RE. NOTICE OF REGULATORY REQUIREMENTS
CASE #24-16
Dear Mr. Edwards:
This letter confirms that on May 16, 2024, Heather Coats of the Division of Coastal
Management (DCM) was notified by the applicant, through their agent CPE, of the initial
deployment error of the Olivine Sand project off Duck, in Dare County, North Carolina. In
summary, the initial deployment of approximately 1,900cy olivine sand missed the target
Deployment Area by approximately 600 feet to the southeast and was outside the
Deployment Corridor by approximately 180 feet to the east. The material was deployed in
approximately -28 feet NAVD88 to a reported height of 6.9 feet above the bottom. This
location is waterward of the authorized Deployment Area and Deployment Corridor. The
applicant has provided an account of the deployment and a location map is attached to this
notice.
To remedy this error, Vesta has revised the deployment methodology. The revised
deployment and quality control plan is attached to this notice. For reference, the
"Deployment Area" is defined as the approximately 300ft x 2,220ft box and the "Deployment
Corridor" as the approximately 670ft x 4,970ft box. In summary, Vesta has committed to the
following.
1. Deployments will take place between 9am and 5pm.

2. A second tug will be used on all deployments to control the scow and assist with
accuracy within the "Deployment Area".
3. Prior to any deployment, the captain will perform a deployment checklist and "dry
run'. Only after a successful "dry run" will the tugs and scow reset and attempt the
deployment.
4. An entrance corridor will be established and, if missed, the deployment will be
aborted and the vessels will reset for a separate attempt.
5. If the criteria outlined in the deployment methodology are not met, the deployment
will be aborted to wait for more favorable conditions.
As part of the STOP WORK ORDER that was conveyed verbally to CPE on May 24, 2024, the
DCM requested following information.
1. A revised Monitoring Plan that includes a comprehensive breakdown of each
monitoring element that will be conducted and not conducted on the material
deployed outside the "Deployment Area". Provided as Additional Information
Response dated 5/24/24.
2. A more detailed after -deployment survey of the deployment relative to the
"Deployment Area", "Deployment Corridor", and profile and area of the material.
Provided as Sheets 1-6 of 6, all dated 5/16/24.
To satisfy the requirement to monitor the deployment area, the DCM has determined
that additional sediment grab samples and bathymetry surveys, in addition to the
wave climate and tides data collection, shall be conducted at the error deployment
location. These additional requirements shall be accomplished in accordance with
the previously authorized and established monitoring schedule.
Furthermore, the DCM would like to stress the importance of the following:
1. Condition No. 1 of the permit, issued as amended on 1/5/24, requires the project be
carried out in accordance with the approved workplans.
2. Condition No. 7 of the permit, issued as amended on 1/5/24, that no material be
placed outside of the final project plans. DCM reminds the applicant that to remain in
compliance with the conditions of the permit, all material must be placed within the
area known as the `Deployment Area", as depicted on the authorized workplans, and
that any expansion shall require additional authorization. This does not authorize
the permittee or their duly authorized agent(s) to modify the 'Deployment Area" or
"Deployment Corridor", or any reason, without authorization from the DCM.

3. The permittee is strongly reminded that previous placement of material within or
outside the permitted "Deployment Area" does not authorize material to be placed in
such a manner that would make it inconsistent with the conditions of the permit. If
previous material placement does not allow remaining material to be placed within
the "Deployment Area" due to issues such as, but not limited to vessel clearance
restrictions, that material shall not be placed until such time as DCM has reviewed
and authorized any modification to the project area.
4. The permittee is strongly reminded that any further errors with material placement
outside of the authorized "Deployment Area" may result in a formal NOTICE OF
VIOLATION that may include civil penalties and may require remediation of the site,
including removal or relocation of materials, at the permittee's sole cost.
5. The permittee shall notify the DCM after each deployment to verify its location
relative to the "Deployment Area" and "Deployment Corridor".
NO WORK MAY PROCEED UNTIL DCM HAS RELEASED THE ACTIVITY IN WRITING.
Continuation of work after receipt of this Notice would constitute a violation of the CAMA
and Dredge and Fill, and you may be subject to civil and/or criminal penalties as provided
by N.C.G.S. §113A-126. Each day that the development described in this Notice is continued
or repeated may constitute a separate violation that is subject to an additional assessment
of $10,000. An injunction or criminal penalty may also be sought to enforce any violation in
accordance with N.C.G.S. §113A-126. Provided you comply voluntarily with this Notice and
all permit conditions henceforth, no further enforcement action or civil assessment would
be necessary beyond this Notice.
Thank you for your time and cooperation in resolving this important matter. The relevant
statutes and regulations are available from this office, and I am willing to assist you in
complying with the requirements of these laws. A site inspection may be required to confirm
this STOP WORK ORDER has been complied with.

Good morning and thanks for your quick response,
In light of Vesta’s commitment to conduct monthly bathymetric surveys and bi-monthly grab
samples in the expanded area to include unauthorized deployment area, in addition to the
other commitments made in the Material Deployment and Quality Control Plan (v4 dated
5/23/24), the Vesta Response to Agencies dated 5/23/24, and the Vesta Additional Information
Response to Agencies dated 5/28/24, DCM releases our Stop Work Order and authorizes the
remaining deployment to continue in accordance with all permit conditions.
Vesta is reminded again that work must comply with the permitted deployment area
boundaries, all permit conditions and all commitments made in the application and
monitoring plan. And that deployment of the olivine material shall not in any case exceed a
total volume of 7,000 cubic yards.

After speaking with you on the phone late this afternoon and conveying DCM’s position to
Vesta, Vesta has agreed to modify the proposed plan described in the email below to align
with DCM’s recommendation to collect the grab samples outside the deployment Area every
other month. As you can imagine, Vesta would like to close the loop on this and get a formal
notice from DCM that the Stop Work Order has been released as soon as possible. Assuming
we receive this release tomorrow morning, we anticipate the next deployment would occur on
Friday May 31.

Vesta agrees to comply with DCM’s request to conduct bathymetry and grab samples on the load of
olivine deployed outside the permitted Deployment Area. Consistent with the original monitoring
plan, analyses of the grab samples will include mineralogy via XRF and/or VIS-IR spectroscopy to
indicate the presence/absence of olivine at the sediment surface to augment the obvious bathymetric
expression of the olivine berm. We propose to collect the additional bathymetric surveys monthly
and the additional grab samples outside the Deployment Area on a quarterly basis, which we believe
is sufficient to track the movement of sand from the first load of sand outside the Deployment Area
and compare these results with loads of sand within the Deployment Area. Our ability to collect
these additional grab samples is logistically limited by the availability of sampling time aboard FRF-
contracted watercraft. The solution proposed above helps to optimize scientific return without
exhausting available sampling resources and still achieves the intent of the sediment sampling to
determine the spatial distribution of olivine from the placement site and its transport pathways
through time.

Vesta fully appreciates your concerns and is committed to providing you with the information
requested in Josh’s email below as soon as possible. We are working on drafting a comprehensive
response now; however, it may not be submitted until early next week. In the meantime,
construction operations have been halted and will not re-commence until a revised plan has been
developed and reviewed with you.
Additionally, we have received preliminary results from the post-deployment bathymetric survey. As
the majority of the sand was deployed outside of the designed deployment area, we do not have
pre-deployment bathymetric survey data where the olivine sand lies, but the surveyor provided
information which indicates a maximum height of 6.9 feet. We haven't independently verified this
but will do so soon.
We will continue to keep you in the loop as more information is being gathered.

Hey Brad,
I have had time to circle my wagons this morning. Below is a list of things we will need to see for
the Colonel’s consideration (feel free to add anything else) before we can proceed. Let me know if
you have any questions!
• A detailed brief BEFORE Vesta deploys the next load on the event/events that led to the
material being deployed well outside the permitted area. With todays’ GPS and equipment, this
should have been avoided and is a violation of the permit and considered an unauthorized
discharge.
• An analysis of the effects of the material being placed outside of the deployment area and
how it will affect the overall data for the project (i.e. hard bottoms, T&E, EFH).
• A plan that details measure that will be implemented to ensure this does not happen again.
• A response detailing the effects of leaving the material in place vs remediation with
detailed effects of doing both

Hey Brad,
I have had time to circle my wagons this morning. Below is a list of things we will need to see for
the Colonel’s consideration (feel free to add anything else) before we can proceed. Let me know if
you have any questions!
• A detailed brief BEFORE Vesta deploys the next load on the event/events that led to the
material being deployed well outside the permitted area. With todays’ GPS and equipment, this
should have been avoided and is a violation of the permit and considered an unauthorized
discharge.
• An analysis of the effects of the material being placed outside of the deployment area and
how it will affect the overall data for the project (i.e. hard bottoms, T&E, EFH).
• A plan that details measure that will be implemented to ensure this does not happen again.
• A response detailing the effects of leaving the material in place vs remediation with
detailed effects of doing both

Good afternoon Heather and Josh,
This morning, Vesta deployed their first load of olivine sand (~1,900 cy) off the coast of Duck, NC
operating under CAMA Major Permit #01-24 and Dept. of Army Permit #SAW-2022-01747. The
scow entered the Deployment Area at approximately 11:30am. The scow doors were opened at
11:35; however, the material did not immediately deploy. Six minutes later, at approximately 11:41,
the material was fully deployed. By that time, however, the scow had moved approximately 600 ft
to the southeast of the targeted Deployment Area and 180 ft east of the Permitted Deployment
Corridor within an area approximating -28 NAVD88 (see attached figure). All pre- and post-
construction monitoring requirements have been implemented including a post-construction
bathymetric survey. We anticipate having the full survey data available for review tomorrow. We
will reach out as soon as we have the data and would appreciate the opportunity for a call to discuss.
We are developing a plan to ensure the next load is accurately deployed within the Deployment
Corridor.
