Dear Mr. Isenhour:
This correspondence is with reference to the request you submitted to modify State Permit No. 34-22. State Permit
No.34-22 was issued to Bluewater Point, LLC on March 23, 2022 for Marina Replacement and upland development
adjacent to Montgomery Slough in Oak Island, NC. The permit is due to expire on December 31, 2025.
The current request for modification would include changing finger pier lengths on the eastern docks within the
original footprint, shifting the permitted gazebo approximately 12 ft. waterward of the existing bulkhead and a slight
shift in the western floating docks within the permitted footprint (see attached drawing dated 2/27/27).
Please Note: The applicant is also requesting a relocation of the eastern floating docks 16 ft. to the north, this cannot
be authorized under a refinement due to a change in footprint and a minor modification request will be forthcoming
for that proposal.
Upon review of the information provided, the Division of Coastal Management has determined that the proposed actions
within the existing footprint continue to be consistent with existing State rules and regulations and is in keeping with
the original purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification of
State Permit No. 34-22, as described in your request dated received by DCM on March 13, 2014. By copy of this letter
we are notifying the US Army Corps of Engineers, Division of Marina Fisheries and the Division of Water Resources of
our action. Please note this refinement does not alleviate the need to obtain any other local, state or federal permits.

Good afternoon Tara,
After discussions with Steve Edwards and with Todd Isenhour, We would like to proceed with the letter of refinement
Bluewater Point Marina to allow us to move forward with what we can while we wait for the minor mod to come back.
Changes that we hope to achieve via the letter of refinement are as follows:
1. The Slips on the Eastern Docks were originally permitted with 32' fingers on both the north and south side of the
main 8x221 walkway. It has since been modified to be 35' on the north side and 30' on the south side. There is
zero change to the over all square footage. Finger length/SF was taken from the north side and moved the south
side of the main walkway of the eastern docks.
The alignment on the Wester docks have been modified slightly
The Gazebo on the Easter dock has been shifted approximately 12' off the bulkhead.
Sea Dog has produced some sketches illustrating the changes. We have attached those drawings along with the major
permit to this email. Please find the following attached:
1. Overall Site Plan
2. Western Docks
3. Eastern Docks
4. Major Permit
The minor modification to the permit will address the —16' shift north of the eastern floating docks however we
understand thatthis cannot be included as part of the letter of refinement.
