New Docking Facility I) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes 2 formalized boat slips at this docking facility. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire • existence of the permitted structure. 4) No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the federally maintained AI W W channel. 5) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource agencies, physical stops shall be placed on the boatlifts at a minimum height of 18" above the bottom substrate to prevent the boatlifts from disturbing the bottom substrate. The physical stops shall remain in place for the life of the permitted docking facility. 6) The authorized covered gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 7) The roof of the covered gazebo shall not be designed for second story use. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. • Coast Guard,through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. • 10) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. • 11) The authorized project is located within a primary nursery area(PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Sedimentation and Erosion Control 12) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. nco.o:wo t5,a,,uo,oaa,eeoee..ecoaoocu00004,000aeaocos. Matthew McCarty Permit No. 108-23 Page 3 of 3 ADDITIONAL CONDITIONS General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 15) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 16) The permittee and/or their contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2023-01326). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4501 and assigned the project DWR Project No. 20230917. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at(910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of$400 was received by DCM for this project. It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6). Although the proposed docking facility would exceed the 1/4 width of the waterbody in an attempt to gain greater water depths,the pier is located between two longer piers and would not exceed the 1/3 width. As proposed,the docking facility would be built up to,but not encroach into the 80' USACE federal channel setback. The proposal is located in shallow depths within an area deemed Primary Nursery Area (PNA)by the NC Division of Marine Fisheries. This office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries, regarding potential impacts to shallow bottom. Provided the proposed work is consistent with all other local,state, and federal permitting requirements,and resource agencies do not have any concerns regarding significant adverse impacts resulting from the proposed project,this office has no objections to the issuance of a permit. Biologists with the North Carolina Wildlife Resources Commission(NCWRC)reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 5550 Peden Point Road adjacent to Myrtle Grove Sound in Wilmington,NC.Our comments are provided in accordance with provisions of the Coastal Area Management Act(G.S. 113A-100 through 113A-128), as amended,Sections 401 and 404 of the Clean Water Act, as amended,the Endangered Species Act of 1973,as amended(16 U.S.C. 1531 et seq.),the Fish and Wildlife Coordination Act(48 Stat.401,as amended; 16 U.S.C. 661 et seq.),the Magnuson-Stevens Fishery Conservation and Management Act (FCMA),as amended(16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act(16 U.S.C.703-712 et seq.). The applicant proposes to construct a new four slip facility.A 6' by 300' fixed pier would extend into the water body and terminate at an 18' by 18' gazebo that has a 18' by 6' pier extending from the NE corner and a 35' by 5' finger pier that parallels the AI W W.A 9' by 6' fixed pier would extend from the SE corner of the gazebo to a 24' by 8' floating dock.The structure would terminate immediately landward the USACE federal setback in water depths ranging from -1' to-1.5' NLW. Myrtle Grove Sound at this location is classified SA ORW by the Environmental Management Commission and is designated a primary nursery area(PNA)by the NC Division of Marine Fisheries(NCDMF). The NCWRC has reviewed the permit application and is concerned with the proposed structure and the water depths within the slip areas. The layout of the facility lends itself to chronic disturbance to important PNA resources from the docking, ingress,and egress of vessels. PNAs are defined as those areas inhabited by the embryonic,larval or juvenile life stages of marine or estuarine fish or crustacean species due to favorable physical,chemical or biological factors.As a designated PNA,the sound provides an important rearing area for this variety of estuarine fishes and invertebrates that need relatively undisturbed habitats. In addition to concerns with slip depth,the floating platform is proposed at a depth less than-2' NLW. Our agency does not generally support floating structures in water depths less than-2'NLW due to the impacts these structures may have on bottom sediments during low water events. Therefore,we request the applicant modify the proposal to minimize impacts to valuable environmental resources. It should also be noted that while we do not object to the installation of fixed structures, shoaling may occur within the project's vicinity. The placement of permanent structures in this area may increase the amount of sediment accretion at the docking facility. Due to the classification of this area as PNA,any future requests for dredging in the area will not be supported. We request the applicant fully evaluate this potential issue prior to project development. The applicant proposes to install a private, four-slip docking facility.The Wilmington-New Hanover County Land Use Plan classifies the area as Resource Protection. The waters in this location are classified as SA; ORW by the Division of Water Resources. The area is designated as a Primary Nursery Area (PNA) by the Division of Marine Fisheries and is in a closed shellfish area. The applicant is proposing a four-slip docking facility in water depths from -1'to -1.5'in PNA waters. According to water depths taken by DCM on 5/11/2023 and corrected to Normal Low Water (NLW),the western proposed boat lift would be in depths ranging from approximately-1' NL W to -1.2' NL W,while eastern proposed boat lift would be in depths ranging from approximately-1.2' NL W to -1. 5' NL W.The proposed floating dock would be in depths ranging from approximately-1.2' NLW to 1.5' NL W. PNAs are estuarine waters where initial post-larval development occurs. Species within this area are early post-larval to juvenile and include finfish, crabs,and shrimp. Shallow soft bottom is an important foraging habitat for juvenile and adult fish and invertebrates, and aids in storing and cycling of sediment,nutrients, and toxins between the bottom and water column. Soft bottom habitat is used to some extent by most native coastal fish species in North Carolina. Species dependent on shallow soft bottom include clams, crabs, flounder,spot,Atlantic croaker, sea mullet,and rays. Many benthic predators are highly associated with the shallow soft bottom habitat, including flounders,weakfish, red drum, sturgeon and coastal sharks,although almost all fish will forage on microalgae, infauna,or epifauna on the soft bottom. The Division does not recommend formalized boat slips in water depths less than 18" NLW. However,the Division does not recommend the use of stops in insufficient water depths,as they are not a permanent component and can be removed easily.The Division recommends physical stops when the water depths on one edge of the floating structure is -2' NLW or greater. Docking facilities have the potential to shoal after construction leading to decreased depths in slip areas and should be considered through the design process. PROJECT DESCRIPTION: The project site is located at 5550 Peden Point Road,adjacent to Myrtle Grove Sound, in Wilmington,New Hanover County. The property consists of a 1.19-acre parcel that is situated on land that is approximately 5' feet above normal high water(NHW)and is vegetated with native shrubs,hardwoods,and grass. A single-family residence and associated driveway are located on the property. The northern side of the property transitions from upland vegetation to a narrow border of Sea Oxeye(Borrichia frutescens)before transitioning to Smooth Cordgrass(Spartina alterniflora)at the edge of the open waters of Myrtle Grove Sound. The southern side of the property transitions from upland vegetation to high marsh coastal vegetation, including Black Needle Rush (Juncus roemarianus) and Spike Grass(Distichlis spicata)before transitioning to Smooth Cordgrass(Spartina alterniflora)at the edge of the open waters of Myrtle Grove Sound.A tidal slough exists to the south of the property extending in a westerly direction,past the subject property.This allows for NHW and coastal wetland species to exist on the southern and western side of the property. The Wilmington-New Hanover County Land Use Plan classifies the area as Resource Protection. The waters in this location are classified as SA;ORW by the Division of Water Resources.The area is designated as a Primary Nursery Area (PNA) by the Division of Marine Fisheries and is on the border of a shellfish closure. It appears that it is CLOSED to the taking of shellfish. 10. PROPOSED PROJECT: The applicant proposes to install a private,four-slip docking facility. A 300' long by 6' wide fixed pier would extend from the upland portion of the property and terminate at an 18' long by 18' wide gazebo as measured from the drip edge. An 18' long by 6'wide fixed pier would extend from the northeast corner of the gazebo waterward and terminate at a 35' long by 5'wide finger pier that extends north,parallel with the AIWW.A 16' long by 16' wide boat lift is proposed on the east and west side of the finger pier. Per application materials,the two boat lifts would have auto stops at 18"above the substrate. A 9' long by 6' wide fixed pier would extend south from the southeast corner of the gazebo;a gangway would extend east from said fixed pier and terminate at a 24' long by 8' wide floating dock, accommodating two additional boat slips. The facility would accommodate up to four vessels. As proposed,the waterward end of the facility would extend approximately 252' from the waterward edge of coastal wetlands and terminate immediately landward of the 80' USACE federal channel setback(See Page 1 and 2 of 3). According to water depths taken by DCM on 5/11/2023 and corrected to Normal Low Water(NLW), the western proposed boat lift would be located in depths ranging from approximately -1'NLW to-1.2'NLW,while eastern proposed boat lift would be located in depths ranging form approximately -1.2'NLW to-1.5'NLW. The proposed floating dock would be located in depths ranging from approximately-1.2'NLW to 1.5'NLW(See Page 2 of 3). According to application materials,if requested by the resource agencies,the applicant would construct stops on the floating dock.
