Coastal Resources Commission for development in an Area of Environmental Concern
pursuant to the Coastal Area Management Act, Section 113A-118 of the General Statutes.
Issued to Dare County & the Stumpy Point Community Center, authorizing development in the Estuarine Shoreline
(AEC) at 249, 251, & 253 Bayview Dr., Stumpy Point, Dare County, as requested in the permittee's application dated
01/16/2024 and received complete on 04/29/2024. This permit, issued on 05/03/2024, is subject to compliance with the
application and site drawing (where consistent with the permit), all applicable regulations and special conditions and
notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may
cause the permit to be null and void.
This permit authorizes the addition of fill, landscaping border, and equipment for playground area.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat drawing
dated 03/26/2024 and received on 03/27/2024. [GS 113A-120]
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.[GS 113A-120]
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit. [GS 113A-120]
(4) A copy of this permit shall be posted or available on site. Contact this office at 252-621-6453 for a final inspection at
completion of work. [GS 113A-120]

This permit action may be appealed by the permitlee or other qualified persons
within twenty (20) days of the issuing date. This permit must be on the project
site and accessible to the permit officer when the project is inspected for
compliance. [GS 113A-1201 Any maintenance work or project modification not
covered under this permit, require further written permit approval. All work must
cease when this permit expires on: DECEMBER 31, 2027
In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of Normal Water Level (NWL)
(Estuarine Shoreline Area of Environmental Concern), in this case, 0 square feet is requested and/or authorized.

(6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of NWL. [07H .0209(d)(10)]
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover. [07H .0209(d)(3)]
(8) Any proposal for grading within the 30' buffer from the NWL must be contoured to prevent additional stormwater
runoff to the adjacent marsh or waterbody. This area shall be immediately vegetatively stabilized, and must remain
in a vegetated state. [07H .0209(d)(3)]
(9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion. [GS 113A-120]

TIPS FOR ADJACENT RIPARIAN OWNER NOTIFICATION
CAMA Regulations require notice of proposed development to the Adjacent Riparian Property Owners (15A NCA.0
7J,0204(b)(5)), Proof of actual notice (a slgn-off by the owner on this form) or certified mail return receipts (showing
dishvey of notice) are needed, or any other mothod which satisfies the Local Permit Officer (LPO) that a good fault effort
has been made to provide notice.
The purpose of this notice is to malco adjacent riparian property owners aware of the proposed development so drat they
have an opportunity to provide comments (or potentially object to) the proposed development, and to give DCM or the
LPO an opportunity to consider these oomments/objections before a permit decision is made. 'Termission" of adjacent
nropet owners is not neooss0 •i� ly rog iu red for DCM or the LPO to Issue a permit. It is in the applicant's best interest to
provide comprehensive and accurate notice so that any concerns or objections can be resolved early in the permit rovlew
process, In addition, if the adjacent riparian property owner appeals the permit decision, insuffiolent notice could be a
basis for granting such an appeal.
Who Is [in Adjacent Riparian Property Owner?

• A property that fronts a natural or mannrado waterbody that is comrected to coastal waters and can support some

What Is Riparian?
Do the boundaries of the adjacent property legally Intersect with the water at mean high tlde? If there is a question about
whether an adjacent property Is considered "riparian," please reach out to DCM Staff or the LPO- especially on the
oceanfront beach where there may be undeveloped parcels on the beach or in the water.
Who/What Is a Property Owner?
For private Individuals (or families), send notice to the address listed on the tax card. N the property is owned by an Ina,
or LLC, please send notice to the person listed as the registered agent on the NC Secretary of State's Corporations Look

(HOMPOA), send notice io the association (which is usually a corporation, for which you send notice to Its registered
agent).
What Is Notice, and how do I onsure it is received?
• You call meet with your adjacent property owner, provide a description or drawing of the proposed development,
and ask them to sign this form and return it to DCM or -the LPO; OR
• You can hand -deliver this form and a description or drawing, and ask your neighbor to return It to ACM or the
LPO (consider providing them with a stamped envelope); OR
• You can muil this form by USPS Certified Mail, return receipt requested (the Green Card), If you choose this
option, your must provide either the signed & returned green card OR track the certified mail package number on
USPS,GOV's onllne tracking system, and provide the tracking pr9nt•out as proof of delivery to DCM or the LPO

The attached permit constitutes authorization under the Coastal Area Management Act
for Dare County to proceed with the project proposal of the Stumpy Point Playground
area. Please print, review, sign and return a copy to this office for our records. You must
have a copy available on site when the project is inspected for compliance.
The project plan is subject to those conditions appearing on the permit form. Otherwise,
all work must be carried out in accordance with your application. Modifications, time
extensions, and future maintenance require additional approval. Please read your permit
carefully prior to starting work and review all project plans, as approved. If you are having
the work done by contractors, it is to your benefit to be sure that they fully understand all
permit requirements.
From time to time, staff mayvisit the site to monitor the project. However, if questions
arise concerning permit conditions, environmental safeguards, or problem areas, you
may contact me or Ron Renaldi, District Manager, at anytime for assistance at 252-621-

In 1974, the North Carolina GencralAssennbly passed the ConstalArca MoungelnentAct
(CAMA) and set file stage for guiding development fit fragile and productive areas that
border tine state's sounds and oceanft-oW. Along with requiring special care by those who
build nutd develop, the General Assembly directed the Coastal Resources Commission
(CRC) to Implement clear regul itiolis that minimize the burden oil the applicant.
'finis application for a minor development permit under LAMA Is part of the
Commission's effort to meet the spirit and Intent of the General Assembly. It has been
designed to be straightforward and require no more time or effort than necessary 11-oin
the applicant. Please go over this folder with the Local Permit Officer (LPO) for the
locality In which you plan to build to be certain flint you understand what Information he
or she needs before you apply.
Under CAMA regulations, (lie mbior permit is to be issued within 25 days once a
complete application is ill hold. Often less time is needed if the project Is simple. Tile
process generally takes about 18 days. You call speed the approval process by mnldng
certain that your application Is complete and signed, that your drawing meets (lie
specifications given inside and that your application fee is attached.
Other permits are sometimes required for development In the coastal area. While those
are not CAMA-related, Nye urge you to check with the Local Permit Officer to determine
which of these you utay treed. A list is included oil page two of this folder.

Please fill out the application completely Including applicant's signature on the second
page. Be sure to complete the "statement of ownership" and the "adjacont property
owners". Your Local Permit Officer can assist you in preparing your application and project
drawings. Once the application and drawing(s) are complete, follow the Instructions below:
SEND THE FOLLOWING ITEMS TO THE ADJOINING PROPERTY
OWNERS: CERTIFIED/RETURN RECIEPT MAIL IS RECOMMENDED
A letter stating you have applied for a CAMA permit and are required to notify them
of your Intended project. (Attached please find an example of this letter)

This process usually takes approximately two (2) weeks from the date that we receive your
complete application. A review period of 25 days is provided by law and an additional 25-
day period can be imposed when such time Is necessary to complete the review of the
proposed project. Undor those circumstances, you will be notified of the need for an
extended review period. If you have any questions about the Minor Permit application, your
project drawing(s), or any other aspect of the N. C. Coastal Area ManagementAct (CAMA),
