Dear Pirates Tale, LLC.:
This letter confirms that on February 17, 2023, Robb Mairs, Minor Permit Coordinator, and I were onsite at
property owned by Pirates Tale, LLC located at 8212 Bald Eagle Lane adjacent to the Atlantic Intracoastal
Waterway (AIWW) located in Wilmington, off Bald Eagle Lane, New Hanover County, North Carolina. The
purpose of the visit was to monitor the permitted development of a single-family docking facility with two slips
adjacent to the AIWW.
Information gathered by the NC Division of Coastal Management shows that Pirates Tale, LLC. has violated
the terms or conditions of CAMA Major Development Permit No. 87606D which was issued to Pirates Tale,
LLC by the Coastal Resources Commission and the North Carolina Department of Environmental Quality. I
hereby request that Pirates Tale, LLC. immediately CEASEAND DESIST such violation(s) and comply with
the terms and conditions of the above permit.
On September 1, 2022, CAMA General Development Permit No. 87606D was issued to Pirates Tale, LLC.
for the construction of a single-family docking facility with two slips adjacent to the AIWW within the Estuarine
Waters and Public Trust Area AECs on property located in New Hanover County, North Carolina. This permit
was issued for a major development in an Area of Environmental Concern, in accordance with North Carolina
General Statutes (N.C.G.S.) 113A-118.
This permit included the following terms and conditions(s):
Permit Conditions stated that: 'Two (2) formalized slips are authorized". Based on 15A NCAC
07H .1205(r) under the General Permit piers and docking facilities shall provide docking for no more
than two boats
For the following reasons, Pirates Tale, LLC. is in violation of the above terms and conditions(s) of their
permit:
1. The docking facility was constructed with four (4) formalized slips, including the installation of two (2)
additional boat lifts.

If the terms and conditions of a permit are not complied with, the permit is null and void from the date of its
issuance. To comply with the terms and condition(s) of the permit issued to Pirates Tale, LLC., the following
Restoration is required. You must notify the adjacent riparian neighbors of the increased development and
provide documentation from the United States Army Corps, and the Division of Water Resources that they
have no objection to this development.
If Pirates Tale, LLC. intends to cooperate with my request, please sign one of the attached Restoration
Agreements and return it to me in the enclosed, self-addressed envelope within ten (10) days of receipt of
this letter. Failure to comply with this request or respond back to this office prior to the requested deadline
with an acceptable schedule for compliance will be interpreted as a refusal to cooperate and will result in a
Notice of Continuing Violation, as well as a court injunction being sought ordering compliance.
I request that Pirates Tale, LLC. immediately CEASE AND DESIST any further development and contact me
about this matter. A civil assessment of up to $10,000 plus investigative costs may be assessed against any
violator. Each day that the development described in this Notice is continued or repeated may constitute a
separate violation that is subject to an additional assessment of $10,000. An injunction or criminal penalty
may also be sought to enforce any violation in accordance with N.C.G.S. 113A-126.
It is the policy of the Coastal Resources Commission to levy a civil assessment not to exceed $10,000 plus
investigative costs against all violations. This is done to recoup some of the costs of investigating violations
and/or to compensate the public for any damage to its natural resources. Whether a higher amount will be
assessed depends on several factors, including the nature and area of the resources that were affected and
the extent of the damage to them.
The relevant statutes and regulations are available from this office, and I am willing to assist you. in complying
with the requirements of these laws. A site inspection will be made in the near future to determine whether
this REQUEST TO CEASE AND DESIST has been complied with. I request that you contact me immediately.

the Restoration Plan Agreement to the satisfaction of the Division of Coastal Management, Pirates Tale, LLC.
will be notified as to the amount of the civil assessment for failure to comply with the terms, conditions, or
requirements of such permit.

of Coastal Management (DCM) by June 15, 2023, or provide an explanation for non-compliance and a reasonable
request for time extension. When corrective actions are complete, I will notify the DCM so the work can be inspected.

I'm working with Steven Jones who owns 8212 Bald Eagle Lane in New Hanover County and trying to get the attached
NOV from DCM on his existing docking facility. He received CAMA GP #87606-D (attached) on 9/1/22 for a 2-slip docking
facility however, he later added 2 boat/jet ski lifts after construction. On 5/5/23 DCM issued CAMA NOV #23-05
(attached) for the unauthorized lifts. The existing water depths in the location of these lifts are: -2' @ NLW for Slip #3
and -3.9' @ NLW for Slip #4. Neither of the structures encroach into the Federal Channel Setback and the adjacent
riparian property owners have indicated that they do not have any objections to the structures however I'm waiting for
the required written confirmation of this.
As requested in items #2 & #3 of the attached NOV Restoration Plan, I am requesting comments from you on this

Dear Mr. Jones:
This letter is in reference to the Notice of Violation dated May 15, 2023 that Kelsey Beachman, representative
for the Division of Coastal Management, issued to Pirates Tale, LLC. for the unauthorized installation of two
(2) boat lifts at a permitted docking facility, creating a total of four (4) formalized slips at the property located
at 8212 Bald Eagle Lane, Wilmington, New Hanover County, North Carolina. The violation took place within
the Estuarine Waters and Public Trust Areas of Environmental Concern (AECs), as designated by the N.C.
Coastal Resources Commission.
The N.C. Coastal Area Management Act provides that a civil assessment of up to $10,000 plus investigative
costs may be assessed for any violation. The rules of the Coastal Resources Commission authorize the
Division of Coastal Management to assess a civil penalty for CAMA violations to recover some of the costs
of investigating violations and/or to compensate the public for any damage to its natural resources.
Under the rules of the Coastal Resources Commission, and in accordance with 15A NCAC 07J.0409(f)(D) &
(E), due to previous violations of the commission's rules, a proposed civil penalty for the major development
violation in the amount of $500.00, plus an investigative cost of $50.00, for a total of $550.00, is appropriate
for this violation.
Pirates Tale, LLC. may expeditiously resolve this matter prior to the assessment of a formal civil penalty by
accepting responsibility for the violation and paying the amount proposed above. To do this, Pirates Tale,
LLC. must: (1) sign the attached "Agreement to Pay Civil Assessment;" (2) attach a check or money order
for $550.00 made payable to the North Carolina Department of Environmental Quality (NCDEQ); and (3)
return the signed agreement and payment to this office within ten (10) days of your receipt of this letter.
Upon deposit of Pirates Tale, LLC.'s check in the Department's account, you will receive a letter from the
Division of Coastal Management officially closing this enforcement action.

If Pirates Tale, LLC. does not send a signed agreement and payment to this office within ten (10) days of
receipt of this letter, the Director of the Division of Coastal Management will formally assess a civil penalty
against Pirates Tale, LLC. and Pirates Tale, LLC. may then make a request to the Director a hearing or
settlement of the penalty.

I understand that the staff of the Department of Environmental Quality will propose the assessment of a civil
penalty in the amount of $550.00 against Pirates Tale, LLC. for violation of the Coastal Area Management
Act, NCGS 113A-100 et seq, committed on or near property located at 8212 Bald Eagle Lane, Wilmington in
New Hanover, North Carolina. To resolve this matter with no further action or expense on my part, I accept
responsibility for the violation, on behalf of Pirates Tale, LLC. as described in the Notice of Violation letter
dated May 15, 2023 and agree to pay the proposed civil assessment of $550.00.

AGREEMENT TO PAY PROPOSED CIVIL ASSESSMENT
I understand that the staff of the Department of Environmental Quality will propose the assessment of a civil
penalty in the amount of $550.00 against Pirates Tale, LLC. for violation of the Coastal Area Management
Act, NCGS 113A-100 et seq, committed on or near property located at 8212 Bald Eagle Lane, Wilmington in
New Hanover, North Carolina. To resolve this matter with no further action or expense on my part, I accept
responsibility for the violation, on behalf of Pirates Tale, LLC. as described in the Notice of Violation letter
dated May 15, 2023 and agree to pay the proposed civil assessment of $550.00,
