This permit, issued on March 12,2013 , is subject to compliance with the application(where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this modification authorizes the repair of the existing bulkhead by
removal and replaceme,,-.t of sections of bulkhead with associated whalers, piles, and gravel backfill as
indicated in the letter dared 12/6/12 and the attached workplan drawing dated received in Wilmington on
12/7/12.
2) If deemed necessary by a Division representative during the course of the authorized activities, a
turbidity curtain shall be placed across the terminal end of the access channel at the point of entrance to
the boat basin to prevent unnecessary siltation into the adjacent water body. The turbidity curtain shall
remain in place until turbidity levels behind the curtain are equal to or lower than ambient levels.
3) If required, the turbidity curtain shall be constructed in a manner to allow for detachment for continued
vessel use of the basin.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
Sedimentation and Erosion Control
4) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
5) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
Maintenance Clause
6) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation activities authorized by this permit and that notification include:
A. The number of the original permit;
B. A statement that no dimensional changes are proposed;
C. A copy of the original permit plan(s) with cross-hatching indicating the area to be maintained
and the area to be used for dredge spoil, and the estimated amount of material to be removed;
D. The date of plan revision and the permittee's signature shown anew on the original plan.

7) No vegetated wetlands shall be excavated or filled, even temporarily.
8) This minor modification shall be attached to the original of Permit No. 160-05, which was issued on
10/21/05 and the minor modifications issued on 6/28/06 and 1/23/12, and copies of all documents shall
be readily available on site when Division personnel inspect the project for compliance.
9) All conditions and stipulations of the active permit remain in force under this minor modification, unless
altered herein.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,the
State Dredge and Fill Law,for you to proceed with your project proposal.The original(buff-colored form)is retained by
you and it must be available on site when the project is inspected for compliance.Please sign both the original and the
copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have
waived your right of appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1 or
113-229.Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center,Raleigh,NC 27611-6714,(919)733-2698 within twenty(20)days
of this decision on your permit.You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty(20)days,the matter must be resolved prior to work initiation.The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application.Modifications,time extensions,and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time,Department personnel will visit the project site. To facilitate this review,we request that you
complete and mail the enclosed Notice Card just prior to work initiation.However, if questions arise concerning permit
conditions,environmental safeguards, or problem areas,you may contact Department personnel at any time for assistance.

Good Morning Rob,
As per our previous conversations concerning Inlet Point Harbor,we would like to get a minor
modification on Inlet Point Harbor's Major Permit#160-05. As you are aware,the new wall that was
installed has failed or is failing in several locations. In the first modification, Phase I, we cut out the
existing, non-functioning weep holes to relieve hydrostatic pressure behind the wall. The sand backfill
and water drained out with virtually no turbidity. A turbidity curtain had been installed but wasn't
necessary. In this modification, Phase II, we are proposing to cut out the remaining weep holes in the
access channel that weren't cut out in Phase I. Due to the success of Phase I and the lack of turbidity,
we don't believe that a turbidity curtain is necessary, but will keep one on site for use if needed.
As in Phase I, cutting out the weep holes will help to relieve the hydrostatic pressure behind the channel
wall. The rest of Phase II of the project is to remove any remaining sand from between the new and old
wall in the basin and in the access channel.
The areas highlighted in green on the attached drawing are areas where the wall has failed or is failing.
We are proposing to remove these sections in order to determine what material can be salvaged and
reused. The new wall will be rebuilt in the same location. A new lower waler with king piles is to be
installed to add additional structural support. The existing deadmen anchors will then be reattached
through the king pile. Jet filters are to be installed in the existing weep holes along with the addition of
more jet filters to prevent any future hydrostatic loading. The void area in between the old wall and
new wall will then be backfilled with a clean gravel along with a small top layer of soil to allow for
ground cover.
The remaining sections of the bulkhead, highlighted in pink will, not have to be removed or replaced.
However, they will have an upper new water attached and king piles installed,so that the existing
deadmen can be properly aligned and attached. Jet filters will also be installed in existing weep holes
along with the addition of more jet filters. The void area in between the walls is then to be backfilled
with clean gravel and a small top layer as in the other sections.
Phase II modification completes the repair and replacement of the existing new failing bulkhead. The
finished product will be a secure, sealed wall that will allow any hydrostatic pressure to properly drain
and will protect the owners property for many years to come. As always,feel free to call me on my cell

Mr. Michael Conard with Carolina Marine Construction, Inc. and acting agent for Inlet Point Harbor
BOA, is requesting a minor modification and renewal of State Permit No. 160-05. State Permit No. 160-05 was
originally issued to Inlet Point Harbor BOA c/o Ann Bowman on October 21, 2005 for maintenance excavation
of an existing community boat basin and access channel, adjacent to the AIWW, Myrtle Grove Sound, in New
Hanover County. Following Hurricane Ophelia in 2005, State Permit No. 160-05 was modified on June 28,
2006 for the replacement of the existing, deteriorating wooden bulkhead located within the Inlet Point Harbor
BOA basin and access channel. Approximately 2,800 linear feet of a new composite bulkhead was installed at
an average of approximately 2 feet to 5 feet waterward of the existing wooden bulkhead.
State Permit No. 160-05 was then modified on January 23, 2012 to remove/cut the filter cloth at the
location of the weep holes of the new composite bulkhead, aforementioned, which would relieve the
hydrostatic pressure landward of the new composite bulkhead to prevent future failure. The authorized work
was based on the recommendations from Mr. Mark Weiss, P.E., Project Engineer with Criser Troutman Tanner
Consulting Engineers, and representing the Inlet Point Harbor BOA. Mr. Weiss indicated that this procedure
served to temporarily alleviate the earth and hydrostatic loads and assist to mitigate future catastrophic failures
of the new composite bulkhead until a permanent engineered solution can be designed and implemented.
According to Mr. Weiss' report, this would result in the loss of fill material from the space between the
new composite bulkhead and the existing old wooden bulkhead into the upland boat basin and access channel
in the amount of approximately 450 to 1,200 cubic yards. Once the material was drained 3/8" plywood was
installed over the existing weep holes, which were cut into the old wooden bulkhead to allow for the installation
of the existing tie-back anchor system for the composite bulkhead. This was done to prevent additional loss of
material behind the existing wooden bulkhead. The plywood installed over the two existing bulkheads was
done during the process to cover the void between the bulkheads for safety purposes.

A turbidity curtain was also installed at the location of the terminal end of the access channel at the
point of the entrance of the boat basin prior to the authorized procedure to reduce the amount of material from
escaping the project area; however, it was observed that very little turbidity was present within the basin and
access channel during the maintenance work. The work describe above will also be known as Phase I in the
authorized initial work to address the hydrostatic pressure on the existing bulkhead.
Mr. Conard is now requesting as Phase II to allow for the removal of sections of the existing bulkhead
within the basin, which were included in Phase I, to determine if the material can be salvaged and reused. The
replacement of these sections would be in the same location, however, new lower whalers with king piles
would be installed to provide additional structural support. The existing deadmen anchors would then be
reattached through the king piles and jet-filters would be installed to prevent future hydrostatic loading. Once
complete, the void between the new bulkhead and the timber bulkhead would be filled with clean gravel along
with a top layer of soil for ground coverage.
Based on the success of Phase I, Mr. Conard requests to allow cutting weep holes in the remaining
access channel bulkhead, which weren't included in Phase I. Further, due to the success of Phase I and the
lack of turbidity observed during the process, the turbidity curtain would not be installed unless determined to
be necessary. If deemed necessary, the turbidity curtain would be installed along the entrance to the boat
basin, and at the entrance to the access channel to the AIWW.
The remaining sections of new composite bulkhead with the basin and access channel, which do not
have to be removed, would be reinforced with new upper whalers with attached king piles so existing deadmen
can be properly aligned and attached. These sections would also include the installation of jet filters, gravel
and soil as described above.
State Permit No. 160-05 is also due to expire on December 31, 2012. Mr. Conard requests renewal of
State Permit No. 160-05 to accomplish the work as described above and also retaining the Maintenance-5
Dredging Clause for the ability to maintain the community access channel and basin.
The agent has submitted checks (ck. # 7938 and #7957) in the total amount of $200.00 for the
modification and renewal request.
This office has no objection to the proposal.
