as authorized by the State of North Carolina, Department of Environmental Quality and the
Coastal Resources Commission for development in an Area of Environmental Concern
pursuant to the Coastal Area Management Act, Section 113A-118 of the General Statutes.
Issued to NENC Properties, LLC, authorizing development in the Estuarine Shoreline (AEC) at 109 Gilbert Street,
Manteo, as requested in the permittee's application dated 03/05/2024, received from Derek Waters on 03/28/2024, and
received complete on 04/05/2024. This permit, issued on 04111/2024, is subject to compliance with the application and
site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth
below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the
permit to be null and void.
This permit authorizes the construction of a 1,624 sq. ft. Single -Family Residence with covered porch and parking.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated 02/27/2024 and drawn by J. H. Miller, Jr., Land Surveying and received on 04/05/2024. [GS 113A-120]
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.[GS 113A-120]
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit. (GS 113A-1201
(4) A copy of this permit shall be posted or available on site. Contact this office at 252-264.3901 for a final inspection at

This permit action may be appealed by the permitlee or other qualified persons
within twenty (20) days of the issuing date, This permit must be on the project
site and accessible to the permit officer when the project is Inspected for
compliance. IGS 113A-1201 Any maintenance work or project modification not
covered under this permit, require further written permit approval. All work must
cease when this permit expires on: DECEMBER 31, 2027
In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.
Check #21172 in the amount of $100 was received on 03128/2024 for
the permit fee.

(5) The amount of impervious surface shall not exceed 30%of the lot area Within 75 feet of Normal Water Level
(Estuarine Shoreline Area of Environmental Concern), in this case, 1,144 square feet is authorized. [07H
.0209(d)(2)]
(6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
developmenticonstruction shall be located a distance of 30 feet landward of Normal Water Level. No portion of the
roof overhang shall encroach into the 30 ft. buffer.,[07H .0209(d)(10)]
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent or water areas, until such time as the area has
been properly stabilized with a vegetative cover. [07H .0209(d)(3)]
(8) Any proposal for grading within the 30' buffer from the Normal Water Level must be contoured to prevent additional
stormwater runoff to the adjacent waterbody. This area shall be immediately vegetatively stabilized, and must
remain in a vegetated state. [07H .0209(d)(3))
(9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction

The attached permit constitutes authorization under the Coastal Area Management Act
for you to proceed with the project proposal of the construction of a single-family
residence at 109 Gilbert Street in Manteo. Please review, sign and return a copy to this
office for our records. You must have a copy available on site when the project is
inspected for compliance.
The project plan is subject to those conditions appearing on the permit form. Otherwise,
all work must be carried out in accordance with your application. Modifications, time
extensions, and future maintenance require additional approval. Please read your permit
carefully prior to starting work and review all project plans, as approved. If you are having
the work done by contractors, it is to your benefit to be sure that they fully understand all
permit requirements.
From time to time, staff may visit the site to monitor the project. However, if questions
arise concerning permit conditions, environmental safeguards, or problem areas, you
may contact me or Ron Renaldi, District Manager, at any time for assistance at 252-621-

Good afternoon Mr. Waters,
On behalf of the NC Division of Coastal Management, I wanted to acknowledge receipt of
the minor application you submitted for NENC Properties, LLC, for State approval for
development of the property located at 109 Gilbert Street in Manteo. The application was
received in our office on March 28, 2024, and appears to be adequate for processing. A
copy of the receipt for the permit fees is attached for your records.
As we had previously discussed, I will need to make an onsite inspection, and you had
noted you would like to meet with me on the property. Please let me know if you may be
available sometime tomorrow or Monday. We are currently short-staffed, and I will need
to coordinate with the other field staff regarding a time if Friday is your preference.
