SAW-2016-02140) Dear Mr. Bernhart: 4038 Masonboro Loop Road Wilmington, North Carolina Tel: +1 910-399-1905 KWillson@coastalprotectioneng.com This letter serves as the project report required by special condition #24 of the above referenced permit, which allowed Dare County to conduct maintenance dredging within the Connector Channel Corridor located between Ocracoke Island and Hatteras Island, North Carolina. Special condition #24 requires that a project report summarizing the results of the dredging and the sea turtle take (if any) be submitted to NMFS within 30 working days of completion and that the reports shall contain information on project location, start-up and completion dates, cubic yards of material dredged, incidental takings (include photographs, if available) and sightings of protected species, mitigating actions taken, screening type (inflow, overflow) utilized, daily water temperatures, name of dredge, names of endangered species observers, percent observer coverage, and any other information the contractor deems relevant. Project Description: On October 3, 2021, the US Army Corps of Engineers (USACE) operated Sidecast Dredge Murden began dredging in the Connector Channel (locally referred to as the South Ferry Channel) in the vicinity of Hatteras Inlet. The Dredge Murden conducted 24-hour operation maintenance dredging in the channel for approximately 4 days between October 3 and October 6. The Dredge Murden concluded its dredging at approximately 6:00 AM on October 6 and moved to the Ocracoke Channel. The Dredge Merrztt conducted maintenance dredging in the channel for approximately 1 day on October 7. The Dredge Merr' could not effectively continue to dredge in the cut longer than one day due to shallow depths on either side of the channel. A comparison of surveys conducted by the USACE on September 21, 2021 and October 6, 2021, indicated the removal of approximately 10,000 CY of material within the area reported to have been dredged by the dredge crews. The removal of the material resulted in controlling depths of approximately -8 ft. MLLW through the South Ferry Channel with a minimum width of approximately 40 feet in the narrowest point of the dredged channel at approximately elevation -6 ft. MLLW. Survey charts for the September 21, October 6, survey events are provided in Attachment 1. For the past year, the deep water channel allowing for navigation through the South Ferry Channel from Sloop Channel to the Hatteras Inlet gorge, has been maintained in the some location. The maintenance dredging of this channel through the use of sidecast dredges resulted in a very narrow channel with relatively high elevations on either side of the channel. The elevations adjacent to the channel on both the north and south side have restricted the amount of maintenance dredging that can be conducted due to the condition of the permits that prohibits discharging of dredged material in areas where elevations are greater than mean low water. County and USACE navigation branch staff have been working to develop and execute an alternative dredge plan to realign the channel in an area that would extend the period of time between maintenance events and allow for a wider, more dependable channel. Following the early October dredge event rapid shoaling of the channel prompted Dare County to request the USACE to bring one of its dredges back to the South Ferry Channel to conduct additional maintenance dredging. The sidecast Dredge Menztt was the only available dredge plant. A condition survey conducted on November 10 indicated that additional shoaling had occurred in the previously maintained channel and that an area to the north and west of the channel had scoured slightly. The November 10 conditional survey is included in Attachment 1. The designed box for dredging of the alternative channel is shown in Attachment 2. On November 11, 2021, the Dredge Menztt began dredging a channel in the vicinity of where the scouring was indicated in the November 10, 2021 survey. The Dredge Merritt conducted 12-hour operation maintenance dredging in the channel for approximately 10 days between November 11 and November 21. A comparison of surveys conducted by the USACE on November 10 and November 22, 2021, indicated the removal of approximately 14,000 CY of material within the area reported to have been dredged by the dredge crew. The removal of the material resulted in controlling depths of approximately -7 ft. MLLW through the South Ferry Channel with a minimum width of approximately 70 feet in the narrowest point of the dredged channel at approximately elevation -6 ft. MLLW. Survey charts for the October 20, November 1, November 10, November 17, and November 22, 2021 survey events are also provided in Attachment 1 Mitigation Actions and Observations: In accordance with the permit, the applicant provided written notice to the USACE Regulatory Division and the Division of Coastal Management prior to October maintenance dredging activities. These written notices dated September 23, anticipated dredging to occur between October 41" and October 251", 2021. The originally stated goal of the October 2021 maintenance event was to establish an approximately 8 ft. deep channel with bottom width of approximately 150 ft. Based on the conditional survey conducted by the USACE on September 21, 2020, establishment of the proposed channel would have required the dredging of approximately 31,600 cy of material. The proposed channel is shown on the project drawings (Attachment 3), which include both plan view and cross -sectional view. In order to take steps to establish a more dependable channel during the winter months, additional maintenance was performed in a new area. In accordance with the permit, the applicant provided written notice to the USACE Regulatory Division and the Division of Coastal Management prior to November maintenance dredging activities. These written notices dated October 27, anticipated dredging to occur after October 281", 2021. However, the actual dredging that occurred differed from what was included in the October 27 plan. The USACE Regulatory Division and the Division of Coastal Management were kept updated on all of modifications to the Dredge Plan, which were all conducted in compliance with the issued permits. The updated dredge plan, which was developed by the USACE Navigation Branch on November 11 using the November 10 survey, was provided to the USACE Regulatory Division and the Division of Coastal Management on November 12. The County and its consultant (CPE) coordinated closely with both NC DCM and USACE regulatory staff on the progress of the project. In accordance with the permit, construction activities complied with the "Guidelines for Avoiding Impacts to the West Indian Manatee". Furthermore, sidecast dredge operations ceased operations when the shoals on either side of the channel, on which material was being discharged, appeared to approach an elevation of MLW. This was done to avoid placement of material above the MLW to avoid impacts to federally listed Seabeach Amaranth, Piping Plover, Red Knot, Green sea turtle, Hawksbill sea turtle, Kemp's ridley sea turtle, Leatherback sea turtle, Loggerhead sea turtle, and their habitat To the knowledge of the contractor, no protected federally listed species was killed, injured, captured, harassed, or otherwise harmed by the conduct of the maintenance activities (i.e. no incidental takings). No protected species were observed during the conduct of the work; however, protected species observers were not required as a condition of the permit Furthermore, in accordance with the permit, material excavated by the Sidecast Dredge Merritt and Sidecast Dredge Murden was placed at least 100 linear feet from known SAV resources.
