HomeMy WebLinkAbout122-23 Smith, WilliamNC Division of Coastal 122.23 Management Permit Number CAMA MINOR DEVELOPMENT PERMIT i i as authorized by the State of North Carolina, Department of Environment, and Natural Resources and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statutes, "Coastal Area Management' Issued to William Ware Smith (Harkaway Retreat LLC) c/o Billy Miller Construction authorizing development in the Estuarine Shoreline — 75' (AEC) at 500 Steep Point Road, in Beaufort, Carteret County as requested in the permittee's application, dated 10/18/23, received by DCM on 10/23/2023 and accepted complete on 11/15/2023. This permit, issued on 11/20/2023, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: addition of 26,917.5 sf of fill (with a gradual slope) within the AEC and the repair of the existing rock retaining wall along the house. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on 11/15/2023. (GS 113A-120) (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances, and FEMA Flood Regulations. (GS 113A-120) (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (GS 113A-120) (4) A copy of this permit shall be posted or available on site. Contact this office at 252-515-5400 for a final inspection at completion of work. (GS 113A-120) (Additional Permit Conditions on Page 2) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on: DECEMBER 31, 2026 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. This permit may not be transferred to another party without the written approval of the Division of Coastal Management. &.u., x d' .' (07H .0209 (d)(10) (6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (07H .0209(d)(3) (7) Any proposed for grading within the 30' buffer from the NHW must be contoured to prevent additional stormwater runoff to the adjacent marsh or waters. This area shall be immediately vegetatively stabilized and must remain in a vegetated state. (07H .0209(d)(3) (8) No disturbance of any wetlands (coastal and 404) is authorized. Per the USACOE rep, no additional areas are to be disturbed outside what has already been touched and disturbed. USACE is closely monitoring to ensure that no areas of further vegetation are removed in the area, should any additional disturbance occur, a violation may be issued by USACOE. (GS 113A-120) and 07H .0205 (d) (9) The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of normal high water (Estuarine Shoreline - ORW Area of Environmental Concern). (07H .0209(d)(2) (9) The repair of the existing rock retaining wall shall remain in the same footprint and shall not fill or remove any wetlands (coastal or 404). (GS 113A-120) (11) The Permittee and/or the Permittee's Agent shall be responsible for obtaining any and all necessary authorizations, approvals, or zoning and building permits from the local government having jurisdiction (Town of Beaufort and /or Carteret County) prior to commencing work.
