Statement of Compliance and Consistency
This permit is subject to compliance with this application and permit conditions. Any violation of these terms may
subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for
compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification of the adjacent riparian property owner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.
River Basin Rules Applicable To Your Project:

NC Design Professional (Engineer or Architect). In lieu of the
engineering design Currituck Inspections will accept the
following design as a proven empirical design method. Bulkhead
height must be no greater than 5' in height in order to be
accepted and approved by our department. Structures in a VE
Special Flood Hazard Area will require a sealed design by an
NC Design Professional.
Bulkhead maximum height is 5' measured from the mud line.
Bulkheads greater than 5' in height will require a sealed design
by an NC Design Professional.

I did not receive any comments from Robin & Tom Tuite or Ace in the Hole about the project at 137 Shell Dr.
Kelly Brady is no longer employed with Currituck County. David Lubelski (copied on this email) replaced her and is the
current CAMA LPO in our Corolla Satellite office (252-453-8555).

On or about July 251h, Stephen Jernigan submitted to the County a Minor Permit application for work at 137 Shell Drive
that could only be by authorized under a General Permit.
You forwarded the application to me; however, I neglected to tell Mr. Jernigan to renotify the ARPOs using the General
Permit version of the Notification Form.
Because Mr. Jernigan used the Minor Permit notification forms, any comments the ARPOs might have had would have
gone to either you or Kelly Brady.
Can you touch base with Kelly and please let me know if you received any objections or no objections from Robin & Tom
Tuite or from an organization called "Ace In The Hole"? According to the USPS tracking number, both parties received
the notification form from Mr. Jernigan.
