I appreciate the information you have provided. Mr. Hall (Brett), we would need for you to retract your objection, and note as such on the ARPO form (pdf scan attached) and initial/redate the form. Concerns of potential water runoff were also brought up regarding the height of the proposed bulkhead (i.e. 4'). However, I will note that the Division's rules do not dictate the proposed height and would not be referenced on the permit*. We would authorize the 20' return to the south, as well as an additional 20' return on the north side*. Upland disturbance (i.e. deadman/tiebacks and backfill) should be limited to 20' landward of the bulkhead. A copy of the last site plan with adjustments noted is attached for your review. If this meets with both parties and the objection is retracted, I can issue the permit after receiving confirmation as noted. With respect, i N.C. We do however have an OBJECTION to Josh Aguilar's proposal. The reasons for our OBJECTION are included below. 1. Josh wants to extend beyond his property line into our property line. Based on where he has proposed to tie his bulkhead in (the 4" post on my bulkhead). Instead, we recommend that Mr. Aguilar tie in at the end of our bulkheads return, which has already been built to maximize the investment we have made within our property. This would allow us to keep what little bit of beach access that we currently have on the southern part of our property and ensure we have an option to access the water on the southside of our property. If Josh is agreeable to this, we would also recommend that he tapers his wall down to our return since he is looking to build a 4' wall for aesthetic purposes. 2. We have some concerns that his proposal of a 4' wall might increase the amount of water runoff to our property. After talking to Doug Dorman, from Atlantic Environmental Consultants, he said that its common sense that water will naturally drain to the lowest ground. If you have any evidence that is contrary to objection #2, then we would be happy to talk through it, and possibly make a compromise. Attached are some notional drawings that I would like you to review and consider. We are hopeful that we can come to an agreement about the construction of a bulkhead between our properties because as I mentioned, we think it will help prevent unnecessary erosion across each of our properties.
