This permit, issued on September 25, 2023 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to civil or criminal penalties; or may cause the permit to be null and void.
New Docking Facility
I) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) This permit authorizes 2 formalized boat slips at this docking facility.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission.

3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire •
existence of the permitted structure.
4) No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the
federally maintained AI W W channel.
5) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource
agencies, physical stops shall be placed on the boatlifts at a minimum height of 18" above the bottom
substrate to prevent the boatlifts from disturbing the bottom substrate. The physical stops shall remain in
place for the life of the permitted docking facility.
6) The authorized covered gazebo shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches are
permitted. Lattice is specifically excluded from being used under this authorization.
7) The roof of the covered gazebo shall not be designed for second story use.
8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. •
Coast Guard,through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work. •
10) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings. •
11) The authorized project is located within a primary nursery area(PNA). Therefore, in accordance with
NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
Sedimentation and Erosion Control
12) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.

General
14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
15) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
16) The permittee and/or their contractor shall meet with a representative of the Division prior to project
initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2023-01326).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4501 and assigned the project DWR Project No. 20230917.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at(910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of$400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Recommendations for State Permit—Matthew McCarty 6/20/2023
The new docking facility would provide a total of 4 formalized boat slips. It appears that the project is CONSISTENT
with the use standards set forth in NCAC 07H .0208(b)(6). Although the proposed docking facility would exceed the 1/4
width of the waterbody in an attempt to gain greater water depths,the pier is located between two longer piers and would
not exceed the 1/3 width. As proposed,the docking facility would be built up to,but not encroach into the 80' USACE
federal channel setback.
The proposal is located in shallow depths within an area deemed Primary Nursery Area (PNA)by the NC Division
of Marine Fisheries. This office supports the recommendations of the resource agencies, particularly the NC
Division of Marine Fisheries, regarding potential impacts to shallow bottom.
Provided the proposed work is consistent with all other local,state, and federal permitting requirements,and resource
agencies do not have any concerns regarding significant adverse impacts resulting from the proposed project,this office
has no objections to the issuance of a permit.

Location description: The site is located in the AIWW adjacent to Myrtle Grove Sound at 5550
Peden Point Road, New Hanover County, North Carolina.
Description of project area and activity: The proposal is to construct a 2-slip docking facility in
Waters adjacent to the AIWW. This docking facility will include a 6 feet by 340 feet fixed pier
extending east into the Waters of the AIWW that will terminate at an 18 feet by 18 feet fixed
covered platform. A 4 feet by 28 feet fixed pier will extend to the north of the main fixed pier
and meet another 4 feet by 30 feet fixed pier (at a right angle) which will also extend east
toward the AIWW. The docking facility will not encroach into the "USACE Setback" for the
AIWW. The docking facility will cover and shade 556 square feet of Estuarine Waters of the
US.
Please note, a Coastal Area Management Act (CAMA) permit authorization must
be obtained from the North Carolina Division of Coastal Management (DCM) prior
to commencing any work on this project.

Biologists with the North Carolina Wildlife Resources Commission(NCWRC)reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 5550 Peden
Point Road adjacent to Myrtle Grove Sound in Wilmington,NC.Our comments are provided in
accordance with provisions of the Coastal Area Management Act(G.S. 113A-100 through 113A-128), as
amended,Sections 401 and 404 of the Clean Water Act, as amended,the Endangered Species Act of
1973,as amended(16 U.S.C. 1531 et seq.),the Fish and Wildlife Coordination Act(48 Stat.401,as
amended; 16 U.S.C. 661 et seq.),the Magnuson-Stevens Fishery Conservation and Management Act
(FCMA),as amended(16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act(16 U.S.C.703-712 et
seq.).
The applicant proposes to construct a new four slip facility.A 6' by 300' fixed pier would extend into the
water body and terminate at an 18' by 18' gazebo that has a 18' by 6' pier extending from the NE corner
and a 35' by 5' finger pier that parallels the AI W W.A 9' by 6' fixed pier would extend from the SE
corner of the gazebo to a 24' by 8' floating dock.The structure would terminate immediately landward
the USACE federal setback in water depths ranging from -1' to-1.5' NLW. Myrtle Grove Sound at this
location is classified SA ORW by the Environmental Management Commission and is designated a
primary nursery area(PNA)by the NC Division of Marine Fisheries(NCDMF).
The NCWRC has reviewed the permit application and is concerned with the proposed structure and the
water depths within the slip areas. The layout of the facility lends itself to chronic disturbance to
important PNA resources from the docking, ingress,and egress of vessels. PNAs are defined as those
areas inhabited by the embryonic,larval or juvenile life stages of marine or estuarine fish or crustacean
species due to favorable physical,chemical or biological factors.As a designated PNA,the sound
provides an important rearing area for this variety of estuarine fishes and invertebrates that need relatively
undisturbed habitats. The NCWRC does not generally support slips within PNA's if water depths are

below-1.5' NLW due to impacts to important shallow habitats and chronic turbidities. In addition to
concerns with slip depth,the floating platform is proposed at a depth less than-2' NLW. Our agency does
not generally support floating structures in water depths less than-2'NLW due to the impacts these
structures may have on bottom sediments during low water events.
Therefore,we request the applicant modify the proposal to minimize impacts to valuable environmental
resources. It should also be noted that while we do not object to the installation of fixed structures,
shoaling may occur within the project's vicinity. The placement of permanent structures in this area may
increase the amount of sediment accretion at the docking facility. Due to the classification of this area as
PNA,any future requests for dredging in the area will not be supported. We request the applicant fully
evaluate this potential issue prior to project development.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the CAMA Permit application for proposed actions that impact fish and fish
habitats. The applicant proposes to install a private, four-slip docking facility.The
Wilmington-New Hanover County Land Use Plan classifies the area as Resource Protection.
The waters in this location are classified as SA; ORW by the Division of Water Resources.
The area is designated as a Primary Nursery Area (PNA) by the Division of Marine Fisheries
and is in a closed shellfish area.
The applicant is proposing a four-slip docking facility in water depths from -1'to -1.5'in
PNA waters. According to water depths taken by DCM on 5/11/2023 and corrected to
Normal Low Water (NLW),the western proposed boat lift would be in depths ranging from
approximately-1' NL W to -1.2' NL W,while eastern proposed boat lift would be in depths
ranging from approximately-1.2' NL W to -1. 5' NL W.The proposed floating dock would be
in depths ranging from approximately-1.2' NLW to 1.5' NL W.
PNAs are estuarine waters where initial post-larval development occurs. Species within
this area are early post-larval to juvenile and include finfish, crabs,and shrimp. Shallow
soft bottom is an important foraging habitat for juvenile and adult fish and invertebrates,
and aids in storing and cycling of sediment,nutrients, and toxins between the bottom and
water column. Soft bottom habitat is used to some extent by most native coastal fish
species in North Carolina. Species dependent on shallow soft bottom include clams, crabs,
flounder,spot,Atlantic croaker, sea mullet,and rays. Many benthic predators are highly
associated with the shallow soft bottom habitat, including flounders,weakfish, red drum,
sturgeon and coastal sharks,although almost all fish will forage on microalgae, infauna,or
epifauna on the soft bottom.
The Division does not recommend formalized boat slips in water depths less than 18" NLW.
The Division recommends the applicant reconfigure the proposed docking facility to
include only two boat lifts,and position them on the waterward side of the proposed L-

shaped pier.To prevent prop scarring the Division recommends the boat lifts include limit
switches that prevent the boat from ingress and egress in waters less than 18" NLW.
The Division does not recommend any floating structure in water depths less than -2' NLW.
The applicant proposes physical stops on the floating dock to minimize impacts to shallow
water PNA bottom. However,the Division does not recommend the use of stops in
insufficient water depths,as they are not a permanent component and can be removed
easily.The Division recommends physical stops when the water depths on one edge of the
floating structure is -2' NLW or greater. Docking facilities have the potential to shoal after
construction leading to decreased depths in slip areas and should be considered through
the design process. Since this area is PNA, future requests to dredge will be opposed by the
Division.

9. PROJECT DESCRIPTION:
The project site is located at 5550 Peden Point Road,adjacent to Myrtle Grove Sound, in Wilmington,New
Hanover County. The property consists of a 1.19-acre parcel that is situated on land that is approximately 5' feet
above normal high water(NHW)and is vegetated with native shrubs,hardwoods,and grass. A single-family
residence and associated driveway are located on the property. The northern side of the property transitions from
upland vegetation to a narrow border of Sea Oxeye(Borrichia frutescens)before transitioning to Smooth
Cordgrass(Spartina alterniflora)at the edge of the open waters of Myrtle Grove Sound. The southern side of the
property transitions from upland vegetation to high marsh coastal vegetation, including Black Needle Rush
(Juncus roemarianus) and Spike Grass(Distichlis spicata)before transitioning to Smooth Cordgrass(Spartina
alterniflora)at the edge of the open waters of Myrtle Grove Sound.A tidal slough exists to the south of the
property extending in a westerly direction,past the subject property.This allows for NHW and coastal wetland
species to exist on the southern and western side of the property.
The Wilmington-New Hanover County Land Use Plan classifies the area as Resource Protection. The waters in this
location are classified as SA;ORW by the Division of Water Resources.The area is designated as a Primary Nursery
Area (PNA) by the Division of Marine Fisheries and is on the border of a shellfish closure. It appears that it is
CLOSED to the taking of shellfish.
10. PROPOSED PROJECT:
The applicant proposes to install a private,four-slip docking facility. A 300' long by 6' wide fixed pier would
extend from the upland portion of the property and terminate at an 18' long by 18' wide gazebo as measured from
the drip edge. An 18' long by 6'wide fixed pier would extend from the northeast corner of the gazebo waterward
and terminate at a 35' long by 5'wide finger pier that extends north,parallel with the AIWW.A 16' long by 16'
wide boat lift is proposed on the east and west side of the finger pier. Per application materials,the two boat lifts
would have auto stops at 18"above the substrate. A 9' long by 6' wide fixed pier would extend south from the
southeast corner of the gazebo;a gangway would extend east from said fixed pier and terminate at a 24' long by
8' wide floating dock, accommodating two additional boat slips. The facility would accommodate up to four
vessels. As proposed,the waterward end of the facility would extend approximately 252' from the waterward
edge of coastal wetlands and terminate immediately landward of the 80' USACE federal channel setback(See
Page 1 and 2 of 3).
According to water depths taken by DCM on 5/11/2023 and corrected to Normal Low Water(NLW), the western
proposed boat lift would be located in depths ranging from approximately -1'NLW to-1.2'NLW,while eastern
proposed boat lift would be located in depths ranging form approximately -1.2'NLW to-1.5'NLW. The
proposed floating dock would be located in depths ranging from approximately-1.2'NLW to 1.5'NLW(See
Page 2 of 3). According to application materials,if requested by the resource agencies,the applicant would
construct stops on the floating dock.
Note: The adjacent riparian property owner to the north submitted an objection to the proposal. The objection is
included in the application materials.
11. ANTICIPATED IMPACTS:
The proposed docking facility would incorporate 2,865 sq. ft. of Public Trust Area and Estuarine Waters and
shade approximately 180 sq. ft. of coastal wetlands. The structures would not encroach into either 15' riparian
corridor setback. The proposed structures would extend approximately 252' into the waterbody, in an area that
measures approximately 765' across.As proposed,the docking facility appears to exceed the 1/4 width distance,
but not the 1/3 width and would not exceed the pier headline nor encroach into the 80' USACE federal channel
setback. The proposed structures would accommodate up to four(4)vessels at this location within water depths of
approximately-1'to-1.5'relative to NLW within a designated Primary Nursery Area.

The Division of Coastal Management hereby acknowledges receipt of your application,as acting agent for Matthew
McCarty,for State approval for development of the subject property located at 5550 Peden Point Road,adjacent to the
Masonboro Sound in New Hanover County. It was received as complete on June 14,2023 and appears to be adequate for
processing at this time. The projected deadline for making a decision is August 28,2023.An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not been notified of a final
action by the initial deadline stated above,you should consider the review period extended.Under those circumstances,
this letter will serve as your notice of an extended review.However,an additional letter will be provided on or about the
75th day.
If this agency does not render a permit decision within 70 days from June 14,2023,you may request a meeting with the
Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will
be held within five working days from the receipt of your written request and shall include the property owner,developer,
and project designer/consultant.
NCGS 113A-119(b)requires that Notice of an application be posted at the location of the proposed development.

The waterway hideaway is a newly renovated guest suite located on the first level with a
private entrance through the shared yard. Surrounded by water on three sides you will have
the opportunity to enjoy beautiful sunset views over the marsh and sunrise views over the `_
ICWW. Please note the dock is not a part of our property,though we do have water access
through our backyard. Extras include beach towels and a tandem kayak to fully enjoy the
beach life. At the end of the day there is no better place in town for stargazing,away from
light pollution. We are happy to provide fire wood for the fire pit should you feel inclined to

cozy up by the fire. Enjoy the comforts of home and cook in the fully equipped kitchen with
a Keurig coffee maker, mini fridge,microwave,and dishwasher. You will find a queen bed as
well as a pull out,queen murphy bed to sleep up to 4 guests. On the days you need extra
rest, roll the blinds down and watch a movie on the Roku TV. The property is run on septic
and well water. So this is a friendly reminder to only flush toilet paper. Although we do have a
filtration system,please take advantage of the provided bottled water for drinking. We will
provide you with all the basic needs- linens, shampoo/soap,trash bags,kit �t`�Ft I ',etc.
to make your stay as easy as possible.

dogs can be leashed at all times during your stay). They may bark when you first arrive,

At this time the applicant is only applying for the facility to be privately used. It has two boat lifts which will be used by
the property owner. I have had a conversation with Mr. McCarty about the idea of renting a slip. If he ever decides to
rent out a boat lift he will take the proper steps to modify his CAMA Major Permit to have resource agencies aware of
any changes to the facility's status.Thanks for all your help!

If the applicant wanted to propose a facility with the intent to rent or potentially rent slips,then it would need to be
stated in the application while also being applied for as a commercial facility.The resource agencies and local level
would need to be aware that the facility would potentially be used for something other than private use.
I'd have to look through the act to see if it is specifically defined but DCM has operated that if the intent is to profit off
the facility to anyone outside of the property owner, that's considered an example of a commercial facility. Let me
know if you have any questions.

Northeastern corner of the tract conveyed to O. K. Pridgen, II and wife by Deed
recorded in Book 995 at Page 338A of the New Hanover County Registry, said
point being South 61 degrees 01 minutes East along the Northern line of said tract
about 36 feet from a concrete reference marker for U.S.G. & G.S. Station "Peden"
in said line said reference marker being North 7 degrees 50 minutes East 70.65
feet from said Station "Peden"; running thence from said Beginning point
Southwardly along said high water line about 67 feet to said Station "Peden";
thence Southwardly along said high water line to a point that is South 55 degrees
21 minutes West 52.5 feet from Station "Peden", said point being the Southeastern

Attached are the most recent workplan drawings which were provided to the Division of Coastal Management (DCM) on
8/21/23.You will find an overhead (birds eye view) and a profile of the docking facility.
The original drawings submitted too DCM requested 4 slips.The most recent, attached drawings, show a redesigned
structure with 2 slips.This is the design we are currently reviewing for authorization.
