This permit, issued on_ February 5,2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action;or may cause the permit to be null and void.
1) This Renewal shall be attached to the original of Permit No. 160-05, which was issued to the
permittee on 10/21/05, as well as all subsequent modifications,refinements, and renewals, and copies
of all documents shall be readily available on site when a Division representative inspects the project
for compliance.
2) In order to protect colonial nesting water birds and juvenile shrimp and finfish populations, no
excavation or filling shall be permitted between April 1 and August 31 of any year without the prior
approval of the Division of Coastal Management, in consultation with appropriate resource agencies.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) The authorized project is located within a primary nursery area(PNA). Therefore, in accordance with
NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
4) All conditions and stipulations of the active permit remain in force under this Renewal.
Maintenance Clause
5) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross-hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a
representative of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No. 05-
1610.
NOTE: The U.S. Army Corp of Engineers has assigned the proposed project COE Action Id.No. SAW-
2005-01155.

Ms. Kelly McMahon, acting as agent for Inlet Point Harbor BOA, is requesting renewal of State Permit No.
160-05 for maintenance dredging of the existing community boat basin and access channel. State Permit No.
160-05 was originally issued to Inlet Point Harbor BOA c/o Ann Bowman on October 21, 2005 for
maintenance excavation of an existing community boat basin and access channel, adjacent to the AIWW,
Myrtle Grove Sound, in New Hanover County.Following Hurricane Ophelia in 2005, State Permit No. 160-
05 was modified on June 28, 2006 for the replacement of the existing deteriorated timber bulkhead located
within the Inlet Point Harbor BOA basin and access channel. Approximately 2,800 linear feet of new
composite bulkhead was installed at an average of approximately 2 feet to 5 feet waterward of the existing
wooden bulkhead.
State Permit No. 160-05 was modified on January 23,2012 and again on March 12, 2013 to remove/cut the
filter cloth at the location of the weep holes of the new composite bulkhead. State Permit No. 160-05 was
modified again on March 23, 2015 authorizing the construction of an additional approximately 78 linear ft.
of new composite bulkhead. State Permit No. 160-05 was last renewed on March 12, 2013 to maintain the
Maintenance 5 Clause, which was due to expire on December 31, 2017. The applicant acknowledges the
permit conditions set forth in State Permit No. 160-05 and requests no other modifications at this time.
This Office has no objection to a 5-Year Maintenance Renewal of State Permit No. 160-05. The
applicant has included a check(No.002391)for the$100.00 renewal fee.
