Docking Facility Expansion 1) This permit authorizes only the docks, boatlift, gazebo and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other • structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes 2 additional formalized boat slips for a maximum of 3 formalized boat slips at this docking facility. (See attached sheets for Additional Conditions) • This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 7) All portions of the authorized structure shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 8) The authorized covered gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 9) The roof of the covered gazebo shall not be designed for second story use. 10) In order to satisfy concerns of the resource agencies, physical stops shall be placed on the floating dock at a minimum height of 18" above the bottom substrate to prevent the floating dock from disturbing the bottom substrate. The physical stops shall remain in place for the life of the permitted docking facility. Bulkhead Replacement 11) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 12) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 13) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re-staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. 14) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 15) The bulkhead shall be constructed prior to any backfilling activities. Meyerhoffer Associates, LLC Permit No. 98-23 Page 3 of 4 ADDITIONAL CONDITIONS 16) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 17) This permit does not authorize any excavation waterward of the approved alignment. 18) The fill material shall be clean and free of any pollutants except in trace quantities. 19) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 20) No backfill material is to be placed within 30 feet of the normal high-water level, except that which will be used to backfill the area behind the permitted bulkhead. 21) All fill material to be placed below normal high-water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control 22) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 23) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 24) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 25) This permit shall not be assigned,transferred, sold,or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 26) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 27) The permittee and/or their contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. As proposed, the docking component of the project would be CONSISTENT with the use standards set forth in NCAC 07H .0208(b) (6), including the 'A width rule, the eight-square foot rule and the pier-width rule. The proposed structures would be located entirely over open water. This office has NO OBJECTION to the proposed work provided it is consistent with all other state and federal permitting requirements. The conditions shall remain in effect for the life of the project, regardless of the expiration date of this Water Quality Certification. Non-compliance with or violation of the conditions herein set forth may result in revocation of this Water Quality Certification for the project and may also result in criminal and/or civil penalties. CONDITIONS OF CERTIFICATION [15A NCAC 02H .0507(c)]: 1. The new bulkhead is authorized a maximum of 6 feet waterward of the exiting bulkhead as measured from the landward most point of the existing concrete wall. All bulkhead backfill material shall be obtained from a high ground source and confined landward of the permitted bulkhead. All bulkhead backfill will consist of clean, earthen material free of any pollutants except in trace quantities. Metal products, organic materials, rock, concrete, bricks, or other non-earthen debris shall not be used. Citation:15A NCAC 02H.0506(b)(1)-(3) Justification:A project that affects waters shall not be permitted unless the existing uses, and the water quality to protect such uses, are protected. In determining that the proposed activity will comply with state water quality standards(including designated uses, numeric criteria, narrative criteria and the state's antidegradation policy), the Division must evaluate if the activity has avoided and minimized impacts to waters, would cause or contribute to a violation of standards or would result in secondary or cumulative impacts. 3. Concrete construction materials used for bulkhead components, such as deadman anchors,tie- back systems and concrete caps, shall be managed in a manner that prevents contact with waters of the State. A dry work area shall be maintained to prevent direct contact between curing concrete and adjacent surface water. Water that inadvertently contacts uncured concrete shall not be discharged to surface waters due to the potential for elevated pH and possible aquatic life and fish kills. Any water that contacts uncured concrete shall be captured, treated, and disposed of properly. Citation:15A 02H.0506(b);15A NCAC 02H.0507(c); 15A NCAC 028.0200;15A NCAC 028.0231 Justification:A project that affects waters shall not be permitted unless the existing uses, and the water quality to protect such uses, are protected.Activities must not cause water pollution that precludes any best use on a short-term or long-term basis. As cited in Stream Standards:(2)Oils, deleterious substances, or colored or other wastes:only such amounts as shall not render the waters injurious to public health, secondary recreation, or to aquatic life and wildlife, or adversely affect the palatability of fish, aesthetic quality, or impair the waters for any designated uses.As cited in Wetland Standards: (2)Floating or submerged debris, oil, deleterious substances, or other material shall not be present in amounts that cause adverse impacts on existing wetland uses. 4. If activities must occur during periods of high biological activity(e.g. sea turtle nesting,fish spawning, or bird nesting),then biological monitoring may be required at the request of other state or federal agencies and coordinated with these activities. All moratoriums on construction activities established by the NC Wildlife Resources Commission (WRC), US Fish and Wildlife Service (USFWS), NC Division of Marine Fisheries (DMF),or National Marine Fisheries Service (NMFS)shall be implemented. Exceptions to this condition require written approval by the resource agency responsible for the given moratorium. Work within a designated trout watershed of North Carolina (as identified by the Wilmington District of the US Army Corps of Engineers), or identified state or federal endangered or threatened species habitat, shall be coordinated with the appropriate WRC, USFWS, NMFS, and/or DMF personnel. The applicant proposes to expand an existing private docking facility(by adding a new platform, boatlift,and floating dock) and replace an existing bulkhead, creating a total of three boat slips. The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina Division of Water Resources. They are not designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries,and they are open to the harvest of shellfish. The applicant is proposing to install a new vinyl bulkhead waterward of the existing failing concrete bulkhead. The new bulkhead is proposed to step out a maximum of 6' from the current bulkhead that would fill 200'of coastal wetlands. The applicant does not provide a purpose or need for the new bulkhead alignment that requires coastal wetland fill. Therefore,the Division recommends minimization of coastal wetland impacts by installing the new bulkhead 2'waterward of the existing bulkhead. A DMF staff member conducted a site visit on June 14, 2023. Staff did not observe any submerged aquatic vegetation (SAV) within the proposed footprint of the expanded docking facility. However,very healthy SAV beds were observed a short distance from the docking facility. SAV is a vital component to the estuarine system and is prime nursery area for many fisheries species,such as gag grouper, flounder, red drum,black sea bass, weakfish and Atlantic croaker. SAV supports high diversity of foraging fish and invertebrates and provides valuable ecosystem services as a primary producer and enhancer of water quality. SAV filters water, stabilizes sediment and provides refuge for juvenile finfish, crabs and shrimp. SAV reproduces by rhizomes and will spread within suitable SAV habitat. Therefore, to minimize impacts to potential SAV habitat,the Division recommends the base of the gazebo be constructed with materials that allows sufficient light penetration for SAV growth,such as ventilated planks or use of gap of 1"between deckboards . PROJECT DESCRIPTION: The project site is located at 1475 Kings Landing Road, adjacent to the AiWW and Topsail Sound in Hampstead, Pender County. Existing man-made features on the property include a single-family residence, bulkhead and private docking facility. High ground vegetation consists of a few Live Oaks,and ornamental vegetation completes the ground cover. According to the application package, the high ground portion of the property is elevated approximately 6' above the normal high water (NHW) level. The shoreline measures approximately+/- 75 linear feet and is stabilized by a dilapidated bulkhead. There is a fringe of Coastal Wetlands (approximately 15'-35' in width and consisting primarily of Smooth Marsh Cordgrass {Spartina Alternrlora}) bordering the property along the eastern shoreline. Residential properties border the property to the north, south and west and the Al W W borders the property to the east. On July 22, 2019, DCM issued CAMA general permit No. 74524-D, which authorized construction of a pier, platform/gazebo, floating dock and boatlift at the subject property; however, a portion of the facility was never constructed. Currently,the facility consists of a single access pier(6' x 100'), small platform (8' x 9') and finger pier (4' x 40'), which is located along the southern side of the existing pier. The existing docking facility is located along the eastern shoreline and extends approximately 130' into the AIWW (as measured from the landward point of the access pier/bulkhead intersect, or approximately 94' from the outer edge of Coastal Wetlands). The existing docking facility is located approximately 15'-18' from the near shore edge of the federally maintained channel, and well within the '/a width of the water body limitation and pier-head line. The width of waterbody in this location is approximately 490 linear feet. The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina Division of Water Resources. They ARE NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries,and they are OPEN to the harvest of shellfish. Based on visual observations made by DCM staff during the April 2023 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the footprint of the proposed development; however, SAV is known to existing along this section of shoreline, and established beds exist along the property's shoreline(landward of proposed docking location). Water depths in the vicinity of the existing facility range from -1.7' to-3.0', relative to normal low water(NLW). PROPOSED PROJECT: Through this permit application,the property owner proposes to expand an existing private docking facility (by adding a new platform, boatlift and floating dock) and replace an existing bulkhead, creating a total of three boat slips. According to the application package and site plan drawings, the applicant proposes to install a new vinyl bulkhead (approximately 58' in length) along the eastern side of the exiting bulkhead. As described, the existing bulkhead is failing and the applicant would like to install a new wall (using a "straight line" approach),connecting the two outer points,rather than placing another bend in the bulkhead(i.e. following same alignment as existing wall). As a result, the new wall would permanently impact approximately 200 sq. ft. of Coastal Wetlands, consisting primarily of Spartina Alterniflora. This would occur primarily along the central portion of the wall, where the applicant is intending to "step-out" approximately 6.0' from the current bulkhead. Along the property lines to the north and south,the applicant proposes to install two wing walls,each measuring approximately 95'and 75',respectively.The application package states the bulkhead and wing wall back fill would be obtained from an upland source and would be clear and free of debris. As proposed, a new 12' x 20' covered platform/gazebo would be constructed along the northern side of the existing access pier, at the pier terminus. The covered platform would provide access to a new 8' x 24' section of floating dock that would run perpendicular to the shoreline, along the northern side of the riparian corridor,just outside the 15' riparian corridor setback. Along the southern side of the existing facility, next to the existing finger pier,the applicant proposes to install a new 12.5'x 12.5' boatlift. The boatlift would be located along the northern side of the existing finger pier, at the finger pier terminus. Neither the proposed floating dock, nor boatlift would be located within the riparian corridor setback and all structures would be located landward of the near shore channel setback line, within 1/4 of the width of the waterbody and within the established pier-head alignment. Based on the proposed design, the applicant would have the ability to dock up to three (3) vessels at the docking facility. 10. ANTICIPATED IMPACTS: The proposed structure would incorporate approximately 588 sq. ft. of Estuarine Waters and Pubic Trust Area. The new boatlifts and finger pier would remain consistent with similar pier length requirements (established pier-head line) and would be located outside of the federal channel setback. The proposed bulkhead would result in the filling of approximately 200 sq. ft. of Coastal Wetlands and would disturb approximately 1,500 sq. ft. of upland area. Minor increases in turbidity should be expected during construction. The total area of the proposed structures was calculated as follows: Shoreline length=+/-75 ft. x 8 sq. ft. =600 sq. ft. allowable. Proposed: Platform = 12' x 20' = 240 sq. ft.
