Authorizing development in New Hanover County at adj. to AIWW, Myrtle Grove Sound, Federal
Point Township , as requested in the permittee's letter dated 6/16/06. including the
attached workplan drawings (2), "received" 6/19/06.
This permit, issued on June 28,2006 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below.Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Shoreline Stabilization
1) Unless specifically altered herein; this modification authorizes the replacement/repair of approximately
2,800 LF of bulkhead located within the Inlet Point Harbor BOA basin and access channel, all as
expressly and specifically set forth in the attached workplan drawings.
2) The alignment of the bulkhead shall follow the alignment of the existing bulkhead to the maximum
extend possible, and shall not extend waterward of the existing bulkhead more than an average of 2 feet
with a maximum of 5 feet.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) The bulkhead shall be constructed prior to any backfilling activities.
4) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation or other land disturbing activities
is permitted except for that which may be required for the construction of the bulkhead wall, riprap,
deadmen cables, etc.
6) The backfill material shall be clean and free of any pollutants except in trace quantities.
7) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
Sedimentation and Erosion Control
8) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities:
9) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.

10) No vegetated wetlands shall be excavated or filled, even temporarily.y
11) This minor modification shall be attached to the original of Permit No. 160-05, which was issued on
10/21/05, and copies of all documents shall be readily available on site when Division personnel inspect
the project for compliance.
12) All conditions and stipulations of the active permit remain in force under this minor modification.

Dear Ms. Bowman:
The enclosed pen-nit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. Please sign both the original (buff-
colored form) and the Xerox stamped "Copy". Return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below. Please retain the original
(buff-colored form),as it must be available on site when the project is inspected for compliance.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 276 1 1-67 14, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation.
The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the pen-nit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands
all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning pen-nit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

Mr. H. Stanley Rudd,acting agent for Inlet Point Harbor BOA, is requesting a minor modification of State Permit
No. 160-05. State Permit No. 160-05 was issued to Inlet Point Harbor BOA c/o Ann Bowman on October 21,2005 for
maintenance excavation of an existing boat basin and access channel,adjacent to the AIWW,Myrtle Grove Sound, in New
Hanover County. State Permit No. 160-05 is due to expire on December 31,2008.
Mr. Rudd is requesting that the permit be modified to allow for the replacement of the existing,deteriorating
bulkhead located within the Inlet Point Harbor BOA basin and access channel. Mr.Rudd states that approximately 2,800
linear feet would be installed throughout the boat basin and indicated sections along the access channel,which would be
installed an average of 2' no further than 5' waterward of existing bulkhead.
The agent has submitted a check(ck. #044723) in the amount of$100.00 for the modification request.
This Office has no objection to the permit modification request.

Dear Robb,
Intercoastal Diving, Inc., on behalf of Inlet Point HOA, requests a minor
modification to Coastal Resources Commission Permit # 160-05 to allow bulkhead
construction waterward of the existing structure. Said construction will result in
the installation of +/- 2800 LF of new bulkhead necessary for soil retention. The
existing system is at the end of its useful life and areas of failure are occurring. We
would request your approval (perhaps conditional) to start remedial repairs and
ultimately new construction as soon as possible. We feel it in the best interest of all
parties to mitigate the negative impacts that this situation is causing. I have
enclosed the site plan and bulkhead details for your review. Please give me a call if
I can assist in any way.
