RE: EXEMPTED PROJECT – SINGLE FAMILY RESIDENCES WITHIN THE ESTUARINE
SHORELINE AREA OF ENVIRONMENTAL CONCERN (15A NCAC 07K .0208).

AREA OF ENVIRONMENTAL CONCERN – Estuarine Shoreline (ORW)
Dear Mr. Turner,
I have reviewed your inquiry concerning the necessary filing of an application for a minor development
permit under the Coastal Area Management Act. I have determined that the activity you propose of adding
an unfinished 27’ x 17’ enclosure inside the existing built-upon footprint of the ground floor of your single-
family residence is exempt from needing a minor development permit, as long as it remains consistent with
your project drawing dated March 11, 2016 and meets the conditions specified below. If your plans should
change and your project will no longer meet these conditions, please contact me before proceeding.
CONDITIONS FOR SINGLE FAMILY RESIDENCE EXEMPTION
1. All development shall be located at least 40 feet landward of the normal high water level from
waters classified as Outstanding Resource Waters (ORW).
2. No ground disturbance or land disturbing activity shall occur within 40 feet of the normal high water
level of waters classified as ORW.
3. The development may not cause the portion of the lot within 575 feet of the normal high water level
in waters classified as ORW to exceed 25% built-upon area.
4. The enclosure may not increase the conditioned square footage of the residence and may have no
new plumbing, electrical, or other service connections.
5. The development shall be consistent with all other applicable CAMA standards, North Carolina
Building Code standards, local ordinances, and local land use plans in effect at the time the
exemption is granted.
6. This exemption does not allow for any development within any wetlands or open water areas. Any
proposal to modify or alter the development plan as proposed will require additional authorization
from the Division of Coastal Management.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other
State, Federal or Local authorization and N.C. Building Permits. This exemption expires 90 days from the
date of the letter.
