Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) The authorized boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. Footprint of the authorized boathouse shall not exceed 624 square feet. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Signature of Permittee Dorcy Gene Belcher Permit#15-03 Page 2 of 3 ADDITIONAL CONDITIONS 3) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 4) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 6) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 8) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) This permit authorizes a maximum of two boat slips. NOTE: It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all'proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. General 10) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall.cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: Should either adjacent property be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to project initiation. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3371 (DWQ Project No. 021901), which was issued on 1/7/03. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 197800056 (COE Action Id. No. 200310231) which was issued on 1/7/03. PROJECT SUMMARY: The applicant proposes to construct a 624 square foot boathouse and 3' x 24' shore-parallel dock. e Dorcy Gene Belcher Field Investigation Report Page Two Project Setting The site of the proposed development is located at 125 Courtney Lane (an unimproved soil road) in Moyock, Currituck County adjacent to the Currituck Sound. Man-made features noted on the 40,000 square-foot residential property include a residence, garage, 192' long wooden bulkhead, and a 15' wide concrete boat ramp. Each of the abutting properties has been similarly developed with a residence and bulkheaded shoreline. To access the site turn off US Highway 168 onto Tulls Creek Road (SR 1122). Travel 3 miles then turn onto Launch Landing Road, then onto Tice Road, then onto Courtney Lane. The applicant's property is located at the east end of the first driveway off Courtney Lane. The waters in the vicinity of this project are classified as SC by the NC Environmental Management Commission. These waters are classified as Joint Fishing Waters by the NC Marine Fisheries Commission and NC Wildlife Resources Commission and as Estuarine and Public Trust Waters by the NC Coastal Resources Commission. Water depths in the project area (out to 29' beyond the bulkhead) measure 3.8' - 4.0' below normal water level. The presence of submerged aquatic vegetation was not noted within the project area. Review of available information suggests that there are no archeological or geological formations associated with the applicant's property. Project Descri tp ion Mr. Belcher is applying for a CAMA Major Permit since the boathouse he wishes to construct exceeds the 400 square-foot maximum allowed by CAMA's General Permit authorization. The larger boathouse would provide protection for his 24' long Suntracker pontoon boat and his 14' long Dargel runabout. The applicant proposes to construct the following: • A 624 square-foot boathouse with 2 boatlifts and with half walls on the north and south sides. The 24' x 26' dimensions include roof overhang. • A 3' x 24' shore-parallel dock between the boathouse and the existing bulkhead. • The boathouse is proposed two feet from the common adjacent riparian property line shared with Mr. Cassell Basnight; who has agreed to waive the 15-foot setback. Anticipated Impacts • The proposal will result in the capture and shading of 696 square-feet of Estuarine/Public Trust Waters. • A temporary increase in turbidity will occur during construction of the boathouse and dock. • Two additional slips are proposed. The proposed boathouse and cross-walk and two boat-lifts will serve the following purposes: provide protection for the boats from the weather which can be severe in and around Currituck Sound; wave action and wakes from large boats using the nearby Intercoastal Waterway precludes tieing the boats to pilings (for storage); the boat lifts will eliminate launching and retrieving either boat from a trailer. At my present age (70) this task is becoming more stressful and launching/retrieving from a trailer may soon be too difficult. Given the above facts the proposed boathouse should extend my years of boating. The boathouse and cross-walk will be constructed to withstand hurricane force winds and resultant wave action. A hip-style roof will provide added strength. Eight inch round pilings will be tied to joists and girders with 3/4 inch stainless steel bolts. The proposal appears consistent with all Use Standards. If a permit is issued I recommend that the following conditions be incorporated into the permit. Boathouse and Dock 1. This permit authorizes only the boathouse and dock and uses located in or over the water that are expressly and specifically set forth in the permit application and depicted in the attached workplan drawings #1 through 43, dated received 12/05/02. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non- water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2. The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The boathouse shall not be designed for second story use. 3. No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 5. The authorized structure and associated activity must not cause an unacceptable interference with navigation. 6. The permittee must install and maintain at his expense any signal lights or signals prescribed by the US Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. General 7. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8. The permittee understands and agrees that if future operations by the United States requires that removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional permits, approvals, or authorizations that may be required.
