including work plan drawings (3) Sheets 1-3 of 3 dated 5/5/23.
This permit, issued on October 20,2023 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to civil or criminal penalties; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the dock, pier, boatlift, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) This permit authorizes a maximum of 1 formalized boat slip at this docking facility for a maximum
of 3 formalized boat slips at this property, as detailed in attached workplan sheet 2 of 3, dated 5/5/23.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered

In issuing this permit,the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
6) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
Sedimentation and Erosion Control
7) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
8) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
9) All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the recent of a
spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the
N.C. Division of Water Resources at(919) 733-5083, Ext. 526 or(800) 662-7956 and provisions of the
North Carolina Oil Pollution and Hazardous Substances Control Act will be followed.
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
11) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
12) The permittee and/or their contractor shall meet with a representative of the Division prior to project
initiation.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2023-01595).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4497 and assigned the project DWR Project No. 20231072.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of$250 was received by DCM for this project.

Recommendations for State Permit- Dunlap Forestry, LLC Private Dock Expansion
The proposed development would expand docking space from 2 formalized slips to 3 formalized slips. The
proposed boatlift would align with the waterward edge of the existing 6' x 30' floating dock (Slip 2) and not
exceed the 1/4 width of the feeder canal. The application appears to be CONSISTENT with the use standards set
forth in NCAC 07H .0208(b)(6), including those which dictate the maximum allowable platform area(the 8
square foot rule), the pier length rule, and the 15' riparian setback.
As proposed, this office has no objections to the proposed project and any permit issued should include the
standard permit conditions for docking facilities.

Location description: The project site is located in an Ocean Isle Beach man-made canal at 49
Dare Street, Ocean Isle Beach, Brunswick County, North Carolina.
Description of project area and activity: The proposal is to expand the existing docking facility
for a total of three formalized slips within the Ocean Isle Beach canal system. A 3 feet by 12
feet access pier will originate from the concrete bulkhead east of existing Slip #2 and extend
north into Feeder Canal #19. The access pier will terminate with a 2 feet by 13 feet T-head and
provide access to a 14 feet by 14 feet open boatlift, oriented parallel with the concrete
bulkhead. The boatlift will extend approximately 24 feet waterward of Mean High Water Level
(MHW), to align with the waterward edge of the adjacent floating dock (Slip 2).
The docking facility expansion will result in the cover and shading of an additional 258 square
feet of Estuarine Waters of the US. Water depths in the vicinity of the proposed boatlift range
from -2.0 feet to -3.0 feet, relative to MLW.
Please note, a Coastal Area Management Act (CAMA) permit authorization must
be obtained from the North Carolina Division of Coastal Management (DCM) prior
to commencing any work on this project.
Applicable Law: Section 404 (Clean Water Act, 33 USC 1344);
Section 10 (Rivers and Harbors Act, 33 USC 403)

Special Condition: In order to further protect the endangered West Indian Manatee, Trichechus
manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee
Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at
http://www.fws.gov/nc-es/mammal/manatee_guidelines.p

Your work is authorized by the above referenced permit provided it is accomplished in strict
accordance with the attached conditions and your submitted application and attached
information and drawings, dated May 5, 2023. Any violation of the attached conditions or
deviation from your submitted plans may subject the permittee to a stop work order, a
restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide
and/or regional general permit authorization is modified, suspended or revoked. If, prior to the
expiration date identified below, the nationwide and/or regional general permit authorization is
reissued and/or modified, this verification will remain valid until the expiration date identified below,
provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or
regional general permit authorization expires or is suspended, revoked, or is modified, such that the
activity would no longer comply with the terms and conditions of the nationwide permit, activities
which have commenced (i.e., are under construction) or are under contract to commence in reliance
upon the nationwide and/or regional general permit, will remain authorized provided the activity is
completed within twelve months of the date of the nationwide and/or regional general permit's
expiration, modification or revocation, unless discretionary authority has been exercised on a case-
by-case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401
Water Quality Certification. You should contact the NC Division of Water Resources (telephone 919-
807-6300) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area
Management Act (CAMA), prior to beginning work you must contact the N.C. Division of Coastal
Management in Wilmington, NC, at (910) 796-7215.
This Department of the Army verification does not relieve the permittee of the responsibility to obtain
any other required Federal, State or local approvals/permits.

The Division of Water Resources (DWR) has received a copy of your CAMA Major application request
received by this office on August 1, 2023, to expand an existing docking facility to provide mooring for
three (3)vessels. DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction
with the CAMA Major Permit and General Permit(s) 198000291 or 197800056 issued by the US Army
Corps of Engineers(USACE). This Certification allows you to use the CAMA Major Permit when the Division
of Coastal Management issues it.
In accordance with the attached General Certification #4497 (GC 4497), the impacts described in your
application do not require written authorization to utilize GC 4497. However, you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal,state and local requirements before you go ahead with your project including(but not limited to)
erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150E by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as

9. PROJECT DESCRIPTION
The proposed project is located on the north end of Dare Street at 49 Dare Street in Ocean Isle Beach,
Brunswick County. General Permit#49150 was issued on 10/11/07 to install a 6' x 10' access pier and a 6' x
31' floating dock on the north side of the property, adjacent to Feeder Canal #19 (Slip 2. See Sheet 2 of 3).
General Permit#69053 was issued on 4/4/17 to install a 4' x10' access pier and an 8' x 20' floating dock on the
west side of the property.adjacent to Finger Canal #7 (Slip I, See Sheet 2 of 3).
The project site is approximately .19 acres and is vegetated primarily with domestic grasses and ornamental
landscaping. The high ground portion is elevated approximately 4' above the normal high water(NHW) level,
and the shoreline (+/-205 linear feet) is stabilized by a concrete bulkhead. There are no indications of any
Coastal Wetlands on-site. The applicant's property sits at the end of a man-made canal system between Finger
Canal #7 to the west and Feeder Canal #19 to the north. Dare Street and residential properties border the project
site to the east and south, respectively. According to the application, Feeder Canal #19 measures approximately
112' wide from NHW at the bulkhead in the vicinity of the proposed project site.
The waters of the canal system are classified SA by the Division of Water Quality and ARE NOT designated as
a Primary Nursery Area(PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of
shellfish. Based on visual observations made by DCM staff during the July 2023 site visit, there appears to be
NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths in the vicinity of the
proposed boatlift range from -2.0' to -3.0', relative to NLW.
PROPOSED PROJECT
The applicant proposes to expand the existing docking facility for a total of three formalized slips within the
Ocean Isle Beach canal system. As proposed, a 3' x 12' access pier would originate from the concrete bulkhead
east of existing Slip #2 and extend north into Feeder Canal #19. The proposed access pier would terminate with
a 2' x 13' T-head and provide access to a 14' x 14' open boatlift (Slip 3, See Sheet 2 of 3), oriented parallel
with the concrete bulkhead. The boatlift would extend approximately 24' waterward of NHW, to align with the
waterward edge of the adjacent floating dock (Slip 2). The proposed boatlift would remain landward of the 'VI
width of the waterbody and outside of the eastern riparian setback. The applicant did not receive any adjacent
setback waivers.
10. ANTICIPATED IMPACTS
The proposed docking facility expansion would result in the incorporation of an additional 258 square feet of
Estuarine Waters and Public Trust Area. As proposed, the boatlift would align with the waterward edge of the
existing 6' x 30' floating dock and would not exceed the 'A width of the waterbody. The proposed development
would be located outside of both 15' riparian corridor setbacks. Water depths in the vicinity of the proposed
boatlift range from -2.0' to -3.0'. relative to NLW. Minor increases in turbidity should be expected during piling
installation.
The square footage of the proposed docking facility is calculated as follows:
Shoreline length= 205 ft. x 8 sq. ft. = 1,640 sq. ft.

Narrative
As acting agent for Dunlap Forestry, LLC who owns 49 Dare Street., adjacent to a
man-made canal, in Ocean Isle Beach, Brunswick County NC, I am submitting the
enclosed CAMA Major Permit application for modifications to their existing
docking facility. This application is for the installation of a new 14' x 14' boatlift
which will be located adjacent to the existing 6' x 30' floating on the westward
end. A new 3' x 12' access pier will also be installed which will extend to a new 2'
x 13' walk board adjacent to the boatlift for access. The boatlift will provide
dockage for 1 additional vessel, creating a total of 3 slips at the property within
existing water depths ranging from -2 to -3' @ normal low water (NLW). As
proposed, the structures will not encroach into either of the adjacent 15' riparian
corridor setbacks nor exceed the existing pier-head line and will not extend beyond
the 'A width of the waterbody which measures approx. 112' in this location.

Forestry,LLC,for State approval for the expansion of an existing docking facility,located at 49 Dare St,Ocean Isle
Beach,Brunswick County,NC.It was received complete on July 24,2023 and appears to be adequate for processing
at this time.The projected deadline for making a decision is October 7,2023.An additional 75-day review period is
provided by law when such time is necessary to complete the review.If you have not been notified of a fmal action
by the initial deadline stated above,you should consider the review period extended. Under those circumstances,
this letter will serve as your notice of an extended review. However,an additional letter will be provided on or
about the 75th day.
If this agency does not render a permit decision within 70 days from July 24,2023 you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project.Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner,developer,and project designer/consultant.
NCGS 113A-1 I9(b)requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will fmd a"Notice of Permit Filing"postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be:Nailing the notice card to a telephone pole or tree along the road right-of-
