HomeMy WebLinkAbout39-24 Burns, Fred Exemption Number – EX 39-24 May 10, 2024 Fred Burns 2389 New River Inlet Road North Topsail Beach, NC 28460 RE: EXEMPTED PROJECT (Statutory Exclusion) – REDISTRIBUTION OF SAND CONSIDERED MAINTENANCE - [G.S. 113-103(5)(B)(5) and 151 NCAC 7K.0103(c)] PROJECT ADDRESS – 2389 New River Inlet Rd, North Topsail Beach NC AREA OF ENVIRONMENTAL CONCERN – Ocean Hazard AEC – Inlet Hazard Area Dear Mr. Burns, I have reviewed your inquiry concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. After making a site inspection on May 8, 2024, I have determined that the activity you propose is exempt from needing a minor development permit as long as it meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. 1. The project consists of removing sand from the privately-owned portion of New River Inlet Road, between 2346 New River Inlet Road and the northern terminus at the cul-de-sac. 2. Clean beach-quality sand may be redistributed to 2389 New River Inlet Road with the property owner’s permission. Sand contaminated with gravel shall be redistributed to 2369 New River Inlet Road with the property owner’s permission. 3. The proposed repairs shall be consistent with all other applicable local ordinances and North Carolina Building Code standards. 4. No excavation or land disturbing activity shall occur outside the approximate 30’ width of New River Inlet Road, or the cul-de-sac. 5. Sand may not be redistributed oceanward of the existing natural dune toe, or man-made sand- bag line. 6. Sand may not be redistributed into any wetlands. 7. The Permittee and/or the Permittee’s Authorized Agent shall be responsible for obtaining all necessary authorizations, approvals, or zoning and building permits from the local government having jurisdiction (Town of North Topsail Beach and/or Onslow County) prior to commencing work. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization and N.C. Building Permits. This exemption expires 90 days from the date of the letter.
