After making a site inspection on March 14, 2024, I have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated received March 13, 2024, and meet the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. This exemption expires 90 days from the date of the letter. STRUCTURAL BEACH ACCESSWAY EXEMPTED 1. The wooden walkway shall be a maximum of four feet in width based on Town Ordinance. 2. The walkway shall be replaced in the same footprint and shall not go beyond the existing ocean side steps to meet 110 ROTHSCHILD STREET • HOLDEN BEACH, NC 28462 * 910.842.6DBO PHONE • 910- 842-7003 FAX www.hbtownhall.com the conditions of chapter 94 located in the Holden Beach Code of Ordinances. 3. The accessway shall be constructed to make negligible alterations to the frontal dunes. This means that the accessway must be constructed on raised posts or pilings to a minimum of five feet in depth, so that wherever possible only the posts or pilings touch the frontal dunes without any alteration to the dunes. In no case shall the frontal dune be altered to significantly diminish its capacity as a protective barrier against flooding and erosion. 4. Construction of the accessway shall be consistent with all other applicable local ordinances and NC Building Code standards. 5. A single walkway is permitted. 6. Any areas of vegetation that are disturbed are to be revegetated as soon as feasible, prior to final inspection. 7. The accessway is exclusively for pedestrian use. 8. The sections on the walkway that are wider than 4 feet must be removed and shall not be re laced. Town Ordinance 94.03 (2) in part: 1. The walkway shall be constructed only of building materials approved by the North Carolina State Building Code. The walking passageway shall be no wider than four feet. The Underside of the walkway across the frontal dune shall be a minimum of 18 inches and a maximum of 36 inches above the crest of the sand. 2. The first step down the beach strand shall be placed no further seaward than the beginning of the downward slope of the dune. 3. Steps shall be of open tread construction with a maximum riser height of eight and one -quarter inches and a minimum tread depth of nine inches and shall meet the requirements of the North Carolina State Building Code. 110 ROTHSCHILD STREET + HOLDEN BEACH, NC 28462 •910.842.6080 PHONE • 910- 842-7003 FAX www.hbtownhall.com 4. In accordance with North Carolina State Division of Coastal Management's enforcement of the Coastal Area Management Act (LAMA), the walkways access to the beach strand over the frontal dune shall be conclusively presumed to entail negligible alteration of the dune. In no case shall the walkway be permitted if it will, in the opinion of the Local CAMA Permit Officer, diminish the dunes capacity as a protective barrier against flooding and erosion. 5. Except for approved handicap ramps, steps from the walkway to the beach strand shall be placed only perpendicular to the frontal dune line. 6. NO STRUCTURE other than the four -foot wide wooden walkway shall be located south of the landward toe of the frontal dune. *The section wider than 4 feet on the frontal dune must be removed and cannot be replaced. The walkway shall end no further than where delineated.* This exemption to the CAMA permit requirements does not alleviate the necessity of obtaining any other State, Federal, or Local authorization.
