This permit, issued on fiPntemhPr 2, 2003 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Shoreline Stabilization
1) The alignment of the permitted bulkhead must be staked by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of any construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.
2) The bulkhead will not extend waterward more than 2 feet from the normal water level at any point along
its alignment at the time of construction.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) The bulkhead must be constructed prior to any backfilling activities.
4) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the
structure.
5) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation is permitted except for that which
may be required for the construction of the authorized bulkhead wall, riprap, deadmen cables, etc.
6) The backfill material will be clean and free of any pollutants except in trace quantities.
7) All backfill material will be obtained from a high ground source and confined behind the permitted
bulkhead.
8) No backfill material is to be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
9) All fill material to be placed below normal water level will be confined behind the permitted bulkhead.
Concrete Boat Ramps
10) The concrete boat ramps must be poured on high ground and pushed or placed into the water once
hardened. No live concrete may come into contact with the water.
Boardwalk and Walkways
11) In accordance with 07H .0209(d)(10), any portions of the permitted boardwalk or walkways constructed
30 feet landward of the normal water level (Public Trust Shoreline AEC) shall be elevated, slated and
made of wood. The boardwalks must not exceed six feet in width.

12) This permit authorizes only the boardwalk and piers, and other structures located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, may become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification.
13) The piers and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge.

14) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
15) The authorized structure and associated activity must not cause an unacceptable interference with
navigation.
16) The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
17) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
18) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
19) This permit authorizes no permanent boat dockage.
Upland Development
20) All excavated materials resulting from clearing and grading activities will be confined above mean high
water, landward of regularly or irregularly flooded marsh and behind adequate retaining structures to
prevent spillover of solids into any marsh or surrounding waters.
NOTE: The Department of Environment and Natural Resources, Land Quality Section approved of this
project on 10/18/02 and 7/15/03.
21) In order to protect water quality, runoff from construction must not visibly increase the amount of
suspended sediments in adjacent waters.
22) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, sand fence, etc.).
Stormwater Management
23) The N.C. Division of Water Quality approved this project under stormwater management rules of the
Environmental Management Commission under Stormwater Permit No. SW7030611 on 8/11/03. Any
violation of the permit approved by the DWQ will be considered a violation of this CAMA permit.

General
24) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
25) No vegetated wetlands will be excavated or filled outside of the area indicated on the attached workplan
drawings.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3400 (DWQ Project No. 030917), which was issued on 8/25/03.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No.
1978001256, General Permit No. 197800080, and Nationwide Permit No. 18 (COE Action Id.
No.200310877) which was issued on 7/23/03.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original(buff-colored form) is retained by you
and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of
appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1 or 113-
229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on
your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit
within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the
final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out
in accordance with your application. Modifications, time extensions, and future maintenance require additional approval.
Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work
done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. By
working in accordance with the permit,you will be helping to protect our vitally important coastal resources.

8. PROJECT SUMMARY: Construct bulkhead, boatramps, access piers, gazebos, boardwalks,
softball fields, tennis courts, volleyball courts, paved parking and bath house at County's 25-acre
Southern Park site in Point Harbor adjacent the Currituck Sound.
Project Setting
The County of Currituck owns a 24 1/2 - acre parcel of undeveloped land, formerly in
agricultural use, in Point Harbor, Currituck County, adjacent the Currituck Sound. The parcel
fronts the Currituck Sound a distance of 485 linear feet. To access the parcel turn east off US
Highway 158 onto a 10" wide soil road located 1.4 miles north of the Wright Memorial
Bridge. The developable portion of the 500' wide flag-shaped parcel starts 750' from the edge
of pavement on US Highway 158 and extends another 1,900' to the Normal Water Level
(NWL) of Currituck Sound.
Elevation of the tract ranges 1' - 9' above Mean Sea Level. Vegetation noted growing within
the level areas formerly under cultivation and along the 7' high bank located 6' - 10' landward
of NWL includes Loblolly Pine (Pinus taeda), Atlantic White Cedar (Chamaecyparis thoides),
Wax Myrtle (Myrica cerifera), Greenbriar (Smilax spp.) and Common Reed (Phagmites
Australis). Scattered and unstable fronds of Salt Meadow Hay (Spartina patens) were noted
growing around chunks of old concrete riprap located along the shoreline. The poorly
maintained riprap located along the shoreline was the only man-made feature noted within the
subject property.
Bank elevation and vegetation found along the unprotected shorelines of the neighboring
properties are similar to those noted on the County's parcel. However, the adjacent
escarpments exhibit a more severe slope and the presence of wetland vegetation was not noted
anywhere along the adjacent shoreline.
The waters of Currituck Sound in the vicinity of the project are classified as SC by the NC
Environmental Management Commission. These waters are classified as Joint Fishing Waters
by the NC Marine Fisheries Commission and NC Wildlife Resources Commission and as
Estuarine and Public Trust Waters by the NC Coastal Resource Commission. Water depths in
the project area (out to 123' in the Sound) measure .5' - 3.0' below NWL. The presence of
submerged aquatic vegetation was not noted in the vicinity of the project. Review of available
information suggests that there are no known archeological sites or geological formations
associated with the applicants' property.
Project Descri tp ion
Currituck County proposes to construct the following:
• Four hundred nineteen (419) linear feet of wooden/vinyl bulkhead a maximum distance of
2' waterward of the NWL and an average distance of 1'.
• Two 17' wide by 40' concrete boat ramps by placing the concrete on unexcavated bottom.
• Three access piers adjacent to the double boat ramp (two 4' x 40' piers and a 6' wide by

123' pier on the north side which will angle to the north).
• A 6' x 370' long wooden slatted boardwalk just landward of and parallel to the bulkhead.
• Four 314 square-foot hexagonal gazebos 2' -3' landward of the 30' buffer and four 6' wide
boardwalks averaging 11 linear feet in length to connect the gazebos to the 370' long shore
parallel boardwalk.
• An asphalt drive immediately landward of the concrete boat ramps (3,715 sq ft of asphalt is
proposed within the Estuarine Shoreline AEC).
• On highground, outside the .Estuarine Shoreline AEC, softball fields, tennis courts,
volleyball courts, playing fields, 128 parking spaces, 28 trailer spaces, 30' x 36' bathhouse
and a 50' x 100' fenced playground.
• A one-mile long 6' wide asphalt walkway, which will surround the tennis and volleyball
courts and the two multi-purpose playing fields.
Anticipated Impacts
• The construction of the 419' long wood/vinyl bulkhead and associated backfilling would
eliminate 50 square feet of Coastal Wetlands vegetated with Salt Meadow Hay (Spartina
patens).
• The construction of the bulkhead and two boat ramps would result in the filling of 1,780
square-feet of Estuarine/Shallow Water Habitat.
• The construction of the 3 access piers would shade 1,094 square-feet of Estuarine/Public
Trust Waters.
• The construction of an asphalt driveway landward of the concrete ramps, four gazebos, and
a 23' long section of 6' wide asphalt walkway would create 4,976 square-feet of
impervious surface within the Estuarine Shoreline AEC. Resultant lot coverage would
equal 13.6%.
• The construction of the park facilities outside the Estuarine Shoreline AEC will result in
the disturbance of 900,000 square feet of uplands.

Currituck County Southern Park-Major CAMA Permitting
Project Narrative-Revised June 25,2003
The subject property consists of approximately 24.57 acres of buildable land located in Point Harbor,
approximately 1.4 miles north of the Wright Memorial bridge in mainland Currituck County. The
property, owned by the County of Currituck, lies at approximately 36°05'35"N latitude and 75°47'58" W
longitude. The land is currently undeveloped, but a former land use includes agriculture. The property
includes approximately 485 linear feet(If) of frontage on the Curritck Sound. Much of the land is clear
of natural vegetation,but existing vegetation includes Pinus taeda, Chamaecyparis thyoides, myrica
cerifera, Smilax spp., Phragmites australis and Spartina patens.
Currently existing along the shoreline is rip rap for shoreline stabilization. The rip rap is located at
approximately normal water level and mostly consists of broken concrete slab. There is an area of the
shoreline towards the north side of the property that does not contain rip rap and has a noticeable higher
erosion rate than the rest of the shoreline. Soils on the property consist of Conetoe loamy sand and
Munden loamy sand according to the Currituck County USDA Soil Survey. The average elevation on the
tract is approximately 8 ft above mean sea level. Elevations gradually decrease towards the Sound
throughout the majority of the property, but there is a more distinct slope immediately adjacent to the
shoreline. With a fetch greater than three miles, this northeast facing shoreline is susceptible to
moderately heavy seas during northeast wind events.
Currituck County is planning a public park on the subject property as shown on sheet one that includes
sporting fields,tennis courts,bath house,boat ramps,parking,bulkhead, walkways and gazebos. Work
requiring Major CAMA permitting includes everything within the 75 ft estuarine area of environmental
concern (AEC) including the boat ramps, a portion of the driveway,bulkheading,wood walkways and
pier and covered gazebos. There are two proposed boat ramps with slotted wood piers on both sides and
in between. The wood pier on the north side of the boat ramps extends approximately 123 ft waterward
of NWL. The purpose of this pier is for a temporary mooring area and boat access for recreational
purposes.The pier can also be used for line fishing and crabbing. Water depths were taken on May 1,
2003 by Quible and DCM. The normal water depth at the end of this proposed pier is approximately 3.5
ft deep. The boat ramps extend 40 ft waterward of NWL and slope down to the existing bottom depth of
3.1 ft at the end of the proposed ramps. Both ramps are proposed to be 17 ft wide. The bulkhead is
proposed to approximately lie along NWL with a total length of 419 If. The proposed alignment is
depicted on the site plans. Bulkhead backfill will come from sandy material located on the property. No
material will have to be brought in from an off-site location. According to DCM.There will be no
measurable disturbance to coastal wetlands in association with this proposed bulkhead construction in the
alignment shown. The minor presence of wetland vegetative species (Spartina patens and Phragmites
australis) is primarily located on sandy embankments above areas of normal flooding. There is a pile
supported wood walkway proposed on the landward side of the bulkhead. There are four proposed wood
gazebos with roofs and open sides. The total impervious coverage within the 75 ft AEC is 4,976 SF
(13.6%). No channel dredging is proposed in association with this project.

The Washington Regional Office --received the completed
Stormwater Application for the subject project on June 16, 2003.
Staff review of the plans and specifications has determined that
the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding
Permit No. SW1030611 dated August 11, 2003 to Currituck County for
grassed swales and an infiltration basin to serve Currituck County
Southern Park located in Currituck County, NC.
This permit shall be effective from the date of issuance until
August 11, 2013 and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to
the Operation and Maintenance requirements in this permit. Failure
to establish an adequate system for operation and maintenance of
the stormwater management system will result in future compliance
problems.
If any parts, requirements, or limitations contained in this
permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form
of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447 .
Unless such demands are made this permit shall be final and

4. No homeowner/lot owner/developer shall be allowed to fill in,
alter, or pipe any vegetative practices (such as swales) shown
on the approved plans as part of the stormwater management
system without submitting a revision to the permit and
receiving approval from the Division.
5. The following items will require a modification to the permit:

In addition, the Director may determine that other revisions
to the project should require a modification to the permit.
6. The Director may notify the permittee when the permitted site
does not meet one or more of the minimum requirements of the
permit. Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the Director
for modifying the site to meet minimum requirements. The
permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have
been. made.
II. SCHEDULE OF COMPLIANCE
1 . The permittee will comply with the following schedule for
construction and maintenance of the stormwater management
system.
a. The stormwater management system shall be constructed in
its entirety, vegetated and operational for its intended
use prior to the construction of any built-upon surfaces
except roads.
b. During construction, erosion shall be kept -to a minimum
and any eroded areas of the system will be repaired
immediately.

l 2. The facilities must be properly maintained and operated at all
times. The approved Operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the
scheduled intervals.
3. The permittee shall at all times provide the operation and
maintenance necessary to assure the permitted stormwater
i system functions. at optimum efficiency including, but not
limited to:

a. Semi-annual scheduled inspections (every 6 months)
b. Sediment removal
C. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved
plans and specifications
f. Debris removal and unclogging of outlet structure,
orifice device and catch basins and piping.
4. Records of maintenance activities must be kept and made
available upon request to authorized personnel of DWQ. The
records will indicate , the date, activity, name of person
performing the work and what actions were taken.
5. This permit shall become voidable unless the facilities are
constructed in accordance with the conditions of this permit,
the approved plans and specifications, and other supporting
data.
6. Upon completion of construction and prior to operation of this
permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that
the permitted facility has been installed in accordance with
this permit, the approved plans and specifications, and other
supporting documentation. Mail the Certification ' to the
Washington Regional Office, 943 Washington Square Mall,
Washington, North Carolina, 27889, attention Division of Water
Quality.
7. A copy of the approved plans and specifications shall be
maintained on file by the Permittee for a minimum of five
years from the date of the completion of construction.
III . GENERAL CONDITIONS
This permit is not transferable. In the event there is a
desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be
submitted to the Division of Water Quality accompanied by an
application fee, documentation from the parties involved, and
other supporting materials as may be appropriate. The
approval of this request will be considered on its merits and
may or may not be approved.
2. Failure to abide by the conditions and limitations contained
in this permit may subject the Permittee to enforcement action
by the Division of Water Quality, in accordance with North
Carolina General Statute 143-215. 6 (a) to 143-215. 6 (c) .
3. The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government

agencies (local, state, and federal) which have jurisdiction.
4. In the event that the facilities fail to perform
satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as
the construction of additional or replacement stormwater
management systems.
5. The permit may be modified, revoked and reissued or terminated
for cause. The filing of a request for a permit modification,
revocation and reissuance or termination does not stay any
permit condition.

I have reviewed the proposal and CRC Rules T15A:07H.0206 (Estuarine Waters), 07H.0207
(Public Trust Areas) and 07H.0209 (Coastal Shorelines). The proposal appears consistent with
all Use Standards. If a permit is issued, I recommend that the following conditions be
incorporated into the permit.
Boat Ramp/Access Piers
1) This permit authorizes only the construction of the docks, piers and ramps and uses located in
or over the water that are expressly and specifically set forth in the permit application. No
other structure, whether floating or stationary, may become a permanent part of this facility
without permit modification. No non-water dependent uses of structures may be conducted
on, in or over public trust waters without permit modification.
2) The authorized boat ramps shall not exceed a width of 17 feet and shall not extend greater
than 40 feet waterward of the normal water level contour. To ensure compliance with this
condition, a representative of the Division of Coastal Management (DCM) must approve the
waterward limit of the boat ramp.
3) The concrete boat ramp must be poured on high ground and pushed or placed into the water.
No live concrete may come in contact with the water.
4) This permit does not authorized excavation in any manner, including "kicking" with boat
propellers.
5) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.

6) The authorized structure and associated activity must not cause an unacceptable interference
with navigation.
7) The permittee will maintain the authorized work in good condition and in conformance with
the terms and conditions of this permit. The permittee is not relieved of this requirement if
he abandons the permitted activity without having it transferred to a third party.
8) This permit does not authorize the interference with any existing or proposed Federal project,
and the permittee will not be entitled to compensation for damage to the authorized structure
of work, or injury, which may be caused from existing or future operations undertaken by the
United States in the public interest.
9) The permittee must install and maintain at his expense, any signal lights or signals prescribed
by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a
minimum, permanent reflectors should be attached to the structure in order to make it more
visible during hours of darkness or inclement weather.
NOTE: This permit does not authorize the placement of mooring pilings in association with
the public ramps/access facility.
10)The pier and associated structures shall have a minimum setback distance of 15 feet between
any parts of the structure and the adjacent property owner's riparian access corridor, which is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the
channel line that intersects with the shore at the point where the upland property line meets
the water's edge.
Shoreline Stabilization
1 The alignment of the authorized bulkhead must be staked by a representative of the Division
of Coastal Management within a maximum of 30 days prior to the start of any construction.
Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather
conditions, will require the alignment to be restaked by DCM within a maximum of 30 days
prior to the new expected start of construction.
T2)The bulkhead will not extend waterward more than 2 feet from the normal water level at an

point along its alignment at the time of construction.
13)The bulkhead must be constructed prior to any backfilling activities.
14)The bulkhead must be structurally tight so as to prevent seepage of backfill materials through
the structure.

15)The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles
or other suitable materials approved by Department personnel. No excavation is permitted
except for that which may be required for the construction of the bulkhead wall, riprap,
deadmen cables, etc. This permit does not authorize any excavation waterward of the
approved alignment.
16)The fill material will be clean and free of any pollutants except in trace quantities.
17)All backfill material will be obtained from a high ground source and confined behind the
permitted bulkhead.
18)No vegetated wetlands will be excavated or filled.
19)No fill material will be placed at any time in the surrounding waters outside of the alignment
of the fill area indicated on the workplan drawings.
20)The temporary placement or double handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
Sedimentation and Erosion Control
21)In order to protect water quality, runoff from construction must not visibly increase the
amount of suspended sediments in adjacent waters.
22)Appropriate sedimentation and erosion control devices, measures or structures must be
implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses
and property(e.g. silt fence, diversion swales or berms, etc).
23)All disturbed areas shall be properly graded and provided a ground cover sufficient to
restrain erosion within thirty days of project completion.
Upland Development
24)The authorized upland development associated with construction of the park facilities shall
be done in accordance with the attached workplan drawings.
25)The fill material will be clean and free of any pollutants except in trace quantities.
26)No excavated or fill material will be placed at any time in any vegetated wetlands or
surrounding waters.

27)All excavated materials resulting from clearing and grading activities will be confined above
mean high water, landward of regularly or irregularly flooded marsh and behind adequate
retaining structures to prevent spillover of solids into any marsh or surrounding waters.
General
28)This permit does not eliminate the need to obtain any additional State, Federal or Local
permits, approvals or authorizations that may be required. This includes any permits that
may be required by the NC Division of Water Quality, Stormwater Management Section.
29)The permittee understands and agrees that, if future operations by the United States requires
the removal, relocation, or other alteration of the structure or work authorized by this permit,
or if in the opinion of the Secretary of the Army or his authorized representative, said
structure or work shall cause unreasonable obstruction to free navigation of the navigable
waters, the permittee will be required, upon due notice from the Corps of Engineers, to
remove, relocate or alter the structural work or obstructions caused thereby, without expense
to the United States or the State of North Carolina. No claim shall be made against the
United States or the State of North Carolina on account of any such removal or alteration.
NOTE: Future development of the permittee's property may require a modification of this
permit. Contact a representative of the Division of Coastal Management at (252) 264-3901
prior to the commencement of any such activity for this determination.
NOTE: The permittee and/or permittee's contractor is urged to meet with a representative of
the Division of Coastal Management prior to project initiation.

The NC Division of Coastal Management hereby acknowledges receipt of your application on
June 16, 2003, for State approval for the development of the referenced project. An initial
screening of the submittal package has been conducted. This revealed certain deficiencies, which
must be corrected before the application package can be accepted as complete. To assist you in
expediting the permitting process as much as possible, I am notifying you of these deficiencies
immediately so that they can be quickly corrected to facilitate the detailed review by the Field
Representative.
Because the deficiencies are easily correctable, I am not returning the original application
package. Please make the needed changes, and submit the appropriate documentation. With the
retained copy of the application, the Field Representative can commence the detailed review.
Please understand that the subsequent detailed review may reveal additional areas where further
information or documentation is required to demonstrate compliance with the rules directly
applicable to the proposed development. If this occurs, you will be notified of such issues
separately by the Field Representative.
Our initial screening has identified the following deficiencies:
1. The appropriate application forms must be submitted. On the DCM-MP-1 Form, you
have indicated that one of the attachments to the application is the DCM-MP-6 Form for
Marina Development. However, no DCM-MP-6 Form was attached, and neither the
narrative, nor the plat indicate any marina development. Please clarify this matter.
2. Not all questions on the application have been answered, or indicated as "not applicable."
Please address the following item: Form DCM-MP-3, Item "m," about water
impoundment.
3. Adequate Work Plans or Drawings have not been submitted. Please address the following
items:
■ When drawings are larger than 11 inches by 17 inches, 29 copies must be
provided; I note from your transmittal document that these copies will be
provided once all corrections have been made and the package is ready for
distribution.
■ A Plan View must be submitted that:

- Indicates Marshlands. The plat does not reflect any coastal wetlands, and
Item "1" of the DCM-MP-1 Form indicates that there are no wetlands on
the site; yet, Item "e" of this Form indicates that one of the coastal
wetland species, Spartina patens exists on the tract. It is possible that this
plant exists at an elevation beyond where occasional flooding would
occur, and therefore not constitute a Coastal Wetland Area of
Environmental Concern. Please clarify this point.
- Indicates Adjacent Property Owners' Names; the application indicates
that Babette K. Lewis is a riparian property owner, but the plat indicates
Point Harbor Beach Subdivision. Please clarify this discrepancy.
- Establishes adequacy of Bulkhead or Dike to Confine Fill Material; I
note that no filter cloth is indicated to be placed landward of the
bulkhead. Is it intended to rely solely on the Vinyl Bulkhead to confine
the fill material?
4. A letter is needed that documents your authorization to act as agent for the applicant.
5. Documentation of Notification of Riparian Property Owners must be provided. Please
submit Certified Return-Mail Receipts for this notification once they have been received.
To expedite our response to your permitting request, we will commence the detailed review of
your application for a permit pending the receipt of the additional information requested above.
However, the statutorily provided 75/150 days allowed for review cannot commence until such
time as we have received a complete application package. Once your application has been
accepted as complete, you will receive a separate notification letter.
I am also sending a copy of this letter to you by Fax to try to expedite the review process. New
procedures provide for the processing clock to not be suspended if we receive a reply from you
within 3 working days of the Fax, or within 5 working days from the date of this letter, that
provides adequate responses to the issues that have been raised.

Dear Mr. Harrell:
As the attached form would indicate I have returned the letter stating that I have no
serious objection to the construction of the above project.
I do, however, have a concern about an escalating erosion problem of my adjoining
property. As I understand the proposal a seawall or bulkhead will be constructed on the
county park property. My problem is, if the bulkhead stops at the property line and I do
not have a wall or bulkhead, I feel that the water would wash around the end and escalate
an erosion problem for my property. This would be worsened with a Northeaster storm
which this area has frequently.
As we discussed on the phone on Monday, I would like to apply for a permit to install
riprap to protect my property. This, however, will take time in the due process of
submitting forms and finding a contractor, etc. In the meantime, I would hope that the
county has a short term solution to my concern. I spoke with Jason Weeks today and he
assurred me that the county would do everything possible to eliminate this problem.
I told Jason I would be in the area in July and would stop by his office to discuss this as
the final plans are drawn up.

The Department of Environment and Natural Resources hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an Area of

Dear Mr. Rubino:
The Division of Coastal Management hereby acknowledges receipt of your
application for State approval for development of property located at 1.4 miles north of
Wright Memorial Bridge, East of US Hwy 158, Point Harbor, Currituck County, and
adjacent Currituck Sound. It was received on July 16, 2003, and appears to be adequate
for processing at this time. The projected deadline for making a decision is October 6,
2003. An additional 75-day review period is provided by law when such time is necessary
to complete the review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from July 16, 2003,
you may request a meeting with the Director of the Division of Coastal Management and
permit staff to discuss the status of your project. Such a meeting will be held within five
working days from the receipt of your written request and shall include the property owner,
developer and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location
of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along
the road right-of-way fronting your property; or at a point along the road right-of-way where
a private road would lead one into your property. Failure to post this notice could result in
an incomplete application.
