HomeMy WebLinkAboutOregon Inlet Modification, September 2022-FINAL-SignedDEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS WASHINGTON REGULATORY FIELD OFFICE 2407 W 5T" STREET WASHINGTON, NORTH CAROLINA 27889 September 29, 2022 Regulatory Division Action ID No. SAW-2019-00175 Mr. Robert Outten Dare County Post Office Box 1000 Manteo, North Carolina 27954 Dear Mr. Outten: Please reference the Department of the Army permit (Action ID SAW-2019-00175) issued on December 16, 2019, and your written request of August 5, 2022, for permit modification to allow the Miss Katie to preform dredging operations in the Alternate (Western) Channel within the same footprint and specifications outlined by USACE Operations Division, within Oregon Inlet, located in the Town of Nags Head, Dare County, North Carolina. This modification addresses your request as it relates to Special Condition 11 that states: "Work authorized under this permit shall strictly adhere to the work at Oregon Inlet described in the document entitled "Finding of No Significant Impact, Use of Government Plant to Dredge in Federally Authorized Navigation Projects in North Carolina, dated September 2004. " Specifically, this permit only authorizes: "A 14 feet deep by 400 feet wide channel through Oregon Inlet and the ocean bar. An approximate 16, 050 foot long portion of the channel from Oregon Inlet to Hell's Gate (12 feet deep by 100 feet wide) and an approximate 2, 850 foot long portion of Old House Channel (12- feet deep by 100 feet wide) in Dare County. The nearshore disposal site for material dredged by a hopper dredge is located on the south side of Oregon Inlet, off the north end of Pea Island, and in deep sour holes beneath the Herbert C. Bonner Bridge." After review of your modification request and coordination with the appropriate state and federal agencies, the U.S. Army Corps of Engineers Wilmington District (Corps) grants modification of the permit. The permit is hereby modified to include the work as shown on the enclosed plan along with the attached special conditions. It is understood that all conditions of the original permit remain applicable, and that the expiration date is unchanged. -2- Thank you for your time and cooperation. All work authorized in the Oregon Inlet Alternate (Western) Route by this permit, as modified, must be performed in strict compliance with the attached plans entitled, Event I — Q3 2022 Oregon Inlet Channel Maintenance Project, dated July 28, 2022. The Oregon Inlet Western Alternate Route includes a 100 foot -wide channel dredged to -8 MLLW with 2 foot overdepth as described by USACE Operations Division Alternate (Western) Channel Emergency Declaration. When the subject reach of the federal project is authorized to full project dimensions, work may be performed in accordance with updated plans consistent with that authorization. Any plans, or modification thereto, must be approved by the U.S. Army Corps of Engineers Wilmington District Regulatory Division prior to implementation. b. Before each dredging event, the Permittee shall conduct a bathymetric survey to determine the location of the proposed dredge areas within the channel. This survey will be coordinated with the Wilmington District Regulatory Division, Attn: Josh Pelletier at (910) 251-4605, or josh.r.pelletier@us ace.army.mil prior to commencement of dredging.
