This permit, issued on September 1, 2023 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
o• f these terms may be subject to civil or criminal penalties; or may cause the permit to be null and void.
New Docking Facility
I) This permit authorizes only the docks, piers, boatlifts, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other structure,

whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) This permit authorizes a maximum of 4 formalized boat slips at this docking facility.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission.
This permit must be accessible on-site to Department

ADDITIONAL CONDITIONS
3) No portion of the authorized docking facility shall extend more than one quarter of the width of the water
body. Measurements to determine width of the water body shall be made from the normal high-water line
or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more
restrictive.
4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
• 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard,through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
• inclement weather.
•
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
•
7) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
8) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six
feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured
from the bottom of the decking.
Sedimentation and Erosion Control
9) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.

10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.

General
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
13) The permittee and/or their contractor shall meet with a representative of the Division prior to project
initiation.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2023-01 156).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4497 and assigned the project DWR Project No. 20230722.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of$250 was received by DCM for this project.

The total area of the proposed structures was calculated as follows:
Shoreline length=+/-105 ft.x 8 sq. ft.=840 sq.ft.allowable.
Proposed:
Finger Pier=4' x 54' =216 sq. ft.
Platform =16' x 16'=256 sq. ft.
Floating docks=6' x 28' and 6' x 12' =240 sq. ft.
Gangway landing=6' x 6'=36 sq.ft.
Boatlifts—2 @ 14' x 14'=392 sq.ft.
Proposed Total=748 sq.ft.
The construction would provide docking space for up to four(4)vessels at this location. As
proposed, the project would be CONSISTENT with the use standards set forth in NCAC
07H .0208(b) (6), including the '/4 width rule, the eight-square foot rule and the pier-width rule.
This office has NO OBJECTION to the proposed work provided it is consistent with all other
state and federal permitting requirements.
It is recommended that any permit issued should include standard conditions for private docking
facilities.

9. PROJECT DESCRIPTION:
The project site is located at 342 Olde Point Loop,adjacent to a man-made canal off the AIWW and Topsail
Sound, in Hampstead, Pender County. Currently,there are no existing man-made features on the property
as it remains undeveloped. High ground vegetation consists of Live Oaks, Pine and scrub vegetation.
According to the application package, the high ground portion of the property is elevated approximately
2'-28' above the normal high water(NHW) level. The shoreline measures approximately +/- 105 linear
feet and is stabilized by natural vegetation. There is a fringe of Coastal Wetlands(approximately 25'-35'
in width and consisting primarily of Smooth Marsh Cordgrass {Spartina Alterniflora}) bordering the
property along the eastern shoreline. Residential properties border the property to the north,south and west
and a man-made canal off the AIWW borders the property to the east.
The waters of Old Topsail Creek,the AIWW and Topsail Sound(adjacent to the project site)are classified
as SA by the North Carolina Division of Water Resources. They ARE NOT designated as a Primary
Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the
harvest of shellfish. Based on visual observations made by DCM staff during the May 2023 site visit,there
appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding area. Water depths in the
vicinity of the proposed facility range from-2' to-4', relative to normal low water(NLW). In the vicinity
of the proposed project,the width of waterbody measures approximately 132' in width,making the width
of waterbody limitation approximately 33' from the outer edge of marsh grass bordering the property.
PROPOSED PROJECT:
According to the applicant package, the property owner proposes to install a new four (4) slip docking
facility. As designed, a new 5' x 52' elevated, wooden walkway would extend (from the high ground)
toward the east out to open water and would connect to a new 16'x 16'elevated,"L-head"shaped platform.
The pier would be centered along the properties shoreline and the proposed platform would be located along
the southern side, at the pier's terminus. Outboard of the proposed platform, the applicant is requesting
authorization to install a new 6' x 28' section of floating dock (including a 6' x 6' landing), as well as a
new 6' x 12' section of floating dock. The floating docks would create an "L-shaped" design that would
partially wrap back around the southern side of the proposed platform. Along the northern side of the
platform,the applicant proposes to install a 4'x 54'finger pier,which would provide access to the proposed
14' x 14' boatlifts (x2). As depicted on the site plan drawings, the finger pier would originate along the
outer edge of marsh and would extend toward the north a distance approximately 20' (4' x 20' section),
before turning toward the east and spanning another 34' (4' x 34' section). The end of the proposed finger
pier would terminate in alignment with the proposed boatlifts and 6' x 28'floating dock,which happens to
fall along the '/4 width of waterbody limitation (i.e. approximately 33' from the outer edge of marsh
bordering the property).
As designed,the proposed docking facility would be located slightly landward of the existing pier-head line
and just inshore of the width limitation. Based on aerial photography,as well as information provided in
the application package,the edge of channel is located waterward of the proposed facility. In addition,the
proposed floating dock would be located in an area of the creek that has approximately-2' to-4' of water
during periods of low tide.Just beyond(waterward)of the floating dock,the bottom contour begins to drop
off into the channel, which is approximately -5' to -7' deep during normal low water. The proposed
development would be centrally located along the shoreline, with no encroachment into the applicant's
riparian corridor setback(i.e_no waivers required).

10. ANTICIPATED IMPACTS:
The proposed structure would incorporate approximately 1,140 sq. ft.of Estuarine Waters and Pubic Trust
Area. The new docking facility would remain consistent with similar pier length requirements(established
pier-head line) and would be located outside of the maintained channel and within 'A of the width of the
waterbody. Minor increases in turbidity should be expected during construction.
The total area of the proposed structures was calculated as follows:
Shoreline length=+/-105 ft.x 8 sq. ft.=840 sq.ft.allowable.
Proposed:
Finger Pier=4' x 54'=216 sq.ft.
Platform= 16'x 16' =256 sq. ft.
Floating docks=6' x 28' and 6' x 12'=240 sq.ft.
Gangway landing=6' x 6'=36 sq. ft.

Narrative
As the acting agent for Fred Abernathy who owns 342 Olde Point Loop, Hampstead in Pender
County, I am submitting the enclosed CAMA Major Permit Application for the installation of a
new pier,finger pier, fixed platform,boatlifts, and floating docks. A new 5' x 52' pier will extend
waterward and a 16' x 16' elevated,fixed platform will extend from the southwest side. Extending
waterward from the terminal end of the pier will be an access ramp which will connect to a"U-
shaped"floating dock via a 6' x 6' landing platform which will connect to a 6' x 28' floating dock
extending westward, parallel to the shoreline and connect to a 6' x 12' floating dock extending
northwest and perpendicular to the shoreline.
Located on the east side of the pier will be a 4' x 20' elevated fixed finger pier extending eastward
and parallel to the shoreline and will connect to a 4' x 34' elevated fixed finger pier extending
southeastward and perpendicular to the shoreline and a 14' x 14' boatlift will be located on each
side of the finger pier at the waterward end.
As proposed, the structures will not encroach into either of the adjacent 15' riparian corridor
setbacks nor the Federal Channel Setback and will not extend beyond the existing pier-head line.
The docking facility will create a 4-slip docking facility within water depths ranging from-3' to -
6' @ NLW.

The Division of Coastal Management hereby acknowledges receipt of your application,acting as agent for the
property owner Fred Abernathy,requesting authorization under the Rules of the N.C. Coastal Resources
Commission for development activities 342 Olde Point Loop,adjacent to a man-made canal off the AIWW and
Topsail Sound,in Hampstead,Pender County. It was received as complete on May 18,2023 and appears to be
adequate for processing at this time.The projected deadline for making a decision on your permit application is
August I,2023. An additional 75-day review period is provided by law when such time is necessary to complete the
review. If you have not been notified of a final action by the initial deadline stated above,you should consider the
review period extended. Under those circumstances,this letter will serve as your notice of an extended review.
However,an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from May 18,2023,you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner,developer, and project designer/consultant.
NCGS 1 13A-1 19(b)requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a"Notice of Permit Filing"postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be:Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property;or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made,and if additional information is required,you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
