Dear Mr. Mohr,
I have reviewed your inquiry concerning the necessary filing of an application for a minor development
permit under the Coastal Area Management Act (CAMA). I have determined that the activity you propose is
statutorily exempt from needing a minor development permit.
ACTIVITIES NOT DEEMED DEVELOPMENT - [G.S. 113-103(5)(b)(2)] –Work by a water or other utility
company for the purpose of inspecting, repairing, maintaining, or upgrading sewers, mains, pipes, and the
like on existing utility property or rights of way, or the extension of any of the above distribution related
facilities, are excluded from the definition of development as set out in G.S. 113A-103(5)(b)(2). Individuals
required to take such measures within an AEC shall contact the local CAMA representative for consultation
and advice before beginning work. This exemption letter is valid provided the project meets the conditions
specified below. If your plans should change and your project will no longer meet these conditions, please
contact me before proceeding.
1. The project consists of construction of two underground concrete vaults and installation of
valves and flow meters on the existing ONWASA water main.
2. The project shall be contained within the 20-foot water main easement on 410 Marina Way,
North Topsail Beach, NC 28460, adjacent to the Atlantic Intercoastal Waterway.
3. All unconsolidated material resulting from associated grading and landscaping shall be
retained on site by effective sedimentation and erosion control measures. Sedimentation and
erosion control measures shall be properly maintained throughout the construc tion period.
4. No excavation or fill of wetlands is authorized.
5. The Permittee and/or the Permittee’s Authorized Agent shall be responsible for obtaining all
necessary authorizations, approvals, or zoning and building permits from the local government
having jurisdiction (Town of North Topsail Beach and/or Onslow County) prior to commencing
work.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other
State, Federal or Local authorization and N.C. Building Permits. This exemption expires 90 days from the
date of the letter.
