This permit, issued on March 23,201 S , is subject to compliance with the application (where consistent
: with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action;or may cause the permit to be null and void.
1) Unless specifically altered herein, this minor modification authorizes the construction of
approximately 78 linear feet of bulkhead, all as expressly and specifically set forth in the attached
workplan drawing. Any additional land disturbing activities and/or construction may require a
t modification of this permit. Contact a Division of Coastal Management representative at(910) 796-
7215 for this determination.

Bulkhead
2) The bulkhead shall be constructed in the same alignment as depicted on the attached workplan
drawings.
3) No backfill material shall be placed within 30 feet of the normal high water line, except that which
will be used to backfill the area behind the permitted bulkhead.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
5) The bulkhead shall be constructed prior to any backfilling activities.
6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
7) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.
8) All backfill material shall be clean and free of any pollutants except in trace quantities.
Sedimentation and Erosion Control
1.
9) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
10) Aground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed
immediately landward of the top of the retaining wall immediately following completion of backfilling ;
f activities.
General
11) This minor modification shall be attached to the original of Permit No. 160-05, which was issued on
10/21/05, the minor modifications issued on 6/28/06, 1/23/12 and 3/12/13, and copies of all documents
} shall be readily available on site when Division personnel inspect the project for compliance.

12) All conditions and stipulations of the active permit remain in force under this minor modification unless
specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: A minor modification application processing fee of$100 was received by DCM for this project.

Dear Sir or Madam:
The enclosed permit constitutes authorization under the Coastal Area Management Act,and where
applicable,the State Dredge and Fill Law,for you to proceed with your project proposal.The original(buff-
colored form)is retained by you and it must be available on site when the project is inspected for
compliance.Please sign both the original and the copy and return the copy to this office in the enclosed
envelope. Signing the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS
113A-121.1 or 113-229.Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings,6714 Mail Service Center,Raleigh,NC 27611-6714,(919)733-
2698 within twenty(20)days of this decision on your permit. You should also be aware that another
qualified party may submit an objection to the issuance of this permit within twenty(20)days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications,time extensions,and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and review
all project plans,as approved.If you are having the work done by a contractor, it would be to your benefit to
be sure that he fully understands all permit requirements.
From time to time,Department personnel will visit the project site.To facilitate this review,we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions,environmental safeguards,or problem areas,you may contact
Department personnel at any time for assistance.By working in accordance with the permit,you will be
helping to protect our vitally important coastal resources.

Inlet Point Harbor BOA c/o Ann Bowman, New Hanover County
Mr. Michael Conard with Carolina Marine Construction, Inc. and acting agent for Inlet Point Harbor BOA, is requesting a minor
modification of State Permit No. 160-05. State Permit No. 160-05 was originally issued to Inlet Point Harbor BOA c/o Ann Bowman on
October 21, 2005 for maintenance excavation of an existing community boat basin and access channel, adjacent to the AIWW, Myrtle
Grove Sound, in New Hanover County. Following Hurricane Ophelia in 2005, State Permit No. 160-05 was modified on June 28, 2006
for the replacement of the existing, deteriorating timber bulkhead located within the Inlet Point Harbor BOA basin and access channel.
Approximately 2,800 linear feet of a new composite bulkhead was installed at an average of approximately 2 feet to 5 feet waterward of
the existing wooden bulkhead.
State Permit No. 160-05 was modified on January 23, 2012 and again on March 12, 2013 to remove/cut the filter cloth at the
location of the weep holes of the new composite bulkhead, aforementioned, which would relieve the hydrostatic pressure landward of
the new composite bulkhead to prevent future failure. The authorized work was based on the recommendations from Mr. Mark Weiss,
P.E., Project Engineer with Criser Troutman Tanner Consulting Engineers, and representing the Inlet Point Harbor BOA. Mr. Weiss
indicated that this procedure served to temporarily alleviate the earth and hydrostatic loads and assist to mitigate future catastrophic
failures of the new composite bulkhead until a permanent engineered solution can be designed and implemented. State Permit No.
160-05 was last renewed on March 12, 2013 to maintain the Maintenance 5 Clause, which was due to expire on December 31, 2017.
Mr. Conard is now requesting the construction of an approximately 78 linear foot section of new composite bulkhead
approximately 2 feet waterward of the existing timber bulkhead maintained by the applicant located along the southern side of the
entrance channel to Inlet Point Harbor Subdivision, which is adjacent to Mr. Willard Buffkin's property located at 229 Gazebo Court.
Mr. Conard states that this section was inadvertently left out of the last modification to State Permit No. 160-05. Mr. Conard has
included a check(ck. No. 9458) in the amount of$100 for the modification request. This office has no objections to the modification of
State Permit No. 160-05. By copy of this memo, DCM is requesting that the USACE and DWR provide any comment that your
agency may have on the proposed project to Jonathan Howell of DCM's Morehead City office within 10 days of receipt of this
memo.

As per our previous conversations, we would like to request a minor modification to permit
#160-05 to include 78' of additional bulkhead along the south wall at the entrance to Inlet Point
Harbor(see attached drawing). This section was inadvertently left out of the last modification
and is in definite need of replacement. As with the rest of the bulkhead, we are proposing to
install a new naval style FRP wall approximately two feet or less in front of the existing
deteriorated wooden bulkhead. It is a concern that if this section of bulkhead was to fail,then it
would block the entrance to the entire canal and basin.
