FEB Z 9 2024 DCM.-E: C RE: EXEMPTED PROJECT (Statutory Exclusion) — BEACH BULLDOZING OF A THREATENED STRUCTURE - G.S. 113A-103(5)(b)(5) and [15A NCAC 07K .0103(b)] PROJECT ADDRESS — 24040 Dean Ave, Rodanthe, NC 27968 AREA OF ENVIRONMENTAL CONCERN — Ocean Hazard Dear Mr. Bailey:: I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. After making a site inspection on 2-2-2024, I have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing(s) submitted on 2-28-2024, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. Beach bulldozing, defined as the process of moving natural beach material from any point seaward of the first line of stable vegetation, for the purpose of preventing damage to imminently threatened structures, by the creation of protective sand dunes shall qualify for an exclusion under G.S. 01 13A-1 03(5)(b)(5) subject to the following limitations: The area on which this activity is being performed must maintain a slope of adequate grade ( 31 or'2:1 or flatter) so as not to endanger the public or the public's use of the beach and should follow the natural slope as closely as possible. The movement of material utilizing a bulldozer, front-end loader, back hoe, scraper or any type of earth moving or construction equipment shall not exceed one foot in depth measured from the preactivity surface elevation; The activity must not exceed the lateral bounds of the applicant's property unless he has permission of adjoining landowners; LAND OF BEGINNINGS PRINTED ON RECYCLED PAPER 3. Movement of material from seaward of the low water line will not be permitted under this exemption; 4. The activity must not significantly increase erosion on neighboring properties and must not have a significant adverse effect on important natural or cultural resources; 5. The activity may be undertaken to protect threatened on -site waste disposal systems as well as the threatened structure's foundations. Additional Beach Bulldozing Conditions 6. This exemption authorizes a one-time beach bulldozing operation to protect an imminently threatened structure, as defined in 15A NCAC 07H .0308(a)(2)(B). 7. Bulldozing equipment must be brought onto the beach at 24040 Dean Avenue, not across existing dunes/berm(s) or unauthorized private property. Contact the KID Jackson at 252-475-5879 to advise crossing location and expected dates of work. 8. A copy of this authorization shall be posted or available on site. Contact KID Jackson the Frisco office at 252-475-5879 for a final inspection at completion of work. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization and N.C. Building Permits.
