Dear Mr. & Mrs. Hoggard:
I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for
a minor development permit under the Coastal Area Management Act. I have determined that the activity you propose is
exempt from needing a minor development permit as long as it remains consistent with your site drawing and application
submitted on February 29, 2024, and meets the conditions specified below. If your plans should change and your project
will no longer meet these conditions, please contact me before proceeding.
MAINTENANCE AND REPAIR — [G.S.113.103(5)(B)(5) and 15A NCAC 7K.0103(a)] - Maintenance and repairs
(excluding replacement) necessary to repair damage to structures caused by the elements are specifically excluded from
the definition of development under the conditions and in the circumstances set out in G.S. 11 3A-1 03(5)(b)(5). Individuals
required to take such measures within an AEC shall contact the local CAMA representative for consultation and advice
before beginning work.
Structures may be repaired in a similar manner, size and location as the original structure. No expansions or additions are
permissible. The repairs are limited to 50% of the market value of the existing structure and the following specific
conditions.
1. The project consists of elevating an existing dwelling within the existing footprint with no expansions, as shown on
the attached drawing and application.
2. The proposed repairs shall be consistent with all other applicable local ordinances and North Carolina Building
Code standards.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or
Local authorization and N.C. Building Permits. This exemption expires 90 days from the date of the letter.

Cynthia,
As you know Able Marine has been hired by Andrew and Laura
Hoggard to lift their house, install new pilings and construct a new
girder system for the house. The house is located at 116 Cypress
Road, Merry Hill, NC 27957, aka Lot 27, Blackbeard Beach
Subdivision, Whites Township, Bertie County. Attached please find
the following documentation:
1. Executed CAMA Agent Authorization Form;
2. Completed CAMA Minor Permit Application;
3. Attachment to CAMA Minor Permit Application of Site Plan. This
site plan was attached in the ARPO letters hand delivered to Harry
V. Thompson and the Black Beard Beach Homeowners group.
4 & 5. Attachments of marked up tax department aerial maps that
were attached to the ARPO letters showing their ARPO's properties
and the Hoggard property.
6 & 7. Copies of the letters that were hand delivered to the
adjacent property owners, Harry Thompson & the Black Beard
Beach Homeowners group are attached and were signed by the
appropriate parties. The proposed project to elevate the house was
explained and they were told the house would remain in the same
footprint.
I will drop the check by to you in the amount of $100.00 sometime
tomorrow. Please let me know if you need any additional

I just received an email from Cynthia that she is out of the office on
an extended leave of absence and to contact you for assistance. I
had been talking with Cynthia about this project and finally was able
to send her a CAMA Minor Permit Application and supporting
documentation on the February 27th. A prior CAMA Permit had
been issued but expired on December 31, 2024. The Hoggards
thought it was a permit to elevate the house but we found out it was
for the construction of a fence.
So, I am forwarding my email to Cynthia to you. I will drop the
check off later today when I leave work. Please call me if you have
questions or need anything further. Thank you.

Good Afternoon Ron,
You are correct. There are no plans for any additions or to expand
the house. It will remain in the existing footprint. Further there are
no plans to rebuild the laundry room that is currently exists on the
ground floor due to Bertie's flood regulations.

any permit. Any person developing in an AEC without permit is subject to civil, criminal and administrative action.
