This permit, issued on October 6, 2023 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to civil or criminal penalties; or may cause the permit to be null and void. Docking Facility Expansion 1) This permit authorizes only the docks, piers, boatlifts, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application.No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit • modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes 6 additional formalized boat slips for a maximum of 9 formalized boat slips at this docking facility. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) No portion of the authorized docking facility expansion shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the normal high-water line or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more restrictive. 5) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. 6) The roof of the covered platform shall not be designed for second story use. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. USACE Conditions • 10) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines2017.pdf.0 • Sedimentation and Erosion Control 11) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. • General • 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. • �0009667009607999066C 0EOCC00090C-0 Brian Forehand Permit No. 111-23 Page 3 of 3 ADDITIONAL CONDITIONS 14) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 15) The permittee and/or their contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not convey any rights, either in real estate or material. NOTE: The permittee is advised that no commercial uses of structures shall be conducted on, in or over Public Trust waters without permit modification. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2023-01601). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4497 and assigned the project DWR Project No. 20231112. NOTE: Future development of the permittee's property may require a modification of this permit. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high-water level. Specifically, the applicant proposes the following activities: 1. Along the northern end of the shoreline, located across from the neighborhood boat ramp, the applicant proposes to construct a new 5'x 50 access pier that would extend from the existing bulkhead and provide access to a new 6' x 50'floating dock. The floating dock would run parallel to the shoreline and would be secured by pilings located on the landward side of the dock, eliminating any potential for dockage on the interior side. 2. South of the floating dock referenced above,the applicant proposes to install a new 4' x 65' finger pier that would extend from the existing bulkhead and would provide access to the existing boatlift(12'x 12'), as well as a new 12'x 12'boatlift(labeled as Iift no. 1 on site plan). The applicant proposes to relocate the existing 12'x 12' boatlift closer toward the end of the finger pier. -2- 3. Immediately south of what is labeled as boatlift No. 2 on the site plan drawings,the applicant proposes to enlarge the exiting 14'x 16'covered platform/deck landward,to 20'x 20'(drip edge). 4. A new 4'x 50' finger pier is proposed along the eastern side of the existing 15' x 15' boatlift(slip no. 3)that would provide access to the existing lift, as well as a new 14' x 14' boatlift(labeled as slip no. 4 on the site plan drawings). This new finger pier would originate from the existing 6'x 75'access pier and run parallel to the shoreline. 5. Along the southern end of the property,the applicant proposes to install two new finger piers extending from the existing bulkhead and three new boatlifts. As proposed, a new 4'x 35'and 4'x 45' finger pier would be constructed near a 45- degree angle to the shore. These two finger piers would originate from the existing bulkhead and would span toward the west, before terminating just inshore of the'/ width of water body limitation. As proposed, a new 8' x 8' lift(lift no. 5)would be located along the northern side of the 4'x 35'finger pier, and a new 12'x 12' lift(lift no. 6)would be located in between the two new finger piers. A third boatlift(lift no. 7@ 11' x 11 ')would be located on the southern side of the 4'x 45' access pier. No changes are proposed to the existing 8' X 32' floating dock or the existing 15'X15' boat lift. The applicant states that the expanded facility is for his own private/personal use, and no slips would be rented or sold. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the submitted plans, which are a part of this permit. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 5. Except as authorized by this permit or any USACE.approved modification to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project,within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 6. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Resources at(919) 733- 5083, Ext. 526 or(800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 7. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products,organic materials(including debris from land clearing activities), or unsightly debris will not be used. 8. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 9. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 10. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally,the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 11. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management(NCDEM), 25 NTU's or AEIVED SEP 3 0 2023 MP SECTION DCM MHD CITY -4- saltwater classes and in all lakes and reservoirs,and 10 NTU's or less in trout waters, are not considered significant. 12. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre-project condition. 13. Travel approximately 11 miles(from WIRO)to Washington Acres Road. Turn right onto Washington Acres Road and travel approximately 1.8 miles to the end of the road.The site is located along the left- hand side at 2224 Washington Acres Road. The subject property is approximately 1.3 acres in size and the entire shoreline(approximately 465 linear feet)is stabilized by a wooden bulkhead. Elevations at the site range from 0' to 8',relative to normal high water.Existing man-made features on the property(at the time of this field investigation report)include a bulkhead and private three-slip docking facility. A residential dwelling existed on the property until this past week,however;the home has been demolished in preparation of re-development(under future CAMA minor permit). The applicant recently purchased the property and has expressed his intension of improving the site, both with a new dwelling and expanded docking facility. The high ground contains a couple of mature Oaks and the understory is blanketed in ornamental landscaping and lawn grasses. A quick search of DCM's permit database confirms the existing docking facility was permitted in April 1997 under CAMA general permit No. 15879.A second permit was issued for the bulkhead in August 1999, under CAMA permit 22034. The facility has been maintained since that time and according to the applicant,it needs repair/replacement. The applicant is now proposing to apply for a nine-slip docking facility by creating six new slips within the basin. The width of the waterbody in the location of the proposed docking facility ranges from approximately 95'- 175' from the edge of marsh on one side to the opposing edge of marsh,allowing a maximum distance between 23'-43' beyond the nearshore edge of marsh. The marsh area along the applicant's shore ranges from approximately l'-135' in width and is comprised mostly of Smooth Marsh Cordgrass (Spartina Alternora). Mill Creek and the finger canals associated with the creek system,has a documented history of dredging, as authorized under CAMA Major/Dredge and Fill Permit 175-07,which was issued to Mill Creek Waterway Restoration,Inc., in 2007. According to the permit,the subject channel was dredged to a depth of-4' (@NLW),and a width of approximately 25',along the centerline.As proposed,NO new dredging is associated with the application package as there is sufficient water to accommodate the proposed dock expansion. The waters of the AIWW adjacent to the project site are classified as SA-HQW by the North Carolina Division of Water Resources. They area is NOT designated as a Primary Nursery Area(PNA)by the North Carolina Division of Marine Fisheries,and they are CLOSED to the harvest of shellfish. In this location,the applicant proposes to enlarge the existing covered platform/deck landward,resurface the existing access pier,install five new finger piers,a new floating dock and five new boatlifts. Beginning along the northern end of the shoreline,almost directly across from the Washington Acres boat ramp,the applicant proposed to install a new 5'x 50 access pier that would extend from the bulkhead and provide access to a new 6'x 50' floating dock. The floating dock would run parallel to the shoreline and would be secured by pilings located on the landward side of the dock,eliminating any potential for dockage on the interior side. The floating dock would be located in waters that are approximately-2' to- 4',at normal low tide and inshore of the 1/4 width of waterbody limitation. The applicant has provided a copy of vessel registration for a 48' vessel,and according to the project narrative,this vessel would be moored at the proposed dock. Just south of the floating dock,the applicant proposes to install a new 4'x 65' finger pier that would extend from the existing bulkhead and would provide access to the existing boatlift(12' x 12'),as well as a new 12'x 12' boatlift(labeled as lift no. 1 on site plan).According to the attached drawings,this finger pier would also originate from the existing bulkhead and span in a western direction, stopping just inshore of the '/width limitation.As part of this project,the applicant proposes to relocate the existing 12' x 12' boatlift closer toward the end of the finger pier. Water depths in the vicinity of the proposed boatlift(s) average approximately-4',at normal low water.According to the application package, the proposed finger pier and boatlifts would be located inshore of the '/ width of waterbody limitation. Immediately south of what is labeled as boatlift No. 2 on the site plan drawings,the applicant proposes to enlarge the exiting 14' x 16' covered platform/deck landward,to 20' x 20' (drip edge).According to the applicant,the existing covered platform/deck needs repairing(new decking),and the applicant wishes to enlarge the structure to provide more access to the proposed boatlift and existing floating dock.According to the application package,the covered platform/deck would be expanded in a landward direction and would not protrude any further toward the existing channel. As designed,the existing 8'x 32'floating dock(located on the south side of the existing covered platform/deck)would remain in place but would be resurfaced with new decking.Additionally,the existing 15' x 15' boatlift(located just east of the floating dock)would remain in its current location.The existing 8' x 32' floating dock and 15' x 15'boatlift are partially located waterward of the 1/4 width of waterbody limitation(but within 1/3 of the width of waterbody);however,there are no plans to expand/enlarge these structures. A new 4' x 50' finger pier is being proposed along the eastern side of the existing 15' x 15' boatlift(slip no. 3)that would provide access to the existing lift,as well as a new 14' x 14' boatlift(labeled as slip no. 4 on the site plan drawings).This new finger pier would originate from the existing 6' x 75' access pier and run parallel to the shoreline.The finger pier and new boatlift(no.4)would both be located well inshore of the 1/4 width of waterbody limitation,in an area where water depths range from-2'to-4',at normal low water. As proposed,a new 4'x 35' and 4' x 45' finger pier would be constructed near a 45 degree angle to the shore. These two finger piers would originate from the existing bulkhead and would span toward the west, before terminating just inshore of the A width of water body limitation.As proposed,a new 8' x 8' lift(lift no. 5)would be located along the northern side of the 4'x 35' finger pier, and a new 12'x 12' lift(lift no. 6)would be located in between the two new finger piers.A third boatlift(lift no. 7 @ 11'x 11')would be located on the southern side of the 4' x 45' access pier. Based on the site plan drawing,these structures would be located approximately 30'-35' from the riparian corridor shared by the southern property owner(Talbert),thereby eliminating the need for waiver. According to the narrative the entire docking facility is for private use and slips would not be rented, leased or sold. 10.ANTICIPATED IMPACTS The proposed new docking facility would incorporate approximately 1,986 sq. ft.of Estuarine Waters and Pubic Trust Area.The proposed docking structure(s)would not encroach into either adjacent 15' Riparian Corridor Setback Areas,and would not extend beyond the ''A width limitation,nor encroach into the adjacent maintained channel.At this time,there is no proposal to dredge around the proposed structures since the existing water depths range from-2'to-4' at normal low water.Based on the application package,there are no proposed wetland impacts associated with this project. Minor increases in turbidity should be expected during construction;however,no long-term impacts are anticipated. The total area of the proposed structures was calculated as follows: Shoreline length=+/-456 ft.x 8 sq.ft.=2,000 sq. ft.allowable. While I am developing plans for the house, which I will apply for separately, I have created a dock plan that works for me and wish for your approval. As you know, I own Marker 17 Marine in Wilmington, NC and my business revolves around selling and servicing boats, some of which I demo and test drive before selling. I am asking for a total of nine slips at my new residence, to allow for my own personal boats, as well as room for any boat I may demo, or for company that may visit. Also,as you will see, I have asked for a 6'x 50'floating dock, which I have designated for a larger boat(48') registered in my name (attached). I do not intend to dock on the land side of this floating dock, as evident by the pilings on the back side. I am asking for a permit to install five new finger piers,a new floating dock, enlarge the covered platform, and install seven new boatlifts for my own personal use.Anything approved will be used by me and/or my guest and will not be rented, leased, or sold. I am keeping the original layout of the current dock and only plan to resurface the pier, move the northern boatlift out closer to the end of the pier,add 4' x 16'to the current covered platform (on the land side to square it up).The current 8'x 32' floating dock will remain,as well as the larger 15' x 15' boatlift.
