Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. j it your project i in ine ocean Hazara AbU 1) The permittee is required to contact Local Permit Officer shortly before he plans to begin construction to arrange a setback measurement which will be effective or sixty (60) days barring a major shoreline change: Construction must begin within sixty (60) days of the determination or the measurement is void and must be red( ie. 2) Any structure within the Ocean Hazard AEC shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline tonfrguration. Th structure(s) shall be relocated or dismantled within two years of the time when it becomes imminently threatened, and in any case upon its collaple or subsidence. However, if natural shoreline recovery or beach Renourishment takes place within two years of the time the structure becomes imminently threatgrred so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to see authorization of temporary protective measures allowed under the Coastal Resources Commission Rules. 3) In order to avoid unreasonable danger to life and property, all development shall be designed and placed so as to minimize damage due to fluct ations in ground elevation and wave action in a 100 year storm. Cantilevered decks and walkways shall meet this standard or shall be designed to break -away wit out structural da t:ge to the main structure. Any building constructed within the ocean hazard area shall comply with the North Carolina Building Code including the�oastal and Flood lair Construction Standards, Chapter 34, Volume I or Section 39, Volume I -B and the local flood damage prevention ordinance as required by the National Flood Insur ince Program. If any provisions of the building code or a flood damage prevention ordinance is inconsistent with any of the AEC standards, the more rjestrictive provisi shall control. 4) The structure must be set back 60 feet fro: 4 the first line of stable, natural vegetation. Decking not to exceed 500 square feet total. 5) The structure must be located entirely off the frbntal dune, and, if a primary dune is present, behind the crest of the primary dune. 6) The structure must be elevated on pilings with a diameter of at least eight (8) inches and the first floor level of the sills and joists must meet they minimal 100 yea flood as required by FIRM Community Panel 63i15 J. j 7) All pilings shall have a tip penetration of at ler ,' five (5) feet below mean sea level, or sixteen (16) feet below average original grade, whicheviIr is least; if locat don a primary dune, the tip penetration must be at least five (5) feet below mean sea level. 8) No impermeable surfaces shall be allowed over any functional part of the septic tank system. 9) Dune disturbances will be allowed only to the extent necessary for development, and if the dune's protective value is not weakened or reduced' Disturbed areas v ill be immediately stabilized. 10) This permit may be renewed for one year, ifreauested before the expiration date. I I) Sand used to strengthen dunes must be brought in from an outside source and must be ofthe same nature all the sand in the area in which it is to be placed. No sand is to be removed from the property. 12) Sand held in storage in any dune other than frontal or primary dunes may be moved laterally in order to strengthen existing primary or frontaj dunes if the wor would enhance the protection to the proposed de%clopment activity and the sand is immediately stabilized. .51 This permit action may be appealed by the permittee o� other qualified persons within twenty (20) days of the issuing date. - From the date of an appeal, any work conducted under thil per mit must cease until the appeal is resolved. AEC HAZARD NOTICE Project Is In An: 4/— Ocean Erodible Area Date Lot Was Platted: 3 This notice is intended to make you, the applicant, aware of the special risks and conditions associated with development in this area, which is subject to natural hazards such as storms, erosion and currents. The rules of the Coastal Resources. Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules onbuilding standards, oceanfront setbacks and dune alteration are designed to minimize, but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual ocean erosion rate for the area where your property is located is 3 feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies Vfeet dicate that the shoreline could move as much as landward in a major storm. The floodwaters in amajor storm are predicted to be about �� feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary devices, including sand bags, may be allowed under certain conditions. This structure shall be relocated or dismantled within two years of becoming imminently threatened. The applicant must acknowledge this information and requirements by signing this notice in the below space. Permits issued for development in this area expire on December 31 of the third year following the year in which the permit was issued. Shortly before work begins on the project site, the Local Permit Officer will determine the vegetation line and setback distance at your site. If the property has seen little change and the proposed development can still meet the setback requirement, the LPO will inform you that you may begin work. It is impor- tant that you check with the LPO before the permit expires for official approval to continue the work after the permit has expired. Generally, if foundation pilings have been placed and substantial progress is continuing, permit renewal may not be necessary. If substantial progress has not been made, the permit must be renewed and a new setback line established. It is unlawful to continue work after permit expiration without this approval.
