This permit, issued on June 23,2023 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to civil or criminal penalties; or may cause the permit to be null and void.
Docking Facility Reconfiguration
1) This permit authorizes the removal of the floating dock and boatlift at the existing docking facility
and the construction of the docks, piers, and other structures and uses located in or over the water that
are expressly and specifically set forth in the permit application. No other structure, whether floating
or stationary, shall become a permanent part of this docking facility without permit modification. No
non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without
permit modification.
2) This permit authorizes a maximum of 2 formalized boat slips.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty (20)days of the issuing date. of the Coastal Resources Commission.
This permit must be accessible on-site to Department

3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
• Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
• reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
6) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
7) The authorized project is partially located within a primary nursery area(PNA). Therefore, in
accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new
dredging or excavation within the areas classified as PNA shall be permitted. Dredging in any manner,
including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and

enforced throughout the entire existence of the permitted structure.

Bulkhead
8) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan
drawings.
9) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction.
10) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.

11) The bulkhead shall be constructed prior to any backfilling activities.
12) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
13) The fill material shall be clean and free of any pollutants except in trace quantities.
14) Unless altered herein, all backfill material shall be obtained from a high ground source and confined
behind the permitted bulkhead.
15) No backfill material is to be placed within 30 feet of the normal high-water level, except that which will
be used to backfill the area behind the permitted bulkhead.

Upland and Maintenance Excavation
16) Unless specifically altered herein, this permit authorizes the upland excavation associated with the
development of the authorized bulkhead and basin expansion, all as expressly and specifically set forth
in the attached permit application and workplan drawings.
17) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted
between April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with appropriate resource agencies.
18) No excavation shall take place outside of the area indicated on the workplan drawings.
19) Excavation shall not exceed -8 feet below the normal low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
20) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
21) All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the recent of a
spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the
N.C. Division of Water Resources at(919) 733-5083, Ext. 526 or(800) 662-7956 and provisions of the
North Carolina Oil Pollution and Hazardous Substances Control Act will be followed.
Maintenance Clause
22) The Division of Coastal Management shall be notified in writing at least two (2)weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross-hatching indicating the area to be maintained, the
area to be used for dredge material disposal, and the estimated amount of material to be removed.
The location, design and holding capacity of the dredge material disposal site shall be approved
by a representative of the Division prior to the initiation of any maintenance dredging activities. •
D. The date of map revision and the permittee's signature shown anew on the original plan.
USACE Conditions
23) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

Dredge Material Disposal
24) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the
site is graded and stabilized.
25) The dredge material disposal area shall be inspected and approved by a representative of the Division of
Coastal Management prior to the commencement of any dredging activities.
26) The permittee and/or their contractor shall take all necessary precautions to ensure that the dredge
material is properly contained during transport to the disposal site, and that all the proper coordination
has taken place with the local or state governments to ensure that any damage to public streets caused by
transport of the dredge material has been addressed.
27) Dredge material from the authorized dredge footprint shall be dewatered before use as backfill. All
remaining backfill material shall be obtained from a high ground source and confined behind the
permitted bulkhead.
Sedimentation and Erosion Control
28) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
29) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.

30) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
General
31) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
32) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
33) The permittee and/or their contractor shall meet with a representative of the Division prior to project
initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, •
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2023-00472).

Quality Certification 4501 and assigned the project DWR Project No. 20090102v3.
NOTE: Future development of the permittee's property may require a modification of this permit.

such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of$400 was received by DCM for this project. This fee also

Recommendations for State Permit—Christopher and Wendy Worden 2/24/2023
The new docking facility would provide a total of 2 formalized boat slips. It appears that the project is CONSISTENT
with the use standards set forth in NCAC 07H.0208(6)(6), including the 'A width rule and eight-square foot rule.
The proposed bulkhead appears to be CONSISTENT with 15 NCAC 7H.0208 (b)(7)Use Standards for Bulkheads.
The proposed excavation appears to be CONSISTENT with 15 NCAC 07H.0208 (b)(1) based on previous permit
authorization and maintenance events of the area provided the resource agencies do not have any concerns regarding
significant adverse impacts resulting from the proposed project and the potential relocation of live oysters.
This office has NO OBJECTION to the proposed work provided it is consistent with all other state and federal permitting
requirements and an appropriate disposal location is authorized prior to the commencement of any excavation.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the CAMA Permit application for proposed actions that impact fish and fish
habitats. The applicant proposes to remove an existing floating dock and boat lift,excavate
an upland basin stabilized by a bulkhead,install a floating dock,and dredge the existing
canal to -8' NLW for the creation of two potential slips.The Wilmington-New Hanover
County Land Use Plan classifies the area as Conservation.The waters in this location are
classified as SA by the Division of Water Resources.The area is designated as a Primary
Nursery Area (PNA) by the Division of Marine Fisheries and is closed to the taking of
shellfish.
The Division does not object to any components of the proposed project. However,the
Division would like to provide the following recommendations to minimize impacts to the
PNA habitat:
• The existing bulkhead should remain in place while the upland basin is excavated,
and new bulkhead is constructed.
• The proposed maintenance dredge channel connects to the AIWW and is directly
across from Shinn Creek that directly flows into Masonboro Inlet. To minimize
impacts caused by dredging turbidity,the division recommends a moratorium of
4/1-9/30 unless all dredge work can be conducted during an outgoing tide.

Reference your application for a Department of the Army permit to remove an existing
docking facility located adjacent to the AIWW, excavate an upland basin stabilized by a
bulkhead adjacent to a man-made canal, install a floating dock,and dredge the existing canal to
-8'NLW for the creation of two potential slips. The site is located adjacent to Shinn Point Canal
and the AIWW at 841 Inlet View Drive,New Hanover County,North Carolina.
The proposal is to remove the floating dock and boat lift at the existing docking facility.
which will remove structures from the USACE AIWW 80 feet setback line.
The proposal is also to excavate a 100 feet long by 10 feet wide portion of high ground
on the southern portion of the property that exists landward of the current bulkhead to a depth of
-8 feet Mean Low Water(MLW). The newly created basin will be stabilized by a 2 feet wide
steel bulkhead, located to the north of the newly created basin,that will run 100 feet long with 10
feet long wing walls on the eastern and western ends to connect with the existing bulkhead. The
proposal further includes plans to excavate to connect the newly created upland basin with the
existing Shinn Point Canal. A 110 feet long by 30 feet wide area will be excavated in the canal,
connecting the created upland basin with the existing Shinn Point Canal dredge footprint. A 100
feet long by 20 feet wide area within the existing Shinn Point Canal footprint, east of the above
dredging area toward the AIWW, will connect to the AIWW. The proposal is to dredge these
areas at a connecting depth to the AIWW at -8 MLW. The spoil material will be trucked offsite
to a 40 feet by 40 feet upland area located at 729 Piner Road, Wilmington,NC.
In addition, extending east from the western wing wall of the newly created upland basin
will be a ramp that will lead to a 68 feet by 8 feet floating dock that will accommodate up to two
formalized boat slips in the newly created upland basin.
The dredging will excavate 6,400 square feet of bottom substrate within the previously
dredged canal. The proposed docking facility will cover and shade 544 square feet of created
Estuarine Waters of the US.

Your proposal has been reviewed and found to be consistent with the provisions and
objectives of the CAMA-Corps Programmatic Permit process, via Regional General Permit 291
(copy attached), for construction activities that receive authorization from the State of North
Carolina. Therefore, you may commence construction activity in strict accordance with the
applicable State authorization, attached Federal special conditions, RGP-291 conditions and the
approved plan. Failure to comply with the State authorization or conditions of the Federal permit
could result in civil and/or administrative penalties. This authorization expires December 31,
2026.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified.

Special Conditions
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans, dated July 14 and October 29, 2022, which are a part of this permit. Any
modification to these plans must be approved by the US Army Corps of Engineers
(USACE)prior to implementation.
2. Except as authorized by this permit or any USACE approved modification to this permit,
no dredge, fill, or mechanized land-clearing activities shall take place at any time in the
construction or maintenance of this project within waters outside the designated permitted
boundary. This permit does not authorize temporary placement or double handling of
excavated or fill material within waters outside the permitted area.
3. Work in wetlands is prohibited during the dredging, material disposal, or any other aspects
of work associated with this project. All dredged material must be deposited on high
ground.
4. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other
toxic materials. In the event of a spill of petroleum products or any other hazardous waste,
the permittee shall immediately report it to the N.C. Division of Water Resources at(919)
733-5083, Ext. 526 or(800) 662-7956 and provisions of the North Carolina Oil Pollution
and Hazardous Substances Control Act will be followed.
5. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shallRECEIVED
provide each of its contractors and/or agents associated with the construction or
maintenance of this project with a copy of this permit. A copy of this permit, including 41IN 2 3 2023
conditions, shall be available at the project site during construction and maintenance of

6. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to,the immediate installation of silt
fencing or similar appropriate devices around all areas subject to soil disturbance or the
movement of earthen fill, and the immediate stabilization of all disturbed areas.
Additionally,the project must remain in full compliance with all aspects of the
Sedimentation Pollution Control Act of 1973.
7. The activity must be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout
waters by the North Carolina Division of Environmental Management(NCDEM),25

NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less
in trout waters, are not considered significant.
8. In order to further protect the endangered West Indian Manatee, Trichechus manatus,the
permittee must implement the U.S. Fish and Wildlife Service's Manatee Guidelines,and
strictly adhere to all requirements therein. The guidelines can be found at

9. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington
District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of
the violation.

I have reviewed this proposal for consistency with the 2006 Wilmington-New Hanover
County Joint Land Use Plan Update and offer the following comments.
The general area of the project is classified as Resource Protection and Conservation.
In general,New Hanover County allows development in Resource Protection and
Conservation classified AECs, which is consistent with the State's minimum use
standards. The Wilmington-New Hanover County Joint Land Use Plan contains some
policies, which exceed the State's minimum use standards;however none of these
policies appear to be applicable to this project.
Provided all local, state and federal requirements can be met,this project appears to
be consistent with the 2006 Wilmington-New Hanover County Joint Land Use Plan
Update.

The Division of Water Resources (DWR) has received a copy of your CAMA Major application request
received by this office on January 24, 2023, to create an upland basin with floating dock and boatlift to
provide mooring for two (2) vessels. DWR issues approval in the form of a Water Quality Certification
(WQC)in conjunction with the CAMA Major Permit and General Permit(s) 198000291 or 197800056 issued
by the US Army Corps of Engineers (USACE). This Certification allows you to use the CAMA Major Permit
when the Division of Coastal Management issues it.
The waters of the Atlantic Intracoastal Waterway in this area are classified as SA;HQW by the Division of
Water Resources (DWR) and has been determined to be Primary Nursery Area (SNA) by the Division of
Marine Fisheries(DMF). Please understand that the waters around your project area have been
identified as a Nursery Area and the DWR supports the concerns and recommendations regarding
dredging within these designated areas that were submitted by the Division of Marine Fisheries and the
Wildlife Resource Commission. Requests to dredge within these areas must be consistent with 15A
NCAC 02B .0220; 15A NCAC 02B .0222 which require that Surface water quality standards require that
conditions of waters be suitable for all best uses provided for in state rule (including, at minimum:
aquatic life propagation, survival, maintenance of biological integrity, and fishing, fish, and Primary
Nursery Area(PNAs) wildlife; secondary contact recreation; and that activities must not cause water
pollution that precludes any best use on a short-term or long-term basis.
In accordance with the attached General Certification #4501 (GC 4501, the impacts described in your
application do not require written authorization to utilize GC 4501. However,you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including (but not limited to)
erosion and sediment control regulations.

existing Shinn Point Canal dredge footprint. A 100' long by 20' wide area within the existing Shinn Point Canal
footprint would connect to the AIWW. The applicant proposes to increase the depth of Shinn Point Canal adjacent
to the subject property to -8' NLW within the existing Shinn Point Canal dredge footprint to connect to the -8'
NLW contour as it extends towards the AIWW(See Sheet 2 of 5).
Written approval from the Shinn Point HOA is provided with the application materials. The spoil material would
be trucked offsite to a 40' x 40' upland area, located outside of any Areas of Environmental Concern, located at
729 Piner Road. Written permission from the property owner of 729 Piner Road for spoil placement is provided
with the application materials.
According to application materials, water depths in the area currently range from -1.5'just waterward of the
existing bulkhead to -15' approximately 10' beyond the waterward extend of the jetty as the canal intersects the
AIWW. The application states average depth of the canal in front of the subject property is approximately-5.5'
NLW.
Based on current water depths taken by DCM on 2/16/2023,the average depth of the canal waterward of the
subject property appears to be-5' NLW. The-8' NLW contour appears to be located approximately at the
waterward end of the existing rock jetty. The last approximately 10' of open water area in the proposal at the
mouth of the previously authorized access channel footprint is below-8'NLW. The applicant is proposing to
maintain the authorized footprint at a connecting depth of-8'NLW due to shoaling that occurs within the access
channel. The application also states the applicant's boat draws 6' or more.
In addition,extending east from the western wing wall of the newly created upland basin would be a ramp that
would lead to a 68' x 8' floating dock that would accommodate up to two formalized boat slips in the newly
created upland basin(See Sheet 1 of 5).
11. ANTICIPATED IMPACTS:
The proposed excavation would result in 1,000 sq. ft. of high ground excavation and 6,400 sq. ft. of bottom
substrate excavation within the previously dredged canal. As proposed,the basin, canal, and access channel would
be excavated to the connecting depth of-8' NLW. Approximately 120 sq. ft. of live oysters are currently located
within the proposed excavation footprint. The approximate 6,400 sq. ft. of spoil will be placed on an upland
location at 729 Piner Road. The proposed docking facility would incorporate 544 sq. ft. of created Estuarine and
Public Trust Area. Minor increases in turbidity should be expected during excavation.

9. PROJECT DESCRIPTION:
The project site is located at 841 Inlet View Road,adjacent to the Atlantic Intracoastal Waterway(A1W W)to the east
and Shinn Point Canal to the south,in New Hanover County.The approximately 0.91-acre lot has approximately 342'
of shoreline frontage stabilized by a wooden bulkhead on the eastern and southern sides.The lot is approximately 4'
above Normal High Water(NHW). The high ground portion of the property is an unbuilt upon lot that consists of
lawn grass, oak trees, and ornamental landscaping. The property is bordered by a single-family residence under
construction to the north(authorized under CAMA Minor Permit 22-56)and the applicant's single-family residence to
the west.
An existing two slip docking facility extends east from the wooden bulkhead towards the AIWW. The facility was
authorized by CAMA General Permit 32540D on 9/25/2002.The General Permit authorized the rearrangement of an
existing facility to include a 16'x16' two-story platform, a 10' wide by 24' long floating dock,and boat lift on the
south side of the floating dock. The floating dock and portion of the boat lift appear to currently encroach into the
USACE AIWW setback. No permit history was found for the wooden bulkhead, but it appears to predate Google
Earth aerial image history.
There are remnant pilings adjacent to the southern side of the property in the area of the proposed project.It appears,
through Google Earth aerials, that some sort of docking facility existed on the southern side of the property within
Shinn Creek Canal predating 1993 until 2007.No permit history was found.In the area of the remnant pilings there is
approximately 60'of what appears to be concrete remnants of an old bulkhead immediately waterward of the existing
bulkhead that is exposed at low tide.The concrete blocks have live oysters growing on them.The agent has stated the
applicant is willing to relocate the oysters if requested by the resource agencies reviewing this proposal (See attached
DCM Provided Photo 1 of 2 and 2 of 2).
An old rock jetty extends approximately 90' from the southeast corner of the property parallel with the northern side
of where Shinn Creek Canal intersects the AIWW. No permit history was found, but it appears to predate Google
Earth aerial image history.
The entire Shinn Point Canal appears to have been created in 1975 under State Permit 167-75 (See application
materials for copy of permit and permit application). State Permit 167-75 authorized the creation of a 2,700' long
canal with varying widths of 40' and 60'to a depth of-12'MLW as well as 1,550 linear feet of bulkhead(See Page 1
of 2 and Page 2 of 2 of"Sound View Estates"in application materials).The canal is currently maintained under active
State Permit 146-95 which authorized the access channel to connect to the depth of-6.5 MLW. There have been
numerous maintenance events to maintain the access channel.
The Wilmington-New Hanover County Land Use Plan classifies the area as Conservation.The waters in this location
are classified as SA by the Division of Water Resources.The area is designated as a Primary Nursery Area(PNA)by
the Division of Marine Fisheries and is CLOSED to the taking of shellfish.
10. PROPOSED PROJECT:
The applicant proposes to remove an existing floating dock and boat lift, excavate an upland basin stabilized by a
bulkhead adjacent to a man-made canal, install a floating dock,and dredge the existing canal to -8'NLW for the
creation of two potential slips.
The applicant proposes to remove the existing floating dock and boat lift at the existing docking facility which
would remove structures from the USACE AIWW 80' setback as well as meet City of Wilmington Ordinances in
regard to docking facility square footage.
The applicant proposes to excavate a 100' long by 10' wide portion of highground on the southern portion of the
property that exists landward of the current bulkhead to a depth of-8'NLW. The newly created basin would be
stabilized by a 2' wide steel bulkhead that would run 100' long with 10' long wing walls RteEiDind
western ends to connect with the existing bulkhead(See Sheet 1 of 5).

and Wendy Worden, for State approval for development of the subject property located at 841 Inlet View Drive, adjaceht
to the Masonboro Sound in New Hanover County. It was received as complete on February 16, 2023 and appears to be
adequate for processing at this time. The projected deadline for making a decision is May 2, 2023. An additional 75-day
review period is provided by law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above,you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided
on or about the 75th day.
If this agency does not render a permit decision within 70 days from Febniary 16,2023,you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting
will be held within five working days from the receipt of your written request and shall include the property owner,
developer,and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property;or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required,you will be contacted by the appropriate State
or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive a copy of

Attached is a new dock plan we are submitting to the HOA. The floating dock will be cut into a new bulkhead
so it won't take up any of the channel. TMC (Greg Taylor) and Jimmy North are the contractors.

Project Location: 841 Inlet View Dr., adj. to Shinn Point Canal& the AIWW, Wilmington, New
Hanover County
Proposed Project: The applicant proposes to remove and existing floating dock and boat lift,
excavate an upland basin stabilized by a bulkhead adjacent to a man-made
canal, install a floating dock, and dredge the existing canal -8' NLW for creation
of the two potential slips.
