sound, in New Hanover County, N.C. The action proposed in your submittal is to allow for a one-time maintenance excavation event within areas of the access channel adjacent to two properties located on Gazebo Court. Excavation would be accomplished by bucket-to-barge method, which would result in the removal of approximately 62 cubic yards of material. The material would be located onto an authorized private spoil area located on the mainland portion of Myrtle Grove Sound, approximately 3.5 miles north. Upon reviewing the information provided, the Division of Coastal Management has determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit#160-05 as described in your letter dated August 17, 2010. Please note this refinement does not alleviate the need to obtain any other local, state or federal permits.
