Access, in Emerald Isle, as requested in the permitted's application, dated 4/3/07. This permit, issued on 5/16/07,"is
subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations
and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine,
imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: Construct a public observation deck and handicap accessible beach access ramp.
(1) All. proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on 4/10/07.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (252) 808-2808 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is. inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. Al work must cease when this permit expires on:

In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) All buildings constructed within the ocean hazard area shall comply with the NC Building Code, including the
Coastal and Flood Plain Construction Standards of the N. C. Building Code, and the Local Flood Damage
Prevention Ordinance, as. required by the National Flood Insurance Program. If any provisions of the building code
or a flood damage prevention ordinance are inconsistent with any of the following AEC standards; the more -
restrictive provision shall control.
(6) All buildings must be elevated on pilings with a diameter of at least 8 inches in diameter if round, or 8 inches to a
side if square; and the first floor level of the sills and joists must meet the 100-year flood level elevation.
(7) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure.
(10)Dune disturbances will be allowed only to the extent necessary for development and if the dune's protective value is
not weakened or reduced. Disturbed dune areas will be immediately stabilized.
(11)AII unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control- measures.,; Disturbed .areas shall -be vegetatatively stabilized (planted and
mulched) within 14 days of construction completion. ,
(12)Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by
changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two years of the time
when it becomes imminently threatened and in any case upon its collapse or subsidence. However, if natural
shoreline recovery or beach renourishment takes place within two years of the time the structure becomes
imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or
dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary
protective measures allowed under CRC rules.
(13) The accessway must not exceed six feet in width and shall provide only pedestrian access to the ocean beach.
(14)The accessway must be constructed so as to make negligible alterations to the frontal dunes. This means that the
accessway must be constructed on raised posts or pilings of five feet or less in depth, so that wherever possible only
the posts or pilings touch the frontal dunes without any alteration to the dunes. In no case shall the frontal dune be
altered so as to significantly diminish its capacity as a protective barrier against flooding and erosion.
(15)Construction of the accessway be shall consistent with all other applicable local ordinances and N. C. Building Code
standards.
(16)The access ramp shall only extend onto the beach far enough to meet ADA requirements as depicted on the plat
dated 10/10/06

In 1974, the North Carolina General Assembly passed the Coastal Area
Management Act and set the stake for guiding development in fragile and
productive areas that border the state's sounds and oceanfront. Along with
requiring special care by those who build and develop, the General As-
sembly directed the Coastal Resources Commission (CRC) to implement
clear regulations that minimize the burden on the applicant.
This application for a minor development permit under CAMA is part of
the Commission's effort to meet the spirit and intent of the General As-
sembly. It has been designed to be straightforward and require no more
time or effort necessary from the applicant. Please go over this folder with
the Local Permit Officer (LPO) for the locality in which you plan to build to
be certain that you understand what information he or she needs.
Under CANIA regulations, the minor permit is to be issued within 25 days
once a complete application is in hand. Often less time is needed if the
project is simple. The process generally takes about 18 days. You can
speed the approval process by making certain that your application is com-
plete and signed, that your drawing meets the specifications given inside
and that your application fee is attached.
Other permits are sometimes required for development in the coastal area.
While these are not CANIA-related, we urge you to check with the Local
Permit Officer to determine which of these you may need. A listing is in -
eluded on page 2 of this folder.

As you are probably aware, the Pier Pointe development is located on the west side of the Eastern Ocean Regional
Access (FORA) that is owned and operated by the Town of Emerald Isle. As such, we are writing to inform of a
proposed project to be located at the EORA so that you may relay this information to the Pier Pointe homeowners.
The proposed project is to involve construction of a 20 ft. x 24 ft. public observation deck to be located at the ocean
dune tine. The project is also to include the construction of approximately 105 linear feet of 6 ft wide handicapped
accessible ramp on the landward side of the deck and approximately 246.6 linear feet of similar ramp to the Oceanside
of the deck. Together, the ramps and observation deck will provide a handicap accessible route to the beach at the
FORA. A single set of plans depicting this planned project exclusive of the structural plan sheets is included for your
review.
Because the proposed project is subject to permitting by the Division of Coastal Management, you and the Pier Pointe
Homeowners have the opportunity to submit comments regarding the proposed project to the agency. Any such
comments must be submitted within 30 days of receipt of this letter to:

construction of projects at the Town's EORA and WORA parks. More specifically, permits that

WOOD PILES SHALL BE TREATED SOUTHERN PINE PILES CONFORMING TO ASTM D-25 AND
WITH MINIMUM LOAD CARRYING CAPACITY OF 4 KIPS/EACH. THE MINIMUM PILE DIAMETER
SHALL BE 8 INCHES. THE DEPTH(S) TO WHICH PILES ARE TO BE DRIVEN SHALL JIE
DETERMINED AS FOLLOWS:
I. ALL PILES, INCLUDING TEST PILES, SHALL BE DRIVEN WITH POWER OR GRAVITY
HAMMERS.
2. THE CONTRACTOR SHALL PROVIDE TO THE ENGINEER AT LEAST 15 DAYS PRIOR TO THE
PLANNED START OF TEST PILE DRIVING OPERATIONS THE SPECIFICATIONS FOR THE PILE
DRIVING HAMMER, CAP BLOCK, AND CUSHIONING MATERIAL HE PROPOSES TO USE TO
DRIVE THE PILES. THE ENGINEER WILL DETERMINE THE DRIVING CRITERIA FOR THE TEST
PILES WITHIN 15 DAYS OF RECEIPT OF ADEQUATE SPECIFICATIONS FROM THE
CONTRACTOR.
3. THE CONTRACTOR SHALL FURNISH AND DRIVE AT LEAST TWO TEST PILES. THE TEST
PILES SHALL BE AT LEAST 20 FEET IN LENGTH. TEST PILES SHALL BE LOCATED SO
THAT THEY MAY BE CUT OFF AND BECOME PART OF THE COMPLETED STRUCTURE. AT
LEAST ONE TEST PILE SHALL BE AT THE LOCATION OF THE PROPOSED OBSERVATION
PLATFORM. AT LEAST ONE TEST PILE SHALL BE LOCATED ALONG THE PROPOSED RAMP
AT THE WATERWARD (OCEAN SIDE) OF THE PROPOSED PLATFORM.
4. TEST PILES SHALL BE DRIVEN IN ACCORDANCE WITH THE DRIVING CRITERIA PROVIDED BY
THE ENGINEER AND UNTIL THE BEARING CAPACITY REQUIREMENT PROVIDED AS PART OF
THE DRIVING CRITERIA IS ACHIEVED.
5. THE CONTRACTOR SHALL PROVIDE TO THE ENGINEER DRIVING RECORDS FOR EACH TEST
PILE WITHIN 7 DAYS OF COMPLETION OF TEST PILE DRIVING OPERATIONS. DRIVING t'► .

PRODUCTION PILES SHALL BE DRIVEN WITH THE SAME TYPE AND CAPACITY OF
EQUIPMENT THAT WAS USED FOR DRIVING TEST PILES. THE CONTRACTOR SHALL
PROVIDE TO THE ENGINEER DRIVING RECORDS FOR EACH PRODUCTION PILE WITHIN 15
DAYS OF COMPLETION OF PRODUCTION PILE DRIVING OPERATIONS. EACH RECORD SHALL
INCLUDE A PILE IDENTIFICATION NUMBER THAT IS REFERENCED TO A MAP AND PROVIDED
BY THE CONTRACTOR.
