Dear Mr. DeGrand,
I have reviewed your inquiry concerning the necessary filing of an application for a minor development
permit under the Coastal Area Management Act. I have determined that the activity you propose is exempt
from needing a minor development permit as long as it remains consistent with the work description
submitted to Jonathan Lucas via email on 6/30/2024 and 6/10/2024, and meets the conditions specified
below. If your plans should change and your project will no longer meet these conditions, please contact
me before proceeding.
MAINTENANCE AND REPAIR - [G.S. 113-103(5)(B)(5) and 15 NCAC 7K.0103(a)] – Maintenance and
repairs (excluding replacement) necessary to repair damage to structures caused by the elements are
specifically excluded from the definition of development under the conditions and in the circumstances set
out in G.S. 113A-103(5)(b)(5). Individuals required to take such measures within an AEC shall contact the
local CAMA representative for consultation and advice before beginning wor k.
Structures, including roads, may be repaired in a similar manner, size, and location as the original
structure. No expansions or additions are permissible. The repairs are limited to 50% of the market value of
the existing structure and the following specific conditions.
1. The project consists of replenishing the surface on an approximately 0.4 mile section of Hunter
Heath Drive.
2. The proposed repairs shall be consistent with all other applicable local ordinances and North
Carolina Building Code standards.
3. No expansions or enlargements of any kind are authorized by this permit. Hunter Heath Drive
may not be widened or extended. All work must occur in the original footprint.
4. All unconsolidated material resulting from associated grading shall be retained on site by
effective sedimentation and erosion control measures. Sedimentation and erosion control
measures shall be properly maintained throughout the construction period.
5. This exemption does not allow for disturbance or development within any wetlands or open
water areas.
6. No other work is authorized by this exemption letter. Any proposal to modify or alter the
development plan as proposed will require additional authorization from the Division of Coastal
Management.
7. The Permittee and/or the Permittee’s Authorized Agent shall be responsible for obtaining all
necessary authorizations, approvals, or zoning and building permits from the local government
having jurisdiction (Town of North Topsail Beach and/or Onslow County) prior to commencing
work.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other
State, Federal or Local authorization and N.C. Building Permits. This exemption expires 90 days from the
date of the letter.

Good afternoon Jonathon:
My name is Tom DeGrand and I am the President of the Ashe Island Homeowners Association. Per the
discussion you had with Moe Afify, attached please find the image of the area of discussion, the road
itself, not the entire circle. We will be using regrinds that we accumulated from repairs done on our main
road itself. The regrinds will be used to replenish the surface. If you can please send us a letter stating
that it is okay to do so, that would be greatly appreciated.
