Issued to the Town of Emerald Isle, authorizing development in the Coastal Shoreline (AEC) at Park Street
Row North, in Emerald Isle, North .Carolina, Carteret County, as requested in the permittee's application,
dated 4/8/05. This permit, issued on 7/14/05, is subject to compliance with the application and site
drawing (where consistent with the permit), all applicable regulations and special conditions and notes set
forth below. Any violation of these terms may subject permittee to.a fine, imprisonment or civil action, or
may cause the permit to be null and void.
This permit authorizes a 60' wide retaining wall. Any other development will require additional permits or
modification of this permit. The following conditions shall apply:
(1) All proposed development and associated construction must be done in accordance with the permitted
work plat drawings(s) dated received on 4/8/05.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and
Federal regulations, applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a
re-evaluation and modification of this permit.
(4) Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold
or otherwise disposed of to a third -party by the applicant, agent, or any entity other than the NC
Division of Coastal Management.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date. From
the date of an appeal, any work conducted under this permit must
cease until the appeal is resolved.
This permit must be on the project site and accessible to the permit
officer when the project is inspected for compliance.
Any maintenance work or project modification not covered under
this permit, require further written permit approval.
All work must cease when this permit expires on
December 31, 2008
In issuing this permit it is agreed that this project is consistent with
the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without the
written approval of the Division of Coastal Management.

In 197, the North Carolina General Assembly passed the Coastal Area
Management Act and set the stage for guiding development in fragile
and productive areas that border the state's sounds and oceanfront. Along
with requiring special care by those who build and develop, the General
.' Assembly directed the Coast a1 Resources Commission (CRC) to imple-
ment clear regulations that minimize the burden on the applicant.''

This is to notify your department that the Minor CAMA Permit, 05-34, issued on April 25, 2005 will
have to be revoked through no fault of your department. The Morehead City CAMA office notified
this office today, July 13, 2005, that the Town of Emerald Isle may not issuepermits to any department
associated with the Town of Emerald Isle. CAMA Officer, Ryan Davenport, asked us to send this
notice to Parks and Recreation, send a copy of this letter to them, and then the Morehead City CAMA
office will issue you a permit.

CAMA PERMIT NOTICE
Pursuant to NCGS 113A-119(b), Emerald Isle, a locality authorized to issue
permits in Areas of Environmental Concern, through the Coastal Area
Management Agency (LAMA), hereby gives NOTICE that on April 8, 2005,
Town of Emerald Isle Parks & Recreation applied for a Minor CAMA Permit to
install a retaining wall within the Area of Environmental Concern, at Park Street
Right -of -Way, North, Emerald Isle.
The application may be inspected at the address below. Public comments
received by April 25, 2005 will be considered. Later comments will be accepted
and considered up to the time of permit decision. Project modifications may occur
based on further'review and comments. Notice of the permit decision in this
matter will be issued upon written request.

This department has inspected the public street end on Park Street used for public access to Bogue Sound.
As an adjacent property owner, I am notifying you as required by Coastal Area Management, of the Town's
intent to improve that are with the construction of a sixty foot wide and four foot tall wooden retaining wall
within the street right of way on the northern most portion of the property to prevent erosion due to runoff
from the street. We propose backfilling the area and constructing a set of steps for public access to the
sound.
The Town needs your compliance to receive an exemption letter for the CAMA permit for this project.
Please acknowledge by signature below your consent to proceed with this project as described or your
objection of the proposed project and return to me in the enclosed envelope at your earliest convenience.

I acknowledge that the land owner is aware that the proposed development is planned for an area which may be susceptible to
erosion and/or flooding. I acknowledge that the local permit officer has explained to me the particular hazard problems associ-
