2) Copies of all referenced documents shall be readily available on site when a Division representative
inspects the project for compliance. In accepting this transfer, the new permittee agrees that all
conditions and stipulations of the active permit remain in force.

on February 24, 2020, for the maintenance excavation of a navigational and access channel adjacent to Bald
Eagle Lane. State Permit No. 164-97 has a Maintenance Clause and is set to expire December 31,2024.
Frank Golden is the property owner of 8700 Bald Eagle Lane and acquired the property in July of 2019. Mr.
Golden's property is one of the properties associated with the permitted dredge footprint. This Office has no
objection to the transfer a of State Permit No. 164-97. Maritech, LLC. has submitted a check (no. 2673) on
behalf of Frank Golden for the fee amount of$100.

8. PROJECT SUMMARY: The applicant is requesting to perform maintenance dredging
of an existing channel, adjacent to eleven homes on Bald Eagle Lane.

9. PROJECT DESCRIPTION
The project site is an existing access channel to the Atlantic Intracoastal Waterway
(AIWW)located adjacent to eleven singly-family residences, between 8637 and 8744 Bald
Eagle Lane, in the Porter's Neck area of New Hanover County. The site is accessed by
Porter's Neck Rd., off U.S. Highway 17-North. Bald Eagle Lane lies parallel to the
AIWW extending from Futches Creek south to the Figure 8 Island Bridge, and is
developed with single family residences on large lots.
The access channel runs parallel to the shoreline with a perpendicular channel at each end
connecting to the AIWW. The access channel was originally permitted for excavation in
1978, by State Permit##170-78, and has not been dredged since that time. Shoaling,
primarily in the southern channel leg, has prompted the applicant to apply for a
maintenance permit on behalf of the eleven property owners.
New Hanover County classifies this area as Conservation in their Land Use Plan. The
area is not a designated Primary Nursery Area by the NC Division of Marine Fisheries.
The waters of Middle Sound are classified SA-ORW by the N.C. Division of Water •
Quality, and are open to the taking of shellfish.
The maintenance proposal is to dredge the 1500-1600 feet of total channel length to a
width of 50 feet and a depth of-6 feet at mean low water(MLW). Current soundings in
the channel indicate the water depths average-1 foot MLW to -4 feet MLW. The
dredging would end where the channel intersects the-6 feet MLW depth contour of the
AIWW. The dredging is to be accomplished hydraulically. The material will be pumped
to an existing USACOE spoil island, located just south and across the AIWW from the
project site. The applicant has received approval from the U. S. Army Corps of Engineers
to use the site. The spoil area is triangular in shape, approximately 3500 ft. x 300 ft. x 450
ft. There is to be a water control structure, with adjustable flashboards, and an effluent
pipe to return the effluent to the mean low water line.
10. ANTICIPATED IMPACTS
This project would create the disturbance of approximately 80,000 square feet of shallow,
sandy bottom. Approximately 8000 cubic yards of material would be removed from the
channel system, and placed on high ground on the spoils disposal island. Temporary
turbidity increases are to be expected during the dredging activity. The project would
promote continued safe boating access.

Recommendations for State Permit- William Boucher
I have no objections to the proposed project subject to the following conditions;
1. The spoil area must be inspected and approved by the Division of Coastal Management prior to
the beginning of any dredge activity.
2. In order to protect juvenile shrimp and finfish populations, no excavation or filling will be
permitted between April 1st and September 30 of any year without the prior approval of the
Division of Coastal Management, in consultation with the Division of Marine Fisheries.
3. Excavation will not exceed 6 feet below the mean low water level.
4. No marsh grass will be excavated and/or filled.
5. The temporary placement or double-handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
6. No excavated or fill material will be placed at any time, in any marsh or surrounding waters,
outside of the alignment of the fill area indicated on the workplat(s).
7. The disposal area effluent will be contained by pipe, trough, or similar device to a point at or
beyond the mean low water level to prevent gully erosion and unnecessary siltation.
8. The terminal end of the pipeline will be positioned at or greater than fifty feet (50') from any part
of the dike and a maximum distance from spillways to allow settlement of suspended solids.
9. A water control structure will be installed at the intake end of the effluent pipe to assure
compliance with water quality standards.
10. The diked disposal area will be constructed a sufficient distance from the mean high water level or
any marsh to eliminate the possibility of dike erosion into or upon any marsh or surrounding
waters.

Dear Mr. Boucher:
The Wilmington Regional Office received a copy of the CAMA Major Permit Application for maintenance
dredging of an existing channel on September 8, 1997. Staff review of the plans and specifications has determined that
the development activities proposed will not pose a threat to surface water quality from stormwater runoff. The
Director has determined that projects that are reviewed and approved by the Division as not posing a water quality
threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A
NCAC 2H.1000. By copy of this letter, we are informing you that your project will not require a stormwater
management permit. The submitted application and $50.00 fee are returned, enclosed.
Please keep in mind that this determination does not relieve you of your legal responsibility to obtain other
permits which may be required by the Division of Water Quality, the Division of Land Resources, Coastal Areas
Management Act, Federal, State, or Local Governments. In addition, any future modifications to the project will
require additional review from this Office to assure that stormwater impacts are not an issue.
