Dear Sirs,
The North Carolina Department of Transportation (NCDOT) proposes to replace the existing 86-foot,
five -span bridge with a 95-foot, two -span bridge on existing alignment. Traffic will be maintained using
an off -site detour. After input from residents in the vicinity, the project was redesigned to address
concerns with the original design.
Impacts to wetland have been avoided for this project. There will be 95 linear feet of permanent stream
impact to Slash Creek due to riprap fill at the bridge approaches, and <0.006 acre for riprap fill at the end
of two pipes for stormwater discharge. Cofferdams will be used for the removal of the existing interior
bents and construction of end bents for the new structure resulting in 15 feet (0.027 acre) of temporary
impact.
Aerial utilities will be relocated with no impact to jurisdictional resources. The water line currently
attached to the bridge will be directionally bored under Slash Creek, also resulting in no impacts to
jurisdictional resources.
Please see enclosed copies of the Division of Coastal Management Major Permit Forms 1 and 5, permit
drawings, stormwater management plan, and utility drawings for the above referenced project. A Type IA
Categorical Exclusion was completed in July 2019 and distributed shortly after. Additional copies are
available at the NCDOT website: https://xfer.services.nedot.gov//pdea/EnvironmentalDocs/
This project calls for a letting date of October 17, 2023 and a review date of August 29, 2023.

In addition to this completed application form, (MP-1) the following items below, if applicable, must be submitted in order for the application
package to be complete. Items (a) — (Q are always applicable to any major development application. Please consult the application
instruction booklet on how to properly prepare the required items below.

drainage patterns have been maintained.

The North Carolina Department of Transportation is planning to replace Bridge No. 8 over Slash Creek
on NC 12 in Hatteras, Dare County. This project was redesigned to address concerns in the project
vicinity. The project involves replacement of the existing 86-foot, 5-span bridge and approaches with a
new 95-foot, 2-span bridge. This project crosses an Area of Environmental Concern, as defined by the
North Carolina Division of Coastal Management (DCM) and must be approved by the DCM under
provisions of the Coastal Area Management Act (CAMA). One of the prerequisites to this approval is that
adjacent riparian landowners be given an opportunity to comment on the proposal. A permit application,
vicinity map and site drawings are enclosed for your review. This package replaces the previous package
sent in March 2022.
The attached form is submitted to ensure that you have an opportunity to comment on the proposal. The
work planned is depicted in the attached drawing. If you have no objections to the proposal, please return

General Statutes and Division of Coastal Management Major Permit approval procedures require that
riparian landowners with property adjoining a proposed development in an Area of Environmental Concern
(AEC) be given thirty (30) days in which to comment on the proposed development. This form allows the
adjacent riparian landowner to express either: (1) that he/her objects to the project; or, (2) that he/her does
not object and desires to waive his/her right to the 30-day period so that the processing of the application
can progress more rapidly. Of course, the adjacent riparian landowner need not sign this form at all if
he/she so chooses.

Mr. Daisey,
My name is Mark Palmatier, I own the old channel Bass property next to the slash creek bridge
NCDOT has plans to replace. I purchased this historical property for my family and I to build
another seafood restaurant there where the old channel bass stood since the 50's, It was one
of the first restaurants on Hatteras island . As you can imagine people in Hatteras like to stay
with the local landscape and traditions of Hatteras village, that's why I love this place . The
original plans impacted my property and Jeff Odens more than anyone else, the DOT went
back and revised the plans. I met with the dot appraiser Robert Chadwick, Mr. Chadwick and
myself didn't think the new plans where gonna effect future restaurant. I was under the
impression I could still use parking on side of HWY 12 for to go orders, I just could not build
any structure over DUE area, now looking at the new plans it is going to impact me. The
embankment and new guardrail will be in front of the existing parking places there , there will
be no parking there. I will lose all this property, only access to my property and restaurant will
be Island Club Lane . Another issue with the proposed new bridge is run off, right now we do
not have any problem with flooding , I know there are plans to put in drainage but if drains
aren't maintained it's useless. There is a DOT drain in front of the post office that never drains
because it's not maintained and that area has standing water with flooding and storms. Mr.
Daisey I don't understand why DOT cannot rebuild this bridge as it is now and not effect
anyone in the village , a lot of people have asked this same question. We have a bridge that is
over 60 years old and still in service , something was done right , I just wanted to write this
letter to be on record about my feelings about this project . I moved here from Leland NC to get
away from progress but I guess it follows us everywhere including this beautiful island.

Here is an update on the issues concerning the replacement of Bridge 8 over the Slash in Hatteras:
-The utilities will not be able to be moved prior to Memorial Day due to right of way issues that have yet to be
resolved. It would be good to go ahead and get the permit for the utility relocation prior to the bridge Letting, as to not
cut into the time of the bridge replacement. It was noted that a section of the sidewalk that was installed will need to
be removed to allow the boring of the water line under the Slash.
-As for the sidewalk, it is not shown on the current set of drawings, but is being added. The sidewalk that Hatteras has
installed is in conflict with the design of the new bridge. NCDOT will remove the sidewalk and replace it with the
sidewalk that was shown in our design. It is unclear why Hatteras installed sidewalk at this location. They were made
aware of DOT's intent to include sidewalk with the bridge replacement as far back as 2018.
-it has been determined that creekside access to Slash Creek at the Hatteras Village Medical Center will still be
available. DOT's current design shows riprap along the "beach" area at this site. The rip rap will not cover the entirety
of the "beach". Also, there is an additional —50 ft of non-bulkheaded shoreline between DOT's proposed riprap and the
remnants of bulkhead on this property allowing for ample space for the launching of kayaks and other small
watercraft. The "parking area" that was used will no longer be available after construction of the new bridge. Thiis area
will have guardrail and curb/gutter installed.
-DOT has determined that the access Mr. Oden references to access his backyard is not an approved driveway to access
NC12. This area, once constructed, will have guardrail and curb/gutter installed.
-Drop inlets in vicinity of Mr. Oden's property and along Islington Court had been redesigned to address Mr. Oden's
previous objections to the project. Originally there were 4 inlets proposed. To address Mr. Oden's objection while still
accomplishing the needed stormwater drainage, these were reduced to 2 inlets. As for Mr. Oden's concern that the
inlets will increase flooding on his property, there is no evidence to substantiate this claim. If water from excessive high
tides or storm surge pushed up into these inlets, the entire area would already be inundated. If anything, these inlets
would help to drain the areas faster.
This project went through a redesign to address objections primarily by Mr. Oden. NCDOT believes it has addressed his
concerns to its most practicable extent while trying to insure that the project is constructed as a safe and resilient
structure along a major arterial for the overall public.

After my initial review of the general permit application related to utilities relocation in the vicinity of
the proposed B-5610 project, please provide additional information on the following:
1. On permit drawing sheet drawing 2 of 5 the shading for asphalt shoulder and concrete
sidewalk is the same. Is the concrete sidewalk that currently exists at the project site and
within the project limits accurately depicted on the provided drawings and is there any
disturbance/removal of the existing concrete sidewalk associated with the utility relocation
project? The sidewalk was recently installed through a CAMA Major Permit processed by the
Elizabeth City DCM office with Dare County as the applicant. Finally, if there is any disturbance
and/or removal of the existing sidewalk, has NCDOT coordinated the proposal with Dare
County?

Greg,
I placed in the mail Thursday the application for relocation of utilities associated with the future replacement of Bridge 8
in Hatteras. In the mailed package I included the greencards we had received with the initial bridge replacement
proposal that included the utility design. No objection was received for the Daniels property or the medical center
property. The Oden greencard is included, however they objected to the bridge proposal. Attached is copy of the
Adjacent Riparian Property Owner Notification/Waiver from Mr. Oden for the proposed utility relocation. Paul Williams
met with Mr. Oden last week where he agreed that he had no objection for the utility work. I have not received the
greencard back from the Palmetier property. I have notice that he picked his package up from the Post Office on March
15'. 1 believe Paul met with the individual around that time and he did not convey any objections to him at that
time. He apparently does not live in the area. Regardless, he has been in receipt of the proposal for 19 days as of
now. NCDOT believe it has fulfilled its obligation to notify the riparian landowners in association with the proposed
relocation of utilities along US 12 at Slash Creek. This proposed work will not result in impacts to jurisdictional features
identified with the study area. NCDOT requests issuance of a General Permit 1600 for the proposed work. Please find
the attached application. As stated earlier, a hard copy is in the mail as well.

DCM has had some continued discussion regarding the current /post project usage of the unimproved beach area and adjacent
to Dare County Bridge No. 8 in Hatteras, Dare County and how the area will look/be able to be utilized post project. DCM
requests additional information and/or clarification that might not be contained in the information that has already been
received. If NCDOT has already provided any requests within this email, it might be beneficial to expand on previously
submitted information for better clarification.
• In the NCDOT email dated 04/14/2023 to DCM it is stated "It has been determined that creekside access to Slash Creek
at the Hatteras Village Medical Center will still be available. DOT's current design shows riprap along the "beach" area

o DCM requests that the additional information be added to Sheet 4 of 6 contained within the submitted drawings
include more detailed information as related to the beach area. It would be beneficial for the drawings to include a
call out that shows the stated 50' of non -bulk headed shoreline between NCDOT's proposed rip rap and the
remnant bulkhead on the adjacent property and call out that shows the distance of proposed rip rap that will exist
post project in the existing "beach area".

o DCM requests confirmation that the proposed guardrail and curb/gutter to be installed adjacent to the beach area is
being incorporated into the project to the most minimal extent practicable in relation to NCDOT's purpose/need.
When the bridge was being designed, redesigned and/or design alternatives were being developed, was the use of
sheet pile investigated in order to reduce fill slopes and lessen impacts to the adjacent area in the northwest
quadrant of the proposed bridge replacement?
Sheet piling was never investigated during the design of this project.
o Sheet 4 of 6 contained within the submitted drawings appears to depict stormwater pipe extending out from the
proposed rip rap revetment into areas that are adjacent to what is currently described as the "beach" area. If the
piping does extend out, what is the approximate length of pipe within surface water? Is this pipe intended to be
above or below NWL and if intended to be below NWL will informationaliwarning signage in its approximate
location be included in the proposed bridge replacement project?
See attached periuit drawings. Also, the fine responsible for the penuit drawings stated that the pipe will be
above NWL and extend approximately IOft beyond the bank.
• Comments received by DCM after NCDOT submitted the application for bridge replacement and information supplied to
DCM by NCDOT related to the summary of the November 20, 2022 public information meeting raised concerns by the
public related to the water access adjacent to the bridge.
o DCM requests that NCDOT provide information/narrative on how the current redesign addressed public
comments/concerns related to water access adjacent to the bridge. It would be beneficial to explain how the area
was proposed originally and any differences/changes that have been incorporated into the current redesigned bridge
project post public information meeting.
The redesign efforts lowered the elevation of the proposed bridge thus reducing the limits the proposed rip rap in
the vicinity of the kayak launch.
o During redesign of the bridge replacement project after the public information meeting, was there any continued
coordination between NCDOT and local business owners concerned about water access or Dare County in order to
attempt address providing continued access/parking similar to what is currently existing adjacent to the bridge.
No additional coordination was completed with any local business owners after the public meeting. It was
determined in the Public Comment Response Meeting that coordination with the Kayak Shop would be
completed, but it was put on hold until the final impacts are detennined.

Thanks for the quick response.
The guardrail is being requested by DCM only on drawings associated with the bridge replacement. It is not necessary to be
shown on any drawings related to the utility project. Since there is currently no existing guardrail and guardrail is being
proposed in association with the new bridge replacement, DCM considers it a part of the total project and a new permanent
feature possibly within the 75' estuarine AEC buffer, therefore should be depicted on the drawings.

It may take a little longer than I'd like to get the utility drawings updated. The utility coordinator is out until July loth. I am assuming that
we are referring just to the drawings associated with the utility relocation. The guardrail is not a part of that work. Is it necessary to
show the proposed guardrail on these drawings? That guardrail will not be installed until the bridge replacement occurs and with the
issues we've been dealing with on the bridge replacement, there is a possibility that some change may occur to its installation by the time
the bridge comes along.

Appreciate you reaching out to me today related the voicemail that I left prior to your vacation.
I was reaching out to request that if the guardrails located on the approaches associated with the new bridge structure are
not shown on the submitted drawings, DCM requests that they bee added. I think it would be beneficial to show the proposed
guardrails on Permit Drawing Sheet 2 of 6 or Sheet 3 of 6 and Sheet 4 of 6. The whole drawing sheet package would not have
to be resubmitted, just two drawings that shows the proposed locations. This would show how the guardrails interact with the
existing parcels in the immediate bridge quadrants.

SPECIAL CONDITIONS
1. The NCDOT shall implement the "Guidelines for Avoiding Impacts to the West Indian Manatee:
Precautionary Measures for Construction Activities in North Carolina Waters" as identified by
the USFW Service.
2. The Wilmington District, Federal Highway Administration, U.S. Fish and Wildlife Service
(USFWS), and the North Carolina Department of Transportation (NCDOT) have
conducted programmatic Section 7(a)(2) consultation for the Northern long-eared bat
(NLEB) for NCDOT projects located in Divisions 1-8. The result of this programmatic
consultation is a Programmatic Biological Opinion (PBO) issued by the USFWS titled,
"Programmatic Biological Opinion — Revised, NCDOT Program Effects on the Northern
Long-eared Bat in Divisions 1-8", dated December 15, 2022. This PBO contains agreed
upon conservation measures which would minimize take of NLEB. As noted in the PBO,
applicability of these conservation measures varies depending on the location of the
project. The USFWS has documented that no reasonable and prudent measures, nor
terms and conditions, are necessary or appropriate to minimize the amount or extent of
incidental take of NLEB caused by the Action; therefore, the incidental take statement
does not provide reasonable and prudent measures for this species. Department of the
Army (DA) authorization under general permit or standard permit (Individual Permit) is
conditional upon the permittee's compliance with applicable, agreed upon conservations
measures of the PBO, which is incorporated by reference in this verification letter.
Failure to comply with the applicable conservation measures, where a take of the NLEB
occurs, would constitute an unauthorized take by the permittee, and would also
constitute permittee non-compliance with this verification letter. The USFWS is the

I wasn't aware that there were still issues with the property owners regarding stormwater. I thought the revised application had
addressed those concerns.
We wouldn't see anywhere near this amount of DI's and piping for a typical bridge replacement on a SR route but it's not unusual to see
in a more urban setting like this one. The direct pipe to stream discharge of stormwater isn't something we like to see but given the
amount of BUA there were not any good options for treatment. I had several discussions with DOT regarding this with the first
application last year. We don't typically allow deck drains on smaller bridges but sheetflow of stormwater off the road shoulder is
preferred to ditches/pipes if the grade allows and there is a good opportunity for vegetated treatment. In this case there were limited
opportunities even for that.

DCM has received some feedback from adjacent property owners in the vicinity of the proposed replacement of Dare County
Bridge No. 8 over Slash Creek in Hatteras on the plans submitted by NCDOT.
It seems that there is belief among some of the property owners that the proposed stormwater collection system might be
more robust than what they think might be necessary when you take into account the elevations in around the project site
and the current existing stormwater situation. The property owner on the northwest quadrant is stating that
stormwater/flooding coming off the bridge/roadway has never been an issue (meaning that whatever comes off of the
bridge/roadway naturally makes it's way to Slash Creek), but that wind driven flooding from down Islington Ct./Slash Creek is a
more typical problem and that the proposed drop inlets are at a higher elevation than what would alleviate any of the wind
driven accumulation of water.
I have a couple questions you might be able to address:
• Is the proposed amount of catch basins, drop inlets, and stormwater piping typically what you see on bridge projects of
this size and with similar elevations of the surrounding area?
• Is there a situation(s) in relation to similar projects that the piping of stormwater would be seen as non -preferable over
existing current stormwater components, or lack there of .... meaning stormwater just sheeting off of the roadway into
the adjacent Right -of -Way and/or into deck drains located on a bridge and then into surface water.

The project shall be constructed in accordance with your revised application dated received March 3, 2023. After
reviewing your application, we have decided that these impacts are covered by General Water Quality Certification
Number 4135. This certification corresponds to the Regional General Permit 201902350 issued by the Corps of
Engineers. In addition, you should acquire any other federal, state or local permits before you proceed with your
project including (but not limited to) Sediment and Erosion Control, Non -Discharge and Water Supply Watershed
regulations. This approval will expire with the accompanying 404 permit.
This approval is valid solely for the purpose and design described in your application (unless modified below).
Should your project change, you must notify the NCDWR and submit a new application. If the property is sold, the
new owner must be given a copy of this Certification and approval letter,and is thereby responsible for complying
with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total
impacts to streams (now or in the future) exceed 300 linear feet, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the
conditions listed in the attached certification(s) and any additional conditions listed below.
Condition(s) of Certification:
1. The issuance of this certification does not exempt the Permittee from complying with any and all statutes, rules,
regulations, or ordinances that may be imposed by other government agencies (i.e. local, state, and federal) having
jurisdiction, including but not limited to applicable buffer rules, stormwater management rules, soil erosion and
sedimentation control requirements, etc.

2. The Permittee shall ensure that the final design drawings adhere to the permit and to the permit drawings submitted
for approval. [15A NCAC 02H .0507(c) and 15A NCAC 02H .0506 (b)(2) and (c)(2)]
3. Adherence to The Guidelines for Avoiding Impacts to the West Indian Manatee: Precautionary Measures for
Construction Activities in North Carolina Waters will be required throughout construction.
4. If activities must occur during periods of high biological activity (e.g. sea turtle nesting, fish spawning, or bird
nesting), then biological monitoring may be required at the request of other state or federal agencies and coordinated
with these activities. All moratoriums on construction activities established by the NC Wildlife Resources
Commission (WRC), US Fish and Wildlife Service (USFWS), NC Division of Marine Fisheries (DMF), or National
Marine Fisheries Service (NMFS) shall be implemented. Exceptions to this condition require written approval by
the resource agency responsible for the given moratorium.
5. The outside buffer, wetland or water boundary located within the construction corridor approved by this
authorization, including all non-commercial borrow and waste sites associated with the project, shall be clearly
marked by highly visible fencing prior to any land disturbing activities. Impacts to areas within the fencing are
prohibited unless otherwise authorized by this certification. [15A NCAC 02H.0501 and .0502]
6. During the construction of the project, no staging of equipment of any kind is permitted in waters of the U.S.,
or protected riparian buffers. [I 5A NCAC 02H.0506(b)(2)]
7. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent
contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. [15A NCAC
02H.0506(b)(3)]
8. No rock, sand or other materials shall be dredged from the stream channel except where authorized by this
certification. [15A NCAC 02H.0506(b)(3)]
9. When applicable, all construction activities shall be performed and maintained in full compliance with G.S.
Chapter 113A Article 4 (Sediment and Pollution Control Act of 1973). Regardless of applicability of the
Sediment and Pollution Control Act, all projects shall incorporate appropriate Best Management Practices for
the control of sediment and erosion so that no violations of state water quality standards, statutes, or rules
occur. [15A NCAC 02H .0506 (b)(3) and (c)(3) and 15A NCAC 02B.02001
a. Design, installation, operation, and maintenance of all sediment and erosion control measures shall be
equal to or exceed the requirements specified in the most recent version of the North Carolina Sediment
and Erosion Control Manual, or for linear transportation projects, the NCDOT Sediment and Erosion
Control Manual.
b. All devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) sites,
including contractor -owned or leased borrow pits associated with the project. Sufficient materials
required for stabilization and/or repair of erosion control measures and stormwater routing and
treatment shall be on site at all times.
c. For borrow pit sites, the erosion and sediment control measures shall be designed, installed, operated,
and maintained in accordance with the most recent version of the North Carolina Surface Mining
Manual. Reclamation measures and implementation shall comply with the reclamation in accordance
with the requirements of the Sedimentation Pollution Control Act and the Mining Act of 1971.
d. If the project occurs in waters or watersheds classified as Primary Nursery Areas (PNAs), SA, WS-1,
WS-11, High Quality Waters (HQW), or Outstanding Resource Waters (ORW), then the sedimentation
and erosion control designs shall comply with the requirements set forth in 15A NCAC 04B .0124,
Design Standards in Sensitive Watershed. [15A NCAC 02H.0506(b)(3) and (c)(3); GC 4135]
10. Sediment and erosion control measures shall not be placed in wetlands or surface waters or within 5 feet of the
top of bank without prior approval from DWR. [15A NCAC 02H.0506(b)(3) and (c)(3)]
11. Erosion control matting in riparian areas shall not contain a plastic or nylon mesh grid which can impinge and
entrap small animals. Matting should be secured in place by staples, stakes, or wherever possible live stakes of
native trees. Riparian areas are defined as a distance 25 feet from top of stream bank. [15A NCAC 0213.02011

12. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, then design and
placement of temporary erosion control measures shall not be conducted in a manner that may result in dis-
equilibrium of wetlands, stream beds, or banks, adjacent to or upstream and downstream of the above
structures. All sediment and erosion control devices shall be removed from wetlands and waters and the
natural grade restored within two (2) months of the date that the Division of Energy, Mining and Land
Resources (DEMLR) or locally delegated program has released the specific area within the project. [I5A
NCAC 02H.0506(b)(3) and (c)(3)]
13. As a condition of this 401 Water Quality Certification, the bridge demolition and construction must be
accomplished in strict compliance with the most recent version of NCDOT's Best Management Practices for
Construction and Maintenance Activities. [I5A NCAC 02H .0507(d)(2) and 15A NCAC 02H .0506(b)(5)]
14. Bridge deck drains shall not discharge directly into the stream. Stormwater shall be directed across the bridge
and pre-treated through site -appropriate means (grassed swales, pre -formed scour holes, vegetated buffers, etc.)
where possible before entering the stream. To meet the requirements of NCDOT's NPDES permit
NCS0000250, please refer to the most recent version of the North Carolina Department of Transportation
Stormwater Best Management Practices Toolbox manual for approved measures. [15A NCAC 02H .0507(d)(2)
and 15A NCAC 02H .0506(b)(5)]
15. All bridge construction shall be performed from the existing bridge, temporary work bridges, temporary
causeways, or floating or sunken barges. If work conditions require barges, they shall be floated into position
and then sunk. The barges shall not be sunk and then dragged into position. Under no circumstances should
barges be dragged along the bottom of the surface water. [I5A NCAC 02H.0506(b)(3))
16. Bridge piles and bents shall be constructed using driven piles (hammer or vibratory) or drilled shaft
construction methods. More specifically, jetting or other methods of pile driving are prohibited without prior
written approval from the NCDWR first. [I5A NCAC 02H.0506(b)(2)]
17. The use of rip -rap above the Normal High Water Mark shall be minimized. Any rip -rap placed for stream
stabilization shall be placed in stream channels in such a manner that it does not impede aquatic life passage.
[I 5A NCAC 02H.0506(b)(2)]
18. No drill slurry or water that has been in contact with uncured concrete shall be allowed to enter surface waters.
This water shall be captured, treated, and disposed of properly. [15A NCAC 02H .0506(b)(3)]
19. A turbidity curtain will be installed in the stream if driving or drilling activities occur within the stream
channel, on the stream bank, or within 5 feet of the top of bank, or during the removal of bents from an old
bridge. This condition can be waived with prior approval from the NCDWR. [15A NCAC 02H .0506(b)(3)]
20. Native riparian vegetation must be reestablished in the riparian areas within the construction limits of the
project by the end of the growing season following completion of construction. [15A NCAC 02H.0506(b)(2)]
21. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters
is prohibited. [I5A NCAC 02H.0506(b)(3)]
22. NCDOT shall be in compliance with the NCS00250 issued to the NCDOT, including the applicable requirements
of the NCGO1000.
23. The permittee and its authorized agents shall conduct its activities in a manner consistent with State water quality
standards (including any requirements resulting from compliance with §303(d) of the Clean Water Act) and any
other appropriate requirements of State and Federal law. If the NCDWR determines that such standards or laws
are not being met (including the failure to sustain a designated or achieved use) or that State or federal law is being
violated, or that further conditions are necessary to assure compliance, the NCDWR may reevaluate and modify
this certification. [15A NCAC 02B.0200]
24. The Permittee shall report any violations of this certification to the Division of Water Resources within 24 hours
of discovery. [I5A NCAC 02B.0506(b)(2)]

25. The NCDOT will conduct a pre -construction meeting with all appropriate staff to ensure that the project supervisor
and essential staff understand the permit conditions and any potential issues at the permitted site. NCDWR staff
shall be invited to the pre -construction meeting. [15A NCAC 02H.0506(b)(2) and (b)(3)]
26. Upon completion of the project (including any impacts at associated borrow or waste sites), the NCDOT Division
Engineer shall complete the "Certification of Completion Form" to notify the NCDWR when all work included in
the 401 Certification has been completed. (I5A NCAC 02H.0502(f)]
27. A copy of this Water Quality Certification shall be maintained on the construction site at all times. In addition, the
Water Quality Certification and all subsequent modifications, if any, shall be maintained with the Division Engineer
and the on -site project manager. [15A NCAC 02H .0507(c) and 15A NCAC 02H .0506 (b)(2) and (c)(2)]

hearing. You may obtain the petition form from the office of Administmtive hearings. You must file the petition

Good afternoon,
I'm processing a CAMA permit application submitted to DCM by NCDOT related to the proposed replacement Dare County
Bridge No. 8 on NC Highway 12 in Hatteras. Comments received by DCM after NCDOT submitted the application for bridge
replacement and information supplied to DCM by NCDOT related to the summary of a November 20, 2022 public information
meeting hosted by NCDOT in Hatteras Village raised concerns by the public related to the water access adjacent to the bridge.
The access area is located between the Hatteras Village Medical Center property (57635 NC Highway 12, Hatteras) and Dare
County Bridge No. 8 (that carries NC Highway 12 over The Slash). Please see attached aerial for exact location
In a NCDOT email sent to DCM dated 04/14/2023 it is stated "It has been determined that creekside access to Slash Creek at
the Hatteras Village Medical Center will still be available. DOT'S current design shows riprap along the "beach" area at this
site. The rip rap will not cover the entirety of the "beach". Also, there is an additional —50 ft of non-bulkheaded shoreline
between DOT'S proposed riprap and the remnants of bulkhead on this property allowing for ample space for the launching of
kayaks and other small watercraft. The "parking area" that was used will no longer be available after construction of the new
bridge. This area will have guardrail and curb/gutter installed."
I did a brief review of the Dare County CAMA LUP, and found that there are policies related to the public's right to access and
use the public trust areas and waters. DCM did receive acknowledgment as a property owner (returned Green Card as a
Riparian Adjacent Property Owner) from Dare County, but I wanted to inquire if NCDOT and Dare County has had any
discussion/coordination on the "beach" access area and how it might look and/or function post bridge replacement project.
Additionally, has Dare County been contacted by property owners or has there been any coordination/communication between
concerned property owners and Dare County related to water access issues in conjunction with the proposed bridge
replacement project?
Any information you may be able to provide will help me continue to process the permit application and in my ongoing
coordination with NCDOT. Thanks for your time.

I reached out to NCDOT related to the informational meeting held in Hatteras related to the proposed replacement
of Dare County Bridge No. 8 (B-5610).
Jason was able to provide a pretty detailed response on the comments received and states "redesign happened in
conjunction with the public meeting to make sure that comments had been heard and addressed as appropriate".
I'm going to further review, but at this time it does not seem that I have received any new concerns from residents
triggered by the resubmitted application in March 2023. All concerns that I am aware of seemed to be directly
stated in the informational meeting/comment process and NCDOT is stating that they have "addressed as
appropriate".
Please see previous email and attachments (2 pdf's) related to NCDOT's response to my inquiry about the
meeting/response. I've also attached (email file) the response I received from DWR related my inquiry about the
stormwater design associated with the bridge replacement.

Greg,
You are correct in that typically on a project this size, we don't have this level of public involvement. You will recall that we attempted to
permit this replacement last year, with a larger than typical showing from the public with concerns about the project. Most of these
comments originated from the ARLO packages that were sent out prior to the CAMA application submittal. Comments were coming in
from the adjacent landowners as well as the general public. This resulted in the current re -design that attempted to address legitimate
concerns about the project. This redesign happened in conjunction with the public meetingto make sure that comments had been heard
and addressed as appropriate.
Attached is a summary of the 11/20/2022 meeting as well as the sign in sheet for the event. Outside of a project initiation letter in 2016
and a project newsletter in 2019, 1 am not aware of any other public interactions.

Preliminary alternatives were developed and evaluated for their ability to meet the purpose and need for the
project, as well as how they minimize impacts to the human and natural environments. The current detailed
study alternatives were selected based on those evaluations Opportunities to further minimize the impacts to
the human and natural environment will continue to be evaluated durina the refinement of preliminary and final
designs.

incorporate several modes of transportation when building new proiects or making improvements to existing
infrastructure The benefits of this approach include making it easier for travelers to get where they need to go
encouraging the use of alternative forms of transportation, building more sustainable communities increasing
connectivity between neighborhoods streets and destinations and improving safety for pedestrians cyclists and
motorists.
Themes Addressed:
• Concern regarding impacts to business operations during construction.
Temporary visual impacts would affect Properties adjacent to areas where construction staging and stockpiling
operations occur. Upon project completion the contractor would be required to remove all equipment and excess

materials and reseed any disturbed areas. Generally, low-cost and easily implemented construction noise control
measures should be incorporated into the project plans and specifications to the extent practicable These
measures may include but are not limited to work -hour limits equipment exhaust muffler requirements, haul -
road locations elimination of "tail gate banging" ambient -sensitive backup alarms construction noise complaint
mechanisms and consistent and transparent community communication
Construction activities may result in temporary noise occurrences but NCDOT will implement practices to
minimize noise during construction Existina trees/plantings generally do not provide noise reduction.
Themes Addressed:
• Request that the bridge width be reduced to 33 feet from the current design width.
Preliminary design alternatives were developed and evaluated for their ability to meet the purpose and need for
the project as well as how they minimize impacts to the human and natural environments. The proposed design
was selected based on those evaluations and with consideration to local standards for pedestrian facilities.
NCDOT will continue to minimize the proiect's impacts to adjacent parcels to the greatest extent practicable
during the refinement of preliminary and final designs As a result of the November 10 2022 public meeting, the
grass strip has been removed and the revised bridge width will be 46 feet on the approaches and 48 feet on the
bridge (34 feet of clear roadway width 45 feet and 5 inches from bridge rail to bridge rail).
Themes Addressed:
• Request that construction occur in the winter during the Town's off-season for tourism.
While project construction may extend into more heavily trafficked times of the year, NCDOT is working to create
a construction schedule that will avoid maior impacts during the area's busier seasons. Construction is
anticipated to begin in the Fall of 2023 and conclude by the end of Spring 2024.
Themes Addressed:
• question from local business owner asking if the proposed bridge design will remove the current kayak
access to Slash Creek that their business relies upon.
The right-of-way of the proposed design will maintain the same extents as current NCDOT right-of-way in the
project area During project construction the area immediately around and under the bridge will not be
accessible to the public in order to maintain a safe environment for the both the public and the construction
contractor crews.
STEWART
Themes Addressed:
• Question regarding the elevation of the proposed bridge design.
The proposed bridge design is at an elevation of 6.8 feet at its highest point and 6.61 feet at its lowest point
Themes Addressed:
• Request that no new drainage systems be installed on Islington Court to mitigate right of way impact to
adjacent parcels.
• Concern regarding flooding impacts in the project area after construction.
• Concern regarding flooding on the proposed detour route along Eagle Pass Road.
NCDOT is taking steps to ensure that this project will not cause any increase to the amount of flooding around
the proiect area. Current conditions will either remain consistent or be improved by the addition of the proiect. A
detailed hydraulic analysis will be conducted during the final design. Potential impacts to an adjacent Property
will be evaluated at that time and minimized to the extent practicable.
NCDOT will also continue to evaluate ways to reduce stormwater impacts to properties and will determine the
appropriate location for drainage boxes and other stormwater facilities during the refinement of final design
Themes Addressed:
• Request that the bridge be closed to through traffic and turned into a pedestrian bridge while also
shifting project funding to the maintenance of Isabel Inlet.
Preliminary alternatives were developed and evaluated for their ability to meet the purpose and need for the
proiect. Based on traffic demand patterns and the lifespan of the bridge it was determined that the proposed
design was the strongest alternative to meet these needs. NCDOT will continue to refine the project design to
minimize the impact on the surrounding area.
The project team met on January 20th, 2023 to review and consider each comment. The responses above
address the comments that were received. The project team greatly appreciates the input received. NCDOT
will continue to refine the project design, where feasible, based on the comments received. You may contact
